Town Council Agenda Report
Date: May 24, 2022
To: Honorable Mayor and Town Council
Subject: 2022-2026 Consolidated Plan, 2022-2023 Annual Action Plan, Analysis of Impediments to Fair Housing Choice, and Citizen Participation Plan

From: Douglas Robertson, Town Manager
Submitted by: Silvia Urenda, Housing and Community Development Spec Housing
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
It is recommended the Town Council approve the 2022-2026 Consolidated Plan, Analysis of Impediments to Fair Housing Choice, the Community Development Citizen Advisory Committee (“CDCAC”) funding recommendations for the 2022-23 First-Year Annual Action Plan, and the Citizen Participation Plan, and authorize the Town Manager to execute all necessary HUD documents on behalf of the Town.

BACKGROUND
The U.S. Department of Housing and Urban Development (“HUD”) mandates entitlement communities receiving Community Development Block Grant (“CDBG”) and HOME Investment Partnerships Program (“HOME”) funds prepare and submit a Consolidated Plan every five years to establish a unified, strategic, vision for housing and community development actions. The 2022-2026 Consolidated Plan encompasses the analysis of local community needs and coordinates appropriate responses to those needs and priorities. It defines the framework for investment of an anticipated $7.1 million in CDBG and HOME funds to address priority needs over the next five years beginning July 1, 2022 and ending June 30, 2027.

To ensure compliance with the Consolidated Plan, the Town is required to submit an Annual Action Plan each year. The Action Plan appropriates CDBG and HOME Consortium funds for the upcoming 2022-2023 Program Year (“PY”).

This year HUD is requiring CDBG and HOME grantees to certify they have taken an action to promote “one or more attributes of fair housing” that is “affordable, safe, decent, free of unlawful discrimination, and accessible as required under civil rights

Page 318 of 325 ends

law.” To determine appropriate actions the Town has completed an Analysis of Impediments to Fair Housing Choice (“AI”) which analyzed data, engaged the community, identified fair housing issues, and established reasonable and meaningful fair housing.

The Citizen Participation Plan (“CPP”) ensures the Town conducts adequate and effective outreach as part of its HUD grant planning and implementation process. It encourages citizen to act as advisors, ensures citizens timely access and opportunity to review and respond to planning and assessment documents, and ensures reasonable language and physical accommodation to facilitate participation.

Citizen Participation
In preparation of the Consolidated Plan, AI, Action Plan and CPP publicly noticed Community Meetings, Public Hearings, and review periods were held. Notices were published in the Apple Valley News, in English and Spanish, on October 29, 2021, November 5, 2021, February 18, 2022, and April 22, 2022. Hardcopies of the draft Consolidated Plan including the Action Plan, AI, and CPP were made available at the Town’s Development Services Building and electronically on the Town’s website.

The Town’s Notice of Funding Availability for CDBG and HOME and Applications were made available on December 16, 2021 and applications were due on February 10, 2022. Applications were made available at the Town’s Development Services Building and electronically on the Town’s website. A mandatory technical assistance workshop for interested participants was held on December 15, 2021 via Zoom. The purpose of the workshop was to allow Town staff to explain the application process and answer any questions. On March 3, 2022, the CDCAC held a public hearing to receive public testimony on the submitted applications and provide funding recommendations for inclusion in the draft 2022-2023 Action Plan.

ANALYSIS
Through consultation with residents, stakeholder organizations, and data analysis the Consolidated Plan identifies Priority Needs, Goals, and anticipated Outcomes, and the AI established goals. These are attached hereto as Exhibit “A” and Exhibit “C” for Town Council’s reference.

The proposed 2022-2023 Action Plan funding recommendations are attached as Exhibit “B” for Town Council’s reference. The recommended funding allocations are in accordance with the goals of the Action and Consolidated Plans. The Town Council retains complete discretion to modify or disregard the funding recommendations as presented and may propose alternative funding allocations.

The CPP meets HUD regulatory requirements, preforms the purposes described above, and streamlines Town processes.

A full copy of the draft 2022-2026 Consolidated Plan, including the 2022-2023 Action Plan, AI, and CPP may be viewed on the Town’s website at www.applevalley.org.

Community Development Block Grant (“CDBG”)
CDBG funds are to be used for projects that promote the development of viable, urban communities by providing decent housing, suitable living environments and expanded economic opportunities, principally for persons of low-to-moderateincome status. All CDBG-funded projects must meet one of the following national objectives: 1) Principally benefit low-to- moderate-income persons; 2) Eliminate slums and blight; or 3) Meet an urgent need. The types of projects and programs which may be considered for funding, subject to National Objectives compliance, include acquisition, disposition, public facilities and improvements, residential rehabilitation, clearance activities, public services, interim assistance, removal of architectural barriers and special economic development activities.

For the program year beginning July 1, 2022, the Town anticipates receiving a total of $618,678 in CDBG funds. HUD regulations allow a maximum of 20 percent of grant funds for eligible Administration/Planning activities and 15 percent for Public Service activities. The Town recommends allocating $123,736 to Administration/Planning activities, $79,200 to Public Services activities, and the remainder of the funds, $415,742,to capital improvements within the Town. The Town expects to spend no less than 70 percent of its funds to benefit low- and moderateincome individuals and areas. The remaining 30 percent of funds may be reserved to address urgent need.

HOME Investment Partnership Program (“HOME”)
The Town participates in a consortium with the City of Victorville (“City”) to qualify for HOME entitlement status with HUD. The successful formation of the consortium has resulted in an annual allocation of HOME funds to both communities. The consortium identifies the Town as the lead agency and the City as a Participating Jurisdiction.

HOME funds may be used to develop and support affordable rental housing and homeownership affordability through acquisition (including assistance to homebuyers), new construction, reconstruction or rehabilitation of non-luxury housing with suitable amenities, including real property acquisition, site improvements, conversion, demolition and other expenses, including financing costs, relocation expenses of any displaced persons, families, businesses, or organizations; to provide tenant-based rental assistance, including security deposits; to provide payment of reasonable administrative and planning costs; and, to provide for the payment of operating expenses of Community Housing Development Organizations (CHDOs).

The Consortium anticipates receiving $1,005,227 in HOME funds during the 2022- 2023 PY. Of this amount, the Town will receive $453,452 and the City will receive $431,174, and $120,601 are CHDO set-aside. At this time, the funds match waiver percentage share for the 2022-2023 PY has not been published; however, it is anticipated the funds match waiver percentage requirement will be waived.

Page 320 of 325 ends

FISCAL IMPACT
There is no impact to the Town’s General Fund as part of the Town Council’s adoption of the 2022-2026 Consolidated Plan, 2022-2023 Annual Action Plan, Analysis of Impediments to Fair Housing Choice, or the Citizen Participation Plan.

The Town’s and Consortium’s 2022-2023 CDBG and HOME entitlement is anticipated be $618,679 and $1,005,227. These resources will be incorporated into the Housing and Community Development Department’s 2022-2023 CDBG and HOME budgets as required to meet the mandates of the plan. CDBG and HOME funds may only be utilized for certain eligible expenses and the 2022-2023 Action Plan satisfies those requirements.
