Ordinance Amending Chapter 2.48 of the City of Anderson Municipal Code to Update the Process for Commissioner Nominations

I RECOMMENDATION
Adopt Ordinance No. 880 (second reading) amending Chapter 2.48 of the Anderson Municipal Code to update the process for Planning Commissioner Nominations, as introduced on September 1, 2026 (first reading).

J FISCAL IMPACT
There will no fiscal impact.

I DISCUSSION and BACKGROUND
Chapter 2.48 of the Anderson Municipal Code governs the City of Anderson Planning Commission, including process for appointment and functions of commissioners. Overall.

This Chapter establishes that the City of Anderson Planning Commission has five commissioners that provide recommendations to the city council regarding land use matters. Each commissioner is nominated by a Councilmember and appointed by a majority of the City Council to fulfill a term concurrent with the respective nominating City Councilmember.

Under the current code, there is a lengthy and cumbersome process for the appointment whereby the City Clerk schedules interviews for prospective commissioners during ITEM 6.5 PAGE1 9/15/2026
20 agendized meetings for the entire council. The appointing councilmember then has 30 days, or longer if requested, to nominate their commissioner. This results in a process that takes many months to complete, leaving a vacancy on the Planning Commission.

This amendment seeks to update the process to a more streamlined version whereby the nominating councilmember reviews applications, and can meet with the applicants as desired, then makes their nomination, followed by approval or denial by the majority of the City Council. During the meeting for the appointment, all City Councilmembers will have the ability to interview the nominee.

After discussion and direction given by Council the amendment also clarifies that eligibility for planning commissioners shall be either residents of the city, individuals that own property in the city and reside in the 96007 zip code, or individuals that own a business physically located in the city. It further clarifies that commissioners cannot be an officer or employee of the city.

21 ORDINANCE NO. 880
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANDERSON AMENDING CHAPTER 2.48 "PLANNING COMMISSION" OF THE CITY OF ANDERSON MUNICIPAL CODE TO CHANGE THE

PROCESS FOR COMMISSIONER NOMINATIONS
THE CITY COUNCIL OF THE CITY OF ANDERSON does hereby find, determine and declare as follows:

WHEREAS, Chapter 2.48 of the Anderson Municipal Code established a Planning Commission for the City wherein five Commissioners are appointed to provide recommendations to the City Council regarding land use matters, with each Commissioner nominated by a City Councilmember and appointed by a majority of the City Council to fulfill a term concurrent with their respective nominating City Councilmember; and
WHEREAS, the City Council seeks to amend the process for nomination and appointment of new Commissioners to ensure a streamlined procedure.

NOW, THEREFORE, the City Council of the City of Anderson does ordain as follows:

SECTION 1. Chapter 2.48 "PLANNING COMMISSION" of Title 2 "Administration and Personnel" of the City of Anderson Municipal Code is hereby repealed and replaced to read as follows:

Chapter 2.48 - PLANNING COMMISSION

2.48.010 - Created.

A planning commission for the city is created.

2.48.020 - Composition, eligibility and term.

The planning commission shall consist of five members. Each member shall serve a term of office which is concurrent with the term, at the time of appointment, of the councilmember who was initially eligible to nominate him or her. If that council member's term is shortened for any reason, the corresponding term of such commissioner is also shortened to cpincide with that of the council member.

To be eligible, planning commissioners shall be either (1) residents of the city, (2) individuals that own property in the city and reside in the 96007 zip code, or (3) individuals that own a business physically located in the city.

A planning commissioner serves at the pleasure of the city council and may be removed at any time without cause by a recommendation for removal by the appointing councilmember with the affirmative votes of any three or more council members. A planning commissioner who fails to maintain eligibility for appointment to the planning commission forfeits his or her seat on the 22 commission. A planning commissioner's term may also expire by his or her resignation which shall be effective upon acceptance by a majority vote of a quorum of the commission.

No commissioner shall be an officer or employee of the city.

2.48.025 - Method of initial appointment and of filling vacancies.

The following procedure will be followed when a councilmember, beginning a new term of office, is eligible to nominate a planning commissioner and when a councilmember, during his or her term of office, is eligible to nominate a replacement of the planning commissioner whose term was concurrent with his or her own term.

A. Initial Appointments at the Beginning of a Term. Each council member, upon first entering office or beginning a new term of office, shall be eligible to nominate an individual to be a planning commissioner if such nomination is made in a timely manner. The procedure for filling such a position is that set forth below for the filling of vacancies.

8. Vacancies During a Regular Term. If a vacancy occurs in a planning commissioner's position for any reason during the regular term of that commissioner, the councilmember who was initially eligible to nominate that commissioner shall be eligible to nominate a replacement for him or her if such nomination is made in a timely manner. The procedure for filling such a position is that set forth below for the filling of vacancies.

C. Procedure to Fill Vacancies.

1. Whenever a vacancy exists in the planning commission, that vacancy shall be filled by city council appointment for the term specified in Section 2.48.020 of this chapter. As soon as a vacancy occurs, but in no case later than twenty days after the vacancy, the public shall be notified in the manner required by law (Maddy Act) and a period of not less than ten working days shall be provided for interested persons to submit applications to the city clerk requesting appointment to the position. The appointing council member, following a review of the submitted applications, will nominate one individual to the city council for approval.

2. If a councilmember's nominee is not approved by the council, he or she shall be eligible to continue making nominations from among the applicants until such time as a nominee is approved.

3. The council retains the authority at any time to readvertise the position, conduct new interviews and go through the entire process again if it deems it appropriate to do so.

2.48.028 - Direction and control.

Although each commissioner appointed will have been nominated by a councilmember, no commissioner shall be answerable to or directed by any individual councilmember. Members of the planning commission shall be subject only to the direction and control of the entire council, 23 as provided in and limited by ordinance and state law. Planning commissioners shall not in any manner be subject to influence by city council members in making the quasi-judicial decisions required of them in their positions, decisions in most cases appealable to the city council.

No commissioner shall be an officer or employee of the city. No commissioner shall hold any other public office if the duties and responsibilities of that office may be incompatible with their duties and responsibilities as a planning commissioner.

2.48.030 - Functions generally.

The functions of the planning commission shall include the following powers and duties:

A. To prepare and recommend for adoption by the council, a comprehensive, long-term general plan, and any amendments thereto or revisions thereof, for the physical development of the city and of any land outside its boundaries which in the commission's judgment bears relation to the physical development of the city; and to include in the general plan such of the elements described in the planning law of the state, or any other elements, as may be required in the commission's judgment;
B. To prepare and recommend for adoption by the council, precise plans based on the general plan as may be required, in the commission's judgment, for the systematic implementation of the general plan;
C. To perform such duties in reference to zoning, subdivision and other matters as may be authorized or required by state laws and by such provisions of this code as are not in conflict therewith;
D. To perform such other duties as the council may, from time to time, require pertaining to planning.

2.48.050 - Meetings-Regular.

A meeting as provided for law or by rule of the planning commission or any regularly advertised public hearing shall be deemed a regular meeting. Unless canceled or postponed due to lack of business or other considerations, the planning commission shall hold at least one regular meeting in each month.

2.48.060 - Absence from meetings-Without cause.

If a member of the planning commission is absent from three successive regular meetings of the commission without cause, the office of such member shall be deemed to be vacant and the term of such member ipso facto terminated and the planning commission shall immediately inform the city council of such termination.

2.48.070 - Absence from meetings-With cause.
24 An absence due to illness or an unavoidable absence from the city and written notice thereof to the planning commission on or before the day of any regular meeting by the commission shall be deemed absence for cause.

2.48.080 - Election of chairman-Rules adoption.

The planning commission shall elect its chairman from among its appointed members for a term of one year and, subject to other provisions of law, may create and fill such other offices as it may determine. It shall adopt rules for transaction of business and shall keep a record of the resolutions, transactions, findings and determinations, which record shall be a public record.

2.48.090 - Powers and duties.

The planning commission shall perform the duties and shall have all the rights, powers and privileges specified and provided for in this code or by state law.

SECTION 2. CEQA. The City Council finds the introduction and adoption of this ordinance is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060( c )(3) (the activity is not a project as defined in Section 15 378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.

SECTION 3. SEVERABILITY. If any section, subsection, sentence, clause, phrase or word of this ordinance is found to be unconstitutional or otherwise invalid by any court of competent jurisdiction, such decision shall not affect the remaining provisions of this Ordinance.

SECTION 4. ENACTMENT. The City Clerk shall certify the adoption of this ordinance and shall cause it to be posted and/or published in accordance with the law. The ordinance will go into effect 30- days after enactment.

The foregoing Ordinance was introduced at a regular meeting of the City Council of the City of Anderson held on September 1, 2026, and enacted at a regular meeting of the City Council of the City of Anderson held on September 15, 2026, by the following vote.

Re: Letter of Support for Rescinding the 2001 Roadless Area Conservation Rule Dear Secretary Rollins and Chief Schultz:

On behalf of the Anderson City Council, and the hometown to our Nation's largest lumber manufacturer, we write in strong support of the U.S. Department of Agriculture's and Forest Service's objective to rescind in its entirety the National 2001 Roadless Area Conservation Rule. This action correctly prioritizes local decision making, active forest management, wildfire risk reduction, and the multiple use mandate of the National Forest System over a rigid, one-size-fits-all national prohibition. For 25 years the 2001 Rule has restricted road construction, reconstruction, and timber harvest on inventoried roadless areas now covering more than 44 million acres of the approximately 193-million-acre National Forest System. Roughly 30 percent of National Forest System lands have been affected. The rule has limited the agency's ability to conduct critical active management work needed to sustain forest health, reduce fire fuels, and hinder productivity. Data underscores the urgency. More than 40 percent of inventoried roadless areas, primarily in the West, have high or very high wildfire hazardous potential. However, only 5 percent of those areas have received hazardous fuels reduction treatments since 2014. At the same time, more than a quarter of City Council

Fax: (530) 378-6648
30 these lands (11.3 million acres) already lie near existing roads. Of the roughly 58.5 million acres once covered, approximately 28 million acres sit in areas of high or very high wildfire risk. Rescinding the national prohibition removes regulatory barriers that have constrained timely, site-specific treatments, effective regulations, forest plans, and environmental review. State-level illustrations further demonstrate the problem.

These restrictions have constrained local officials who understand specific conditions of fuels, insect and disease outbreaks, watershed needs, and community protection. Rescission does not mandate timber cutting or new road construction. It restores authority to local national forest officials and places decisions within the established land management planning framework, informed by states, tribes, and communities. This approach better addresses watershed, economic, and wildfire risk conditions on a landscape-by-landscape basis. It aligns with the Forest Service's statutory multiple use responsibilities and recent executive direction favoring deregulation of unnecessary burdens, expanded American timber production, and resource potential. More than 95 percent of inventoried roadless areas lie in ten Western states; returning flexibility there supports rural economies, forest products jobs, and the protection of neighboring communities and infrastructure from catastrophic wildfire. Active forest management is essential, not optional. Overgrown stands, insect outbreaks, and disease have turned healthy landscapes into tinderboxes. Local officials are best positioned to restore balance, reduce risk, and maintain long-term forest health and productivity for the benefit of communities such as ours and the nation as a whole. Anderson City Council therefore urges prompt finalization of this mission to rescind the 2001 Roadless Area Conservation Rule. We stand with our local Forest Service members and our timber industry ready to support this commonsense restoration of local authority and responsible stewardship.

Respectfully submitted, Anderson City Council.

Senior Sewer Rebate Program Amendment and Update

I RECOMMENDATION

1. Receive a staff report;

2. Receive public comments;

3. Adopt a Resolution amending the Senior Sewer Rebate Program ] FISCAL IMPACT
At this time the Senior Sewer Rebate Program is funded 100% through community donations with no impact to the general fund. Program availability is limited and will be distributed on a first come first serve basis.

I DISCUSSION and BACKGROUND
At the City Council meeting on September 2, 2025, Councilmember Gallagher and Councilmember Simmons were selected to serve on a Wastewater Rebate Program Ad Hoc Committee. Over a six-week period, the Ad Hoc Committee developed guidelines for a Senior Sewer Rebate Program intended to provide financial assistance to qualifying senior citizens to help offset the cost of wastewater utility bills. The program was established to be funded entirely through community donations and grant funding. with no impact to the City's General Fund.

ITEM 8.3b PAGE1 9/15/2026
36 The program is available to qualifying seniors age 62 and older who own and occupy a residence within the City of Anderson and meet the established income and eligibility requirements. Applications are accepted annually from November 1 through April 30, and participants are required to reapply each year. Because the program relies entirely on donations and grant funding, funding is limited and rebates are awarded on a first-come, first-served basis upon receipt of a complete and eligible application.

The first year of the Senior Sewer Rebate Program has now been completed. One of the primary goals established for Year 1 was to assist at least ten qualified seniors. The City successfully met this goal by assisting 17 of the 53 seniors who turned in applications.

Demonstrating both a need for and interest in the program within the community.

While the participation goal was achieved, the program did not meet its original fundraising goal of $10,000. During the first year, the City raised a total of $3,900 for the program. Of that amount, $1,900 was contributed by four private donors, and an additional $2,000 was received through a grant from the Redding Rancheria Community Fund.

Although this funding was sufficient to allow the City to successfully launch the program and assist qualifying seniors, the amount raised was below the level originally anticipated for the long-term sustainability and potential expansion of the program.

The original program guidelines contemplated increasing the rebate amount in future years. However, based on the fund raising results from the first year and the limited amount of funding available, staff recommends maintaining the maximum annual rebate at $225 per qualifying household. Maintaining the rebate at this level will allow available funding to assist a greater number of qualifying seniors rather than increasing the benefit for individual participants and potentially reducing the overall number of households the program can serve.

Moving forward, the Senior Sewer Rebate Program will continue to be dependent upon community donations and grant opportunities. Each program year will have a limited amount of funding available, and applications will continue to be processed on a first-come, first-served basis until available program funds are committed. Any remaining funds will be carried forward to support the program in subsequent years.

Staff believes the first year of the program was successful in achieving its primary objective of providing direct financial assistance to qualifying Anderson seniors. Maintaining the rebate at $225 while continuing fundraising and grant-seeking efforts provides a sustainable approach that balances the level of assistance provided to each household with the goal of serving as many eligible seniors as available funding allows.

I FISCAL IMPACT
This is a 90 percent reimbursement-based grant, meaning the City will fund 10 percent of the total project cost. The total project amount is $396,000, with $360,000 requested from the grant and $36,000 as the City's share, funded out of the Gas Tax fund.

41 I DISCUSSION and BACKGROUND
The California Department of Transportation (Caltrans) recently released its Notice of Funding Opportunity (NOFO) for the Highway Safety Improvement Program Cycle 13. This program funds construction-ready safety improvements on public roads, bicycle facilities, pedestrian facilities, and tribal roads. Projects must address a specific safety problem and use countermeasures that directly reduce crash risk. Cycle 13 includes a Benefit Cost Ratio category and set-asides for guardrails, pedestrian crossings, lane departure prevention, bike safety, and Tribes.

Approximately $23.4 million is available statewide for the Pedestrian Crossing Enhancements Funding Set-Aside, with applications due by November 2, 2026, and award announcements scheduled for summer to fall of 2027.

City Staff proposes requesting $396,000 from the HSIP Cycle 13 to fund the design and construction of Rectangular Rapid Flashing Beacons (RRFB), pedestrian crossing/signage, advanced yield lines/signs, and other striping and signage for up to 14 locations throughout Anderson. The grant requests $360,000 for reimbursement, with the City providing a 10 percent match not to exceed $36,000.

The current crosswalk markings at the identified crossings will be updated from a basic style to a ladder style; advanced yield markings will be installed; pedestrian crossing advanced signage will be installed; and the existing signage will be adjusted within the immediate project limits only where necessary to accommodate the identified improvements.

City Staff recommends that the Anderson City Council authorize the submission of an application for the HSIP Cycle 13 Grant. If the City is selected as a recipient of the grant, a resolution will be agendized for the Anderson City Council to discuss and review before accepting the awarded grant funding.
