East Street Right of Way Abandonment & Dedication

I RECOMMENDATION
The Deputy Public Works Director recommends that the City Council:

Consider adoption of a resolution to abandon a portion of the East Street right of way that was created by PM 08-01.

Consider adoption of a resolution to dedicate right of way and public service easement.

JFISCAL IMPACT
There will be no fiscal impact associated with the abandonment and dedication of the East Street right of way.

ITEM 6.10 PAGE1 10/18/2022
I DISCUSSION and BACKGROUND
At the time when developer Eric Dutton subdivision Parcel Map 08-01 was recorded, the developer constructed water and sewer line improvements. To the south developer Jerry Knighton's Map 19-01 development was undeveloped. At the time they were two separate projects owned by two separate developers. It is still two separate parcel maps but is now owned by a single developer. Through the Parcel Map conditions of approval there is a requirement for the extension of East Street from its connection to the Portola/East Street intersection.

Parcel Map 08-01 for the Eric Dunton development created a 68' right of way that is not consistent with the conditioned right of way for Tentative Subdivision Map 19-01. The existing right of way established a horizontal curve, the City's desire is for the right of way and roadway to be consistent throughout the proposed development. This will create uniformity throughout the development across both maps.

These resolutions have been modified following the September 20, 2022 Council meeting due to technical adjustments.

Date: October 18, 2022
!SUBJECT
CDBG-CV 1 Amendment

I RECOMMENDATION

1. Conduct a Public Hearingj

2. Consider adoption of the proposed Resolution supporting the changes as outlined as our timeline for expenditures does not provide adequate time to seek other projects or programs. The above projects were considered as part of the 2022 CDBG Program outline and program needs.

The program/project outcomes support the goals and objectives of the City.

I DISCUSSION and BACKGROUND
The Department of Housing and Community Development CDBG Program allocated funding from the CARES Act provided in response to the impacts of COVID-19 to the State Program participants using a method allocation formula. The funding is required to be expended within one year for CV-1 funds and 24 months for CV-2 funding. The City's program for the CV-1 funding was not over subscribed and a remaining balance can be expended on the current CV 2/3 project. An amendment is required to accomplish this process and to request an extension in time to expend the funds.

funding. The City's program for the CV-1 funding was not over subscribed and a remaining balance can be expended on the current CV 2/3 project. An amendment is required to accomplish this process and to request an extension in time to expend the funds.

The city team met internally and with the CDBG HCD team and has determined the best use of the remaining CV 1 is to include in the CV 2/3 project that would support the needs of the community impacted by the COVID-19 response.

City of Anderson 2020 Urban Water Management Plan (UWMP)

I RECOMMENDATION
The Deputy Public Works Director recommends that the City Council:

1. Conduct a Public Hearing;

2. Consider adoption of the City of Anderson 2020 Urban Water Management Plan.

I FISCAL IMPACT
Adoption of the 2020 Urban Water Management Plan (UWMP) will have no impact on the City's General Fund. However, there could be a significant impact to the Water Enterprise Fund if the 2020 UWMP is not adopted since the City would not be eligible for state water grants or loans unless the City complies with the Urban Water Management Act.

ITEM 7.0b PAGE1 10/18/2022
I DISCUSSION and BACKGROUND
In 1983 the California Legislature approved Assembly Bill 797, Division 6, Part 2.6, and Sections 10610 - 10656 of the California Water Code. This legislation, the Urban Water Management Planning Act, requires urban water suppliers providing water for municipal purposes to more than 3,000 service connections or supplying more than 3,000 acre-feet (AF) of water annually to prepare and adopt an Urban Water Management Plan (UWMP) every five years.

An UWMP supports long-term water resource planning in order to ensure that adequate water supplies are available to meet existing and future water demands. The 2020 UWMP describes the City of Anderson water system and includes information about water supply sources, historical and projected water use, water quality, and water shortage contingency measures.

In order to comply with Government Code 6066, the City notified multiple Shasta County public agencies (see Table 1 UWMP), State public agencies and the public of the DRAFT UWMP preparation via a newspaper announcements, email notification, and online posting.

All interested parties were given a 30+ day review period from August 10, 2022 to September 9, 2022, during which a draft of the UWMP was available on the City's website and at City Hall. All agencies and the public were invited to provide comments and feedback to the City of Anderson Public Works Department in regard to the Draft UWMP.

In addition, the City provided follow up newspaper notices regarding the public hearing on September 29th, 2022 and October 6 th, 2022.

To date, the City Public Works Department has received no written comments.

Complete plan is available on the City website and at the City Clerk's Office for review.

Request for Extension of Water Service Outside City Limits to Serve Wooded Acres.

I RECOMMENDATION
Staff recommends that the City Council:

Consider adoption of the attached Resolution requesting the Shasta Local Agency Formation Commission initiate proceedings for a water services extension outside the City limits to serve the properties in the Wooded Acres Pressure Zone.

I FISCAL IMPACT
The requested actions have no direct fiscal impact if Shasta County funds the required LAFCO and City processing of the request. The City will be required to maintain additional water lines and provide water service capacity to serve the property. This cost will be offset partially by payment of water connection fees and monthly supply service charges.

The City will receive no property tax or other direct revenue from service extension.

ITEM 8.9b PAGE1 10/18/2022
I DISCUSSION and BACKGROUND
In 1968 the City of Anderson purchased the Anderson Oaks Water System which consisted of the Tucker Oaks Well, 5,000 gallon hydropneumatic tank, 3,000' of 6" water main, 45 services and a 4" emergency connection to the Tucker Oaks Golf Course.

In 1976 the City of Anderson purchased Rhyne Well from William Rhyne as part of the 5th addition of the Wooded Acres Subdivision. The purchase included the Rhyne Well, 5,000 gallon hydropneumatic tank, 3,900' of 8" water main and 900' of 4" water main. The Rhyne infrastructure was connected to the Wooded Acres South Subdivision.

In 1987 the City of Redding incorporated the Wooded Acres North Subdivision into the City of Redding. At that time, the Anderson City Council relinquished the water system serving the area to the City of Redding.

Since that time, there has remained an interconnection between the two water systems for the purpose of water transfers in times of emergency. The interconnection is a direct physical link between the two water systems and consists of mainline water valves and two-way, forward and reverse, water meters to account for the water supplied by either agency.

The connection has remained in service and has functioned to the benefit of both municipalities on several occasions, such as when Anderson experienced problems with the pressure tank at Rhyne's Well on Meadow Lane or when the Redding Airport Well experienced water quality problems and was removed from service for quite some time.

The cost of using City of Redding water from the 2006 Water Master Plan was $1,042 per million gallon, which is approximately $930 per million gallon more than using the Rhyne Well pump.

In the 2006 Water Master Plan, the following was written regarding the Wooded Acres Pressure Zone. It is not expected that the Wooded Acres Estates system will expand outside its current limits. Any new development that may occur, however, would place an added burden on an already restricted supply system, and would warrant at least one additional well capable for providing for the additional domestic requires and fire flows to be connect to the current Wooded Acres system. An interim option that should be considered before a new Wooded Acres Well is constructed would be to negotiate with the City of Redding to permanently open the existing pressure-regulating valve and allow flow into the Wooded Acres zone during low pressure events, such as a fire.

The City currently only provides water service outside its city limits to the Wooded Acres area and the Riverside Mini Storage.

Local Agency Formation Commission (LAFCO) Requirements
State law prescribes the general powers and duties of LAFCO in each county with respect to the review and approval or disapproval of proposals for extensions of utility services outside jurisdictional limits. Existing law permits a city to provide extended services outside its boundaries only if it first requests and receives written approval from LAFCO.

ITEM 8.9b PAGE2 10/18/2022
Shasta LAFCO may only authorize a city or district to provide new or extended services outside its jurisdictional boundaries under very specific circumstances. Section 56133 of the Government Code allows LAFCO to authorize such an extension service only in case of an emergency and in anticipation of a later change of organization (i.e. annexation).

Such an extension of services may be done to respond to an existing or impending threat to the public health or safety of the residents of the affected territory if the entity applying for the approval has provided LAFCO with documentation of a threat to the health and safety of the public or the affected residents.

Initiating a LAFCO services extension will require either a property owner petition or a petition from the City. It will involve an application to LAFCO, a deposit for LAFCO processing costs, a plan for the extensions of services, a City Council resolution of support, various services extension exhibits, a CEQA determination.

LAFCO requires a processing fee of $5,000.00 for the application to extend services. Shasta County has agreed to pay this fee amount to LAFCO if the City of Anderson submits the request. As a result, there will be no cost to the City for submitting this application.

Overall, the intent of submitting this application is to begin a collaborative process with LAFCO, Shasta County and the City of Redding in an effort to resolve the issue. The problem cannot be solved until the matter is formally placed in front of LAFCO, which will then require all jurisdictions to come to the table to have a discussion and will not necessarily result in the City taking over long-term responsibility for Wooded Acres. Before that could occur, the City Council would need to approve a subsequent resolution formally taking over the ongoing responsibility. In effect, this resolution will only start the process with LAFCO, but will not commit the City to anything beyond that point. !ATTACHMENTS

Wooded Acres Water Services Extension - Plan for Service (GC § 56653 a-b) The plan for providing services shall include all of the following information and any additional information required by the commission or the executive officer:
(1) An enumeration and description of the services to be extended to the affected territory.

Shasta LAFCO, the City of Anderson, the City of Redding and Shasta County have received property owner inquiries, about extending City of Anderson water service to additional parcels in the Wooded Acres Subdivision. In order to help the homeowners in the Wooded Acres subdivision the Anderson City Council has asked staff to help the home owners solve the water issue. In order to accomplish this LAFCO needs to determine who and how the water system should be expanded and funded . The subdivision is located ln the Shasta County unincorporated area, adjacent to the Redding City limits and the Tucker Oaks Water District Boundary. It is not within a City of Anderson city limits or within the city sphere of influence (SOI). Information provided by City of Anderson staff shows that the subdivision ls substantially served by water from the City of Anderson Wooded Acres Pressure Zone. The pressure zone and jurisdictional boundaries are shown on attached map.

Approximately 220 parcels within the Wooded Acres Pressure Zone receive water, the remaining parcels are not served, some have requested water service, due to low volume or dry wells. To connect additional Wooded Acres parcels to the Wooded Acres Pressure Zone, the City of Anderson would apply to Shasta LAFCO for out of area water services. (See attached "Utility Plan Exhibit")
(2) The level and range of those services.

The City of Anderson water service currently operates the Tucker and Rhyne wells in the Wooded Acres Subdivision. The wells currently serve approximately 220 connections, including two commercial 3-inch meter serving the Fairway Oaks mobile home park in the City of Redding. The system has adequate volume but operates at a static pressure of 40psi. The City of Anderson has an intertie with the City of Redding on the northeast corner of the subdivision. The intertie is opened when service issues with either of the Tucker or Rhyne wells. Opening the intertie adjusts operating pressure to 80 psi and creates a $1000 a day flat fee for the opening of the intertie. The City of Redding city limits borders the Wooded Acres subdivision on the northerly edge and has existing water service infrastructure In place.
(3) An indication of when services can be feasibly be extended to the affected territory.

The City of Anderson doesn't not know what the effect will be by adding additional customers on t he existing pressure zone and/or what improvements would be needed at this time. ( 4) An indication of any improvement or upgrading of structures, roads, sewer or water facilities, or other conditions the local agency would impose or require within the affected territory if the change of organization or reorganization is completed.

The additional connections will require an engineering analysis to determine how the additional water demand can be met. For example, the City of Anderson to serve it is likely an additional well maybe needed to provide the minimum amount of water pressure and volume needed to meet current fire flow requirements. For the City of Redding to serve the opening of the intertie and additional water line installation may be needed to make an effective and efficient system. (5) Information with respect to how those services will be financed.

Depending on how water is served will determine the cost. The cost will be borne by the water users in the Wooded Acres subdivision.
