Date: May 17, 2024

SUBJECT
Consider a Resolution approving exception to the California Public Employee's Retirement System (CalPERS) 180-day wait period with regard to hiring of retired annuitant Debby Beckman.

RECOMMENDATION
The City Manager recommends that the City Council:

FISCAL IMPACT
The total salary cost for this position for this fiscal year will not exceed $7,606. For fiscal year 24- 25, the impact would be approximately $36,510. This position is limited to 960 hours per fiscal year.

ITEM 8.3 PAGE 1 5/17/2024
DISCUSSION and BACKGROUND
The Resolution, if approved would allow the hiring of Debby Beckman as a retired annuitant to assist with the Support Services division of the Police Department.

Ms. Beckman has retired from the position of Support/Administration Division Supervisor from the City of Anderson, with a retirement effective date of December 22, 2023. Her anticipated start date with the City of Anderson is May 28, 2024. The general rule is that a CalPERS recipient may not commence employment following their retirement for a period of 180-days. See Gov.

Code Section 7522.56. Following this rule, Ms. Beckman would not be eligible for employment with the City of Anderson until June 20, 2024.

Section 7522.56 does provide an exception to this 180 day rule when certain exceptions are met.

This includes a representation that the employee has not received a retirement related incentive, such as a golden handshake. The exception also requires the City Council to approve a certificate resolution to be provided to CaPERS when the hire occurs prior to the expiration of the 180 days.

If the attached resolution is approved, it will be provided to CaPERS, as required pursuant to Section 7522.56, permitting Ms. Beckman to begin work for the City of Anderson on May 28, 2024.
