!SUBJECT
Enact Ordinance No. 850 Repealing Chapter 17.52 - Manufactured Home Certificate of Compatibility.

I RECOMMENDATION
Enact Ordinance No. 850 (second reading) to repeal in full, Chapter 17.52 of the Anderson Municipal Code regarding the requirement for a Manufactured Home Certificate of Compatibility as introduced on August 16, 2022 (first reading). !FISCAL IMPACT
There is no fiscal impact.

I DISCUSSION and BACKGROUND
Chapter 17 .52 of the Anderson Municipal Code was adopted in 1987 and titled "Manufactured Home Certificate of Compatibility." It outlined the process for creating an application for certification, established criteria for proposed new manufactured homes to meet to be deemed compatible, and established the process for planning commission to review and approval of applications.

ITEM 6.3a PAGE1 9/20/2022
A Manufactured Home Certificate of Compatibility is the concept of the City imposing a form of aesthetic regulations over proposed manufactured housing developed within the City. This type of regulation is no longer permissible as it conflicts with current state law and goals, whose intent is to treat manufactured housing the same as traditional "stick and brick" single-family homes.

Government Code Section 65852.3 establishes certain requirements for the inclusion of manufactured housing in a jurisdiction. One of these requirements is to consider manufactured housing to have the same development standards which apply to conventional single-family homes. The Current adopted Housing Element of the City of Anderson, General Plan includes Program HE.3.4: Evaluation of Certificate of Compatibility for Manufactured Housing which recommends City staff to review Section 17.52 for compatibility with State Law. The certificate of compatibility required for the installation of manufactured housing as required in Anderson Municipal Code Section 17.52 is not consistent or compatible with Government Code Section 65852.3.

Staff is recommending that the entire Chapter 17.52 be repealed rather than making small amendments. As the ordinance is written currently, there is no amendment that will achieve compliance with current state law. The city may, at a later date, establish objective design standards that apply to all single-family residences (manufactured homes and traditional "stick and brick homes").

ENVIRONMENTAL DETERMINATION:

The City of Anderson finds that this Ordinance is not a "project" according to the definition set forth in the California Environmental Quality Act ("CEQA"), and, pursuant to CEQA Guidelines sections 15060( c )(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15061(b)(3) (there is no possibility the activity in question may have a significant effect on the environment) based on the Addendum to the certified Environmental Impact Report number 2006092026 and approved 2019-2028 City of Anderson, General Plan Housing Element, for which the addendum was adopted, June 2020.

PUBLIC NOTICE:

A 10-day public hearing notice of the proposed amendment was published in the RecordSearchlight No public comments on the project have been received at the Planning Department at the time of this report.

!SUBJECT
Enact Ordinance No. 851 amending Title 17- Zoning to include Chapters 17.70 and

17.71 to the Anderson Municipal Code.

I RECOMMENDATION
Enact Ordinance No. 851 (second reading) to add Chapters 17.70 and 17.71 to the Anderson Municipal Code to comply with SB 9 permitting two-unit development and urban lot splits on single family residential parcels as introduced on August 16, 2022 (first reading).
!FISCAL IMPACT
There is no fiscal impact.

I DISCUSSION and BACKGROUND
On September 16, 2021, Senate Bill (SB) 9 was signed into law by Governor Newsom. taking effect on January 1, 2022. SB 9 allows all properties within a "single-family residential zone" to be developed with two units and be subdivided into two parcels, irrespective of local development standards. There are two new types of development that must be reviewed ministerially under SB 9:

ITEM 6.3b PAGE1 9/20/2022
• Two Unit Development - Allows a single-family residential parcel to be developed with two primary dwelling units instead of just one, including an Accessory Dwelling Unit (ADU) and a Junior Accessory Dwelling Unit (JADU), for a total of four dwelling units.
• Urban Lot Split - Allows a single-family residential parcel to be subdivided into two parcels and for each parcel to be developed with two primary dwelling units. Local jurisdictions are not required to approved ADU's or JADU's on lots created by an Urban Lot Split.

SB 9 does allow a local jurisdiction to impose objective zoning, design, and subdivision standards, but is prohibited from applying any standard(s) that would preclude the construction of two units of less than 800 square feet on any single-family zoned property.

No setbacks are required for an existing structure or for new construction in the same location and having the same dimensions as an existing structure. Additionally, a local jurisdiction is also precluded from applying side or rear setbacks greater than four feet or requiring onsite parking for properties within one-half mile walking distance of either a high-quality transit corridor or a major bus stop, or within one-block of a car share vehicle.

A local agency may deny a proposed housing development project if the building official makes a written finding, based upon a preponderance of the evidence, that the proposed housing development project (1) would have a specific, adverse impact upon public health and safety or the physical environment; and (2) there is no feasible method to satisfactorily mitigate or avoid the specific, adverse impact.

The proposed ordinance seeks to add two new chapters to the Anderson Municipal Code to address SB 9, rather than combine the two. Chapter 17.70 will pertain to urban lot splits and Chapter 17.71 will focus on two-unit development on the same lot.

For both the lot splits and two-unit development, the parcel cannot be (1) prime farmland, (2) wetlands, (3) within a high fire severity zone, ( 4) a hazardous waste site, (5) within a delineated earthquake fault zone, (6) within a special flood hazard zone, (7) within a regulatory floodway, (8) lands identified for conservation in adopted natural community conservation plan, (9) a habitat for a protected species, and (10) lands under a conservation easement.

Further, under both chapters, the owner must sign a declaration/affidavit, which will be recorded on the property stating that the property will remain residential before the building permit will be issued.

ENVIRONMENTAL DETERMINATION:

The City of Anderson finds that this Ordinance would be exempt from the California Environmental Quality Act (CEQA). Senate Bill 9 (Atkins) states that an ordinance adopted to implement this incorporation of Senate Bill 9 shall not be considered a project under Division 13 (commencing with Section 21000) of the Public Resources Code.

AGENDA ITEM
September 20, 2022, City Council Meeting
To:

Through:

Honorable Mayor and Members of the Anderson City Council Jeff Kiser, City Manager
From:

Date:
!SUBJECT
Lt. Steve Blunk and City Attorney, Collin Bogener
September 20, 2022
Consider and Approve Online Action Services Contract with NorCal Estate Sales and Online Liquidation Services.

I RECOMMENDATION
The City Attorney recommends that the City Council:

1. Receive a Staff Report

2. Approve Online Auction Services Contract with NorCaJ Estate Sales and Online Liquidation Services and authorized the City Manager to sign the agreement. !FISCAL IMPACT
Fiscal impact is unknown at this time.

I DISCUSSION and BACKGROUND
The Anderson Police Department ("APO") routinely takes possession of personal property items as part of its general operations, which ADP is then authorized to sell after specific legal procedures have been followed. At present, APD uses a nationwide company to ITEM 8.2b PAGE1 9/20/2022
auction off these items for sale. APD would prefer to contract these services to a local company, which would allow direct contact and easier transfer of items.

NorCal Estate Sales and Online Liquidation Services ("Company") is located here in Anderson on Balls Ferry Road and owned and operated by Robert Crouse and Hannah Crouse. The Company takes photos of personal property items and then posts the photos on their website for online auctions. Members of the public are then able to bid on the items for purchase. While primarily used for estate sales, the business model applies to the personal property items held by the APO as well.

Per the proposed contract, APO would contract with the Company to provide online auction services. APO would notify the Company of the personal property item to be sold, which the Company would then inventory, clean, display, photograph, and then add to its website. After posted, the Company would advertise the items via the Company website, internet and utilize the Company's email list of over 25,000 local buyers. Finally, the Company will conduct the online auction and liquidate the personal property items to the public.

The Company will receive 50% of the sale price for items under $500.00 and 40% of the items over $500.00. The City will then receive the proceeds from the sale within 30 days from the date of the sale. A hard copy of the monthly final accounting will also be provided to the City.

The term of the proposed agreement is three (3) years with an additional 3 one (1) year option to renew. That said, either party can terminate the agreement without cause by providing 30 days' notice. If the Company fails to perform its obligations under the Agreement, then the City may immediately terminate the agreement and take back the personal property items not sold.

APD has been in communication with the Company and looks forward to contracting with it for these services.

Stafford Disaster Relief and Emergency Assistance Act of 1988, and/or state financial assistance under the California Disaster Assistance Act.

I FISCAL IMPACT
Repairs to damage associated with the storm events between February 1, 2017 and February 23, 2017 is eligible for reimbursement at the rate of 75% from the federal government and 18. 75% from the state.

ITEM 8.9a PAGE1 9/20/2022
I DISCUSSION and BACKGROUND
On March 19, 2017, Governor Brown requested a major disaster declaration due to severe winter storms, flooding, and mudslides during the period of February 1-23, 2017. The Governor requested a declaration for Public Assistance for 42 counties and Hazard Mitigation statewide. On April 1, 2017, President Trump declared that a major disaster exists in the State of California. This declaration made Public Assistance requested by the Governor available to state and eligible local governments and certain private nonprofit organizations on a cost•sharing basis for emergency work and the repair or replacement of facilities damaged by the severe winter storms.

Anderson River Park sustained substantial damage during the high-water events on the Sacramento River associated with the February storm events. Staff is working with FEMA and CalOES to identify and execute projects to restore park facilities to pre-storm conditions. In addition, emergency response by the City during the storm events is eligible for reimbursement.

East Street Right of Way Abandonment & Dedication

I RECOMMENDATION
The Deputy Public Works Director recommends that the City Council:

Consider adoption of a resolution to abandon a portion of the East Street right of way that was created by PM 08-01.

Consider adoption of a resolution to dedicate right of way and public service easement created by TSM 19-01.
!FISCAL IMPACT
There will be no fiscal impact associated with the abandonment and dedication of the East Street right of way.

ITEM 8.9b PAGE1 9/20/2022
I DISCUSSION and BACKGROUND
At the time when developer Eric Dutton subdivision Parcel Map 08-01 was recorded, the developer constructed water and sewer line improvements. To the south developer Jerry Knighton's Map 19-01 development was undeveloped. At the time they were two separate projects owned by two separate developers. It is still two separate parcel maps but is now owned by a single developer. Through the Parcel Map conditions of approval there is a requirement for the extension of East Street from its connection to the Portola/East Street intersection.

Parcel Map 08-01 for the Eric Dunton development created a 68' right of way that is not consistent with the conditioned right of way for Tentative Subdivision Map 19-01. The existing right of way established a horizontal curve, the City's desire is for the right of way and roadway to be consistent throughout the proposed development. This will create uniformity throughout the development across both maps. !ATTACHMENT
