SUBJECT: Resolution Appointing a City Clerk and Canceling the General Municipal Election for City Clerk Scheduled for November 3, 2026 ______________________________________________________________________

RECOMMENDED ACTION

It is recommended that the City Council adopt a resolution:

1. Appointing Michael J. Mandy as City Clerk; and

FISCAL IMPACT

The City Clerk’s General Fund budget includes a total of $140,000 for the November 3, 2026, General Municipal Election. The County Elections Office estimates the cost of the election to be $2.50 to $4.50 per registered voter.

The City of Antioch has 67,226 registered voters; however, the final election cost will depend on voter turnout. Voter turnout is historically less than the total registered, and the cost also depends on how many at-large and district seats are part of the election.

General Municipal Election costs for the two district seats and City Clerk are LPS

demonstrated in Attachment C. Based on the City’s adopted budget, and assuming a 66% voter turnout, savings are estimated to be between $44,720 and $87,726, dependent upon the final cost per voter determined and voter turnout. The final cost will not be known until after the election.

BACKGROUND

Resolution No. 2026/098 was adopted by the City Council on June 23, 2026, calling a General Municipal Election to be held on November 3, 2026, to elect an at-large City Clerk. DISCUSSION

On August 17, 2026, pursuant to California Elections Code § 10229, a “Certification That There Are Not More Candidates Than Offices To Be Elected” was forwarded to the members of the City Council by the City Clerk. In accordance with the Elections Code, a notice of these facts was published in the City’s newspaper of general circulation on August 15, 2026, for at least five days prior to this meeting.

Under these circumstances, the City Council may either appoint the nominated candidate and cancel the election or direct that the election nonetheless be held. If the election is not canceled, the Office of the City Clerk will accept write-in candidates during the period of September 7, 2026, through October 20, 2026.

If the City Council chooses to appoint the nominee and cancel the election for City Clerk, it is appropriate to direct the Mayor to present the appointee with a Certificate of Appointment and swear him into office; with the official term beginning November 4, 2026, after the November 3, 2026, General Municipal Election.
