Adopt a Resolution Amending the Anderson Fee Schedule to increase the fees for CEQA staff work
!RECOMMENDATION
The City Attorney recommends that the City Council:
1. Conduct a Public Hearing; and
2. Consider for adoption a resolution amending the Anderson Fee Schedule to change the subject line "Environmental Assessments and Negative Declarations" to "Environmental Assessments- Categorical Exemption, Initial Study /Negative Declaration, Mitigated Negative Declaration, and Environmental Impact Report" and to change the fee for the work to "actual costs."
I FISCAL IMPACT
This item will result in the City receiving compensation for staff time related to CEQA.
ITEM 7.0a PAGE1 2/7/2023
I DISCUSSION and BACKGROUND
Pursuant to the provisions of the California Constitution and the laws of the State of California, the City is authorized to adopt and impose use and regulatory fees and charges for the municipal services and activities it provides. Such user and regulatory fees may not exceed the reasonable costs of providing the service for performing the activity.
The City Council has previously established fees for staff time in connection with California Environmental Quality Act ("CEQA") work, which includes costs for "Environmental Assessments and Negative Declarations" which is $450 per application. Following a staff review of the amount of time required for these applications, the application fee is far less that the actual costs for the review, resulting on the City losing costs in connection with this staff review. The City seeks to change the fee amount to "actual costs" so that all amounts incurred are reimbursed by the City.
The City also intends to expand the title of the CEQA related work to ensure there is no confusion regarding the type of work in which the fee can be charged, which includes categorical exemption, initial study /negative declaration, mitigated negative declaration, and environmental impact report.

ITEM 7.0a PAGE2 2/7/2023
RESOLUTION NO. 23-_
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANDERSON, CALIFORNIA,
AMENDING THE FEE SCHEDULE TO INCREASE THE FEES FOR CALIFORNIA
ENVIRONMENTAL QUALITY ACT STAFF WORK
WHEREAS, pursuant to the provisions of the California Constitution and the laws of the State of California, the City is authorized to adopt and impose user and regulatory fees and charges for the municipal services and activities it provides; and WHEREAS, Article XIIIC of the California Constitution generally states that such user and regulatory fees may not exceed the reasonable costs of providing the service or performing the activity; and
WHEREAS, the City Council has previously established fees for staff time in connection with California Environmental Quality Act ("CEQA") work, which includes costs for "Environmental Assessments and Negative Declarations" which is $450 per application.
Following a staff review of the amount of time required for these applications, the application fee is far less that the actual costs for the review and the City seeks to change the fee amount to "actual costs" so that all amounts incurred are reimbursed by the City; and WHEREAS, the City also intends to expand the title of the CEQA related work to ensure there is no confusion regarding the type of work in which the fee can be charged, which includes categorical exemption, initial study /negative declaration, mitigated negative declaration, and environmental impact report; and
WHEREAS, the City Council seeks to amend the Anderson fee schedule to change the fee to "Actual Costs" for all CEQA related work, and expand the title of the work to be performed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANDERSON DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The recitals set forth above are true and correct and are incorporated into this Resolution by reference.
Section 2. The City Council hereby amends the Anderson Fee Schedule change the subject line "Environmental Assessments and Negative Declarations" to "Environmental Assessments- Categorical Exemption, Initial Study /Negative Declaration, Mitigated Negative Declaration, and Environmental Impact Report.
Section 3. The City Council hereby further amends the Anderson Fee Schedule to change the fee for the work described in Section 2 above from "$450.00" to "Actual Costs." The Amended version of the Anderson Fee Schedule is attached hereto as Exhibit "A." Section 4. The City Council finds that the setting or revising of fees pursuant to this Resolution is exempt from environmental review under the California Environmental Quality Act ("CEQA"), pursuant to Public Resources Code Section 21080(b)(8) and Section 15272 of the CEQA Guidelines, which provide an exemption for the establishment or modification of charges by public agencies that the public agency finds are for the purpose of meeting operating expenses. Based on the record as a whole, the establishment or modification of fees or other charges pursuant to this Resolution is entirely for the purpose of meeting operating expenses in that none of the recommended fees or fee increase would recover more than one hundred percent of the cost incurred by the City to deliver the service provided.
Section 4. This resolution shall take effect immediately upon its adoption.
APPROVED AND ADOPTED by the members of the City Council of Anderson this 7th day of February, 2023.

Public Hearing: Adoption of updated California Building Standards Code
I RECOMMENDATION
The Building Official recommends that the City Council:
1. Conduct a Public Hearing; and
2. By motion, Introduce an Ordinance (First Reading) revising Anderson Municipal Code Chapter 15 and adopting by reference the 2022 Edition of the California Building Standards Code, and set for enactment (Second Reading) on February 21, 2023
3. Direct the City Clerk to read the Ordinance by Title Only. !FISCAL IMPACT
The adoption of the 2022 California Building Codes will have a minor negative fiscal impact While all building and plan check fees are proposed to remain the same, the new Codes have additional requirements that will take more time to verify compliance during the plan check process.
ITEM 7.0b PAGE1 2/7/2023
I DISCUSSION and BACKGROUND
In January 2023, the State Building Standards Commission adopted the 2022 California Building Standards Code with State amendments. It was published in July 2022 and became effective throughout the State in January 2022.
Building Codes are typically updated every three years and adopted by the State with amendments. The State mandates through the Health and Safety Code that the CBSC be enforced by local jurisdictions. Local jurisdictions may not adopt lesser construction standards than those mandated by the State; however, they may adopt more stringent standards when based on findings of fact for climatic, geographical, or topographical reasons.
Although the 2022 CBSC will entail many changes in the way buildings and structures are constructed, staff does not recommend modifications to the code other than continuing to provide the clarifications that the City has previously provided. !ATTACHMENT

ITEM 8.3 PAGE1 2/7/2023
I DISCUSSION and BACKGROUND
Previous Discussion (1-17-23)
With current vacancies in both the Director of Development Services and the Public Works Director, there is a need for daily management level supervision and guidance for the line level staff. The Director will also oversee the consultants that supplement staff. This will create salary savings but having a department head level position is important to provide direction and guidance. The Director of Operations and Administration reports to and receives general administrative direction from the City Manager.
New Discussion (2-7-23)
After advertising the position for two weeks we have not be successful with attracting a pool of qualified candidates. In reaching back to candidates that have choose not to submit they are stating it would be a pay cut or needs to pay higher to get them to leave their current job. The new proposed pay scale matches the same pay as the pay scale for the Public Works Director.
