Consider approving Notice of Withdrawal from the Shasta County Waste Management Agency
I RECOMMENDATION
The City Attorney recommends that the City Council:
1. Receive a Staff Report
2. Approve Notice to Withdraw from the Shasta County Waste Management Agency
I FISCAL IMPACT
There is no fiscal impact for this item.
I DISCUSSION and BACKGROUND
In February of 2000, Shasta County, the City of Shasta Lake, and the City of Anderson entered into a Joint Powers Agreement creating the Shasta County Waste Management Agency. The purpose of the JPA was to form a regional agency to combine disposal and diversion quantities to achieve compliance with the California Integrated Waste Management Act of 1989, to assign ITEM 6.3 PAGE1 8/20/2024
responsibilities assessed pursuant to that Act, to allow for the efficient diversion programs on a region-wide basis, and to develop and maintain a regional Integrated Waste Management Plan.
Per the Agreement, Shasta County was to be responsible for the general administrative services for the JPA, the Shasta County Public Works Director was to control any property of the JPA, and the Shasta County Auditors office was to have custody of all funds. In effect, the overall operation of the JPA was to be handled by the County.
After a few years, the JPA became inactive. There were no annual meetings and essentially no communication between the agencies regarding the JPA. In early 2024, when City staff began negotiations with Waste Management for a contract renewal, the JPA came to the attention of current City staff for the first time. Upon further investigation, it did not appear that any of the members agencies were doing what they were required to do, including the County.
Because of the lack of activity with the JPA, and the additional reporting requirements under SB 1383 that have arisen in the last few years, the City of Anderson staff believe it is in the best interest of the City to withdraw from the JPA. The tasks handled by the JPA would be assigned to a third-party consultant that would be compensated through the agreement with Waste Management. This would ensure that the City is compliant with its reporting requirements.
Pursuant to Section 25 of the Agreement, a member agency must provide 180-days notice of withdrawal from the Agency. If this Notice of Withdrawal is approved, the City of Anderson would formally exit the JPA in February of 2025. That will provide the City with sufficient time to have the alternative system of reporting and compliance in effect.

AGENDA ITEM
August 20, 2024 City Council Meeting

From:
Honorable Mayor and Members of the Anderson City Council Joey Forseth- Deshais, City Manager
Date: August 20, 2024
!SUBJECT
Letter of opposition towards Assembly Bill 1886 (Alvarez)
I RECOMMENDATION
Staff recommends the City Council send the letter of opposition towards AB 1886 (Alvarez) that subjects cities to builder's remedy projects.
\FISCAL IMPACT
This action has no fiscal impact.
I DISCUSSION and BACKGROUND
AB 1886 (Alvarez) subjects cities to builder's remedy projects unless the California Department of Housing and Community Development or a court determines that the local agency's housing element substantially complies with the law. The builder's remedy allows a developer to construct a project that is inconsistent with both the city's general plan and zoning standards, except for sites that are identified for very low-, low-, or moderateincome housing. This eliminates local government's ability to "self-certify" their housing element. Also, encouraging builder's remedy projects is counterproductive and could result in homes being built on sites never considered for residential uses.

RE: AB 1886 (Alvarez) Housing Element Law: Substantial Compliance Notice of Opposition Dear Senator Dahle,
The City of Anderson must oppose measure AB 1886 (Alvarez), because it turns its back to a fundamental provision of housing element law: A city may disagree with HCD; explain why its housing element is in substantial compliance with the law; and then adopt that housing element which is thereafter considered "in substantial compliance with housing element law."
For decades, cities have worked with HCD to draft housing plans that accommodate their fair share of housing at all income levels. These extensive and complex plans can take years to develop, include public involvement and engagement, and environmental review. Cities go to great lengths to ensure that their housing element substantially complies with the law, even if HCD disagrees. Current law acknowledges this fact by allowing cities to "self-certify" their housing element or take the issue to court and have a judge make the final determination of substantial compliance.
AB 1886 encourages "builder's remedy" projects by eliminating self-certification for the purpose of what it means to have a housing element "in substantial compliance with the law." The "builder's remedy" allows a developer to choose any site other than a site that is identified for very low-, low-, or moderate-income housing, and construct a project that is inconsistent with both the city's general plan and zoning. AB 1886 facilitates such projects for those cities that have a good faith disagreement based on substantial evidence.
The City of Anderson believes that AB 1886 is counterproductive. What is really needed is for HCD to partner with cities to provide meaningful direction that helps them finalize their housing elements and put those plans to work so that much needed housing construction City Manager's Office

!SUBJECT
Memorandum of Understanding: Anderson Police Department participation in the Shasta Interagency Narcotics Task Force.
I RECOMMENDATION
The City Manager recommends the City Council:
Approve the Memorandum of Understanding for Anderson Police Department participation in the Shasta lnteragency Narcotics Task Force (SINTF).
IFISCAL IMPACT
The employee selected to participate in SINTF would be eligible for Investigator Pay, which equates to a five (5) percent increase in the employee's base pay.
I DISCUSSION and BACKGROUND
Historically, the Anderson Police Department (APD) has consistently participated in the Shasta lnteragency Narcotics Task Force (SINTF). In June 2023, the now former APD Police Chief decided to discontinue APD participation. The employee formerly assigned to SINTF returned to the department to work as a detective, focusing on narcotics related crime within the city limits of Anderson. Upon analyzing the practicality of the job duties along ITEM 6.9 PAGE1 8/20/2024
with the availability of resources necessary to carry out the duties of the position, it was determined that the effectiveness of the position was not sustainable. The detective could not dedicate the time nor cultivate additional resources necessary to be successful in combating narcotics activity in the city.
As a result of the ineffectiveness of carrying out the core function of the position ( narcotics enforcement), the current APO Police Chief re-evaluated the feasibility of participating in SINTF once again. The Police Chief met with the SINTF Task Force Advisory Council and received overwhelming support to participate.
SINTF has resources available to dedicate to the city whenever a commercial narcotics case arises. The APO employee assigned to SINTF will be a valuable resource to APD patrol and can dedicate the time, resources, and expertise to thwart the sales of narcotics and dedicate the time necessary to handle complicated and extensive criminal investigations. With APO's participation in SINTF, the city will have the necessary resources at its disposal through SINTF.

Consider Zone Amendment (ZA) 24-03, amending Section 17.67.050, "COMMERCIAL MARIJUANA OPERATION AS A COMMERCIAL USE" of Chapter 17.67 "MARIJUANA ACTIVITIES" of Title 17 "ZONING" of the City of Anderson Municipal Code.
I RECOMMENDATION
1. Review the staff report and environmental determination.
2. Open the public hearing and consider public testimony.
3. After closing the public hearing, consider introduction of Ordinance No. _ amending 17.6 7.050 of the Anderson Municipal Code regulating retail delivery of medical marijuana within all zones in the city, and set for second reading on September 3, 2024
4. Direct the City Clerk to read by title only.
I PROJECT DESCRIPTION
In order to protect the public health, safety, and welfare, the Planning Commission will review and make a recommendation to the City Council to amend Anderson Municipal Code Section 17.67.050 to regulate cannabis dispensaries, cultivation facilities, commercial cannabis activities, and cannabis deliveries.
ITEM 7.0 8/20/2024
I ENVIRONMENTAL DETERMINATION
The City Council hereby finds that the action to adopt this Ordinance to amend Section
17.67.050 of the Anderson Municipal Code in its entirety is exempt from the provisions of the California Environmental Quality Act (Public Resources Code Section 21000, et seq.) (CEQA) because the City Council hereby finds that it can be seen with certainty that there is no possibility the adoption and implementation of this Ordinance may have a significant effect on the environment, and the Ordinance is exempt from CEQA pursuant to CEQA Guidelines Sections 15061(b)(1), 15061(b)(2), and 15061(b)(3).
I BACKGROUND
Ordinance No. 825 an update to Chapter 17.67 - Marijuana Activities was adopted by Anderson City Council on August 20, 2019 in response to Assembly Bills 243 and 266 and Senate Bill 643 (collectively, the Medical Marijuana Regulation and Safety Act or "MMRSA").
This legislation preserved local control over marijuana facilities and land uses, including the authority to completely prohibit marijuana dispensaries, cultivation and deliveries.
Currently, Chapter 17.67.050 prohibits commercial marijuana use in all zone districts.
In 2022, the Legislature passed and Gov. Gavin Newsom signed into law SB 1186 (Wiener), the Medicinal Cannabis Patients' Right of Access Act (Act). Beginning Jan. 1, 2024, the Act bars a city from adopting or enforcing any regulation that directly or indirectly prohibits retail delivery of medicinal cannabis to patients or caregivers in the city.
Under the Act, a city cannot adopt or enforce regulations that prohibit the "retail sale by delivery" of medicinal cannabis. This includes any regulation that has the effect of prohibiting patients within the city or their caregivers from purchasing, by delivery, sufficient medicinal cannabis to meet their demands in a timely and readily accessible manner. Examples of prohibited regulations which may have this effect include those that:
1. Limit the number of businesses authorized to deliver medicinal cannabis in the city.
2. Limit the operating hours of medicinal cannabis businesses.
3. Limit the number or frequency of medicinal cannabis sales by delivery.
4. Limit the types or quantities of medicinal cannabis.
5. Require the establishment of physical premises within the city.
The Act does not prevent a city from adopting or enforcing reasonable regulations on retail delivery of medicinal cannabis related to:
1. Zoning requirements.
2. Security or public health and safety requirements.
3. Licensing requirements.
ITEM 7.0 8/20/2024
4. Imposing or collecting applicable state or local taxes on retail sales of medicinal cannabis occurring within the city.
5. Regulations consistent with requirements or restrictions imposed on cannabis businesses by state law or regulations issued by the California Department of Cannabis Control (DCC).
On June 4, 2024 a joint Planning Commission and City Council workshop was held to review SB 1186 and to receive Council's direction regarding possible amendments to Anderson Municipal Code Chapter 17.67 - Marijuana Activities. Based on the parameters established by SB 1186 and consistent with direction provided by both the Planning Commission and City Council, the Anderson Municipal Code is proposed to amended as follows:
"17.67.050- Commercial marijuana operation as a prohibited use.
A. A commercial marijuana operation is a prohibited use in all zone districts in the city.
8. As an exception to subsection A and above, and as required by the Medicinal Cannabis Patients' Right of Access Act (Business and Professions Code Sections 26321, et seq.) a person may deliver or transport medicinal cannabis to a medicinal cannabis patient, subject to the following requirements:
1. Deliveries of medicinal cannabis to a medicinal cannabis patient must be made to fixed addresses and may not occur at locations such as schools, day care centers, youth centers, public parks, houses of worship, open spaces, public buildings, and establishments serving food or beverages.
2. A retailer with a physical address outside of the city that wishes to deliver medicinal cannabis or medicinal cannabis products to a patient or customer within city limits is required to obtain a City business license prior to commencing any delivery service within city limits.
3. All medicinal cannabis or medicinal cannabis products must be securely packaged and labeled according to State regulations, ensuring that they are not accessible to minors during transit.
4. Delivery vehicles must adhere to safety and security standards, which include GPS tracking, alarms, and secure storage.
5. The delivery of cannabis accessories, branded merchandise of the licensee, or promotional materials is prohibited, except for any equipment, products or materials necessary to enable a qualified patient to ingest, inhale, or otherwise introduce cannabis or cannabis products into the human body."
This proposed amendment continues to prohibit a commercial marijuana business to operate within the city limits. Under AB 1186, this continued exclusion does not have the effect of prohibiting medical marijuana patients from access through retail delivery of ITEM 7.0 8/20/2024
medical marijuana, because numerous commercial marijuana businesses in Redding deliver to patients in Anderson. Other jurisdictions like San Marcos and Brentwood have interpreted the new law in a similar manner.
On July 22, 2024, the proposed ordinance was considered by the Planning Commission during a public hearing. The Planning Commission approved recommending the proposed ordinance to the City Council in a 5-0 vote.
I PUBLIC NOTICE
A 10-day public hearing notice of the subject project was published in the Record-Searchlight and in accordance with notice requirements provided in AMC Section 17.54.040 - Zoning Amendments. The Planning Department received no public comments on the project at the time of this report.

Re: Letter of Support
To Whom It May Concern,
On behalf of the City of Anderson, we are pleased to offer this letter of support for the Sunrise Cottages affordable senior housing development proposed at the southwest corner of North Street and Stingy Lane in our beautiful City. In recent years, our community and the surrounding region have been impacted by devastating wildfires. In response to these disasters, we are pleased to be able to support a housing project that will utilize Community Development Block Grant Disaster Recovery (CD BG-DR) funding allocated specifically to assist our community to rebuild and recover.
The Sunrise Cottages development will add 44 energy efficient and low-cost housing units for senior households ages 62 and over with income of 30 and 50 percent of the Area Median Income, or below. 11 units will be set aside for seniors who are homeless or at risk of homelessness. Tenants will have access to various community amenities including central laundry, a recreation area, EV charging stalls, and on-site management by Rural Communities Housing Development Corporation (RCH).
Additional amenities targeted towards seniors include pullcords, handrails, a resident services coordinator and supportive services provided by Faith works Community Coalition.
Our community is unique in that it has a higher average population of elderly residents compared to other impacted and distressed areas. This presents special challenges as our senior residents are particularly vulnerable and disproportionately affected in the face of disaster. We believe this housing will provide excellent quality senior affordable housing, improving the lives of our seniors, the neighborhood, and our city.

Stan Neutze

Re: Notification of Funding Application for the Department of Housing and Community Development's Community Development Block Grant-Disaster Recovery Multifamily Housing Program for the Sunrise Cottages Development
Dear Mr. Forseth-Deshais,
Rural Communities Housing Development Corporation (RCHDC) is an affordable housing developer based in Ukiah and serving the northernmost rural counties of California. Our mission is to provide decent and affordable housing to low- and moderate-income people. We have been successful in carrying out our mission for almost 50 years through the development and management of nearly 1500 multi-family units and over 400 owner-built homes.
We are pleased to notify you, pursuant to Health and Safety Code §50675.7(e), that RCHDC is the Sponsor of an application for loan funds from the Community Development Block Grant-Disaster Recovery Multifamily Housing Program administered by the State Department of Housing and Community Development. RCHDC will use these funds to develop Sunrise Cottages, an affordable housing development located on the corner of North St and Stingy Ln, Anderson, CA 96007. As such, we are required to notify the local legislative body of our loan application prior to application submission. Please accept this letter as notification of our application for funding to the Department of Housing and Community Development for the Multifamily Housing Program.
Furthermore, we are seeking support for the proposed project by way of a support letter or resolution. Thank you in advance for taking this request to the legislative body, the City Council, in time to submit a signed letter with our application by the September 6, 2024 due date.

Authorization to award the Cobblestone Sewer Replacement Project
I RECOMMENDATION
The Public Works Director recommends that the City Council:
1. Award the contract for the Cobblestone Sewer Replacement Project to Sunrise Excavating Inc. from Redding, CA, in the amount of Seventy-Seven Thousand Dollars ($77,000.00);
2. Authorize the City Manager to execute the contract upon receipt of required insurance certificates and payment and performance bonds; and
3. Authorize the City Manager to approve additional project change orders not to exceed 15% of the contract bid amount.
IFISCAL IMPACT
The Wastewater Enterprise Fund will fund the project. The lowest responsible bid of $77,000.00 is less than the engineer's estimate of $143,000.
ITEM 8.9a PAGE1 08/20/2024
I DISCUSSION and BACKGROUND
The City has an ongoing sewer line maintenance program to maintain the integrity of the wastewater collection system and to prevent costly catastrophic failures resulting in sanitary discharges. The Cobblestone Sewer Replacement project consists of removing and replacing approximately 110 LF of 6-inch TRUSS pipe with 6" ASTM D3034 SDR 26PVC pipe in the same location, rehabilitating manhole D411M, reconnecting three sewer laterals, and completing surface restoration.
This project will help reduce Infiltration and Inflow (1&1) into the sewer system. The 2010 Cobblestone Loop Replacement Project corrected areas where pipe sags, disconnected laterals, and offset joints had occurred. This project will address the same issues on Limestone Court and the area surrounding manhole D411.
Three bids were received by the due date, with Sunrise Excavating, Inc. from Redding being the lowest responsible bidder.

McMurry Drive Rehabilitation Project
jRECOMMENDATION
The Public Works Director recommends that the City Council:
1. Adopt a resolution finding the McMurry Drive Rehabilitation Project Categorically Exempt in accordance with Section 15301, Class 1(c) of the California Environmental Quality Act (CEQA);
2. Approve the Plans, Specifications, Estimates and Contract Documents for the McMurry Drive Rehabilitation Project and instruct the Public Works Director to advertise for bid.
I FISCAL IMPACT
The Engineers Estimate is $1,000,000 and will be funded from the Regional Surface Transportation Program, S81 Gas Tax, and Local Transportation Funds.
ITEM 8.9b PAGE1 8/20/2024
I DISCUSSION and BACKGROUND
Historically McMurry Drive has been a two-lane road but is classified as a minor arterial connecting Balls Ferry Road to North Street. With the construction of Interstate 5, McMurry Drive became the arterial between the Northbound Interstate 5 off-ramp and Northbound Interstate 5 on-ramp. As additional developments occurred, frontage improvements were made to construct curb, gutter, and sidewalk. As these developments were completed, the road was widened to match the 84' Right of Way. However, as this was done, the layout of travel lanes did not change, except for the Southerly section below Ganyon Drive to Balls Ferry Road. When Rite Aid was developed on the Northerly section, a second lane was added from their parcel limit to North Street. The layout and capacity of the road didn't change again until Quick Quack was developed in 2022.
On July 5, 2022, a reimbursement agreement with Quick Quack was approved to design, construct, and install off•site improvements to provide continuity for McMurry Drive. This extended the arterial design that Rite Aid had started back in 2006. This design established two 12' travel lanes and a 4' bike lane consistent with the City of Anderson Construction Standards 112.70 and the General Plan Circulation Element.
At the June 4, 2024, City Council meeting, the task order for GHD's proposal to create a 100% PSE package for the rehabilitation of McMurry Drive was approved. This design creates a well-defined roadway with two travel lanes and a 4' bike lane for Northbound and Southbound directions. The exception to this design is for three parcels created by Parcel Map 22-02. To complete the gap between Anderson Walk-In Clinic and Round Table Pizza, the developer was conditioned to construct complete frontage improvements, including curb, gutter, sidewalk, and paving. This area will be designed and designated to be constructed privately. This design will be provided to the developer to aid in their construction efforts. Completing this during the overall design process ensures continuity throughout the project.
Staff is looking to start this project in the Fall of 2024 and would like to advertise the project on August 21, 2024 to complete this project before Winter of 2024. This project was previously identified in the SRTA 2022 Regional Transportation Plan as a capacity increase project.
