To: Honorable Mayor and Members of the Anderson City Council From: Jon Poletski, Acting City Manager
Through: Collin Bogen er, City Attorney and Christy White, City Clerk Date: October 17, 2023
I SUBJECT
Consider Approval of Side Letter Amendment to the Memorandum of Understanding between the City of Anderson and the Anderson Police Management Association regarding Patrol Sergeant Scheduling
I RECOMMENDATION
The City Clerk and City Attorney recommends that the City Council:
1. Receive a Staff Report
2. Authorize staff to amend the APMA MOU to change the scheduling for Patrol Sergeants
I FISCAL IMPACT
There is no fiscal impact.
I DISCUSSION and BACKGROUND
Earlier this year, the City Council of the City of Anderson approved a Memorandum of Understanding between the City and the Anderson Police Management Association, which ITEM 6.9 PAGE1 10/17/2023
had not previously been a bargaining unit. That MOU contained a provision pertaining to employee scheduling, discussed in Article 12- Hours and Overtime.
The APMA would like to amend section 12.2(b) of Article 12 to state that Patrol Sergeants will not be allowed to work more than two consecutive "Day Shift" or "Night Shift" assignments in a row in a calendar year. Additionally, it clarifies that the Patrol Sergeants will choose their shift rotations at the beginning of the year, with that selection based on seniority.
City staff recommends the amendment, as this is a routine and non-controversial matter. !ATTACHMENTS

SIDE LETTER OF AGREEMENT BETWEEN
THE CITY OF ANDERSON
AND
THE ANDERSON POLICE MANAGEMENT ASSOCIATION
PATROL SERGEANT SCHEDULING
This document amends the current Memorandum of Understanding ("MOU") between the City of Anderson ("City") and the Anderson Police Officer's Association ('J\POA''). This amendment supersedes the MOU, where in conflict as follows:
Section 12(b) of the MOU is repealed and replaced with the following:
12.2(b) For those employees who are assigned to a twelve-hour shift work schedule, the regular biweekly shift schedule shall consist of one eight (8) hour shift and six twelve (12) hour shifts with a meal break. Twelve-hour shift work hours are: Day Shift - 0600 hours to 1800 hours and Grave Shift - 1800 hours to 0600 hours. With the exception of shift rotations, the biweekly work schedule for shift employees shall normally consist of four consecutive workdays and three consecutive non-work days followed by three consecutive workdays and four consecutive non-work days. Shift employees' workweek may begin on any day of the week or any shift of the day. The foregoing work hours, workdays, and work schedules may, however, be modified from time to time by the Chief of Police as he determines necessary by the needs of the service. Prior to each four (4) month period beginning with the first day of a pay period closest to January 1, May 1, and September 1 each year, the City shall post the shift schedule for each position. Employees shall then indicate their preference for a work schedule. Insofar as is practicable and consistent with the needs of the service, the City shall assign work days and work hours, giving first consideration to employees' preferences in the order of employee's seniority in rank. Seniority in rank shall mean the senior Sergeant shall have a preference among Sergeants and so forth for additional ranks of Lieutenant and Captain. Except as otherwise approved by the Chief of Police, employees will be prohibited from remaining on the same shift for more than two (2) consecutive four ( 4) month periods. Employees shall not work more than sixteen (16) consecutive hours in a twenty-four-hour period unless directed by the Chief of Police.
Whenever it becomes necessary to reschedule any employee's workdays and/or work hours, the Chief of Police will give as much notice as possible. The City will not reschedule individual employees solely for the purpose of avoiding overtime work.

Whenever it becomes necessary to reschedule any employee's workdays and/or work hours, the Chief of Police will give as much notice as possible. The City will not reschedule individual employees solely for the purpose of avoiding overtime work.
Employees holding the rank of Sergeant that are assigned to the Patrol Division will not be allowed to work more than two consecutive "Day Shift" or "Night Shift" assignments in a row in a calendar year. With the understanding that changes may be made based on the needs of the department. Employees holding the rank of Sergeant that are assigned to the Patrol Division will choose their shift rotations at the beginning of the calendar year for the entire upcoming year. The shifts will be chosen based on seniority, with the most senior Sergeant choosing first.

!October 17, 2023 City Council Meetine
To: Honorable Mayor and Members of the Anderson City Council From: Jon Poletski, Acting City Manager
Through: Collin Bogener, City Attorney
Date: October 17, 2023
I SUBJECT
Approval of Interim City Manager
I RECOMMENDATION
Consider approval of Police Chief Jon Poletski as Interim City Manager.
I FISCAL IMPACT
Fiscal impact is limited to a 5% increase to Chief Poletski's salary. However, no City Manager salary will be paid during this period.
I DISCUSSION and BACKGROUND
October 17, 2023 is Jeff Kiser's last day with the City of Anderson. Mr. Kiser designated Police Chief] on Poletski as Acting City Manager for a period of time ending October 17th. It is now time for Council to select an Interim City Manager.
The City Council would like to appoint Chief Poletski to act as an Interim City Manager until a permanent City Manager is selected by the Council. Chief Poletski will perform all duties of the Interim City Manager consistent with Chapter 2.04 of the Anderson Municipal Code, which governs the City Manager.
ITEM 8.2 PAGE1 10/17/2023
One item of concern is the employment of Chief Poletski's daughter in the City's Public Works Department. Chief Poletski's position in her line of supervision could run afoul of the City's Nepotism Policy. The City Council is very cognizant of this fact and wants to include safeguards in place to prevent any concerns of nepotism occurring. As Interim City Manager, Chief Poletski will not be involved in any work-related meetings, discussions, or communications that pertain to his daughter. Further, to ensure an additional separation, the Public Works Director will direct all personnel issues to the City Attorney for review, rather than the Interim City Manager.
The City Council wants to emphasize to all staff and members of the public that this decision does not lessen its desire to pursue the goals in its Nepotism Policy (Personnel Rule XVIII), which include avoiding favoritism, potential conflicts of interest, and decreased employee morale. Rather, this decision is made due to the unique circumstances in front of the Council and the Council's need to provide some consistency to the City.

Award bid for the River Splash Shade Structure Installation Project.
I RECOMMENDATION
The Director of Community Services recommends that the City Council:
1. Award the contract for the River Splash Shade Structure Installation Project to GameTime in the amount of $103,641.91.
2. Authorize the City Manager to execute the contract upon receipt of the required insurance certificate and bonds.
3. Authorize the Public Works Director to approve change orders not to exceed 15% of the bid amount.
I FISCAL IMPACT
This project is being funded by the Parks Capital Improvement Fund with one-time American Rescue Plan Act (ARPA) funding. This product and service is being procured by use of the California Multiple Award Schedule (CMAS) contract which manufacturers pricing can be based ITEM 8.6b PAGE1 10/17/2023
off competitively bid or assessed pricing, the federal GSA schedule or better. The bid from GameTime is $103,641.91 and change orders as a contingency are not to exceed 15% of the original contract.
j DISCUSSION and BACKGROUND
During the construction of River Splash in 2020 the city had to reduce costs and removed additional shade structures from the overall design. Due to one-time ARPA funding being available we can construct these three shade structures at River Splash before the next operating season.
With the increasing popularity of River Splash, it has been identified that there is a shortage of shade and that it is an important asset for the park users' overall experience.
The CMAS contract to supply and install the shade structures is $103,641.91.
