Honorable Mayor and City Council Members
Jeff Kiser, City Manager
City Attorney Collin Bogener
April 4, 2023
Ordinance No. 854 amending Chapter 10.60 of the Anderson Municipal Code which pertains to "Regulation of Special Events"

I RECOMMENDATION
The City Attorney recommends that the City Council:

Enact Ordinance No. 854 (second reading), amending Chapter 10.60 of the Anderson Municipal Code which pertains to "Regulation of Special Events" as introduced on April 4, 2023 (Second Reading)

I FISCAL IMPACT
The City may receive an increase in special event permit fees due to the removal of exemptions for funerals and school related activities.

I DISCUSSION and BACKGROUND
Last amended in 2014, Chapter 10.60 was created by the City to implement a process for the approval of special event permits when community groups seek to have a parade, special event or other public assembly occur within the city limits. Recent review of the Chapter reflects that further revisions are needed to ensure a clear process for applicants to follow.

ITEM 6.3a PAGE1 4/4/2023
First, the current ordinance provides an exemption for funerals and schools even though those events have the same impact on city staff as any other special event. Public safety and public works are required to review the proposed event and provide staff as necessary to ensure the event is conducted in a safe and orderly manner. The amendment proposes to remove the exemptions for funerals and schools so that the City is not required to lose costs when these events occur.

Second, the proposed amendment seeks to enhance the indemnification requirements that an applicant must commit to prior to a permit being granted. At present, the ordinance only requires an applicant to agree to a "Hold Harmless Agreement." The new language expands the protection to indemnification and defense requirements ensuring additional levels of protection for the City.

Third, the current ordinance provides the City Manager with broad discretion to waive entire portions of the code if the requirements are "unnecessary or inappropriate." However, no guidance is provided as to these terms and how they are defined. This results in members of the community attempting to circumvent the code requirements by going directly to the City Manager but leaving the City Manager no clear clarity on when the authority can be exercised. The amendment seeks to remove this discretion and require all applicants to meet the designated application requirements.

Lastly, in conjunction with the third item above, the amendment adds an appeal process for the applicant if they believe it was improperly denied. Per the amendment, if an applicant wants to appeal the denial of a special use permit, they can appeal to the City Council for review if they file a request with the City Council within 10 days of the denial.

Overall, the intent of the amendment is to "clean up" the ordinance to ensure the City is capturing all necessary costs and removing any arbitrary decisions regarding these permits, while also providing the applicant with an appeal process.

10.60.030 - Rules and regulations.

11. Adequate coordinated and identifiable security, with emphasis on control of alcoholic beverages and prevention of illegal drug consumption.

C. Processing of Application. Before issuing a permit for a special event, the city manager shall cause a review to be made by each appropriate department regarding the application and shall have the findings set forth in writing and attached to the permit.

D. Fees. No application fees required. Facility rental fees shall apply. Reimbursement for personnel. Unless otherwise specified by the city council, all costs of services determined by the city to be necessary and provided by the city, including but not necessarily limited to the assignment of police, fire, and public works personnel necessitated by the event shall be borne by the applicant.

10.60.040 - Liability provisions.

A. Liability Insurance. Before a permit is issued, a certificate of insurance and endorsement will be required in an amount of at least one million dollars, naming the city of Anderson as a co-insured for protection against claims of third persons for personal injuries, wrongful deaths, and property damage. The city, its officers, employees and volunteers shall be named as additionally insured by endorsement of the policy. The policy shall not be subject to cancellation or modification until after thirty days written notice to the city. An original copy of the certificate and endorsements will remain on file with the city.

8. Workers' Compensation Insurance. An applicant shall conform to all applicable federal and state requirements for workers' compensation insurance for all persons operating under a permit.

C. Hold Harmless and Indemnification Agreement. D. Faithful Performance Bond. To ensure cleanup and restoration of the site, an applicant may be required to post a refundable faithful performance bond or cash deposit (amount to be determined by the city manager) at the time application is submitted. Upon completion of filming and inspection of the site by the city, the bond may be returned to the applicant if the site is clean and has been restored to its previous condition.

10.60.050 - Denial of Application and Appeal
A An application for a special event permit may be denied if:

1. Information contained in the application or supplemental information requested from the applicant is found to be false in any material detail;

2. The applicant fails to complete the application form after having been requested to do so;

3. Another special event permit application has been received prior in time, or has already been approved to hold another event at the same time and place requested by the applicant, or so close in time and place as to cause undue traffic congestion, or city resources are unable to meet the needs for both events;

4. The time, route or size of the event will substantially interrupt the safe and orderly movement of traffic contiguous to the event site or route;

5. The concentration of persons, animals and vehicles at the site of the event, or the assembly and disbanding areas around an event, will prevent proper police, fire or ambulance services to area contiguous to the event.

B. An applicant may appeal a denial of special event permit by submitting a written request for appeal to the city clerk within ten (10) days of the denial. That appeal will be considered by the city council at a regularly scheduled meeting within thirty (30) days of the submittal of the request for appeal.

10.60.060 - Violation.

If an applicant violates any provision of this chapter or a permit issued pursuant thereto, the city may cancel the permit. Violation of the terms and conditions of the special event permit is considered an infraction.

SECTION 2. CEQA. This ordinance is exempt from the California Environmental Quality Act (CEQA) pursuant to the General Rule (14 C.C.R. Section 15061(b)(3)) because it can be seen with certainty that the project will have no possibility for causing a significant effect on the environment.

SECTION 3. SEVERABILITY. If any section, subsection, sentence, clause, phrase or word of this ordinance is found to be unconstitutional or otherwise invalid by any court of competent jurisdiction, such decision shall not affect the remaining provisions of this Ordinance.

SECTION 4. ENACTMENT. The City Clerk shall certify the adoption of this ordinance and shall cause it to be posted and/or published in accordance with the law.

The foregoing Ordinance was introduced at a regular meeting of the City Council of the City of Anderson held on March 21, 2023 and enacted at a regular meeting of the City Council of the City of Anderson held on April 4, 2023 by the following vote.

Ordinance No. 855 amending Section 9.38.140 "Park Closures" of the City of Anderson Municipal Code to amend park hours.

I RECOMMENDATION
The City Attorney recommends that the City Council:

Enact Ordinance No. 855 (second reading), Amending Section 9.38.140 "Park Closures" of the City of Anderson Municipal Code to amend park hours as introduced March 21, 2023 (first reading).

I FISCAL IMPACT
There is no fiscal impact.

I DISCUSSION and BACKGROUND
In 1977, the Anderson City Council established, by ordinance, the "Control and Regulations within Public Works," which included the park to be closed from midnight to one-half hour before sunrise. This ordinance established Anderson Municipal Code Section 9.38.140.

ITEM 6.3b PAGE1 4/4/2023
In 1979, City Council adopted an ordinance amending Section 9.38.140 of the Anderson Municipal Code. The adopted ordinance of the Anderson Municipal Code was amended to read as follows:

All public parks shall be closed to the public nightly at eleven o'clock and opened daily to the public at one-half hour before sunrise. The Rupert Road entrance to Anderson River Park shall be closed during such periods as are determined to be necessary by the City Manager.

The proposed amendment of the Anderson Municipal Code Section 9.38.140 "Park Closures" of Chapter 9.38 "Control and Regulations within Public Parks" of Title 9 "Public Peace, Morals, and Welfare" would read as follows:

All public parks shall be closed to the public nightly at 10:00 p.m. and opened daily to the public at 7:00 a.m .. The Rupert Road entrance and the Dodson Road entrance to Anderson River Park, and the entrances to Volante Park, shall be closed nightly from 10: 00 p.m. to 7:00 a.m. These park entrances may be open outside of these time frames if approved through a Special Event Permit as set forth in Chapter 10.60 of this Code.

The proposed amendment to Section 9.38.140 would eliminate discretionary verbiage of the park hours. This amendment will also allow individuals or groups to request the park to be opened outside the set hours by seeking approval through a Special Event Permit.

Consider authorization to award the concrete footings for the Amphitheater Renovation

I RECOMMENDATION
The City Manager recommends that the City Council:

1. Award the contract for concrete footings for the Amphitheater Renovation to Muse Concrete Inc. from Redding, CA in the amount of Ninety-Seven Thousand One Hundred and Ten Dollars. ($97,110.00);

2. Authorize the City Manager to execute the contract upon receipt of required insurance certificates; and

3. Authorize the City Manager to approve additional project change orders not to exceed 15% of the contract bid amount.

The proposed project will be funded with ARPA funds.

ITEM 8.3a PAGE1 04/04/2023
I DISCUSSION and BACKGROUND
In 1986 the City constructed the amphitheater roof line and stage, in 2009 the stage was raised and expanded, the dance floor was added and tiered seating was installed. Since its original construction the Mosquito Serenade concrete series has continued to grow in popularity and the sound requirements continue to evolve with technology. Forty years ago, when Mosquito Serenade began sound equipment was "ground stacked", today digital sound equipment needs to be flown in the air above the stage.

The proposed project will raise and extend the front of the roof further over the stage to allow for the speakers to be raised to manufacturers recommended height. Muse Concrete will pour footings for fabricated steel structures.

Side Letter to Memorandum of Understanding with the Teamsters Local 137 Contract

I RECOMMENDATION
The Assistant City Manager recommends that the City Council:

Consider adoption of a Resolution approving a Side Letter to the Memorandum of Understanding (MOU) negotiated between representatives of the City of Anderson and representatives of the Teamsters Local 137.

I FISCAL IMPACT
The fiscal impact will be approximately $15,044 annually per employee. Depending upon the employee, the Funds affected can be Public Works, Water, Sewer or the General Fund.

ITEM 8.5 PAGE1 4/4/2023
I DISCUSSION and BACKGROUND
In January of 2023, the City met with Teamsters Local 137 for an update for employees to be available for stand-by in case of incidents that may occur in the City.

Several years back stand•by was implemented in the Wastewater Division due to regulatory requirements. The amount agreed upon at that time was $ 180.00 per week per employee. This rate has not been adjusted since it's inception.

In discussions regarding stand-by pay it was acknowledged that in addition to the Wastewater Division, employees holding classifications as Maintenance Worker and Water classifications have a need for stand-by pay as well due to their job tasks and duties.

The attached Letter of Understanding increases the amount of stand-by pay to $289.13 per week from the $180.00 per week and now includes employees in the employees holding Maintenance Work and Water classification.

ITEM 8.9 PAGE1 04/04/2023
I DISCUSSION and BACKGROUND
In 1986 the City constructed the amphitheater roof line and stage, in 2009 the stage was raised and expanded, the dance floor was added and tiered seating was installed. Since its original construction the Mosquito Serenade concrete series has continued to grow in popularity and the sound requirements continue to evolve with technology. Forty years ago, when Mosquito Serenade began sound equipment was "ground stacked", today digital sound equipment needs to be flown in the air above the stage.

To begin the process for this project the City Council must make an environmental determination.

The Anderson River Park Amphitheater Renovation project was found to be Categorically Exempt in accordance with Section 15301, Class l(a) of the California Environmental Quality Act (CEQA). This section deals with replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.
