ITEM 8.9 PAGE1 7/26/2023

I FISCAL IMPACT
The requested actions will have no direct fiscal impact. Pursuant to Council direction, Sierra Pacific Industries is required to fund LAFCO and City processing costs for the request and to pay for all engineering and construction costs. The City will be required to maintain additional water lines and provide water service capacity to serve the property, however, this cost will be offset by the payment of water connection fees and monthly supply service charges. The City will receive no property tax or other direct revenue from the development.

I DISCUSSION
Sierra Pacific Industries has requested water service from the City for their mill and administration building which is located as shown in Attachment 1. Currently, The City has agreed to provide water to locations in this area, the mini storage and the fire station.

The City currently has a l0·inch water main in Ox Yoke Road that has sufficient capacity to serve this new development. Sierra Pacific Industries is to extend the existing 8-inch main and construct approximately 1,100-feet of new 8-inch main that will provide service to their parcels. All new water facilities will be constructed to City standards.

CONSTRUCTION TO CITY STANDARDS: City staff have already articulated these requirements to Sierra Pacific Industries.

SIERRA PACIFIC INDUSTRIES AGREEMENT: The request is to authorize the City Manager to negotiate and execute an agreement with Sierra Pacific Industries. The agreement will require Sierra Pacific Industries to bear all design, construction, permitting, and processing costs.

LAFCO: Existing law allows a City to extend services outside its boundaries only if it first requests and receives written approval from LAFCO. Section 56133 of the Government Code allows LAFCO to authorize such an extension of services only in case of an emergency and/or in anticipation of a later change of organization (i.e. annexation). Initiating a services extension will require a LAFCO petition from the City. The process will involve an application to LAFCO, a deposit for LAFCO processing costs, a plan for the extension of services, a City Council resolution of support various services, extension exhibits, a CEQA determination, and a City approved agreement with Sierra Pacific Industries to not oppose a future annexation. The request is to authorize the City Manager to execute the LAFCO documents with all costs and fees paid by the County.

HISTORICAL CONTEXT: On April 4, 2017 the Council authorized a very similar agreement with MW Holdings LLC (Weaver) for a mini storage facility project at 19912 Riverside Avenue. The mini storage project was subsequently constructed along with the City water line infrastructure. On October 6, 2020 the City agreed to provide water to the County fire station located just east of the SPI location. The proposal from Sierra Pacific Industries under ITEM 8.9 PAGE2 7/26/2023
consideration will extend City water infrastructure in a manner that supports future annexation in the event annexation becomes desirable to the City.

ENVIRONMENTAL DETERMINATION: Pursuant to the California Environmental Quality Act ("CEQA") and the City's local CEQA Guidelines, City staff determined that the water line extension and service ("Project") is categorically exempt from CEQA pursuant to CEQA Guidelines §15303 Class 3 (d) 11New Construction or Conversion of Small Structures"; OPTIONS: Staff has provided the following options for the consideration of the City Council:

1. Approve the request to provide water service and enter into a LAFCO agreement.

2. Deny the request.

5. The City Manager is authorized and directed to take all actions consistent with this resolution to negotiate and approve an agreement for the services extension with the County of Shasta.

6. That such extension of services is limited in scope, and any revision to the nature and purpose of the Property Owners request or use of the property or of City services shall require the separate approval of the City Council.
