I SUBJECT
League of California Cities participation.

I RECOMMENDATION
Staff recommends Council:

1. Discuss and determine the City's interest in continuing to participate in the League of California Cities as a member for 2025.

2. Discuss and determine which City Council Members will be attending the 2024 Annual Conference and Expo.

I FISCAL IMPACT
The fiscal impact will be the annual membership fee of approximately $6,740 and any additional costs of training attended by Staff or City Council members.

I DISCUSSION and BACKGROUND
The League of California Cities (Cal Cities) advocates on the issues that matter most to California's 482 towns and cities. Their advocacy team works with regional field staff and lawmakers to sponsor, draft, and support legislative and regulatory measures that promote local decision-making, and lobby against policy that erodes local control.

Cal Cities also offers year-round education and networking opportunities for new and seasoned city leaders. Comprehensive, specialized programs allow officials to learn about new developments in their field while exchanging ideas on solutions to common challenges. Cal Cities ITEM 8.3 PAGE1 7/16/2024
goal is to provide the information, training, and resources necessary to effectively run a municipality.

The cost of membership for Cal Cities is $6,740 per calendar year and membership fee is based on the population of the city. Being a member allows for reduced registration cost when attending any of the Cal Cities trainings or conferences. Many of their conferences average around $700 for registration as a member and can be up to $1,700 for non-members to attend.

Many of these conferences are multiple days and cover a variety of topics and allow opportunities for networking. The other costs associated with attendance would include travel and lodging expenses which vary based on location. The typical courses throughout the year City Councilmembers and staff attend could be:
o Annual Conference & Expo
o Mayors & Council Members Academy
o Planning Commissioners Academy
o City Leaders Summit
o City Managers Conference
o City Attorneys Conference
This year the Cal Cities Annual Conference and Expo will be in Long Beach October 16th - 18th and features general sessions, workshops, and networking events for hundreds of leaders from all sections of government.

Cross Connection Control Ordinance update to the Anderson Municipal Code.

I RECOMMENDATION

1. Approve an Ordinance (first reading) amending Chapter 13.44 of the Anderson Municipal Code regarding the Customer Responsibilities update and set for adoption (second reading) on August 20, 2024.

2. Direct staff to submit the Cross-connection Control Policy Manual to the State Water Resources Control Board

3. Direct the City Clerk to read the Ordinance by title only. !FISCAL IMPACT
There is no fiscal impact.

I DISCUSSION and BACKGROUND
The State of California has established a Cross Connection Control Policy Handbook (CCCPH), which requires all Public Water Systems to have a Cross-Connection Control Program Coordinator and Certified Cross-Connection Control Specialist. A complete Cross Connection Control Plan must be submitted to the State Water Board for review. This was adopted by the State Water Board at their December 19, 202 3, meeting with an effective ITEM 8.9a PAGE1 7/16/2024
date of June 31, 2024. These systems must be in place by July 1, 2025, which is 12 months after the CCCPH was adopted.

The City has created a Cross Connection Control Policy manual based on the requirements of the Cross-Connection Control Policy Handbook. These requirements can be found in section 3.1.4 Plan for Public Water System Cross-Connection Control subsection (b). A cross-connection is an interconnection between a potable water supply and a non-potable source via any actual or potential connection or structural arrangement between a Public Water System and any source or distribution system containing liquid, gas, or other substances not from an approved water supply.

The purpose of a Cross-Connection Control Policy is to prevent backflow into a Public Water System's distribution system and protect customers from contamination or pollution from on-site hazards. The Policy establishes guidelines for backflow incident responses, incident notifications, hazard assessments, and required record-keeping policies.

Amendment to the Professional Services Agreement with PACE Engineering for Anderson Park Village Engineering Services.

I RECOMMENDATION
The Public Works Director recommends that the City Council:

Consider authorization for the City Manager to execute an amendment to the Professional Service Agreement with PACE Engineering for Anderson Park Village Engineering Services During Construction.

I FISCAL IMPACT
The originally approved contract was not to exceed $215,064 without written approval from the City. Amendment 1 for $30,000 was approved by the City Council on 10/3/23. The Drinking Water State Revolving Fund (DWSRF) loan will reimburse the contract. This amendment is not to exceed $558,636.00 plus 15% contingency without written approval from the City.

ITEM 8.9b PAGE1 07/16/2024
I DISCUSSION and BACKGROUND
Pace Engineering and Sacramento State University approached the City of Anderson regarding partnering with Anderson Park Village Apartments to apply for a grant through the Drinking Water State Revolving Fund. Anderson Park Village is the apartment complex at the southwest quadrant of the Bruce Street/Emily Drive intersection. They are on a private well but want to be on municipal water.

The master meter consolidation project includes improvements to a small community public water system on the Anderson Park Village apartment complex property and improvements to the City's Volante Well. The existing and deteriorating well used by the apartment complex would be abandoned, and the apartment complex would be connected to the City's public water system by installing a + /-SO-foot waterline from the apartment complex to the City's existing water main in Bruce Street.

The Volante Well was constructed in 1974 and needs repairs. Improvements to the Volonte Well include removing the existing fence and all above-ground structures on the well site. The 45- year-old pump will be removed, and the well will be redeveloped. A new +/-300-square foot concrete masonry building and concrete slab will be constructed, a new well pump will be installed, and miscellaneous electrical improvements will be completed. In addition, a new backup emergency generator and perimeter fencing would be installed.

This amendment will focus on supervisory control and data acquisition (SCADA). A recent comprehensive City•wide study evaluated the effectiveness of adding the Volante Well redesign into the City's existing SCADA network. Upon review of the City's SCADA system, the proposed Volonte Well improvements are incompatible with the existing SCADA system. PACE Engineering, and City staff worked with the Department of Funding Authority to include the necessary City-wide SCADA improvements to be include in the proposed Volante Well Project.

This amendment will focus on the final SCADA design that was recently approved by the Department of Funding Authority. This design includes SCADA upgrades City-wide to modernize all well facilities and infrastructure upon completion of the Vo Jonte Well Project.

27.92 Subject: City of Anderson -Anderson Park Village Consolidation Project SWRCB Agreement No. D2102061, Project No. 4510001-002C Final Budget Approval The purpose of this letter is to provide justification for the budget increase request for the City of Anderson's (City's) Anderson Park Village Consolidation Project (Project). The City's current agreement with the SWRCB is in the amount of $1,238,400 as shown in Table 1, so that they can complete construction of the Project.

Table 1
Task Description Current Agreement Proposed Final Budget No. 02102061 Approval
Construction $868,000 $1,877,500
Pre-Purchased Material/Equipment $- $ -
Purchase of Land/Easements $- $ -
Change Order Contingency $86,800 $ 375,500
Force Account $- $ -
Allowances (Soft Costs) $283,600 $987,500
Total: $1,238,400 $3,240,500
The most significant problem that has occurred in the last few years is the Covid-19 pandemic.

The pandemic has drastically increased construction and materials costs primarily due to supply chain issues, staffing shortages, and other related effects of the pandemic. The original cost estimate for the Project was completed in January 2020. While the 2020 cost estimate included a 3% per year inflation adder, this was only projected to year 2021. The 3% inflation factor that had been historically used in the construction industry has been exceeded (closer to 7% in 2022}, particularly in the last two years, mostly due to cost increases as a direct result of the pandemic.

In November 2021, the construction costs were updated by the Engineering News Record Construction Cost Index (ENR CCI); however, at that time, the true impacts to construction costs as a result of the pandemic had not been felt. The November 2021 cost estimate included construction costs for construction in 2022 to be $868,000. The City received the SWRCB funding agreement in March 2023. Bid opening for the Project was January 18, 2024, and the low bid construction cost was $1,877,500. In the November 2021 cost estimate, it was also 5155 VENTURE PARKWAY • REDDING, CA 96002 • (530) 244-0202 State Water Resources Control Board

Exhibit A

27.92 noted that the soft costs were originally developed anticipating construction in 2021 and would need to be updated to 2022 costs if construction was going to occur in 2022. It was decided to wait until closer to starting construction and update the soft costs during the final budget approval process.

While post-pandemic supply chain disruptions have largely stabilized, we continue to encounter prolonged lead times for several project components, including control panels and generators.

As such, the City extended construction contract times for the Project, which requires PACE Engineering, Inc. (PACE) to increase our Construction Management and Administration budget to account for the additional status reports, reimbursement requests, prevailing wage monitoring, and other miscellaneous construction administration tasks that will need to be conducted for longer than originally anticipated. To help offset this, the City has indicated they plan to complete some of the administration for the Project and are requesting their effort be eligible for reimbursement as well.

Final design costs also increased from the November 2021 budget as summarized below.

Completed in February 2020, the 90% Drawings and Specifications were designed around the 2016 California Building Codes. Due to the delays in receiving Project funding, the Project had to be redesigned to meet the 2022 California Building Code requirements. This included moving the disinfection equipment into a separate room within the well building, which required the size of the well building to increase by approximately 25 square feet. Not only was additional design required to engineer the electrical, mechanical, and structural components of the second room, the site grading had to be reworked to account for the increased building footprint.

The original 90% Contract Documents were also completed in February 2020 and utilized the 2013 EJCDC Construction Documents and 2018 Standard Specifications also known as the "Greenbook." The City of Anderson has adopted the City of Redding Construction Standards with a few exceptions. On May 12, 2023, the City of Redding updated their standards to utilize the 2021 Greenbook. As such, PACE had to update all of the Contract Documents to reflect the 2021 Green book and 2018 EJCDC Construction Documents.

Furthermore, while finalizing the design of the supervisory control and data acquisition (SCADA) improvements to the Volante Well, which was already included in the original Project scope, it was discovered that the City's existing SCADA system is outdated and no longer serviceable. Due to an outdated system, any improvements made to the Volante Well will not be compatible with the City's existing SCADA system. To make matters worse, in the event that the existing SCADA system goes down, the City will not be able to operate key components of their water system. If the City cannot operate their water system via SCADA, it jeopardizes their ability to provide potable water and protect the health and safety of their customers. The importance of including the SCADA improvements in the current Project scope of work is further outlined in the technical memorandum that was submitted to SWRCB on December 22, 2023. As such, the City requests these SCADA improvements be incorporated into the Project scope as part of the final budget approval process.

AGENDA ITEM
~uly 16, 2024, City Council Meetin~
d for Submittal By:

To:

Through:

Honorable Mayor and Members of the Anderson City Council Joey Forseth-Deshais, City Manager
From: Adam Whelen, Public Works Director
Date: July 16, 2024
!SUBJECT
Agreement with Anderson Park Village for Consolidation and Water Service Agreement.

I RECOMMENDATION
The Public Works Director recommends that the City Council:

Consider authorization for the City Manager to execute an Agreement with Anderson Park Village Apartments for Master Meter Consolidation and Water Service Agreement.

I FISCAL IMPACT
The Drinking Water State Revolving Fund (DWSRF) loan will reimburse all costs related to this Master Meter Consolidation. There will be a fiscal increase to the Water Fund for the impact fee and monthly water consumption for the Apartment Complex.

I DISCUSSION and BACKGROUND
PACE Engineering and Sacramento State University approached the City of Anderson regarding partnering with Anderson Park Village Apartments to apply for a grant through the Drinking Water State Revolving Fund. Anderson Park Village is the apartment complex at the southwest ITEM 8.9c PAGE1 07/16/2024
quadrant of the Bruce Street/Emily Drive intersection. They are on a private well but want to be on municipal water.

The master meter consolidation project includes improvements to a small community public water system on the Anderson Park Village apartment complex property and improvements to the City's Volonte Well. The existing and deteriorating well used by the apartment complex would be abandoned, and the apartment complex would be connected to the City's public water system by installing a +/-SO-foot waterline from the apartment complex to the City's existing water main in Bruce Street.

The Volonte Well was constructed in 1974 and needs repairs. Improvements to the Volante Well include removing the existing fence and all above-ground structures on the well site.

The City received a signed Final Budget Amendment on June 27, 2024. The City is required to create an agreement with Anderson Park Village Apartments per DWSRF Policy Appendix A This agreement must cover the following: The consolidating water system(s) must enter into a consolidation and water service agreement(s) with the restructured water system that identifies:
(i) the terms of service; (ii) infrastructure ownership; (iii) operation and maintenance; (iv) transfer of facilities; (v) inactivation of the consolidating water system; (vi) intent to surrender its domestic water supply agreement; and (vii) other terms as negotiated between the entities.
