I SUBJECT
Appointment of Joey Forseth-Deshais as New City Manager and Approval of the Related Employment Agreement

I RECOMMENDATION
Approve the appointment of Joey Forseth- Deshais as the City of Anderson City Manager and approve the proposed employment agreement

I FISCAL IMPACT
Pursuant to the Agreement, Forseth- Deshais will start off at step 4 at time of hire, which is $219,877.00. During the first year, his salary will be increased one step per quarter until he is at step 7 during the last quarter of the year, which is $256,485.00.

I DISCUSSION and BACKGROUND
Following the retirement of City Manager Jeff Kiser, the Anderson City Council engaged in a recruitment process to select his successor with the firm Peckham & McKenney. After interviewing multiple applicants, the City Council extended an offer to Joey ForsethDeshais, the City's Director of Community Services.

ITEM4.2 PAGE1 1/2/2024
Mr. Forseth-Deshais started his career as a Firefighter for the United States Forest Service in Weaverville, travelling throughout the United States fighting fires and working with multiple public agencies. His city experience began working for the City of Redding as a gardener, before quickly moving up the ranks to a Parks Superintendent and then a Parks and Facilities Manager, followed by Assistant Director of Community Services. As the Assistant Director of Community Services, Mr. Forseth-Deshais managed an annual budget of over 14 million dollars and oversaw over 50 staff members.

Mr. Forseth-Deshais came to the City of Anderson earlier this year and has already made a significant impact. He coordinated the Christmas in Anderson event and has organized various youth sports events. He is already taking steps to prepare for the highly popular summer concert series, Mosquito Serenade, a role he will continue as City Manager.

If the employment agreement is approved, Mr. Forseth-Deshais will begin serving the City as the new City Manager on January 3, 2024. The agreement is for an initial 3-year term, beginning on January 3, 2024 and ending on January 2, 2027. The agreement provides the following salary and benefits:
• Initial salary will be $219,877.00, which will be increased to $231,462.00 after the first quarter, $243,651.00 after the second quarter, and $256,485.00 after the third quarter. The intent is to the compensation be higher than his closest subordinate by the end of the first year;
• During the first year, the City Council will conduct quarterly performance evaluations of the City Manager to ensure he is hitting appropriate benchmarks.
• The City will provide the City Manager with a vehicle for City use, along with fuel, maintenance and insurance costs.
• There is a compaction provision in the Agreement that maintains the City Manager's salary at 5% above his highest paid subordinate. • If terminated without cause, the City will pay the City Manager 4-months of salary during the first year, and 6-months of salary in years 2 and 3. • Vacation and sick leave will be provided on the same basis as all other employees.
• The City will pay for the City Manager's professional development costs, including ICMA and League of Cities courses.

The terms of this Agreement are consistent with the terms included in the previous City Manager's agreement.

The proposed contract requires Mr. Forseth-Deshais to comply with the ICMA Code of Ethics which provides guidelines for the performance of his duties as City Manager and defines, to some extent, the respective roles of the Manager and the City Council with respect to governance of the city. All terms and provisions of the agreement have been fully reviewed by the City Attorney.

Adopt City Manager Salary Schedule.

I RECOMMENDATION
The City Clerk recommends that the City Council:

Consider adoption of the attached pay schedule for the City Manger position.

I FISCAL IMPACT
There is no fiscal impact of this action.

I DISCUSSION and BACKGROUND
Pursuant to the Public Employees' Retirement Law (PERL), the Public Employees' Pension Reform Act Of 2013 (PEPRA), and subdivision (a) of CCR section 570.5 the city must adopt a salary schedule for the position of City Manager. If the City does not have a Publicly Available Pay Schedule, then the PERS Board may determine, in its sole discretion, the amount that will be considered as a pay rate.

ITEM 6.3b PAGE1 1/2/2024
Staff recommends adoption of the attached pay schedule to avoid any uncertainty in connection with PERS regarding the pay rate for the City Manager position, and to avoid PERS having the discretion to make determine regarding compensation.

There is no fiscal impact associated with endorsing the plan.

ITEM 8.3a PAGE1 1/2/2024
I DISCUSSION and BACKGROUND
At its meeting of June 20, 2023, the City Council (City) appointed Mayor Mike Gallager and Council Member Susie Baugh to participate on a County of Shasta-wide ad-hoc Steering Committee to develop a regional plan to address homelessness. The ad-hoc committee unofficially dubbed itself the AT HOME Shasta Committee (Committee) in reference to the California State Association of Counties AT HOME Plan. The Committee met several times with the first meetings dedicated toward information sharing, education and setting expectations. The outcome of these sessions is the attached Action Plan (Plan). It is important to recognize that this Plan is not inclusive of all activities and efforts that are, or will be, taking place in attempting to assist those who are without homes. Instead, it is an attempt to start a process to bring consistency, unity, coopl:ration and collaboration to the forefront.

As part of the Committee's work, five sub-committees were formed addressing issues around homelessness in conjunction with Law Enforcement, Outreach, Continuum of Care, Case Management and Shelter. While many good topics rose out of these sub-committees there were consistent themes such as the need for a day resource center, better coordination, more outreach and, of course, shelter of all types. Based on this, the plan focuses on five objectives: Fiscal Responsibility; Homeless Management Information System; Navigation/Day Resource Center; Choice, Accountability, Incentives and Crime; and, Focus. The first two objectives are more directive as to their outcomes whereas the last two objectives are intended to drive collaboration and the development of a roadmap to assist in the allocation of current and future funding sources.

This Action Plan will be presented to the City Councils of Shasta Lake and Redding as well as the Shasta County Board of Supervisors, all of which have participated on the Committee. Should all Shasta County local governments endorse this plan it will provide a clear message that our community is working together to assist those experiencing homelessness and that we are dedicated to helping those in need in the most efficient, productive and cost-effective way.

The AT HOME Shasta committee has found value in participating in this ad-hoc committee and recommends it continue to meet at regular quarterly meetings and special meetings as needed. The purpose of the standing committee will be to continue to update the plan, receive reports back as to program effectiveness, suggest focus areas for future grant opportunities and to maintain coordination and communication amongst the legislative bodies. As the Plan is changed, the updates will be provided to the City Council for consideration.

Draft Water Rate Study Update

I RECOMMENDATION
The Public Works Director recommends that the City Council:

1. Receive a Staff Report;

2. Receive a report from the City's consultant, Lechowicz + Tseng Municipal Consultants.

3. Provide direction to staff to implement the consultant's recommendations or provide alternative direction.
!FISCAL IMPACT
Increased rate-payer revenue will fund the cost of service and maintain a reserve fund for emergencies and unforeseen circumstances.

I DISCUSSION and BACKGROUND
Since 2001, the City has proposed water rate increases of a modest nature by increasing monthly water meter charges and consumption charges by 2.8% to 3% per cycle. In 2014, this ideology shifted from 3% to 5% for 2014 and 2015 and then for 2021 through 2025.

Over the last 20 years, the City has only proposed a rate increase nine times.

Per the City Council's direction on 10/20/2020, City staff worked with Lechowicz and Tseng Municipal Consultants to review the City's existing rate structure.

ITEM 8.9 PAGE1 1/02/2024
Consumers of the City's water service are charged user fees to maintain our water system.

Each year, staff analyzes the revenues and expenditures in the Water Enterprise Fund, comparing the service's costs with user revenues. To keep up with inflationary costs, the City typically imposes small increases in user fees each year.

Unfortunately, continuing increases in operating expenses have made safe drinking water more expensive and have already outpaced the rate increases implemented by Resolution No. 21-06. For the fiscal year 2021, the water enterprise fund showed a decrease in reserves of $282,527; again, in the fiscal year 2022, there was a decrease in reserves of $135,042.46. Expenditures continue to outpace revenues in the water fund, leaving an approximate reserve balance of $218,500 at the beginning of the fiscal year 2023 /2 024.

Much like the General Fund reserve, having a healthy reserve in the water enterprise fund is essential. Traditionally, the reserve is used for planned and unexpected water infrastructure repairs. The water system is comprised of 10 large municipal wells, over 46 miles of water line, 3 million gallons of storage, and five large hydropneumatic tanks. An unexpected repair on any of the many water system components could quickly deplete the reserves in the water enterprise fund.

The City Water Department faces the significant challenge of repairing aging infrastructure that often breaks down, leading to water outages. However, constantly responding to such issues leaves little time to focus on preventing future occurrences that would extend the lifespan of the water system. To tackle this problem, city staff has recommended adding a dedicated staff member to the Water Department; this staff member would also be hired to perform the duties of a Cross-Connection Control Specialist. This team member would be responsible for tasks such as valve exercising, valve replacement, and meter replacements.

By focusing on these tasks, the overall health of the water infrastructure would be improved, and the system would run smoother for years to come.

There are several key reasons why operating costs have quickly outpaced the rate increases implemented in the past. Utility rates, unfunded state mandates, and conservation efforts are all significant factors related to rates.

An example of the increased cost can be seen in the rise of the rates the City pays for PG&E service.

Each of the wells depends on electric motors to operate the pumps to extract the water from the ground. In the past, the City has upgraded the pumps and motors to make them as energy efficient as possible, but increased energy costs have offset the decrease in energy usage. Another factor is the increased state and federal regulations for drinking water.

Every year, there are new mandates for increased testing and reporting. The number of compounds tested for and the frequency of tests have continued to increase. Moving forward, the previously stated costs will continue to increase. The State of California is working to establish a Cross Connection Control Policy Handbook (CCCPH), which requires all Public Water Systems to have a Cross-Connection Control Program Coordinator and Certified Cross-Connection Control Specialist. A complete Cross Connection Control Plan must be submitted to the State Water Board for review. This was adopted by the State Water Board at their December 19, 2023, meeting with an effective date of June 31, 2024.

These systems must be in place by July 1, 2025, which is 12 months after the CCCPH was adopted.

The State Water Board highlights "Making Conservation a California Way of Life" through AB1668 and SB606. Both were adopted in 2018, and water use objectives for efficient water use were established for all urban water suppliers. They include indoor residential water use, outdoor residential water use, and commercial, industrial, and institutional irrigation with dedicated meters.

As stated, small rate increases have occurred regularly to keep up with rising costs. These rate increases were generally determined by City staff reviewing revenue vs. expenditures and making an educated approximation about future expenses.

The City of Redding just completed a water rate increase of 12% for meter rates and 18% for commodity charges. This approved rate increase establishes their rate for a (5/8" meter and 21 ccf/month) to be $67.40, while the City of Anderson's rate is currently set at $29.71 (2023 rate) or $31.11 (2024 rate).

Although it is necessary to increase the rates, programs are available to help eligible households offset the increase. Earlier this evening, the Self-Help Home Improvement Project highlighted the low-income home water assistance program (LIHWAP), which aids low-income households in paying their residential water bills.

The City of Anderson strives to maintain our affordable water rates. Our water service remains a tremendous value for our residents. A rate increase is needed to maintain a sustainable water utility for our citizens.

Water Rate Study Update 2023
Draft Tables - December 19, 2023
The main driver of the rate increases is the Water CIP. Here are the updated capital improvement projections:

Previous CIP Updated CIP Difference
Immediate Improvements (FY2024-29) (3) $5,035,000 $2,617,000 $2,418,000 Near-Term lmgrovements (FY2030·39l $4,640,000 $12,640,000 1ss,ooo,0001 Total 15-Year CIP $9,675,000 $15,257,000 ($5,582,000)
The construction of the Anderson Reservoir Project has been moved to the Near-Term Improvements (FY2020-39) at an estimated cost of $8 million. The City anticipates that this project will be grant funded. The planning and design of the Anderson Reservoir Project is included in the Immediate Improvements {FY2024-29) at an estimated cost of $650,000 which will be cash-funded.

Over the five-year rate study period, the water rate increases are proposed to meet the following objectives, in order of importance:

1. Fund operating costs

2. Fund capital costs

3. Revenues cover expenses (Positive net revenues)

4. Meet the fund balance reserve target by 2027 /28
The first rate increase will go into effect on May 1, 2024 with future rate increases effective January 1 of each year beginning in 2025 through 2028. The projections are based on the 2023/24 budget and include the following assumptions:

Revenues
■ The January 1, 2024 adopted rate increase is already accounted for in the 2023/24 budget. ■ Rents, Late Fees, and Other Revenues are increased by 3.0% each year. ■ Ready to Serve & Connection revenues are not projected to increase over the next 5 years. ■ The Interest earnings rate is projected at 1.0% each year. ■ No Water Capital Fees are included in the 2023/24 budget or the 5-year projection. ■ Growth is estimated at 0.5% each year. No major changes in the customer base are expected through 2024/25.
■ Water consumption is based on a 5-year average (2018 through 2022) and is not anticipated to increase over the next 5 years due to conservation.
1 Expenses
■ Salaries & Benefits are increased by 6.0% each year.
■ Utilities are increased by 6.0% each year.
■ All other expenses increased by 3.0% each year.
• Includes one cross connection specialist in 2024/25 and one water operator in 2025/26 at an estimated cost of $146,000/year.
■ The construction of the Anderson Heights Reservoir project has been moved to the Long-Term Improvements estimated at $8 million. This project will likely be grant funded. ■ Total CIP costs (Immediate Improvements FY2024 through 2029) equal $2,617,000 and will be cash funded.

Proposed Revenue Increases:

Here are the proposed revenue increases to fully fund the CIP. For the first increase, the 24% increase does not directly translate into a 24% increase in the actual rates because the City is implementing the first rate increase in May 2024. Additionally, to comply with Prop 218, the cost allocation has been updated based on current costs, customer counts, and water use. The proposed rates are shown on Table 13. Bill impacts are included on Table 14.
