3. Perform annual review of military equipment use ordinance and policy

I FISCAL IMPACT
Fiscal impact is unknown at this time.
\ DISCUSSION and BACKGROUND
In May of 2022, the Council approved a military equipment policy consistent with AB 481. AB 481 requires each law enforcement agency's governing body to adopt a written military use policy by ordinance in addition to other requirements by the bill. The following are required:

ITEM 8.8 PAGE1 6/6/2023
o Publish the draft military equipment use policy to the Police Department's website 30 days ahead of a public hearing to approve the policy.
o Obtain approval by the applicable governing body (Mayor and City Council), by adoption of a military equipment use policy prior to taking certain actions relating to the funding, acquisition, or use of military equipment, as defined. (See definitions below) o Publish an annual report by the law enforcement agency to include each type of military equipment approved by the governing body.
o Annual review of the military equipment use ordinance by the governing body, and option to either disapprove a renewal of a type of military equipment or amend the military equipment use policy if it determines that the military equipment does not comply with standards for approval.
o Hold at least one well-publicized and conveniently located community engagement meeting within 30 days of submitting and publicly releasing the annual military equipment report.

This agenda item is to meet the annual obligation for the Council to review the ordinance and policy. The ordinance and the policy are attached to this staff report and have remained unchanged since last year. The annual report is being prepared by APO and the public meeting will be scheduled.

Per AB 481, the annual report must include the following items:
(1) A summary of how the military equipment was used and the purpose of its use. (2) A summary of any complaints or concerns received concerning the military equipment. (3) The results of any internal audits, any information about violations of the military equipment use policy, and any actions taken in response.
( 4) The total annual cost for each type of military equipment, including acquisition, personnel, training, transportation, maintenance, storage, upgrade, and other ongoing costs, and from what source funds will be provided for the military equipment in the calendar year following submission of the annual military equipment report.
(5) The quantity possessed for each type of military equipment. (6) If the law enforcement agency intends to acquire additional military equipment in the next year, the quantity sought for each type of military equipment.

In compliance with the annual requirements, APO provides the following report, which is also discussed in the updated policy:
1) The military equipment continues to be used for the same purpose as originally indicated in the initial report.
2) No complaints or concerns have been received regarding the military equipment. 3) APD conducted an internal audit and determined that no violations of the military equipment had occurred.
4) The total costs for the military equipment remains the same as in the original policy. 5) The quantity of military equipment remains the same as in the original policy. 6) APD does not intend to acquire additional military equipment in the next year.

ITEM 8.8 PAGE2 6/6/2023
It is also intended that the community engagement meeting, pursuant to Government Code section 7072(b ), occur at this same time. Members of the community should be asked to provide feedback, if any, regarding the military use policy and annual report.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ANDERSON DOES ORDAIN AS FOLLOWS:

Section 1. Determinations and Orders.

1. Anderson Police Department Policy 706 meets the requirements of subdivision (d) of Government Code section 7070 because substantial evidence in the record estabHshes that:

A Policy 706 is necessary because there is no reasonable alternative that can achieve the same objective of officer and civilian safety; and B. Policy 706 will safeguard the public's welfare, safety, civil rights and civil liberties; and
C. The equipment set forth in Policy 706 is reasonably cost effective compared to available alternatives that can achieve the same objective of officer and civil safety.

2. Anderson Police Department Policy 706 is approved and adopted.

3. The Chief of Police shall, no later than forty-five ( 45) days before the one (1) year anniversary of the adoption of this ordinance, produce the annual military equipment report required by Government Code section 7072, publish the same on the Anderson Police Department Internet website, and provide the notice and public engagement required by subdivision (b) of Government Code 7072.

4. The Chief of Police shall, after undertaking all actions set forth in Section 3, herein, agendize consideration of the annual military equipment report for a regular meeting of the City Council no later than the one (1) year anniversary of the adoption of this ordinance.

5. The Chief of Police shall, no later than eleven (11) months after the adoption of this ordinance cause consideration of an ordinance to renew this ordinance for an additional term of one (1) year to be agendized for first reading.

Section 2, Severablllty. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance, or its application to any person or circumstance, is for any reason held to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity or enforceability of the remaining sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases of this Ordinance, or its application to any person or circumstance. The City Council of the City of Anderson hereby declares that it would have adopted each section, subsection subdivision paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more other sections, subsections subdivisions paragraphs, sentences, clauses or phrases hereof be declared invalid or unenforceable.

Section 3. The City of Anderson finds that this Ordinance is not a "project" according to the definition set forth in the California Environmental Quality Act ("CEQA"), and, pursuant to CEQA Guidelines sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15061(b)(3) (there is no possibility the activity in question may have a significant effect on the environment), the adoption of this ordinance is therefore not subject to the provisions requiring environmental review.

I HEREBY CERTIFY that the foregoing ordinance was introduced and read by the City Council of the City of Anderson at a regular meeting on the 3rd day of May, 2022, and was duly read and adopted at a regular meeting on the 17th day of May, 2022, by the following vote:

2023-2024 Budget Workshop - Capital Improvement Planning I DISCUSSION and BACKGROUND
Bacqround
Tonight, the City Council will review staffs recommended Capital Improvement Plan for the coming five-year period. This five-year plan is updated each year and includes our projections for development fee revenues and plans for construction needed infrastructure.

Ca,pital Improvement Plannin&:

Each spring, the City Manager develops a proposed annual update of the City Council's adopted Five Year Capital Improvement Plan. As part of the CIP development process, staff has updated our development projections for the next five years and completed estimates of anticipated development fee revenues and current fund balances. In developing CIP recommendations, management considers growth and development projections, areas of greatest need, and, most importantly, the City Council's adopted priority projects for the 2023-2024 fiscal year.

ITEM W.S.1 PAGEl 6/6/2023
The CIP only includes new projects to begin in future years; the budget for projects that are currently underway will roll forward until they are complete.

In addition, as it is difficult to project revenues and project needs four or five years from now, the proposed projects and schedules should be considered tentative in the later years.

The purpose of tonight's workshop is for the City Council to consider the projects in the proposed CIP update and to provide feedback to the City Manager and staff.

The Planning Commission has adopted a resolution advising the City Council of the conformity of the proposed Capital Improvement Plan with the General Plan.

The City Council will be asked to adopt the final CJP, along with the rest of the 2023-2024 budget, at the conclusion of a public hearing scheduled for June 20, 2023.

Corp Yard and Police Facility Fund (108)
Revenues in the fund are set aside for improvements and expansion of two city facilities:
the Corp Yard on Barney Street and the Police Department on North Street. While construction of these facilities is still many years down the road staff is recommending planning for pre-construction activities of the Police Department in the fiscal year 2023- 2024. During this budget cycle staff is recommending budgeting $150,000 for those preconstruction activities for a new Police building. Revenues in the fiscal year 2023-2024 are projected at $68,500. The current reserve for this fund is approximately $630,166.

Draina&e Capital Improvement Fund (109)
The Drainage Capital Improvement fund is used for capital improvements to citywide drainage, including Tormey Drain. Although we show funding for miscellaneous minor projects in the CJP, our primary area of focus will continue to be Tormey Drain. Tormey Drain needs clearing and maintenance in several sections. We have projected $48,000 in the 2023-2024 fiscal year for this maintenance. Revenues are projected at $114,500 in 2023-2024. The current reserve in this fund is approximately $1,016,067.

Parks Capital Improvement Fund (110)
The Parks Capital Improvement Fund will never have sufficient revenues to finance significant improvements to our park system, and, as such, the fund is typically used for local matches for grants. Future projects are the Phase II Amphitheater Improvements and playground refurbishments. Revenues are projected to be $25,000 in 2023-2024. Council has recently approved American Rescue Act Funding for several park projects. The projects are listed on the Capital Improvement Project sheets. Currently there is no reserve in this fund.

Wastewater Capital Improvement Fund (111)
Out of this fund the City continues to pay for the 2007 Wastewater Improvement bonds:
which allowed for projects, such as the inflow and infiltration project on Cobblestone Loop ITEMW.S.1 PAGE2 6/6/2023
# 2. Anticipating that we will be seeking either grant or loan funds to extend sewer to the Ox Yoke area, staff believes that environmental clearance and right of way acquisition for this important project will not occur until the 2025-2026 fiscal year. Revenues are projected at $166.732 in 2023-2024. Current reserves are approximately $784,590.

Water Capital Improvement Fund (112)
The revenues in this fund are used to construct capital improvements to the City's water system. Cash balances in this fund are expected to remain in a deficit position due to the Southwest Booster Pump Project and, as such, no projects are planned for any time during this planning period. However, this fund is recovering slowly and in the 2021-2022, the Anderson High Reservoir has been recoated. Revenues are projected at $47,000 in the 2023-2024 fiscal year. As mentioned above there is no reserve in this fund.

Traffic Capital Improvement Fund (113)
The Traffic Capital Improvement Fund is the funding that is set aside to fund traffic improvements at identified locations, for example, these are the funds that would be used to improve an intersection with signals or widen a road that has seen an increase in the volume of traffic. It has been several years since the traffic impact fee program has been updated, so staff is recommending that an update occur in the coming year. Staff is estimating $50,000 in the 2023-2024 year to update the Traffic Impact Fee. Revenues are projected at $44,000 in fiscal year 2023-2024. The current reserve in this fund is approximately $2,125,807.

Deschutes lnterchanie Project (115)
This fund was established to collect capital development fees for improving the Deschutes Interchange: construction of the eastside roundabout and new north bound off ramp is completed. The west side improvements (phase 2) will be constructed based on traffic needs, currently forecasted to be more than ten years out. Revenues in 2023-2024 are projected at $18,000. Current reserves in this fund are approximately $257,836.

Shastec Project Area (331)
The Anderson Redevelopment Agency partnered with the City of Redding and Shasta County to form the Shastec Redevelopment Project Area in 1996. All Redevelopment Agencies were dissolved as of February 1, 2012. These are again, remaining funds that are required to be used on an identified project. Curb, Gutter, Sidewalk north side of Riverside Drive to 1-5. The sidewalk will be constructed on the north side of the road. This project is projected to begin and be completed in the 2025-2026 fiscal year. Again, once this project is complete this fund will be closed. The reserve balance in this fund is $541,206.
