I SUBJECT
Adoption of an Ordinance Amending Chapters 5.48, 6.24, 6.28, 9.38, and 9.57 of the ~nderson Municipal Code to increase specific fee~ or penalties.

I RECOMMENDATION
Staff recommends that the City Council:

1. Receive a staff report;

2. Receive public comments;

3. Introduce an Ordinance (First Reading) amending Chapters 5.48, 6.24, 6.28,

9.38 and 9.57 of the Anderson Municipal Code to increase fees or penalties in certain sections, and set for adoption on September 1, 2026 (Second Reading).

4. Waive full reading and direct the City Clerk to read the ordinance by title only.

I FISCAL IMPACT
There will be an unknown increase fiscally based on these increases. !DISCUSSION and BACKGROUND
At the April 7, 2026 City Council regular meeting, the City Council approved a resolution updating fees to ensure the city is able to recover the cost of providing services. That approval followed a fee study from Revenue & Cost Specialists, LLC which evaluated the full ITEM 8.2 PAGE1 8/18/2026
32 cost of providing services, identify cost recovery levels, and recommend updated fees consistent with California law and the "costs reasonably borne" standard.

In connection with that fee update, city staff also reviewed the Anderson Municipal Code to determine if there were changes or updates to the fees or penalties in the code that were necessary. That originally resulted in an ordinance in April of this year removing many fees from the code so that they could be shifted to the Master Fee Schedule.

Staff also located numerous fees or penalties that could be increased to ensure that the city is capturing the cost of service. Those proposed increases are in front of the City Council tonight, and include fees for coin-operated devices, animal regulation fees, penalties for littering in the park, and penalties for certain tobacco use violations.

I SUBJECT
Adoption of an Ordinance Amending Chapter 2.48 of the City of Anderson Municipal Code to Update the Process for Commissioner Nominations

I RECOMMENDATION
Staff recommends that the City Council:

1. Receive a staff report;

2. Receive public comments;

3. Introduce an Ordinance (First Reading) amending Chapter 2.48 of the Anderson Municipal Code to update the process for Planning Commissioner Nominations, and set for adoption on September 1, 2026 (Second Reading).

4. Waive full reading and direct the City Clerk to read the ordinance by title only. j FISCAL IMPACT
There will no fiscal impact.

I DISCUSSION and BACKGROUND
Chapter 2.48 of the Anderson Municipal Code governs the City of Anderson Planning Commission, including process for appointment and functions of commissioners. Overall.

This Chapter establishes that the City of Anderson Planning Commission has five commissioners that provide recommendations to the city council regarding land use matters. Each commissioner is nominated by a Councilmember and appointed by a• ITEM 8.3 PAGE1 8/18/2026
39 majority of the City Council to fulfill a term concurrent with the respective nominating City Councilmember.

Under the current code, there is a lengthy and cumbersome process for the appointment whereby the City Clerk schedules interviews for prospective commissioners during agendized meetings for the entire council. The appointing councilmember then has 30 days, or longer if requested, to nominate their commissioner. This results in a process that takes many months to complete, leaving a vacancy on the Planning Commission.

This amendment seeks to update the process to a more streamlined version whereby the nominating councilmember reviews applications, and can meet with the applicants as desired, then makes their nomination, followed by approval or denial by the majority of the City Council. During the meeting for the appointment, all City Councilmembers will have the ability to interview the nominee.

The amendment also clarifies that commissioners must be residents, property owners or business owners within the city. It further clarifies that commissioners cannot be an officer or employee of the city.

!SUBJECT
HOME Program Income Application - Owner-Occupied Rehabilitation Program and Long-Term Monitoring.

I RECOMMENDATION
The Finance Director recommends that the City Council:

1. Receive a staff report;

2. Receive public comment;

3. Adopt a resolution authorizing the submittal of an application to the California Department of Housing and Community Development ("HCD") for authority to expend HCD HOME Program Income, Recaptured Funds, and Program Income Administrative Funds (hereinafter collectively "Pl Funds") under the HOME Investment Partnerships Program (HOME); and if approved, the execution of a Standard Agreement, any amendments thereto, and of any related documents necessary to participate in the HCD HOME Program.

I FISCAL IMPACT
Establishing the HOME Pl contract would provide a mechanism for the City to claim eligible Long-Term Monitoring & OOR Program administration activity delivery costs under the contract.

ITEM 8.5 PAGE1 8/18/2026
49 [ DISCUSSION and BACKGROUND
The State is seeking to place the City's HOME Program Income activities under a new PI contract. Once the PI contract is established, activity delivery associated with Long-Term Monitoring and OOR may be claimed under that contract.

This approach would allow eligible L TM & OOR activity delivery costs to be recognized and reimbursed through the HOME Pl contract, subject to HCD's approval and applicable HOME requirements. The City & County would continue to perform the required monitoring and compliance activities associated with its existing HOME-funded projects.

Approval of the recommended action would provide the necessary governing board authorization for the City to submit its application and, if approved, execute the required HOME Standard Agreement and related documents. HCD requires an executed City Council resolution to accompany the application.

As an extension of the L TM agreement between the City of Anderson and Shasta County approved on July 7, 2025, this application submission and approval will help to fund some of the costs to the City incurred through the HOME programs The California Department of Housing and Community Development (HCD) administers the federal HOME Investment Partnerships Program and permits eligible jurisdictions to utilize HOME Program Income, recaptured funds, and Program Income administrative funds for eligible HOME activities.

HCD's current HOME PI-oniy application instructions require a governing boar1 resolution authorizing submission of the application, identifying the specific activities proposed, identifying the amount of HOME PI funds recaptured, and authorizing execution of the HOME Standard Agreement and related documents.

The City's proposed application will include two activities:
• Owner-Occupied Rehabilitation (OOR) Program - providing eligible rehabilitation assistance to qualified owner-occupied residential properties; and • Long-Term Monitoring (LTM) - continuing required monitoring and compliance activities associated with prior HOME-funded projects.

The Resolution identifies both the Owner-Occupied Rehabilitation Program and Long-Term Monitoring as eligible activities under a HOME Pl application. The City is currently responsible for Long-Term Monitoring activities associated with prior HOME-funded projects & OOR Program administration. These activities are necessary to ensure continued compliance with applicable HOME requirements and the City's prior HOME agreements.

Approval of the recommended action will allow the City to submit its HOME Pl application for the Owner-Occupied Rehabilitation Program and Long-Term Monitoring.

ITEM 8.5 PAGE2 8/18/2026
50 Establishing the HOME PI contract will provide the City with a funding mechanism for eligible OOR activities and, once the contract is established, allow eligible L TM activity delivery costs to be claimed under the Pl contract.

54 I DISCUSSION and BACKGROUND
In 1983, the California Legislature approved Assembly Bill 797, Division 6, Part 2.6, and Sections 10610 - 10656 of the California Water Code. This legislation, the Urban Water Management Planning Act, requires urban water suppliers providing water for municipal purposes to more than 3,000 service connections or supplying more than 3,000 acre-feet (AF) of water annually to prepare and adopt an Urban Water Management Plan (UWMP) every five years.

The purpose of the UWMP is to maintain efficient use of urban water supplies, continue to promote conservation programs and policies, ensure that sufficient water supplies are available for future beneficial use, and provide a mechanism for response during water drought conditions.

The 2025 UWMP requires an update to the City's Water Shortage Contingency Plan (WSCP), which was originally written in 2015 and modified in the 2020 UWMP. The WSCP framework needs to be adjusted to include the required climate resilience and drought scenarios for the 2026-2030 period. In addition to the WSCP updates, there is a required update to the water use demand forecasting based on the annual water supply and demand assessment submitted to DWR annually.

The City's original UWMP was prepared in 2015, and the 2020 UWMP was due July 1, 2021, and was submitted to the Department of Water Resources (DWR) on November 10, 2022, and corrections were required to update the submitted plan. The corrected UWMP was submitted on February 1, 2023. DWR notifies non-compliant water agencies, which are reported to the Legislature. To date, the Citf has not received a letter for the 2025 UWMP, whic~ was due on July 1, 2026.

Based on the approval of the Professional Services Agreement in August, we anticipate having the Draft Report to the City Council in April, with the Final Report to the City Council in July of 2027.

This will allow the City to submit to DWR in July or August of 2027.

55 PROPOSAL
March 25, 2026
Peter Wickenheiser, Deputy Public Works Director
City of Anderson

[email protected]
Dear Peter,
Subject: Urban Water Management Plan
Proposal for Engineering Services
5155 VENTURE PARKWAY
REDDING, CA 96002
(530} 244-0202
PACE Engineering, Inc. {PACE) is pleased to respond to your request for a proposal to prepare an update to the City of Anderson's (City's) Urban Water Management Plan (UWMP). The City's 2020 UWMP was prepared in 2022. Using the last plan as a guide, along with the 2025 UWMP Guidebook and updated California Water Code (CWC) requirements, we anticipate our Scope of Services will be as follows:

SCOPE OF SERVICES
The UWMP must address certain requirements addressed in the CWC. We anticipate the following major tasks:

Task 1-Gather Information/Existing Report Review
Review background data, including the 2020 UWMP, water system improvements since 2020, current and historical water consumption and production data, and the City's current General Plan. We will also want to evaluate the City's current water shortage response program and discuss improvements and modifications of this program.

Review 2025 UWMP development guidelines, including any new changes to the ewe.

Task 2 - Update Service Area Characteristics and Water System Update the service area map showing the current sphere of influence, water distribution system, wells, and storage facilities based on the Water Master Plan. Describe the City's current water distribution, production, and storage facilities.

Update the City's population projections utilizing the City's current General Plan, Water Master Plan, and discussions with City staff. Per capita water use factors from the 2020 UWMP and updated water billing data will be incorporated into the plan for existing and future water 56 PROPOSAL

Urban Water Management Plan
demands. The City's Water Master Plan will be used as a template for potential developments in the planning stages.

Baseline and target water consumption will be calculated, and it will be determined whether the interim water use target from the 2020 UWMP was achieved. A plan will be developed to achieve the future water use target.

Regional climatic characteristics such as temperature, precipitation, and evapotranspiration rates shall be included within the plan.

Task 3 - Water Supply System
Evaluation of the City's current water source(s) and historical and projected reliability will be conducted. Based on City input, the water service reliability analysis will be performed for a normal water year, a single dry year, and for multiple dry years scenarios. The assessment will compare the total water production available versus the amount of consumption over a 25-year period.

Other sources of water shall be examined, including utilizing recycled water from the City's wastewater treatment plant and groundwater wells, as potential sources for future water needs.

The use of recycled water in the future will be addressed, including potential recycle markets, treatment plant improvements, possible funding sources, and a staged recycle water distribution system.

City water and wastewater ordinances shall be reviewed, and the most applicable (i.e., water conservation, landscaping, etc.) shall be referenced in the report. In addition, the City's current water billing rate structures shall be discussed as it relates to water conservation.

The report will discuss the City's future plans for improvements to the water supply system, expansion of the wastewater treatment plant to supply recycle water, coordination with other local agencies for the import or export of water, and development of new conservation measures within the City.

Task 4 - Best Management Practices
The UWMP will contain an update to the City' s water shortage contingency analysis to meet 2025 UWMP guidelines, which will include the following:
• A multi-stage water shortage response plan that will address supply reduction levels, voluntary and mandated conservation methods, public notices, public education programs, and penalties for excessive water use.
• The City's water wastage ordinances and pricing structure shall be reviewed, and recommendations on updating these regulations shall be provided. • The listing of the City's demand management measures shall be reviewed by PACE and City staff in order to update this list.
