DISCUSSION and BACKGROUND
The City of Anderson has recently had some significant projects: emergency and non- emergency, that have cost the city $2.76 million in the last 12 months. We are currently waiting for two reimbursements totaling over $1.46 million. One is through FEMA, the other is through the California State Water Board. Further details are below:
ITEM 8.5 PAGE 1 10/24/2025
Project 1 - Anderson Park Village - Master Meter Consolidation This project is funded by DWSRF, which reimburses the City after the City has paid the contractor, see section B.6.4. above. We typically bill quarterly to DFA (Division of Financial Assistance). The quarter we are dealing with was a heavy construction quarter, which has the city expenditures at $921,000.00 for a 3-month period.
Project 2 - Bruce Well - Emergency Work
This project is due to issues that were identified in Project 1 above; the existing Volonte well was intended to be rehabilitated. During the initial camera inspection of the well, it was discovered that the well was no longer viable and needed to be redrilled. DFA would not approve this work under Project 1, and it was funded as an emergency project by the Anderson City Council. This project is budgeted for $1.5 million, of which $825,000 was expended in 6 months. This was deemed an emergency because the Southern Pressure zone (1/3 of the City of Anderson) was left with only one water well that could not meet the peak demand or fire flow requirements for the geographical area. The city intends to continually ask the DFA for a funding extension to Project 1 to include these costs as a reimbursement.
B.6 REIMBURSEMENT PROCEDURE.
Except as may be otherwise provided in this Agreement, reimbursements will be made as follows:
1. Upon execution and delivery of this Agreement by both parties, the Recipient may request immediate reimbursement of any eligible incurred planning and design allowance costs through submission to the State Water Board of the Reimbursement Request Form 260 and Form 261, or any amendment thereto, duly completed and executed.
2. The Recipient must submit a Reimbursement Request for costs incurred prior to the date this Agreement is executed by the State Water Board no later than ninety (90) days after this Agreement is executed by the State Water Board. Late Reimbursement Requests may not be honored.
3. Additional Project Funds will be promptly disbursed to the Recipient upon receipt of Reimbursement Request Form 260 and Form 261, or any amendment thereto, duly completed and executed by the Recipient for incurred costs consistent with this Agreement, along with receipt of progress reports due under this Agreement.
The Recipient must not request reimbursement for any Project Cost until such cost has been incurred and is currently due and payable by the Recipient, although the actual payment of such cost by the Recipient is not required as a condition of Reimbursement Request. Supporting documentation (e.g., receipts) must be submitted with each Reimbursement Request. The amount requested for Recipient's administration costs must include a calculation formula (i.e., hours or days worked times the hourly or daily rate= total amount claimed). Reimbursement of Project Funds will be made only after receipt of a complete, adequately supported, properly documented, and accurately addressed Reimbursement Request. Upon request by the Division, supporting documents for professional and administrative services must include the employees' names, classifications, labor rates, hours worked, and descriptions of the tasks performed.
Reimbursement Requests submitted without supporting documents may be wholly or partially withheld at the discretion of the Division.
5. The Recipient must spend Project Funds within 30 days of receipt. If the Recipient earns interest earned on Project Funds, it must report that interest immediately to the State Water Board. The State Water Board may deduct earned interest from future reimbursements.
6. The Recipient must not request a reimbursement unless that Project Cost is allowable, reasonable, and allocable.
ITEM 8.5 PAGE 2 10/24/2025
7. Notwithstanding any other provision of this Agreement, no reimbursement shall be required at any time or in any manner which is in violation of or in conflict with federal or state laws, policies, or regulations.
Additionally, this April the city finally received permitting from regulatory agencies to fix and bolster the Anderson River Park Trail that had been damaged by the 2017 flooding of the Sacramento River. This being due to a natural disaster, the cost recovery of this project is through FEMA. The total project cost was $672,144, where $585,000 has been awaiting reimbursement through FEMA since May 2025. Due to the government shutdown, we fear that this could delay payment even longer.
One other project that the city completed last fiscal year, that is not reimbursable, but was needed, was the rehabilitation of McMurray Drive. The project created a well-defined roadway with two travel lanes and a 4' bike lane for Northbound and Southbound directions. The project included excavation, aggregate base, hot mix asphalt paving, cold planing, signing, and pavement delineation. Prior to this rehab project, the lanes were undefined, the asphalt was breaking up, and there were no curbs/gutters along much of the street. The total cost of this project was $930,545.
Section 6 of Article XVI of the California Constitution provides in part that "the treasurer of any city, county, or city and county shall have power and the duty to make such temporary transfers from the funds in custody as may be necessary to provide funds for meeting the obligations incurred for maintenance purposes by city, county, city and county, district, or other political subdivision whose funds are in custody and are paid out solely through the treasurer's office." Such a transfer is to be made "only upon resolution adopted by the governing body of the city, county, or city and county directing the treasurer of such city, county or city and county to make such temporary transfer." The City is requesting a temporary transfer of its property tax revenue from Shasta County in order to meet ongoing operational needs of the City. The temporary amount sought is $1,500,000.00, which will be formalized through the attached agreement. If approved, the matter would be placed on the November 6, 2025 Shasta County Board of Supervisors agenda for consideration and approval. If the resolution passes, the temporary transfer will be issued within an approximate week. After that, the amount would be deducted from the property tax funds issued to the City in January 2026.
In January 2026, the City will receive its first apportionment of Property Taxes for 25/26 in the estimated amount of $3.7 million. We are looking to take advantage of the Dry Period Funding option from Shasta County for a temporary transfer of funds against our upcoming property tax revenues in which the county is the custodial collector of with an interest rate equal to the rate the Treasury Pool had earned in the most recent prior quarter, plus ten (10) basis points or 0.10 percent from the date of transfer until the entire transfer and applicable interest is repaid. We estimate this to be roughly 4.51% ITEM 8.5 PAGE 3 10/24/2025

BACKGROUND AND PURPOSE
Section 6 of Article XVI of the California Constitution provides in part that "the treasurer of any city, county, or city and county shall have power and the duty to make such temporary transfers from the funds in custody as may be necessary to provide funds for meeting the obligations incurred for maintenance purposes by city, county, city and county, district, or other political subdivision whose funds are in custody and are paid out solely through the treasurer's office." Such a transfer is to be made "only upon resolution adopted by the governing body of the city, county, or city and county directing the treasurer of such city, county or city and county to make such temporary transfer." Government Code section 23010 contains comparable provisions with respect to certain enumerated special districts, Education Code Section 42620 contains comparable provisions with specific reference to school districts and to the county school service fund, and Education Code Section 85220 contains comparable provisions with respect to community college districts.
The purpose of this guidance is to establish a procedure whereby the County Auditor-Controller and the County Treasurer-Tax Collector can processrequests for temporary transfers of funds to Districts within the County of Shasta upon a resolution by the Board of Supervisors with respect to each individual request.

2 The amount of such transfer has been certified by the County Treasurer-Tax Coledor to be available.
The interest on any transfer will acorue and be payable by the District at a rate equal to the rate the Treasury Pool had eared in the most recent prior quarter plus ten (10) basis points or 0.10 percent from the date of transfer until the entire transfer and applicable interest is repaid, or such other interest rate as may be lawíully established by the Board of Supervisors.
The temporary transfer of funds to a District shall not exceed 85% of the anticipated revenues accruing to such District.
The temporary transfer of funds shall not be made prior to the first day of the fiscal year nor after the last Monday in April of the current fiscal year.
Funds may be transferred by the Treasurer-Tax Collector to the District requesting such temporary transfer in the amounts requested by the District and certified by the District to be necessary to provide funds for meeting the obligations incurred for maintenance purposes by the District, to the extent such amount does not exceed the maximum amount allowed by law, and provided the Treasurer-Tax Collector determines that funds in his or her custody are available for such transfers.
7. Funds transferred to the credit of a school district, community college district, or the County school service fund shall be retransferred by the County Auditor- Controller and by the County Treasurer-Tax Collector to the fund from which they were taken from the first moneys accruing to the school district, community college district, or the County school service fund and before any other obligation of the requesting agency is paid from the money accruing.
8. Funds transferred to a special district, other political subdivision, or entity shall be replaced from the revenues accruing to such special district, other political subdivision, or entity before any other obligation of the requesting agency is met from such revenue.
9. Repayment of any transfer, including interest, shall be the first payment made from the property taxes and principal apportionment accruing to the District before any other obligation of the District is met from such revenue. To effect repayment, an immediate transfer from said revenues shall be made by the Auditor-Controller to the County of Shasta Investment Pool's fund. In addition, the County reserves the right to seek repayment of any transfer from any moneys accruing to the District.
10. The District shall enter into a Temporary Transfer Agreement consistent with the terms of the resolution, and which Temporary Transfer Agreement may be signed on behalf of the County by the Treasurer-Tax Collector.

Districts must include an Interim cash flow worksheet that supports the maintenance expenses and anticipated revenues for the relevant period.
Additional evidence supporting the need for cash to pay current maintenance expenses may be requested.
2. The County Auditor-Controller shall determine the amount which is 85% of the amount of money which will accrue to a school district, community college district or the County school service fund during the fiscal year, or the amount of the anticipated revenues accruing to a special district, other political subdivision, or entity and 85% of such amount, as applicable; and the resultant amount which is transferable as of a specified date to the requesting agency within the constitutional or statutory provisions cited in this Guidance. The Auditor-Controller shall set forth these amounts in a certificate placed on or attached to the request and transmit the request and his certificate to the County Treasurer-Tax Collector. The amount of temporary transfer of funds would be 85% of the amount of money accruing to the District or the amount necessary to provide sufficient funds for meeting the obligations incurred for maintenance purposes of the district, whichever is less.
