RE: Angels Creek Trail Update
RECOMMENDATION
No recommendation at this time as this is an update on the Angels Creek Trail by Matt Satow with Dewberry
DISCUSSION
Council last received an update on the Angel Creek Trail in 2019. Since that time, efforts have continued, focusing on cultural and environmental studies and planning, all behind the scenes. Nearly three years since that last update, there are several new faces on the Council and the public isn’t aware that this project is still alive and moving head.
As planning studies have been occurring, staff have been focusing on future funding to go towards construction when the time comes.
This Class I Trail project implements the community’s goals developed in the Angels Creek Master Plan.
The Master Plan identified a vision for a citywide network of trails that connect the residential neighborhoods to the historic downtown and transit stops. Ultimately this trail will connect our community to the New Melones Reservoir and its full range of outdoor recreational activities.
Angels Camp is built around the congested SR 49, Main Street, and is currently the only corridor for people to travel from one end of town to the other. When complete, this trail will provide a nonmotorized option for residents and tourists.
The proposed improvements will improve safety, support climate resiliency, enhance economic competitiveness, encourage multi modal transportation, and further the City’s goals of environmental Sustainability.
By providing a safe and attractive facility for cycling, walking, and transit our community will finally be able to access the historic downtown core without their cars! Converting trips from motorized to nonmotorized modes will reduce Vehicle Miles Traveled (VMT), improve physical and mental health, and reduce air pollution.

RE: Disability Retirement- Steven Sanford
RECOMMENDATION
Adopt Resolution No. 23-41 authorizing the Industrial Disability Retirement of Police Officer Steven Sanford
DISCUSSION
Steven Sanford has filed an Industrial Retirement application with CalPERS. California Government Code Section 21156 requires that a local safety member shall be retired for disability upon the employer’s determination that the member is incapacitated physically or mentally for the performance of the usual job duties. CalPERS agency procedures require that such determination be made by Resolution of the governing body.
Under the Public Employees’ Retirement Law, disability is defined as the incapacity of a member from the performance of duty in public service for permanent or extended and uncertain duration as determined on the basis of competent medical opinion. Disability is not necessarily an inability to perform every function of a given position. Rather, the courts have concluded the test in any case is whether the employee can substantially perform the usual duties of the current position. Mr. Sanford held the position of police officer and has been determined by a Medical Examiner to be permanently disabled and unable to perform the duties of police officer.
Based upon the information available to us and the medical reports, staff believes that the findings and determinations as set forth in the attached Resolution are appropriate.
FINANCIAL IMPACT

RE: UPDATE TO COUNCIL PROHIBITIONS ON PERMIT AND CONTRACT APPROVALS
RECOMMENDATION
Discussion and education item regarding AB 1439 that limits Council’s approval on permits and contracts.
BACKGROUND
Council already has certain restrictions on making decisions where a conflict of interest exists. AB 1439 further includes campaign donations as the nexus to a conflict.
DISCUSSION
The Levine Act has to date, regulated campaign contributions for state officials and appointed local officials, e.g., Planning Commissioners, and limits covered officials’ ability to participate in governmental decisions related to those who donate more than $250 to a campaign. AB 1439 (Glazer, D-Contra Costa) extends the Act to local elected officials — City Council members and Special District Board members. Subject to some key exceptions, starting January 1, these officials cannot participate in approving a contract, license, permit, or other entitlement sought or opposed by a donor of more than $250 to his or her campaign in the 12 months before the decision.
The new prohibitions apply in three situations. First, local officials are prohibited from acting on a permit or contract if a donor of more than $250 to their campaigns within the past year is a party or a “participant” in the matter. One “participates’ merely by speaking at a public meeting. Second, local officials may not accept or solicit campaign contributions of more than $250 while a permit application or contract request is pending before their agency.
Third, these officials may not accept or solicit campaign contributions of more than $250 from any party or participant in a decision for a year after it is made. FPPC regulations apply 7E
CITY HALL
CITY OF ANGELS PO Box 667, 200 Monte Verda St. Suite B, Angels Camp, CA 95222 P: (209) 736-2181 Home of the Jumping Frog - Angelscamp.gov
the prohibitions to any land use permits and contracts, except competitively bid contracts, union and other labor contracts, or personal employment contracts, e.g., a City Manager’s contract.
The prohibitions apply if a campaign donor of more than $250 is directly involved in a decision, e.g., an applicant or contractor, but also if he or she speaks at a hearing. A financially interested participant under this law includes one who owns a home within 1,000 feet of a proposed land use who speaks at a hearing after donating $250 or more to one or more Council members’ campaigns. In that situation each Council member who received the donation must either disclose it and abstain, or commit to returning that part of it in excess of $50 within 30 days to participate in the decision.
The new law applies only to donations to a candidate-controlled committee not independent expenditures by non-candidate-controlled committees.
Applicants, contractors, and other participants must also disclose any contributions to Council or Board members of more than $250 in the past year. Agencies should consider adding the disclosure requirement to agendas, display it in meeting rooms, and on permit application and contract bid forms.
The FPPC adopted an opinion that SB 1439 does not apply retroactively to contributions made in 2022.

RE: NEWS AND NOTES FOR THE MONTH OF MARCH 2023
RECOMMENDATION
No action is required.
DISCUSSION
This is a monthly departmental staff report covering a month’s worth of activities to share.
Administration Update
The City is now included in two federally declared disasters. The first includes all aspects of assistance, including individual assistance. The second one is currently limited to public assistance and mitigation funding. I met with staff to discuss mitigation projects and started working with engineering on formulating those. Additionally, I worked with staff to ensure that ALL possible damages are identified and included in our assessments to CalOES and FEMA.
The Utica mine has an environmental issue that I am working feverishly with various state authorities to identify the next steps. I have also notified the property owner. In the meantime, the creek is closed until further notice and testing are being scheduled with State Water Resource Board as well as Fish and Game.
Met with staff to go over the next steps on the firehouse project. Our architect is continuing the P&E, using CDBG funding and we are preparing plans in order to proceed with grant funding for construction.
Sat on the selection committee meeting for the Utica Bathroom project and assisted on the preparation of Council information.

CITY OF ANGELS PO Box 667, 200 Monte Verda St. Suite B, Angels Camp, CA 95222 P: (209) 736-2181 I met with Engineering, Bret Harte staff, and City staff to do a site visit on Murphys Grade Road to discuss the water drainage issue that presented itself, post-construction during the storms. We are working on a solution that will be brought forward to Council for approval soon.
I am working with staff on getting updated financial information and soon budget schedules to begin developing the fiscal year 2023-24 budget.
Lastly, as the Deferred Compensation Plan Administrator, I updated the plan documents to allow more beneficial use of deferred compensation plan for the participants and am working with Valic to provide more education and assistance to employees of the City.

Water/Wastewater Update
Staff continues monthly O&M of the water treatment plant including daily lab samples, weekly equipment verifications, weekly distribution sampling, monthly alarm testing, and quarterly calibration of analytical equipment. Staff repaired the streaming current discharge equipment for the sedimentation basin, and repaired a malfunctioning chlorine pump this month. Staff continues monthly O&M of the wastewater treatment plant including daily lab samples, weekly calibrations and verifications of lab equipment, weekly belt filter press operations, and quarterly calibrations of analytical equipment. Staff have also been doing a lot of sprinkler repairs in the spray fields getting ready for the upcoming spaying season. Staff have also started vegetation management around the plant including brushing and weed control. The wet weather during this month created a few challenges in the operation of the plant including a hydraulic overload of the SBRs, increased cleaning of the IPS basin, and filter plug-ups creating turbidity issues. Staff has been monitoring the Utica Mine property water discharge 3 times a week as requested by the State Water Resources Control Board. All reports are complete and up to date.
Building Update
12 new permits were issued in March. One new residence, four solar permits, two re-roofs, two HVAC, one home addition, one demolition (on Summit) and one deck expansion. Staff distributed notices to landowners with pending rezones as part of the citywide rezoning. Most callers with questions were from Country Lane Estates. After discussing with staff, they are in agreement with the proposed rezoning to R-1:SP (SP replaces planned development). Staff also will be attending the Home Owner's Assn Meeting on 4/11/23 at Country Lane. Staff has also met with several larger and multiple property landowners - primarily those with pending rezones to Special Planning (SP). In response, a minor amendment is going before the Planning Commission and City Council in April/early May to add permitted uses to the SP zoning district. In March, staff drafted guidelines in accordance with state regulations establishing the City's procedures for implementing the California Environmental Quality Act (CEQA) and environmental reviews. These guidelines allow for transparency in the development process and predictability for developers. The City's Annual Housing Report was prepared and submitted to the

Staff has conducted ongoing coordination in hiring consultants for the Utica Park Expansion. As of 4/4, all consultants and contractors have been hired (Vegetaton removal, Playground, Park Renovation and Expansion and Bathroom). Vegetation removal has commenced. The County Sheriff's office requested and was granted the old playground equipment. Staff is contacting individuals/relatives of those with dedicated "monuments" in the park that may be disturbed (e.g., drinking fountain) to ensure that future plans for each are approved in advance of disturbance. Foundry Lane Access is pending recordation of a final 17 feet of property before appraisals begin. This is the last step before proceeding to the California Transportation Commission for an approved access off SR 4 at Foundry Lane. Planning and Fire Staff meet with the California Department of Forestry and Fire Protection regarding a review of the City's General Plan Safety Element and upcoming map revisions to the City's very high fire hazard severity maps. An update to the general plan Safety Element is anticipated to gain certification through the Board of Forestry. Special events permits were processed and/or issued for the Walk for Life (held in March), Earth Day (scheduled for 4/22), and the Frog Jump Youth Parade. The Junior Frog Jump and Fireman's Pancake breakfast are expected to be the final events held at the park before it is closed for renovation. Staff is continuing coordination with Interwest on the City's All Hazards Planning Codes updates, Calaveras COG on the County/City Climate Action Plan and Calaveras County Preparedness Plan, Caltrans/Dewberry on the Clean California frog monument signs, and Dewberry on finalizing the environmental document for the Angels Creek Trail. Final purchases have been made for upgrades to the Utica Park Kitchen (ice machine, meat slicer) per the City's Covid Relief Community Development Block Grant (CDBG). Final plans are being evaluated by engineers for banner poles at Utica Park (to replace over-the-highway banners) Ongoing projects include Habitat for Humanity (continuing with vegetation removal and nearing infrastructure plan approvals), and a possible commercial project behind Swendeman's.
Finance Update
During March Accounting/HR attended more discovery sessions with Springbrook Accounting Software to see how we can utilize the system better. Sessions on Utility Billing and Payroll were most helpful, and we began using some of the tools we learned about in the meeting. Accounting/HR staff is working in both Springbrook Enterprise (current system) and Cirrus (online enhanced system). Cirrus has a lot of bugs that need to be worked through, so we have been unable to complete a task from beginning to end in the new system. Feedback has been given to Springbrook for enhancements. City Hall Staff along with Fire watched a demonstration of the new Employee Self-Service portal which will allow staff to enter timesheets, view pay stubs/W-2’s, and make changes to address online for Payroll. We were

CITY OF ANGELS PO Box 667, 200 Monte Verda St. Suite B, Angels Camp, CA 95222 P: (209) 736-2181 happy with what we saw and will move forward with this enhancement. Payroll needs to be overhauled prior to rolling out but testing will begin soon for City Hall employees to work out discrepancies. We continue to clean up Springbrook’s chart of accounts and prepare for budgeting. Information has been sent to department heads and a meeting to provide SharePoint training occurred to help with the budgeting process. Greenhorn Creek LLD has met and started preparing its budget for FY 23/24, Michelle will be meeting with SCI and members of the LLD to finalize the budget for the Engineers’ report. Staff have been focused on updating/writing procedures on daily tasks and we are meeting monthly to plan activities and important due dates. Accounting has been doing a push to offer ACH payments to AP Vendors, saving postage and supplies for the City. We have received a good response and will continue to offer this as a form of payment. Our FY 21/22 Single Audit was submitted to the Federal Clearinghouse on March 31, 2023. Billings this month went out to CDBG CV1 for the Generator/Fence at Utica Park. Next month is a quarterly billing through March 31st and will include CalTrans DOT, CDBG Kitchen Bathroom and Firehouse, CalOES, and reporting for the Winter Storms.
Code Compliance
Code compliance has increased efforts to two days per week. The main concerns have been a focus on dangerous buildings (we have several) that continue to be used as housing units. Worked with the Police and the Building Inspector to inspect and notice. I have been reaching out to property owners and tenants working on solutions to get properties to comply.
