RE: DISCUSSION OF THE CODE COMPLIANCE EFFORTS IN THE CITY SINCE BRINGING ON
CSG AND IMPLEMENTING THE EDUCATIONAL AND ADMINISTRATIVE PROCESS
RECOMMENDATION
Discussion item only
BACKGROUND
The City of Angels has been without a staffed Code Compliance department for several years. The City did work with Interwest and Augustine Planning Associates, Inc. (APA) to bring the City’s Municipal Code in line with best practices for carrying out an administrative process on code violations starting in 2018 and continued to make updates through 2021. Unfortunately, staffing to enforce administrative citations has been limited as Interwest did not have Code Enforcement as an available scope/task.
DISCUSSION
The City issued a Request for Qualifications (RFQ) in April 2022. CSG Consultants was selected by a review panel and the City Council approved a contract for services on June 21, 2022. While the emphasis was on Plan Review and Building Inspections, the City was also focused on ensuring that we had adequate Building Official and Code Enforcement assistance when needed.
Staff met with CSG on August 9, 2022,to discuss what the City’s needs are with regard to Code Compliance and from that discussion, CSG Management identified a resource that the City could work with to get the process going.
On September 14, 2022, The City staff met with Irma Gowin. Irma has worked directly with City staff and engaged with the current case files we have. Her focus has been to establish an educational outreach first and then move through the administrative cycle, always engaging with the property owner for a win-win solution.

RE: Ordinance 533 to amend Chapter 15.04 of the City of Angels Municipal Code (AMC) to remove sections inconsistent with the California Building Codes, adopt the 2022 California Building Codes effective January 1, 2023, and add the 2021 International Property Maintenance Code and its 2024 update
RECOMMENDATION
Introduce, waive the first reading, hold a public hearing, and set December 6, 2022, for a second public hearing to consider adopting Ordinance 533 updating the City Building Code.
BACKGROUND/DISCUSSION
Planning Commission Resolution of Intent 22-25 Attachment A details the proposed changes to AMC Chapter 15.04.
The City of Angels Building Code is comprised of 12 separate volumes:
1. CA Administrative Code
2. CA Building Code
3. CA Residential Code
4. CA Electrical Code
5. CA Mechanical Code
6. CA Plumbing Code
7. CA Energy Code
8. CA Historical Code
9. CA Fire Code
10. CA Existing Building Code
11. CA Green Building Code
12. CA Referenced Standards Code
The California Building Codes (California Code of Regulations, Title 24) are published on a triennial basis. The last issue was dated 2019. The 2022 code is scheduled to go into effect on January 1, 2023. California State Law mandates that local governments enforce these updated regulations provided for in the CA Building Standards Code. The proposed ordinance complies with state law.
The City of Angels Code Compliance officer has also requested the addition of the 2021 International Property Maintenance Code (IPMC). This code is updated triennially. The 2021 IPMC will be updated in 2024. Calaveras County, Tuolumne County, Amador County, the City of Jackson, Ione, etc. include the International Property Maintenance Codes as part of their building codes.
In addition to triennial updates, a comprehensive review of Chapter 15.04 by the City Building Official 5A
Building Code 15.04 Amendments Page - 2
identified areas where the City code conflicts with the CA Building Codes and recommends changes or deletions highlighted in Planning Commission Resolution of Intent 22-25 Attachment A. These include, in summary:
• Deleting permit expiration for non-activity. These are addressed in state codes. The state has been amending these in association with efforts encouraging housing production (e.g., increased permit expiration from 6 months to 12 months). • Fees. The City is reviewing and expects to update Building fees. The proposed code changes will simplify those efforts.
• Cross referencing other city requirements commonly required in conjunction with a building permit (e.g., water and sewer hook-ups, encroachment permits). This assists the public in recognizing other potential costs and permits that may be associated with construction. • Building official liability (CBC A 104), temporary occupancy (CBC 111.1, CA Residential Code R110.4) are addressed in the California Building Code. They are proposed for removal to avoid conflicts between city and state codes.
The City of Angels Planning Commission considered Resolution of Intent 22-25 for these changes at its November 10, 2022, meeting. Their recommendation(s) will be provided to the City Council at the Council meeting.
ANALYSIS
Angels Municipal Code Section 15.04.024 allows for amendments to Title 15 by City Council resolution.
Generally, such amendments are limited to simple updates to adopt the current building code changes triennially. However; because changes in addition to the usual triennial updates are being undertaken here, the proposed changes are being accomplished by ordinance.
Pursuant to AMC Section 17.90.040, the following findings are required for amendments:
Finding A and B: The proposal conforms with the City's General Plan and Municipal Code The proposed amendments will implement the following general plan policies and programs:
Program 1.A.b Continue to Conduct Reviews of the Angels Camp Municipal Code and General Plan for Consistency
Program 2.B.a Undertake a Comprehensive Update to the City of Angels Municipal Code The proposed changes will bring Chapter 15.04 into compliance with state regulations and remove inconsistencies between local and state regulations consistent with the general plan and the City of Angels Municipal Code. Therefore, Findings A and B can be made.
Finding C. The proposed change or amendment will not be substantially detrimental to the health, safety, or general welfare of the city
The proposed changes are being undertaken to comply with state regulations related to health and safety of buildings. Therefore, the proposed changes are not substantially detrimental to the health, safety and general welfare of the City and Finding C can be made.
ENVIRONMENTAL FINDINGS
The proposed changes to Title 15 of the Municipal Code are exempt from environmental review pursuant to Section 15061(b)(3) of the state guidelines for implementation of the California Environmental Quality Act Building Code 15.04 Amendments Page - 3
(CEQA) because the project is an update to state regulations for compliance with existing state law.
Therefore, it can be seen with certainty that the project will have no potential for causing a significant effect on the environment therefore, the activity is not subject to CEQA.
FISCAL IMPACT
None.

City Administrator Rebecca Callen • City Attorney Doug White, Churchwell White, LLP The two buildings located at 1195, 1197, and 1201 South Main Street were evaluated pursuant to the referenced inventory as Resource #3, the Gottfrey Reber Saloon and Lodging House (aka Smith’s Apartments) on Assessor’s Parcel 64-004-008 and determined eligible for listing on the National Register of Historic Places as a contributor to a National Register district due to its association with the City’s mining history and the building’s embodiment of the style known as “Mother Lode Architecture” that lined main streets throughout the Mother Lode.
Originally a saloon and lodging house, the “structure” consists of a single-story building to the north and a twostory building on the south built in 1894 for Gottfrey Reber. The two-story building to the south, is a false-front commercial with Queen Anne Elements which served as a lodging house and saloon. It has an Italianate false front with a cornice, decorative brackets and finials on each end. Queen Anne elements include spindlework in the front gable and over the second story window heads. The original building had a twostory shed-roofed porch over the sidewalk that did not extend to the building on the north. Original to the building are the 1/1 light frame sash double-hung and paired windows on the front façade (but replaced with double-hung aluminum on side elevations). Storefront windows date to the 1930s. The single-story building to the north housed various businesses including a Chinese laundry and Reber’s Jewelry Store.
By 1910, the buildings were owned by Mrs. Charles D. Smith, wife of a dentist, Dr. Charles Smith. The upper story of the two-story building has almost continuously been used for lodging. It housed miners in the 1890s and 1930s. In approximately the 1950s, the upstairs was converted to apartments, the “Smith’s Apartments.” The building located at 1200 Rasberry Lane was evaluated pursuant to the referenced inventory as Resource #4, Siegal’s Blacksmith Shop (aka Raggio’s Stage Barn) on Assessor’s Parcel 64-004-009 and determined eligible for listing on the National Register of Historic Places as a contributor to a National Register district.
The post and beam barn was constructed circa 1890 and originally used as a three-bayed stage barn run by the Raggio Brothers stage (a carriage shed to the west and an office to the east of the central bay). By 1922, the two side bays were removed and what remains is what is seen today. The structure was then used as a blacksmith shop. In the 1930s, metal siding replaced some of the board and batten as it became an auto storage garage. Due to its association with the industries of staging and blacksmithing and as the sole remaining barn of what were once numerous barns that once lined the commercial district streets, it is considered a contributor to the City’s National Register eligible district.
The Planning Commission considered the preceding as Resolution of Intent 22-27at its 11/10/22 meeting with a staff recommendation that the Planning Commission find that the buildings are qualified for and should be added to the City of Angels Register of Cultural Resources. The Commission’s recommendations will be provided to the City Council at the Council Meeting.
ENVIRONMENTAL FINDINGS
Pursuant to the state guidelines for implementing the California Environmental Quality Act (CEQA), the proposed resolution is exempt from further review pursuant to Section 15331, Class 31 Historical Resource Restoration/Rehabilitation because the inclusion of the Utica Hotel on the City of Angels Inventory of Cultural Resources will allow it to maintain, repair, stabilize, rehabilitate, restore, preserve, conserve or reconstruct an historical resources in a manner consistent with the Secretary of the Interior’s Standards for the Treatment of Historic Properties with Guidelines for Preserving, Rehabilitating, Restoring, and Reconstructing Historic Buildings (1995), Weeks and http://www2.cr.nps.gov/tps/standards/index.htm through the application of the State Historic Building Code.

RE: APPROVAL OF AMENDMENT NO. 2 TO AGREEMENT FOR PROFESSIONAL CONSULTING
SERVICES WITH BLACKWATER CONSULTING ENGINEERS FOR DESIGN OF FACILITY
IMPROVEMENTS AT CITY WATER TREATMENT PLANT
RECOMMENDATION:
It is recommended that the City Council execute Amendment No. 2 with Blackwater Consulting Engineers (Blackwater) for a not to exceed amount of $286,000.
BACKGROUND:
Blackwater was retained by the City in 2017 to prepare construction documents for facility improvements at the City water treatment plant (Plant). As part of the design development for the project, Blackwater prepared and submitted technical memoranda in 2018 to the City including an alternatives analysis to identify cost-effective options for facility enhancements to improve operational efficiencies and system reliability. Project design was then suspended pending development of a 5-yr capital improvement program for water and wastewater systems and a list of priority projects at the Plant. Following approval of the 5-yr capital improvement program and water/wastewater rate increase in August 2019, design activities were re-initiated for the project. Considering the priority of improvements established in the 5-yr capital improvement program, changes in the original scope of the project were triggered. Preliminary design was completed for all capital improvements outlined in the 5-yr capital improvement program for the Plant; however, final design documents will be limited to the following: 1) Backwash handling; 2) Residuals dewatering; 3) Dewatered residuals storage/stockpile facilities; and 4) Piping improvements required for routing of raw water from UWPA to adjacent landowners. Amendment No. 1 incorporated these changes in project scope and included the following additional services from Blackwater: 1) Assistance in obtaining project approval from the Division of Drinking Water (DDW) including preparation of an updated Operations Plan; 2) Assistance in developing options for offsite disposal of Plant residuals; and 3) Preparation of a preliminary engineering report, CEQA document, and funding application for submission to the State Water Resources Control Board Division of Financial Assistance (DFA).
The preliminary design has since been completed and approved by the DDW. A funding application and supporting documentation have been submitted to DFA with subsequent approval likely based on feedback from DFA staff. The referenced funding application includes “soft” costs to be incurred by the City during project implementation including design engineering, construction oversight, and administration. These costs, in addition to construction costs, would be eligible for reimbursement from the State.
With preliminary design completed and project funding through the State imminent, City staff have met with Blackwater and reviewed their staffing and approach to completing final design of the Phase 1 project. A scope of services and fee estimate was negotiated with Blackwater by the City Water/Wastewater Engineer and is reflected in the recommended Amendment No. 2 to the professional Consultant Services Agreement with Blackwater. 5C

City Administrator Rebecca Callen • City Attorney Doug White, Churchwell White, LLP DISCUSSION:
Currently backwash water and residuals from quarterly cleaning of the plant sedimentation basin are discharged offsite to a natural drainage course. Recent inspection reports prepared by the State Division of Drinking Water staff have flagged this practice as inconsistent with the water supply permit for the plant. A time schedule for elimination of discharges has been requested including completion of backwash and residual handling improvements. Design and construction of backwash and residual handling improvements will be prioritized with this amendment with the goal of completing design in late spring of 2023 with construction commencing in the summer of 2023.
FISCAL IMPACT:
Costs for final design engineering included within Amendment No. 2 are within the engineering allowance included in the funding agreement submitted to DFA.
Adjust the Fiscal Year 2022-23 budget to include expenses for the CIP Backwash Handling/Water Treatment Plant. The CIP has the project, but an adjustment was to occur when this cost was going to be known and the City was closer to submitting the General package for construction funding for eh Drinking Water State Revolving Fund Program.
Increase Grant Revenue and increase Capital Project Expenses for Fund 365 (Water R&R) to include the Blackwater amendment and Dewberry assistance on project for a total of $300,000.

RE: PUBLIC HEARING TO DISCUSS THE CITY OF ANGELS DROUGHT CONTINGENCY PLAN TO BE APPROVED BEFORE DECEMBER 31,2022
RECOMMENDATION
Discussion and public input on the draft Drought contingency Plan for the City of Angels.
BACKGROUND
Senate Bill 552 (Water Code 10609.51 subd (k) requires water utilities to have a Drought Contingency Plan in place by January 1, 2023.
DISCUSSION
The California Department of Water Resources is administering the Drought Planning for Small Water Suppliers and Rural Communities. This included development of template plans to help suppliers complete a plan, catered to their respective communities and gather public input prior to adoption.
The City of Angels met with Union Public Utility District (UPUD) and Utica Water and Power Authority (UWPA) to discuss impacts that are specific to our JPA. Our water sources include surface water and stored water throughout the system. Discussions about what conditions would trigger each step of the plan were identified and while some responses will be the same across all three of our plans, some of the responses are specific to our system within the City, such as reclaimed water use.
The main takeaway is that to date, the State has not triggered mandatory conservation measures on small community systems throughout the state. The 2014 drought conservation mandate was a local mandate.
At that time, only urban suppliers were required to mandate conservation measures upon customers.
While it is always possible that could change, any type of mandatory water conservation would be caused initially by the State’s mandate on small community systems. All efforts prior to that level, would be voluntary, with the City’s emphasis on no water waste or theft. 5D

In order to conserve the available water supply and protect the integrity of public water system (051003) supply facilities, with particular regard for domestic water use, sanitation, and fire protection, and to protect and preserve public health, welfare, and safety and minimize the adverse impacts of water supply shortage or other water supply emergency conditions, the City of Angels hereby adopts the following regulations and restrictions on the delivery and consumption of water through an ordinance/or resolution.
Water uses regulated or prohibited under this Water Shortage Contingency Plan (the Plan) are considered to be non-essential. Continuation of such uses during times of water shortage or other emergency water supply conditions are deemed to constitute a waste of water which subjects the offender(s) to penalties as defined in Section XI of the Plan.

AND CORRECTING THE HOLIDAY STIPEND PAYMENTS TO CONFORM TO CALPERS
REQUIREMENTS
RECOMMENDATION
Approve Resolution 22-78 approving the side letters with the City of Angels Employee Association, the Angels Camp Firefighters Association, and the City of Angels Police Officers Association granting cell phone stipends to employees not already covered under the current MOUs and correcting the holiday stipend payments to conform to CalPERS requirements.
BACKGROUND
With the incorporation of software for staff from email to workorder solutions, the need to either have access to perform these functions on their phones or the need to have a Two-Factor Authentication application was needed. The Holiday Stipends paid to non-traditional schedule positions was not in conformance to CalPERS requirements.
DISCUSSION
The Miscellaneous MOU had addressed only Public Works Field Staff for Cell Phone Stipends. The Firefighters MOU only addressed one employee for cell phones and had holiday stipends paid as lump sums. The Police Officer association had no stipends for cellphones an had holiday stipends paid as a lump sum.
Per labor law, if an employer requires use of a cell phone by an employee for business, the employee can either provide one or pay a stipend. Council agreed to paying a tiered stipend for cell phones, based on use and need, as identified by that employee’s department head. 5E

Holiday Stipends are considered a statutory special compensation benefit per CalPERS. As such, the pay must be reported in the period it is earned. Historically, the City had been paying as lump sums twice per year for Police and Fire, which does not comply with the requirements of CalPERS. The Unions and the City Council agreed to make this change.
Side letters addressing both issues were presented to the unions and language has been approved per each side letter.
FINANCIAL IMPACT
Cell phone stipends not already covered will increase the budget by $3,840 per year.

The Council needs to see and the public to be aware of the work done daily by hardworking staff. The Council should get these weekly reports as there are updates to give.
Administration Update
We met with UWPA to discuss drought contingency targets and responses that will be compiled into the City Drought Contingency Plan for the public hearing on November 15. Discussed the Greenhouse Gas Plan with Rincon, Sierra Business Council, the City, and County. Working on the following steps to firm up the plan. We discussed a workshop date with Citygate. Given the City wanting to keep the survey open until October 30, that pushes the ability to have a workshop into December. We are looking at Thursday, December 1, starting at 10 AM for a special meeting. The City has ordered new flags for downtown, and Tyra Dragomanovich with BHHS is working on getting volunteers set up to hang them.
In going through closeout for the Greenhorn Creek Bond, there is a remaining balance of nearly $1 million that the City needs to determine what to do with it. This will be a discussion and direction item on the November 15th meeting. I have sent several draft agreements to Legal, including an MOU between UWPA and the City and a relinquishment agreement for the SR49 sidewalks. The sidewalk project did not include landscaping per discussions with Caltrans that will be in a future project.
Landscaping options will be going to the Planning Commission. Given our new logo, I am working with a local (Calaveras)designer to clean it up a bit for more effortless reproduction and also design NEW business cards for when staff needs new ones. We have seven businesses enrolled for the Hop N' Shop with Frog Bucks. City staff called the first group of 15, and I hand-delivered fliers to an additional 15 8A

Same as last week
Public Works Update
This week staff concentrated on winter preparations, including brush removal in Angels Creek and cleaning out drainage ditches throughout the city. Staff also continued with vegetation management, including mowing the parks and tree removal on Utica Ln. Staff finished the repairs to the gate on Chicken Ladder. They also did some road patching on Birds Way, Fairview, and Angels Oaks subdivision.
Staff also had to repair the valve exercising equipment to get on track with annual valve exercises. Staff had forty-five meter rereads, twelve water shutoffs, four USA digs, and two work orders this week.
CITY HALL
CITY OF ANGELS PO Box 667, 200 Monte Verda St. Suite B, Angels Camp, CA 95222 P: (209) 736-2181 Water/Wastewater Update
Operations of the treatment plants and spray fields continue as usual. Staff completed repairs to the water line to the polymer system for the belt filter press and continued to work on repairs to the reclaimed water system. Thomas Chimente completed his Grade 2 wastewater exam this week and passed.
Building Update
A new administrative services specialist for building and planning was hired. Planning Staff continued updating the City's zoning and general plan land use designations and meeting with landowners in conjunction with the citywide rezoning for consistency with General Plan 2020. Staff also began researching locations of wells and private septic systems citywide, explored potential annexation areas, and finalized an amendment for the City's Building Code for consistency with state building codes.
Planning completed and released an RFP for consulting services to provide code updates for the All Hazards Planning Codes grant through CAL OES. Updates will address fire safety, flood hazards, stormwater runoff, grading, and emergency response and prepare or update guidelines as applicable.
Staff continued coordinating with Caltrans to finalize legal descriptions and property transfers associated with the Foundry Lane access off SR 4 (decertification).
Finance Update
Met with Dan Lewis of GHC LLD to talk about the process for submitting expenditures on the LLD. He shared some of his financial reports, and we planned to send him the monthly budget so he could process his reporting. Finalize the 21/22 Annual Street Report, and the State Auditor will submit the report. Continue to work on the year-end close with the auditor cleaning up old accounts and researching balances that have not changed in the prior year.

Administration Update
The Holiday Employee Committee met, and we have agreed to December 8th at 3:30 pm.
Representation from Police, Fire, Public Works, and Administration are all involved in trying to get the most involvement possible. We will be having the event at the Museum in the Carriage House. I met with HDL to discuss the next steps with the Shop Local program. We currently have 23 businesses signed up and will be going live with customer purchases of cards on November 7th. I met with Craig Pedro, County interim CAO. We discussed ways that the City and County could collaborate. He had a similar relationship with the City of Sonora when he was the Tuolumne County CAO. Animal Services, some Road discussions, and economic development were on topic. Craig and I have had a great working relationship in the past, and we are excited about the changes happening in the County that can help assist our residents and staff. Had a department head meeting. The most prominent topic was the present homeless issues from last week. The colder weather has caused many of them to seek shelter.
However, I have a call into Lee Kimball at the County to discuss ways we can better collaborate, given that this is a countywide issue and a severe drain on our limited resources. The City does not have a social services department. That is under the County. As such, we are extremely limited in what options we have to provide any response without being engaged with the County. I had the monthly UWPA JPA meeting. We coordinate mutual aid contracts, drought contingency plans, and grant opportunities. I 8B

Martin believes that the $15,000 for museum advertising could be retained by the City to go towards other economic/marketing programs that the City would want to engage in. We also discussed the CVB and ways that their marketing could be more closely aligned with the City's allocation from TOT. We discussed different things that would help with that and ways to move forward on some historical downtown projects that would bring more foot traffic.
