RE: Resolution 23-08 Authorizing the Purchase of APN 60-006-006 for the Utica Park Expansion and authorizing the City Administrator to sign, authorize and have recorded all relevant documents and agreements
RECOMMENDATION
Approve Resolution 23-08.
BACKGROUND
The subject property is identified in Figure 1. It totals 3.8± acres and adjoins Utica Park to the north. 6A
PLANNING
CITY OF ANGELS PO Box 667, 200 Monte Verda St. Suite B, Angels Camp, CA 95222 P: (209) 736-1346 The property was identified for the expansion of Utica Park under the Rural Recreation and Tourism grant awarded by the state to the City of Angels. It is expected to provide space for a parcourse/intepretive trail, amphitheater, Angels Creek trailhead, bocce courts, hardcourt, outdoor gym equipment, shade structures and associated amenities. The grant would fund 100% of the purchase price.
A Phase 1 environmental hazard assessment was prepared for the parcel and did not identify hazards that would preclude its use as a park. A commercial appraisal was conducted on the parcel by a Certified General (AG) appraisal and, per the grant requirements, a written concurrence was secured from a second Certified General (AG) appraiser.
At its September 20, 2022 meeting, the City Council, in closed session, discussed the item, reviewed the Phase 1 Assessment and appraisals and directed staff to make an offer on the subject property based on the documentation.
The seller accepted the City Council’s offer of $320,000. It is anticipated that up to $30,000 in contracting, taxes and escrow costs, will be required to complete the transaction. $400,000 was budgeted in the grant for the purchase. The purchase would be within the park expansion budget for the acquisition.
The site carries a general plan land use designation of and is zoned Historical Commercial.
FISCAL IMPACT
Acquisition will be funded entirely by the City’s Rural Recreation and Tourism Grant from the state. Total cost:
$320,000 purchase plus estimated contracting, taxes, and escrow fees of $30,000 for a total of $350,000.

RE: DISCUSSION AND APPROVAL OF A FEE WAIVER FOR THE VOLUNTEER CENTER OF
CALAVERAS BANNER
RECOMMENDATION
Approve a fee waiver for the Volunteer Center of Calaveras in the amount of $255.38 for City costs associated with installing and removing a banner. Gold Electric will donate the $270.00 it normally charges the City for banner installation/removal.
BACKGROUND
The Volunteer Center of Calaveras (Calaverasvolunteer.com) is requesting a waiver of City costs associated with installing and removing a banner promoting the non-profit’s Volunteer Center, available assistance, encouraging volunteerism, thanking the county’s volunteers, and promoting the February 11, 2023, Sweetheart Supper fundraiser. They are requesting a waiver given the community support programs they provide.
DISCUSSION
Per the current City fee schedule, banner installation and removal costs $525.38. Of this, $270.00 goes to Gold Electric for use of a bucket truck and operator. Gold Electric is waiving those charges to the City for this banner. The remaining $255.38 is for City staff time to set up signs, provide traffic control, and coordinate with Caltrans for the road closures required to install and remove banners. The Volunteer Center is requesting a waiver of the City portion of the City’s $525.38 fee.

Perhaps you or someone you know would like to give someone a ride to their doctor appointment, take someone to the post office or grocery store . . . maybe read the labels for them! Maybe you're up to changing a light bulb, or fixing a leaky faucet, tighten the screws in the front door so it closes, cut wood, clear weeds for fire defense, take someone to the Senior Center or to senior meals for an outing, make regular phone calls to check on a neighbor who is living alone, serve as a board member or as secretary or financial accountant, or . . .
The idea is to help our neighbors continue to reside safely in their own homes for as long as possible, and each do our part to prevent isolation. You will be forever grateful that you did! It's all about helping to identify issues, define solutions and make good decisions. It's all about quality of life. It’s all about community.
Should you or anyone you know need assistance, or wish to become part of the volunteer "safety net," please SIGN UP TO BE A VOLUNTEER then read more on the VOLUNTEER OPPORTUNITIES page. If you are in need of a volunteer, CLICK HERE to add your information to our database.

RE: OVERVIEW OF BROWN ACT CHANGES FOR 2023
RECOMMENDATION
Discussion of Brown Act changes impacting cities in 2023
BACKGROUND
The Brown Act is California’s “sunshine” law for local government. It is found in California Government Code beginning at Section 54950. Basically, it requires local government business to be conducted at open and public meetings, except in certain limited situations.
DISCUSSION
Several notable changes to public meetings are coming in 2023 thanks to new legislation that takes effect on Jan. 1 and the Governor’s announcement that the COVID-19 State of Emergency will end on Feb. 28.
Ending the state of emergency will restrain how cities can conduct remote meetings by limiting their ability to utilize AB 361 (Rivas, Robert), which is effective during a declared state of emergency.
Cities will now be left with pre-pandemic teleconferencing laws and this year’s AB 2449 (Blanca). These pre-pandemic laws include several outdated provisions, such as requiring members of a Ralph M. Brown Act body to make their teleconference location accessible to the public. Meanwhile, AB 2449 is limited in its scope and governed by onerous requirements.
Two other laws — AB 2647 (Levine) and SB 1100 (Cortese) — will also take effect on Jan. 1, which govern public meetings more generally.
New remote public meetings option
Asm. Rubio Blanca’s AB 2449 allows local agencies to hold remote public meetings without identifying each teleconference location and without making each location accessible to the public. This alternative option can only be used under limited circumstances and will expire on Jan. 1, 2026. 6C

Crucially, this measure may be used if “just cause” is met or if “emergency circumstances” exist. Just cause is defined as any one of the following:
• Child care or caregiving of a child, parent, grandparent, grandchild, sibling, spouse, or domestic partner that requires a member to participate remotely.
• A contagious illness that prevents a member from attending in person. • A need related to a physical or mental disability.
• Travel while on business of the legislative body or another state or local agency.
An emergency circumstance is a physical or family medical emergency that prevents a member of a legislative body from attending in person.
Under AB 2449, a member must notify the legislative body at the earliest possible opportunity — including at the start of a meeting — of their need to participate remotely and provide a general description of the circumstances related to one of the four items above. The member must make a request of the legislative body, which must approve the request.
A member may only use the just cause provisions up to two meetings per calendar year. A member may not participate in remote meetings under this law for more than three consecutive months or 20% of the agency’s regular meetings within a calendar year. If the legislative body regularly meets less than 10 times a year, a member may not participate remotely for more than two meetings.
The legislative body must request a general description of the circumstances relating to the member’s need to appear remotely. This description does not have to be more than 20 words and does not need to include any personal medical information.
The following rules also apply when meeting under just cause or emergency circumstances:
• Members participating remotely must do so through audio and visual technology. • The legislative body must provide a way for the public to remotely hear, visually observe, and remotely address the legislative body.
• The legislative body must provide notice of how the public can access the meeting and offer comment.
CITY HALL
CITY OF ANGELS PO Box 667, 200 Monte Verda St. Suite B, Angels Camp, CA 95222 P: (209) 736-2181 Home of the Jumping Frog - Angelscamp.gov
• The agenda must identify and include an opportunity for the public to attend and directly address the legislative body through a call-in option, an internet-based service option, and in-person at the meeting. • The legislative body cannot require comments to be submitted before the start of the meeting. The public must be allowed to make “real time” public comment.
• If there is a disruption to the meeting broadcast or in the ability to take call-in or internet-based public comment, no further action can be taken on agenda items until the issue is resolved. • The legislative body must implement a procedure for receiving and resolving requests for reasonable accommodations for individuals with disabilities and must give notice of these procedures.
Additionally, members participating remotely must publicly disclose at the meeting whether anyone else 18 years or older is present with the member and the general nature of the member’s relationship with the individual.
Supplementary materials and public meetings
Under the Brown Act, any documents that are distributed to a majority of a legislative body less than 72 hours before a meeting must be distributed to the public at the same time. To meet this requirement, some local governments posted these materials online. However, the Third District Court of Appeals recently held that this does not meet Brown Act’s requirements.
As a result, local governments had to place copies of the document in a designated office open to the public. This meant that agencies had to keep offices open past normal business hours or withhold latebreaking information until the next business day. This increased costs or caused delays in decisionmaking, as materials often need multiple days for analysis.
The Cal Cities-sponsored AB 2647 (Levine) seeks to resolve the issues created by this decision. This measure clarifies that supplementary materials distributed less than 72 hours before a meeting can be posted online if physical copies are made available for public inspection at the beginning of the next regular business day at a public office. These documents can also be made available at a designated location if the documents are made physically available for at least 24 hours before that meeting.

Disruptive conduct and public meetings
The last few years have seen a rise in disruptive and threatening behavior in public meetings. Lawmakers responded by passing SB 1100 (Cortese), a new process that allows a presiding member of a legislative body conducting a meeting, or their designee, to remove someone for disrupting the meeting.
SB 1100 prescribes the following process for removal:
• Warn the individual that their behavior is disrupting the meeting and their failure to cease their behavior may result in removal.
• Remove the individual if they do not "promptly" cease their disruptive behavior.
The bill defines disruptive behavior as that which disrupts, disturbs, impedes, or renders infeasible the orderly conduct of the meeting. This includes, but is not limited to:
• A failure to comply with reasonable and lawful regulations adopted by a legislative body pursuant to Section 54954.3 or any other law.
• Engaging in behavior that constitutes the use of force or a true threat of force. “True threat of force” means a threat that a reasonable observer would perceive to be an actual threat to use force by the person making the threat.
However, existing statutory and case law already specifies other avenues for addressing public meeting disruptions. Under existing law — and as interpreted by the courts — a city council may adopt rules governing the conduct of their public meetings, including the removal of a person who makes slanderous, profane, or threatening remarks or other disorderly conduct that disrupts the meeting.
Additionally, legislative bodies can adopt reasonable regulations to ensure that people can address a legislative body on any item of interest to the public. However, the legislative body may not prohibit public criticism of its policies, procedures, programs, or services.
City officials and their attorneys may want to consider — should a situation call for it — whether they want to remove disruptive individuals pursuant to a rule adopted under existing statutory and case law or follow the new SB 1100 process.

RE: NEWS AND NOTES FOR THE MONTH OF DECEMBER 2022
RECOMMENDATION
No action is required.
DISCUSSION
The Council needs to see and the public to be aware of the work done daily by hardworking staff. While Council has been getting these weekly staff will continue to report to the City Administrator more frequently and that will be summarized to City Council monthly. Additionally, we will start folding in Strategic Plan objectives and progress once the draft report gets adopted in January or February 2023 Administration Update
I attended the Caltrans D10 and CalCOG Partnership Meeting. I will be updating Council on the projects in our area, status, and next steps soon. We worked on the Staff Holiday Party. We had it at the Museum in the Carriage House. It was a fantastic night with quite a bit of turnout. Food was amazing and the decorations were magical! I met with CVB and A graphic artist to discuss options for downtown. We have a potential plan to create some buzz and get feet on the street (sidewalks) downtown that will help businesses in that area. I am working with Corebridge to change the Deferred Compensation plan to a Mutual Fund option as opposed to an Annuity. This would save the participants costs and realize more market returns. I verified that the early December storm did not cause any damages to claim under the state's initial damage assessment. Coordinating a meeting with the County after the holidays to discuss the housing issue regarding our homeless population. Hop N' Shop is going well.
People like it. The only complaint is they would like physical cards. CSG will have a Permit Technician helping us while Caytlyn is out. Edith Robles will also be identifying best practices within what we are doing to cleanup some processes to make them easier and more efficient. I had Dewberry get the valves and other water and sewer infrastructure made into a shapefile to upload into iWorQ. I have submitted the two projects to the Department of Water Resources for the Small Community Drought grant.
I prepared a full draft of the Police Officers Association MOU. 9A

Building and Planning coordinated for our transition with Caytlyn's maternity leave. Planning walked the Utica Park site with CCC a second time and has received a proposal for commencing site clearing. The Planning Commission held its 12/8 meeting and approved free standing solar panels in the parking lot behind the MACT building. Staff continues to meet with the Caltrans/COG/Dewberry team on monument signs in Angels Camp. The potential date for construction to begin in June 2023. Engineering continues reviewing the Habitat for Humanity submittals for infrastructure improvements.
Building and Planning continued processing building and planning permits with added assistance from CSG and staff in response to our assistant's absence on maternity leave. Staff received a proposal and contract from the San Joaquin County Office of Education Greater Valley Conservation Corps for removing vegetation and playground equipment in anticipation of the City's Utica Park Renovation and Expansion project and as necessary to meet grant deadlines associated with the proposed new playground. Staff visited the park and expansion area with certified arborists to evaluate trees in need of removal for safety and pruning for longevity. Staff began drafting an RFP for a design and build contractor for the playground (Phase 1) at Utica Park. Phase 2 will include the remainder of the project renovation and expansion (outside of the playground) - primarily funded by the state's Rural Recreation and Tourism Grant. Staff is coordinating with individuals that may have scheduled events in Utica Park after June 1st to earlier dates to avoid potential construction conflicts. The public is being urged to consider using Gateway Park or Tryon Park for events during Utica Park construction anticipated to commence after Frog Jump events are completed in May. Staff has been processing/reviewing the MACT Museum and Administration Building permit application and anticipates issuance near the end of 2022. Staff is compiling necessary documents in for the City's annual banner and Christmas decorations permit application from Caltrans. In the coming months, Planning/Planning Commission will be working to complete multiple code updates and rezonings to be completed by June 2023 due to grant funding deadlines associated with SB2 and LEAP Grants. These are expected to include extensive rezonings citywide in compliance with the General Plan 2020 Land Use Element and necessary to allow for development to proceed on individual parcels and streamlining processes and procedures in the development codes to assist in facilitating development applications and the provision of safe and affordable housing in compliance with General Plan 2020's Housing Element.
Finance Update
We are fully staffed with Kasey Douglas working full time and Taylor Wilden as our limited hire Accounting Tech working Tuesday, Thursday, and Friday. Taylor will be with us until she goes off to Chico State next Fall. Her help is much needed to help answers calls, help with customers at the front desk and scan documents into the system.
Andrea was out on vacation, and it was Caytlyn's last week until maternity leave. Caytlyn was a great help in training the new hires and getting them up to speed to handle the duties in the front office.
New employee training has been going very well and both employees are learning their new positions quickly. This is the first week that Caytlyn was out on maternity leave, so we have been setting up systems to provide coverage for building and planning customers. Submitted Local Transportation Fund audit request and will focus on mid-year invoices to various agencies in the coming week. Springbrook is now offering payroll and other services in Cirrus (new system). I am planning on reviewing some of the training materials online to see how we can move forward

The week was a busy, short week with the Holiday. Lots of training for the front desk with new hires in Accounting.
A lot of activity around business license renewals and cash receipts for Utility Billing. Submitted reports for CDBG to Adams Ashby and resubmitted final invoice to Caltrans for 49 sidewalks. Looks like all close out forms were accepted, and Rebecca Neilon is writing a letting to explain why the final report was late. We should have to Caltrans by the end of next week.
