Date: September 1, 2026
!SUBJECT
Ordinance No. 879 Amending Chapters 5.48, 6.24, 6.28, 9.38, and 9.57 of the I Anderson Municipal Code to increase specific f~es or penalties.
I RECOMMENDATION
Adopt Ordinance No. 879 (Second Reading) amending Chapters 5.48, 6.24, 6.28, 9.38 and 9.57 of the Anderson Municipal Code to increase fees or penalties in certain sections, as introduced on August 18, 2026 (First Reading).
I FISCAL IMPACT
There will be an unknown increase fiscally based on these increases.
I DISCUSSION and BACKGROUND
At the April 7, 2026 City Council regular meeting, the City Council approved a resolution updating fees to ensure the city is able to recover the cost of providing services. That approval followed a fee study from Revenue & Cost Specialists, LLC which evaluated the full cost of providing services, identify cost recovery levels, and recommend updated fees consistent with California law and the "costs reasonably borne" standard.
In connection with that fee update, city staff also reviewed the Anderson Municipal Code to determine if there were changes or updates to the fees or penalties in the code that were ITEM 6.3 PAGE1 9/1/2026
19 necessary. That originally resulted in an ordinance in April of this year removing many fees from the code so that they could be shifted to the Master Fee Schedule.
Staff also located numerous fees or penalties that could be increased to ensure that the city is capturing the cost of service. Those proposed increases are in front of the City Council tonight, and include fees for coin-operated devices, animal regulation fees, penalties for littering in the park, and penalties for certain tobacco use violations. jATTACHMENTS

I SUBJECT
Resolution to accept the FV26/27 grant award funding from the California Alcohol Beverage Control (ABC), in the amount of $50,000.
I RECOMMENDATION
City staff recommends that the Anderson City Council approve the requested resolution to accept the FV26/27 grant award funding from the California Alcohol Beverage Control (ABC), in the amount of $50,000.
I FISCAL IMPACT
This is a reimbursement structured grant with no net fiscal impact to the City of Anderson. The City will initially cover eligible expenses such as police department overtime, equipment, training, and educational materials which will be reimbursed on a quarterly basis by the State.
The grant period runs from July 1, 2026, through June 30, 2027. All initial costs will be funded through the City's FY26/27 budget and are expected to be reimbursed within the same fiscal year. No matching funds are required, as this is a fully funded grant.
ITEM 6.9 PAGE1 9/1/2026
24 Police Department staff will be responsible for grant administration, including oversight of operations, scheduling of overtime, and completion of quarterly reports. These duties will be absorbed within existing staff workload and will not require additional staffing or resources.
I DISCUSSION and BACKGROUND
The Anderson Police Department (APD) serves approximately 6.5 square miles and a population of about 11,300. Within the City, there are 25 on-sale and 23 off-sale Alcohol Beverage Control (ABC) licensed establishments. About one-third of APD officers have fewer than five years of experience and limited exposure to ABC laws and enforcement.
According to the U.S. Census Bureau, 24.2% of Anderson's population is under 18, highlighting the need for youth-focused alcohol education and prevention efforts.
APO applied for this ABC grant through the State of California to enhance efforts in reducing underage access to alcohol. The grant supports law enforcement agencies by funding equipment, training, and resources to address alcohol-related issues.
Grant Application Submission:
In March 2025, the Anderson Police Department submitted a grant application for funding through the State of California, Alcohol Beverage Control. This grant is specifically designed to assist law enforcement agencies by providing financial support for equipment, training, and other resources to reduce youth access to alcohol.
As part of the grant award process, a formal resolution from the Anderson City Council is required. The resolution will authorize the City to enter into a grant agreement with ABC and accept the awarded funding, either in full or in part.
On June 3, 2026, APO was notified they were awarded this grant for $50,000. The grant authorized the following expenditures:
• Personnel Services - $42,000
• Operating Expenses - $2,500
• Equipment - $2,500
• Travel/Training - $3,000
Proposed Use of Grant Funds:
The grant will provide funding for essential resources aimed at enhancing community safety, improving public education on youth access to alcohol, reducing impaired driving, and strengthening proactive enforcement efforts. The Anderson Police Department has identified the listed goals/objectives for this grant:
ITEM 6.9 PAGE2 9/1/2026
25 1. Conduct "Shoulder Tap" and under age attempts to purchase alcohol from ABC licenses establishment operations, including participating in the Statewide Shoulder Tap Operation conducted by ABC.
2. Perform proactive alcohol-related enforcement activities during special events or holidays. (On dates such as: Shasta District Fair week, Mosquito Serenade Concert events, St. Patrick's Day, Cinco De Mayo, Superbowl Sunday, New Years Eve).
3. Provide training on the TRACE program to all patrol shifts.
4. Coordinate and conduct IMPACT (Informed Merchants Preventing Alcohol-Related Crime Tendencies) Operations at 100% of the licensed premises within our jurisdiction.
5. Issue press / social media releases regarding the grant and/or the activities conducted under the grant after every enforcement operation.
6. Conduct additional operations when specific concerns regarding ABC licensed establishments are identified, such as narcotics trafficking within an establishment, overserving of intoxicated patrons, etc.
7. Provide youth education opportunities to the community.
Conclusion:
The State ABC grant award presents a valuable opportunity for the City of Anderson to proactively address youth access to alcohol and enhance public safety. This funding will support targeted education and enforcement, training, and community outreach efforts, while also fostering stronger collaboration between law enforcement, local businesses, schools, and community partners.
City staff recommends that the Anderson City Council adopt the proposed resolution authorizing the city manager to sign the agreement and accept the grant funding of $50,000 from the California Department of Alcoholic Beverage Control.

Ordinance Amending Chapter 2.48 of the City of Anderson Municipal Code to Update the Process for Commissioner Nominations
I RECOMMENDATION
Staff recommends that the City Council:
1. Receive a staff report;
2. Receive public comments;
3. Introduce an Ordinance (First Reading) amending Chapter 2.48 of the Anderson Municipal Code to update the process for Planning Commissioner Nominations, and set for adoption on September 15, 2026 (Second Reading).
4. Waive full reading and direct the City Clerk to read the ordinance by title only.
I FISCAL IMPACT
There will no fiscal impact.
I DISCUSSION and BACKGROUND
Chapter 2.48 of the Anderson Municipal Code governs the City of Anderson Planning Commission, including process for appointment and functions of commissioners. Overall.
This Chapter establishes that the City of Anderson Planning Commission has five commissioners that provide recommendations to the city council regarding land use matters. Each commissioner is nominated by a Councilmember and appointed by a ITEM 8.3a PAGE 1 9/1/2026
42 majority of the City Council to fulfill a term concurrent with the respective nominating City Councilmember.
Under the current code, there is a lengthy and cumbersome process for the appointment whereby the City Clerk schedules interviews for prospective commissioners during agendized meetings for the entire council. The appointing councilmember then has 30 days, or longer if requested, to nominate their commissioner. This results in a process that takes many months to complete, leaving a vacancy on the Planning Commission.
This amendment seeks to update the process to a more streamlined version whereby the nominating councilmember reviews applications, and can meet with the applicants as desired, then makes their nomination, followed by approval or denial by the majority of the City Council. During the meeting for the appointment, all City Councilmembers will have the ability to interview the nominee.
After discussion and direction given by Council the amendment also clarifies that eligibility for planning commissioners shall be either residents of the city, individuals that own property in the city and reside in the 96007 zip code, or individuals that own a business physically located in the city. It further clarifies that commissioners cannot be an officer or employee of the city.

Staff recommends that the City Council:
1. Receive a staff report;
2. Receive public comments;
3. Adopt a proposed resolution pertaining to the compensation of the Planning Commission.
I FISCAL IMPACT
This item will potentially create a small general fund savings, based on the number of meetings a Planning Commissioner does not attend.
I DISCUSSION and BACKGROUND
During the August 18, 2026 City Council meeting, the City Council directed staff to place the topic of Planning Commission compensation on the agenda for the next regular meeting and to prepare a resolution providing that Planning Commissioners are compensated only for regular meetings they attend, or that are cancelled by staff, and do not receive compensation for meetings they fail to attend.
ITEM 8.3b PAGE 1 9/1/2026
52 Pursuant to Government Code section 36506, the City Council may provide compensation to appointive officers, such as Planning Commission members, by resolution or ordinance.
Planning Commissioners currently receive $150.00 per month in compensation and hold one regular meeting per month. The proposed resolution does not change this monthly rate; it amends the terms of compensation so that Commissioners receive the $150.00 payment only for months in which they attend the regular meeting or the meeting is cancelled by staff. Commissioners who do not appear at the regular meeting will not receive compensation for that month.
