48. Adequate on-site turn-around area shall be provided for any gates or fencing installed at the beginning or end of a driveway. All gates shall be setback a minimum of 25 feet from the property line along Wilbur Avenue.
49. Gated entrances to the site shall include rapid access technology for Fire, Police and other emergency responders.
50. When the implementation of C.3 treatment and flow-control measures are required the following conditions shall apply:

RESOLUTION NO. 2019/142
September 10, 2019
a.
b.
Per Contra Costa Flood Control District and as shown on the hydrology map for Drainage Area 29G, the storm runoff from the project site drains to the 48" inch line at Wilbur Avenue. Before directing the project site's runoff upstream to the 24" line, a hydraulic analysis shall be conducted to verify that the line can adequately convey the additional storm water runoff. The analysis shall be reviewed by the Contra Costa County Flood Control District at no cost to the City and approved by the City Engineer.
The project shall connect to Line "A" in Drainage Area 29G for the purposes of flood control. The developer should perform a title search to determine if any drainage easement has been dedicated, and if not, shall obtain all easements necessary to connect to Line "A", at no cost to the City.
PHASE 1 IMPROVEMENTS (This phase provides for the use of the existing buildings (including tenant improvements), and minor improvements necessary to operate, such as on-site paving for parking, on-site lighting, street/driveway lighting, street landscaping, fencing, and security.)
51. The developer shall repair the existing driveway and pavement to the satisfaction of the City Engineer prior to the certificate of occupancy for any building in Phase
1. 52. Prior to issuance of a building permit, the developer shall revise the fencing and entry/access gates to allow for adequate vehicle storage and turnaround on-site).
53. All fencing at the property frontage needed to secure the dispensary building shall be installed prior to a certificate of occupancy for the dispensary.
54. Frontage landscaping and frontage lighting shall be provided. The developer may provide temporary private streetlights (in lieu of public street lighting) at the intersection of Wilbur Avenue and the east entrance to the project as approved by the City Engineer and defer public street lighting to Phase 2.
55. The developer shall approve the assignment of the County deferred improvement agreement to the City or execute a new agreement substantially the same as the existing recorded agreement.
PHASE 2 IMPROVEMENTS (This phase provides for the construction of any new buildings/structures and appurtenances and associated physical improvements.) I

RESOLUTION NO. 2019/142
September 10, 2019
56. Prior to issuance of certificate of occupancy for any portion of Phase 2, the developer shall dedicate additional right-of-way along the project frontage as necessary for the widening of Wilbur Avenue to accommodate a half-width section (within a 100-foot wide arterial roadway), to the satisfaction of the Director of Public Works. This will amount to an approximate 33.3' dedication by the developer/owner.
57. The developer shall determine the kV required for development of the entire project, and provide the City with a utility plan. If the voltage required is less than 12kV, the developer shall underground the utilities along Wilbur Avenue. If the voltage required exceeds 12kV, the City may approve deferral of overhead utilities after evaluating the utility work needed to provide additional power to the property, the cost, and the benefit of undergrounding overhead utilities on Wilbur Avenue.
58. Prior to issuance of a certificate of occupancy, the developer shall design and construct full frontage improvements unless a deferral is approved by the City Engineer. If a deferral is approved, a form of security or other approved mechanism to ensure the construction of frontage improvement shall be provided prior to. issuance of a building permit and as approved by the City Engineer.
Add;tional revisim1s to the deferral agreement may be imposed based on the proposed cons!ruction.
59. Full frontage improvements shall include: design and construction of left-turn pockets or a twoway !eft turn lane to provide access to driveways on Wilbur Avenue as required by the City Engineer. The developer shall apply for and obtain a County encroachment permit if necessary to accomplish this work. Additional frontage improvements shall include, but are not limited to: pavement widening, constructing barrier curb and sidewalk (consistent with existing development on the north side of Wilbur Avenue west of the proposed project at APN 051-031-020, with 1-foot wide curb cuts approximately 10 feet on center and 6-foot wide sidewalk), public street lighting, storm drainage, signing, marking and striping, and include transition pavement tapers, as required by the City Engineer.
60. The developer shall provide a study performed by a licensed traffic engineer and approved by the City Engineer demonstrating that the proposed driveway spacing is safe.
61. The widening of Wilbur Avenue shall include roadside C.3 bio-retention, or other appropriate green infrastructure, between curb and sidewalk to provide for the treatment of stormwater runoff from the public street, to the satisfaction of the City Engineer. The C.3 treatment facility and all pipes connecting it to public facilities shall be maintained by the property owner.
D21
RESOLUTION NO. 2019/142
September 10, 2019
62. Prior to a certificate of occupancy for this phase, the developer shall annex into I Street Light and Landscape Maintenance District 2A Zone 3 and accept a level of annual assessments sufficient to maintain public street lights and landscaping.
The annual assessment shall cover the actual annual cost of maintenance as described in the Engineer's Report.

Request
• Use Permit to allow a Type 7 Volatile
Manufacturing License at the existing Contra
Costa Farms Cannabis Business
• Type 7 is the California Cannabis Control license
type for manufacturing cannabis products using a
volatile solvent, such as butane or propane, that
produce a flammable gas or vapor
Background
• The City of Antioch first adopted an ordinance
allowing cannabis businesses in 2018 and has been
amended since, including additional overlay areas
• The ordinance requires Use Permits for cannabis
businesses be approved by City Council
• The project site is within Cannabis Overlay District
1, which allows Type 7 licenses in single tenant
buildings
Site History
• In 2019, the City Council approved the Contra Costa
Farms Cannabis business
• The approvals allowed for cultivation, non-volatile
manufacturing, distribution, and a retail dispensary
• The ultimate build out of the project was proposed
for two phases – including new construction in the
second phase
• The proposed use would occupy an existing building
at the site, which is in the first phase
Recommendation
• The Planning Commission recommends that the
City Council approve the Use Permit to allow a Type
7 volatile manufacturing license
• The included recommended conditions of approval
in the resolution require compliance with the original
conditions of approval, including conditions related
to security and odor mitigations

RECOMMENDED ACTION
It is recommended that the City Council introduce and waive the first reading of an Ordinance of the City Council of the City of Antioch Amending Sections 3-4.02, 3-4.03, 3-
4.10, 3 -4.11, 3- 4.22, 3-4. 24, and 3- 4.25 of the A ntioch M unicipal C ode C oncerning Purchasing.
FISCAL IMPACT
There is no fiscal impact associated with this action.
DISCUSSION
The City’s Purchasing Ordinance, which appears at C hapter 4 of T itle 3, of t he Antioch Municipal Code governs t he process by w hich the City se cures goods and services. It does so, among other things, by specifying the authorities by which goods and services may be acquired depending on the values of the respective services or goods.
The provisions affected by the proposed ordinance, which principally concern the thresholds for administrative and City Council approvals, have not been amended since 2010. The ordinance would update these thresholds by modernizing the now 15-year old thresholds. Specifically, for general contracts and services, the ordinance would:
• Increase the lowest department contract authority —which may be exercised by a department head or designee—to $15,000 from $5,000; • Increase the department head contract authority to $50,000 from $15,000;
• Increase the City Manager’s contract authority to $100,000 from $50,000; and
Antioch City Council Report
December 9, 2025 Agenda Item #8 2
• Require City Council approval for all contracts over $100,000.
For public works contracts, the ordinance would:
• Increase the lowest department contract authority —which may be exercised by a department head or designee—to $10,000 from $5,000; • Increase the department head contract authority to $75,000 from $10,000;
• Increase the City Manager’s contract authority to $220,000 from $76,000; and
• Require City Council approval for all contracts over $220,000.
Public Works contract thresholds are being increased to conform with the California Uniform Construction Cost Account Act, the procedures set forth in the Act, and to the California Uniform Public Construction Cost Accounting Commission’s policies and procedures, of which the City is subject to. The ordinance would also make technical changes concerning appeals to conform to the City’s current organizational structure.
City Administration recommends the increases in these thresholds to ensure the City may more effectively and efficiently administer its purchasing processes. The current thresholds—which as noted, have been in place for a decade and a hal f—require many routine purchases and services to come forward for City Council approval. The preparation for placement of these routine contracts on the agenda consumes scarce Administration time and resources and increases the volume of routine matters that are included in City Council agenda packets —almost always on the Consent Calendar.
These contracts are already considered and incorporated into department budgets the City Council approves in its Annual Budget. The City Council through its budget process necessarily exercises fiscal oversight over the expenditures that would be shifted to department or management-level approvals.
In short, any marginal benefit of maintaining the current contract thresholds would be greatly outweighed by the benefit that would be created if D epartment heads and City Administration could shift some of their agenda-item preparation time to project and policy implementation. In this regard, there would be a significant opportunity cost in not approving the ordinance.

SUBJECT: Introduction and Waiver of First Reading of an O rdinance Concerning the City’s Process for Payment of Demands Against the City (“Warrants”)
RECOMMENDED ACTION
It is recommended that the City Council introduce and waive the first reading of an Ordinance of the City Council of the City of Antioch Amending an Ordinance Concerning the City’s Process for Payment of Demands Against the City (“Warrants”).
FISCAL IMPACT
There is no fiscal impact associated with this action.
DISCUSSION
The Antioch Municipal Code is current silent regarding the process for approval of City warrants. The City’s practice for many years has been to include lists of recently paid warrants as Consent Agenda items on City Council agendas. T hese lists have been presented for informational and transparency purposes. Government Cod e Section 37209 allows ratification of warrants or checks by the City Council after they have been paid if the City Clerk has certified that payments made conform to a budget approved by ordinance or resolution. These duties may be transferred to the Finance Director if explicitly allowed by ordinance. Government Code Section 37208 allows ratification of payroll warrants or checks to be approved in the form of an audited annual comprehensive financial report. While this is the actual working practice for warrants and checks, the City’s municipal code needs to be updated to memorialize the practice in conformance with Government Code Sections 37208 and 37209.
The proposed ordinance would amend the City’s warrant process by amending Section 3-2.01 of the Antioch Municipal Code. The ordinance would enact a new process as follows:
• Upon receiving warrants for payment, the Finance Director will ensure the invoice or purchase order to be paid conforms to the adopted Budget or an adopted resolution;
Antioch City Council Report
December 9, 2025 Agenda Item #9 2
• Upon conformation an item conforms to the Budget or resolution, it will be presented to the City Council for ratification at the next City Council meeting; and
• Budgeted payrolls paid by warrant or check would be presented to the City Council in the form of an annual comprehensive financial report.
City Administration, along with the need to reduce administrative burden, and enhance operational fidelity, strongly recommends and supports this proposed process as it is the current and past practice and allowed per Government Code. If warrants or checks were required to be reviewed and approved by City Council prior to payment, this would result in significant payment delays and late fees for past due invoices. The process for payment of invoices falls within the administrative duties of City departments under the City Manager’s authority.

A 2025/26 General Fund budget amendment may be required if the full $750,000 becomes due prior to June 30 th. In addition,
previously presented projections for the General Fund include the $1.2M annual subsidy unless other funding sources can be identified.
DISCUSSION
On November 18, 2025, the State Department of Housing and Community Development (HCD) provided a letter (see Attachment D) to the City and co-applicant (CSH Mahogany) requesting that modifications be made to the previously adopted resolution for the HomeKey+ project in the City. The attached amended and restated resolution (see Attachment A – Proposed Resolution in “Clean” version and Attachment C – “ Redline” version) respond specifically to HCD’s requested changes in their letter, listed as items No. 1.a.i – wherein HCD asks for a resolution to follow their “template”. Text in red is new language. Blue text has been omitted from originally approved resolution. The text in blue

has been incorporated in the amended and restated version of the resolution. Note: The HCD letter incorrectly states that the “Eligible Applicant” is the “County of Santa Barbara” and not the City of Antioch. The requested “Template” for HCD’s purposes i s found in Attachment E.
CEQA
The proposed act ivity of adopting a n amended and restated resolution for submitting a joint application to HCD for a HomeKey+ project is "not a project" under the California Environmental Quality Act (CEQA) as the adoption of the resolution does not have the potential to cause a direct or reasonably foreseeable indirect physical change in the environment.

Authorizing Resolution Template for Applicant with Co-Applicants
NOTICE AND INSTRUCTIONS
1. Notice
. Pur
suant to the Homekey+ Notice of Funding Availability (NOFA) Section 300. vi. (a), Homekey+ applications must include a duly executed resolution authorizing the entity to apply for funds and to participate in the Homekey+ Program. The California Department of Housing and Community Development (HCD) is providing this Authorizing Resolution template as informational guidance only. HCD encourages each Applicant to consult with professional legal counsel during the development of its own formal, legally binding statement that it is authorized to apply to and participate in the Homekey+ program. i. Please note, however, that any limitations or conditions on the authority of the signatory or signatories to execute the Application or the Homekey+ Documents (as defined) may result in HCD rejecting the Authorizing Resolution.
2. Accuracy, Verification. HCD will verify that this Authorizing Resolution comports with the legal authority and composition of Co-Applicant’s governing body. Co-Applicant must timely notify HCD, in writing, of any factors that limit its ability to provide an Authorizing Resolution which is materially in line with this template.
3. One Resolution per Project. A Resolution that includes multiple projects under one Resolution will not be accepted. Applicants and Co-applicants must submit a Resolution for each discrete Project.
4. Applicants and Co-Applicants. Include all Applicants and Co-applicants identified on the application. If the Resolution does not include all Applicants and Co-Applicants HCD will require a new Authorizing Resolution.
5. Anticipated Grant Award Dollar Amounts. HCD recommends seeking authorization for a higher dollar amount than the anticipated grant award since award amounts are subject to change. If Applicant is awarded an amount larger than the amount authorized in the Authorizing Resolution, HCD will require a new Authorizing Resolution.
6. Authorized Signatory or Signatories, Designee. Co-Applicant, as a state, regional, or local public entity, may designate an authorized signatory by title only. In addition, Co-Applicant may authorize multiple signatories, so long as there is clarifying language in the resolution(s) as to whether the signatories are authorized to execute the Homekey+ Documents individually or collectively. In addition, Co-Applicant may authorize a designee of the authorized signatory to execute the Homekey+ Documents. In such case, Co-Applicant must append a supporting document (e.g., memorandum, meeting notes of official action), which indicates the name and title of the designee who is authorized to legally bind the governing body.
7. City Mayor as Authorized Signatory. CA Government Code 40602 requires that the mayor of California cities must sign all contracts unless a city ordinance is in place that identifies a different individual as the Authorized Signatory for the city.
8. Vote Count. Please fill out the field by every voting category (i.e., Ayes, Nays, Abstain, Absent).
If none, please indicate zero (0) for that field. The vote count must comport with the legal authority and membership of Co-Applicant’s governing body.

STAFF REPORT TO THE CITY COUNCIL
DATE: Regular Meeting of December 9, 2025
TO: Honorable Mayor and Members of the City Council
SUBMITTED BY: Derek P. Cole, Interim City Attorney DC
SUBJECT: Selection of the Mayor Pro Tempore for the 2026 Calendar Year
RECOMMENDED ACTION
It is recommended that the City Council select its Mayor Pro Tempore for the 2026 calendar year.
FISCAL IMPACT
There is no fiscal impact associated with this action
DISCUSSION
Government Code § 36802 states that the mayor shall preside at the meetings of the City Council. If the mayor is absent or unable to act, the mayor pro tempore shall serve until the mayor returns or is able to act. The mayor pro tempore has all of the powers and duties of the mayor.
Antioch Municipal Code § 2- 1.403 states that the mayor pro tempore shall have all the duties and responsibilities specified in the California Government Code. Pursuant to California Government Code § 36802, the mayor pro tempore serves in the absence of the mayor or if he is unable to act until the mayor returns or is able to act. During such time, the mayor pro tempore has all of the powers and duties of the mayor. However, pursuant to California Government Code § 34902, in the case of a vacancy in the off ice of the mayor for any reason, the City Council shall fill the vacancy by appointment, or by calling an election as specified in that provision. (AMC § 2-1.403)
On June 23, 2020, the City Council adopted an ordinance amending Sections 1.401 and
1.402 of Title 2 of the Antioch Municipal Code revising the selection process and term of office for mayor pro tempore (“Ordinance”). The selection process under the ordinance reads as follows:
§ 2-1.401 SELECTION.
(A) At the first City Council meeting following each general municipal election, or at the first City Council meeting of December during every odd year commencing Antioch City Council Report
December 9, 2025 Agenda Item #11 2
in 2021, the City Council shall designate one of its members to be mayor pro tempore.
(B) The City Council shall select the mayor pro tempore as follows:
(1) The council member who has not previously served as mayor pro tempore shall be selected. If more than one council member has not previously served as mayor pro tempore, the City Council shall select the member who received the highest percentage of votes from his or her district in the most recent general municipal election at which the council member was elected. If the selected council member declines, the City Council shall select the next council member who has not previously served and has the next highest percentage of votes from his or her district.
(2) If all council members have previously served as mayor pro tempore, or if the council members eligible in accordance with subsection (B)(1) decline, the City Council shall select the council member who received the highest percentage of votes in his or her district in the most recent general municipal election at which the council member was elected. If the selected council member declines, or if the council member would serve two consecutive years if chosen, the City Council shall select the member wit h the next highest percentage of votes from his or her district in the most recent general municipal election at which the council member was elected.
The following council members have previously served as mayor pro tempore:
• Louie Rocha (appointed December 10, 2024)
• Monica E. Wilson (appointed December 12, 2023)
• Tamisha Torres-Walker (appointed December 13, 2022)
The only member of the City Council who has not served as Mayor Pro Tempore is Councilmember Freitas, elected in 2024. Councilmember Freitas is accordingly eligible to serve as Mayor Pro Tempore unless he declines.
Pursuant to Antioch Municipal Code § 2- 1.401(B)(2), if the councilmember eligible to serve as Mayor Pro Tempore declines, the City Council shall select the council member who received the highest percentage of votes in his or her district in the most recent general municipal election at which the council member was elected. Attachment A to this staff report contains the December 4, 2024 City of Antioch City Council election results.
Louis Rocha received the highest percentage of votes in his district in the most recent general municipal election at which the council members were elected (“Attachment A”).
But because he would serve two consecutive terms, the selection would follow to Councilmember Freitas, the other member of the City Council who stood for election in 2024.
However, if Councilmember Freitas declines, then under § 2 -1.401(B)(2), the Council would look to 2022 election results to determine the next eligible Councilmember. That person would be Monica E. Wilson.

DISCUSSION
Warming Center Options for Cold Weather Activation
Contra Costa County opens warming centers during severe cold spells based on National Weather Service (NWS) criteria, which specify predicted temperatures at or below 32 degrees for three straight days. One activated, City Staff will work Contra Costa County to ensure the community is notified in advance when County -operated warming centers are scheduled to open. While the County has confirmed it will activate centers during qualifying conditions, it does not seem that any specific locations are identified in East Contra Costa County, specifically in Antioch.
Staff has reached out to multiple local churches in the last month to check to ascertain whether any were offering warming centers to the public. None were found to operate public warming centers. However, one church in Antioch has recently expressed willingness to activate a warming center if the City provided funding for staffing, supplies, and operations. Another option is for the City to work with local faith-based organizations to jointly explore partnership models, shared-resource approaches, or cost -sharing options, which might be more sustainable than a City-operated center.
One possibility that can be considered is for the City of Antioch to operate its own warming center based on activation criteria established by the Council, such as when temperatures fall below 40 degrees or other local thresholds. However, this option is not recommended due to staffing limits and high estimated costs. All responsibilities would be managed through overtime, with estimated nightly expenses ranging from $3,500 to $4,500.
Antioch City Council Report
December 9, 2025 Agenda Item #12
If the City were to pursue a stand -alone warming center, any potential location would need to meet core operational and safety requirements, including:
• Appropriate liability insurance;
• Accessible restrooms;
• Phone service for emergency communications;
• Accommodation considerations for individuals with children and pets; • Secure storage of personal property during operating hours; • Sufficient space and equipment for set -up, sleeping/rest areas, and supervision; and
• Adequate time and resources for cleaning and breakdown after closure.
Staff is seeking City Council direction on preferred next steps, including:
• Whether to rely on Contra Costa County’s warming center program exclusively; • Whether to pursue partnerships with churches or community organizations; and:
• Whether further evaluation of a City -funded warming center is desired despite staffing and cost constraints.
