Town Council Agenda Report
Date: April 12, 2022
To: Honorable Mayor and Town Council
Subject: ADOPT RESOLUTION OPPOSING INITIATIVE 21-0042A1, THE

TAXPAYER PROTECTION AND GOVERNMENT ACCOUNTABILITY
ACT
From: Douglas Robertson, Town Manager
Submitted by: Julie Ryan, Special Projects Manager
Town Manager
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
Adopt Resolution No. 2022-10 opposing State Ballot Initiative 21-0042A1, The Taxpayer Protection and Government Accountability Act.

BACKGROUND
In 2018, the “Tax Fairness, Transparency and Accountability Act” (California Attorney General File #17-0050 amdt. #1), was being circulated to qualify for the November 2018 ballot. This initiative would have drastically limited local revenue authority.

Through the successful work and advocacy of the League of California Cities (Cal Cities) and its coalition, the measure’s proponents withdrew the initiative from the ballot in June 2018. On Jan. 4, 2022, the California Business Roundtable filed the Taxpayer Protection and Government Accountability Act, Attorney General File # 21-0042A1. This measure is far more detrimental to cities than the measure filed in 2018, because it would decimate vital local and state services to the benefit of wealthy corporations.

Cal Cities, along with a broad coalition of local governments, labor and public safety leaders, infrastructure advocates, and businesses, strongly oppose this initiative, which would limit voters’ authority, adopt new and stricter rules for raising taxes and fees, and make it more difficult to hold violators of state and local laws accountable.

ANALYSIS
This initiative has been noted by Cal Cities to do the following:

Page 40 of 70 ends

Limit voter authority and accountability
 Limits voter input. Prohibits local voters from providing direction on how local tax dollars should be spent by prohibiting local advisory measures.  Invalidates the Upland decision that allows a majority of local voters to pass special taxes. Taxes proposed by the Initiative are subject to the same rules as taxes placed on the ballot by a city council. All measures passed between January 2022 and November 2022 would be invalidated unless reenacted within 12 months.

Restrict local fee authority to provide local services
 Impacts franchise fees. Sets new standard for fees and charges paid for the use of local and state government property. The standard may significantly restrict the amount oil companies, utilities, gas companies, railroads, garbage companies, cable companies, and other corporations pay for the use of local public property. Rental and sale of local government property must be “reasonable” which must be proved by “clear and convincing evidence.”  Except for licensing and other regulatory fees, fees and charges may not exceed the “actual cost” of providing the product or service for which the fee is charged. “Actual cost” is the “minimum amount necessary.” The burden to prove the fee or charge does not exceed “actual cost” is changed to “clear and convincing” evidence.

Restrict authority of state and local governments to issue fines and penalties for violations of law
 Requires voter approval of fines, penalties, and levies for corporations and property owners that violate state and local laws unless a new, undefined adjudicatory process is used to impose the fines and penalties.

Restrict local tax authority to provide local services
 Requires voter approval to expand existing taxes (e.g., UUT, use tax, TOT) to new territory (e.g., annexation) or expanding the base (e.g., new utility service).  City charters may not be amended to include a tax or fee.  New taxes can be imposed only for a specific time.
 Taxes adopted after Jan. 1, 2022, that do not comply with the new rules, are void unless reenacted.
 All state taxes require majority voter approval.
 Prohibits any surcharge on property tax rate and allocation of property tax to state.

Other changes
 No fee or charge or exaction regulating vehicle miles traveled can be imposed as a condition of property development or occupancy.

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN

OF APPLE VALLEY, CALIFORNIA, OPPOSING THE

TAXPAYER PROTECTION AND GOVERNMENT
ACCOUNTABILITY ACT (AG# 21-0042A1)
WHEREAS, an association representing California’s wealthiest corporations and developers is spending millions to push a deceptive proposition aimed for the November 2022 statewide ballot; and
WHEREAS, the measure includes undemocratic provisions that would make it more difficult for local voters to pass measures needed to fund local services and infrastructure, and would limit voter input by prohibiting local advisory measures where voters provide direction on how they want their local tax dollars spent; and WHEREAS, the measure creates new constitutional loopholes that allow corporations to pay far less than their fair share for the impacts they have on our communities, including local infrastructure, our environment, water quality, air quality, and natural resources; and WHEREAS, the measure makes it much more difficult for state and local regulators to issue fines and levies on corporations that violate laws intended to protect our environment, public health and safety, and our neighborhoods; and
WHEREAS, the measure puts billions of dollars currently dedicated to state and local services at risk, and could force cuts to public schools, fire and emergency response, law enforcement, public health, parks, libraries, affordable housing, services to support homeless residents, mental health services, and more; and
WHEREAS, the measure would also reduce funding for critical infrastructure like streets and roads, public transportation, drinking water, new schools, sanitation, utilities, and more.

NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF APPLE VALLEY AS FOLLOWS:

Section 1. That the Town Council opposes Initiative 21-0042A1.

Section 2. That the Town Council will join the NO on Initiative 21-0042A1 coalition, a growing coalition of public safety, labor, local government, infrastructure advocates, and other organizations throughout the state.

Section 3. That the Town Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.

For good cause shown, and finding a waiver will serve a public purpose, approve the waiver of the rental fees for the James Woody Auditorium in the amount of $164.00 for the Pro Bono Legal Clinic in honor of “Law Day”.

BACKGROUND
On 8-14-01, the Town Council adopted a policy stating fees can be administratively waived for a local public agency, a utility company or service district, or a similar entity providing an essential service to the general community, whereas non-profit requests for fee waivers must go before the Town Council for consideration.

March 17, 2022
Dear Mayor Kari Leon & Town Councilmen,
On Saturday, May 21, 2022, The Church for Whosoever will be hosting an Outreach at the Civic Center Park in Apple Valley from 10:00am to 1:00pm. We are requesting a waiver for the amount that will be charged to us for using your facilities. The amount is $912.00 totalfor our event.

For the last 26 years, our church has had the privilege of hosting this charitable outreach in the Apple Valley community and every year the needs get greater and greater. At each event, many people benefit by receiving food, clothing, haircuts, bikes and bibles, all at no charge. All donations are given by our congregation and 2 other churches in the area, along with local businesses who also donate their time and services to help us serve this low income and high crime area. Our target area is the "Mountain Vista" area, behind the Target Shopping Center on Hwy 18.

We host this event only twice a year and have built relationships with the people in these areas, many of whom are children. OurOutreach goes beyond giving out free things, we also pick up many of the children in that area and bring them to church for Sunday School. We meet the physicaland spiritualneed of these families. We believe this is very important because if we can reach one heart, we can reach one family and ultimately a communityl
We hope that you willconsider waiving our fee of $912.00 We would also like to invite you to attend this event. This is a community outreach and it would be an honor to have one of you come out and see first-hand what takes place. Please consider our invitation.

God bless you and thank you,

BACKGROUND
After multiple fires and, subsequent abandonment, the house, which was once used as an entertainment and conference center, has fallen into disrepair. It was ultimately, condemned by Town officials and a contract engineering firm in 2016. Due to the condition of the property Town Council has approved the demolition of the Hilltop House.

The intent of the completed Hilltop House project is to demolish, design and reconstruct.

Staff intend to work with a qualified design firm to preserve the look and feel of the original structure and provide additional open space for residents to enjoy.

ANALYSIS

RESOLUTION

From: Douglas Robertson, Town Manager
Submitted by: Thomas Rice, Town Attorney

RECOMMENDED ACTION
Town Council to discuss the relative merits of the Tan Map and Map 101 and to adopt either:
(1) RESOLUTION NO. 2022-11 (A) – A RESOLUTION OF THE TOWN COUNCIL OF

THE TOWN OF APPLE VALLEY, CALIFORNIA, ADOPTING THE PROPOSED MAP 101 AS THE REDISTRICTING MAP FOR THE TOWN OF APPLE VALLEY PURSUANT TO ELECTIONS CODE SECTION 21600 ET SEQ.; AND APPLE VALLEY MUNICIPAL CODE SECTION 2.04.140 (C)
OR
(2) RESOLUTION 2022-11 (B) A RESOLUTION OF THE TOWN COUNCIL OF THE

TOWN OF APPLE VALLEY, CALIFORNIA, ADOPTING THE PROPOSED TAN MAP

AS THE REDISTRICTING MAP FOR THE TOWN OF APPLE VALLEY PURSUANT TO ELECTIONS CODE SECTION 21600 ET SEQ. AND APPLE VALLEY MUNICIPAL CODE SECTION 2.04.140 (C)

BACKGROUND
In 2019, in response to a threat of litigation under the California Voting Rights Act and like many jurisdictions throughout the state, the Town transitioned from an at-large to a five member by-district election system. The Town did so after a lengthy public outreach process, which included holding five public hearings and a workshop. The Town is presently divided into five districts, which were based on the following factors:
 Geography
o Use major roadways as dividing lines

Page 52 of 70 ends

o Consider future growth areas
 Communities of Interest
o Attempt to keep distinct communities together
o Attempt to place some commercial property in every district o Attempt to place some parks or open space in every district o Attempt to split the North Apple Valley Industrial Specific Plan (NAVISP) so a single council member is not responsible for the entire area
 Cohesiveness, Contiguity, Integrity, and Compactness of Territory  Accept that it will be natural for their to be a wide variation in district size due to lack of density in various parts of Town
 Do not prioritize trying to make districts the same size in area terms In November 2020, the Town held its first by-district elections. Districts 1 and 2 were the subject of the election.

On January 11, 2022, the Town Attorney provided an update on the redistricting process.

At that meeting, the Town Council requested the Town Attorney provide the Town Council with an opportunity to consider a transition to a “4+1” system with an at large Mayor. On January 24, 2022, the Town entered into a contract with National Demographics Corporation (NDC) to perform redistricting services, including the drawing of maps.

On February 8, 2022, the Town Council held its first redistricting hearing and received a presentation from NDC on the appropriate criteria for consideration. The Town Council discussed and deliberated on a proposed ordinance to transition to a “4+1” system with an at large Mayor. At the conclusion of the hearing, the Town Council chose to introduce two ordinances in order to facilitate further public input on the possible transition. One ordinance would leave the Town Council with five districts; the other would transition to a “4+1” system with an at large Mayor. Both ordinances would have permitted the Town Council to adopt new maps by resolution.

On February 22, 2022, the Town Council adopted Ordinance No. 549(A) transitioning the Town from a system with five single member council districts to a “4+1” system with an at large Mayor elected every two years.

Following the decision on February 22, the Town’s redistricting consultant prepared three draft maps dividing the Town into four districts. Those maps were posted by the Town on March 1.

The Town Council held two public hearings on the draft maps, including additional maps submitted by the public, on March 8 and March 22. After reviewing and discussing the available maps, at the March 22 Town Council meeting, the Town Council narrowed its

Page 53 of 70 ends

choices to two maps: the Tan Map (a consultant prepared map); and Map 101 (a map submitted by a member of the public).

DISCUSSION:

Redistricting
Every ten years, cities with by-district election systems must use new census data to review and, if needed, redraw district lines to reflect how local populations have changed.

This process, called redistricting, ensures all districts have a nearly equal population. The redistricting process for the Town of Apple Valley must be completed by April 17, 2022.

The Town’s districts must now be redrawn using the 2020 census data and in compliance with the FAIR MAPS Act, which was adopted by the California legislature as AB 849 and took effect January 1, 2020. Under the Act, the Town Council shall draw and adopt boundaries using the following criteria in the listed order of priority (Elections Code 21621(c)):

1. Comply with the federal requirements of equal population and the Voting Rights Act;

2. Be geographically contiguous;

3. Undivided neighborhoods and “communities of interest” (socio-economic geographic areas that should be kept together);

4. Display easily identifiable boundaries;

5. Be compact (do not bypass one group of people to get to a more distant group of people); and

6. Shall not favor or discriminate against a political party.

Once the prioritized criteria are met, other traditional districting principles can be considered, such as:

1. Minimize the number of voters delayed from voting in 2022 to 2024;

2. Respect voters’ choices/continuity in office; and

3. Future population growth.

By law, the Town must hold at least four public hearings that enable community members to provide input on the drawing of district maps:
 At least one hearing must occur before the agency draws draft maps;  At least two hearings must happen after the drawing of draft maps (the fourth hearing can happen either before or after the drawing of draft maps); and  Agency staff or consultants may hold a public workshop instead of one of the required public redistricting hearings.

To increase the accessibility of these hearings, the Town must take the following steps:
 At least one hearing must occur on a Saturday, Sunday, or after 6:00 p.m. on a weekday;

Page 54 of 70 ends

 If a redistricting hearing is consolidated with another local government meeting, the redistricting hearing must begin at a pre-designated time; and  Local public redistricting hearings must be made accessible with people with disabilities.

Town Schedule
The Town has set the following schedule for the redistricting process:

February 8, 2022 First Public Hearing - Hearing begins at 7:30 p.m.

February 22, 2022 Second Public Hearing – Hearing begins at 7:30 p.m.

March 1, 2022 Draft Maps Released; Mapping Tool Released to Public
March 8, 2022 Third Public Hearing - Consideration and input on proposed draft maps
March 15, 2022 New Maps released - if any
March 22, 2022 Fourth Public Hearing; Selection of Map
April 12, 2022 Formal Adoption of Map by Resolution
This Meeting
It is appropriate at this juncture for the Town Council to discuss and formally adopt by resolution either the draft Tan Map or the draft 101 map in advance of the April 17 meeting. The Town Council may adopt its chosen map by resolution in accordance with Apple Valley Municipal Code section 2.04.140 (C).

FISCAL IMPACT
The redistricting process should cost the Town approximately $50,000 depending on the number of public meetings the consultant attends. However, the Town must incur this cost in order to comply with applicable law.

Resolution No. 2022-11 (A)

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN

OF APPLE VALLEY, CALIFORNIA, ADOPTING THE
PROPOSED MAP 101 AS THE REDISTRICTING MAP FOR

THE TOWN OF APPLE VALLEY PURSUANT TO
ELECTIONS CODE SECTION 21600 ET SEQ. AND APPLE
VALLEY MUNICIPAL CODE SECTION 2.04.140 (C)
WHEREAS, on February 22, 2022, the Town Council adopted Ordinance No. 549 (A) – An Ordinance of the Town Council of the Town of Apple Valley Amending Section

2.04.140 and Adding Section 2.04.150 to Chapter 2.04 of Title 2 of The Town of Apple Valley Municipal Code Transitioning to By-District Elections for Four Councilmembers and an At-Large Mayor and Allowing Maps to be Adopted by Resolution; and WHEREAS, the California Legislature enacted Assembly Bill 849, amending sections of the Elections Code. Elections Code section 21601( a) requires that every ten years, following each federal census, California cities that use district - based elections must review the boundaries of those voting districts and readopt district boundaries based on current census data; and
WHEREAS, the purpose of this process is to review and re -adopt Council district boundaries that ensure voting districts remain substantially equal in population and protect the rights of members of communities of interest to vote for the candidates of their choice; and
WHEREAS, pursuant to Elections Code section 21607. 1( d), the Town held meetings regarding redistricting consolidated with regular meetings of the Town Council at fixed times, which were noticed to the public; and
WHEREAS, pursuant to Elections Code section 21607. 1( a)( 1), before drawing draft maps, the Town held two public hearings, one on February 8, 2022 and another on February 22, 2022 where an overview of the redistricting process was presented, and there was an opportunity for public comment; and
WHEREAS, pursuant to Elections Code section 21607. 1( a)( 2), the Town held two public meetings, one on March 8, 2022 and another on March 22, 2022 to receive public testimony regarding draft maps. WHEREAS, after the 2020 census data was released, the Town' s consultant determined that each district population should be roughly 15,213 residents. The law

Page 62 of 70 ends
