Town Council Agenda Report
Date: January 10, 2023
To: Honorable Mayor and Town Council
Subject: FY 2022-2023 BUDGET OF THE APPLE VALLEY VILLAGE

PROPERTY AND BUSINESS IMPROVEMENT DISTRICT (PBID)

ASSOCIATION

From: Douglas Robertson, Town Manager
Submitted by: Orlando Acevedo, Assistant Town Manager
Economic Development
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
That the Town Council approve the Fiscal Year 2022-2023 Budget of the Apple Valley Village Property and Business Improvement District Association (Association).

SUMMARY
The PBID Association Board unanimously adopted its FY 2022-23 Budget (Attachment 1) on November 16, 2022, approving key programs and services consistent with its adopted District Management Plan, including continuation of marketing activities, seasonal pole banners; business directory signs and landscape replacement along the Highway 18 center median island; a private property aesthetic and rehabilitation grant program (ARGP) and, other streetscape related improvements, as approved by the Apple Valley Village Board of Directors.

The Association estimates FY2021-22 year-end operational expenses of $519,122 plus $175,000 in Town-administered programs for a total of $694,122 in expenses.

The Association’s approved budget for the new FY2022-23 is $203,030 for both operational and capital expenses and an additional $45,000 for contract services administered directly by the Town which includes enhanced police services in the Village area and ongoing Highway 18 Median landscape maintenance costs.

Page 15 of 36 ends

The Town will remit to the Association a portion of their collected annual assessment dollars for day-to-day activities, approximately $56,930 ($300,920 minus Association’s cash on hand of $146,100). The Association remains accountable for all funds it directly administers and is required to submit expense reports and financial statements to the Town annually. An annual Agreed-Upon Procedures Report was completed by a thirdparty Certified Public Accountant on November 11, 2022, and subsequently submitted to the Town to receive and file.

Based upon the foregoing, staff recommends adoption of the form motion.

BACKGROUND:

In 2007 the Town Council adopted a resolution establishing the Apple Valley Village Property and Business Improvement District (PBID) for five years (FY2007-08—FY2011- 12) to levy annual assessments against the PBID’s assessable parcels to be used solely for purposes described in the PBID’s adopted Management District Plan (Plan). In 2008, the PBID property owners formed and incorporated the Village PBID Association (Association), a 501 c (4) nonprofit corporation. The Association Board was subsequently selected to act as the PBID administering body and entered into an Agreement for Services with the Town in December 2008 to implement the Plan and to access and expend assessment revenues. In 2017, the Association led a successful grassroots campaign to renew the PBID for an additional five-year period, FY2017-18—FY2021-22.

In 2022, the Association led another successful renewal effort. In August, the PBID Association successfully passed a ten-year renewal by a vote of 81.43% YES to 18.57% NO.

Pursuant to the Agreement, the Town remits to the Association the PBID assessment revenues (collected by the County of San Bernardino and paid to the Town) on an asneeded basis and in accordance with an approved annual Budget. Components of the Budget that are directly administered by the Town will be paid directly by the Town.

Components of the Budget that are directly administered by the Association will be paid directly by the Association and may be advanced to the Association annually upon Town Council approval of that year’s Annual Budget Report.

FISCAL IMPACT
The PBID Association’s annual budget only utilizes PBID Assessment Revenues and has no direct impact on Town funds.

Subject: ACCEPTANCE OF WORK FOR THE COLD MIX OVERLAY 2022

PROJECT
From: Douglas Robertson, Town Manager
Submitted by: Mike Podegracz, Town Engineer
Engineering
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
A. Accept the work completed by Calmex Engineering, Inc. as part of the Cold Mix Overlay 2022 project for a total contract cost of $1,063,469.48.

B. Direct the Town Clerk to file the Notice of Completion for the contracted work.

C. Direct the Finance Director to release the retained funds 30 days after the Notice of Completion has been filed, provided no claims are filed against the contractor.

BACKGROUND
As part of the Town’s annual paving priorities, staff evaluated local roadways and determined priority areas in need of maintenance. The Project generally consisted of providing the necessary labor, equipment, and materials for the application of cold mix asphalt on the listed segments.

ANALYSIS
The project was awarded to Calmex Engineering, Inc. on October 11, 2022, and work began in mid November. On December 16, 2022, engineering staff inspected the project area and deemed the work to be complete and acceptable.

FISCAL IMPACT
Funding for this project has been appropriated in the adopted FY 2022-2023 budget under Paving Priorities (2011-5010-9525-0000 and 2021-5210-9525-0000).

The current language in Section 6.5 of the Personnel Policies and Procedures Manual lists the 4th of July as the only designated Town Holiday that employees shall be compensated at the overtime rate for all hours worked on that day. The Human Resources Department recommends amending this section to include all approved Town Holidays.

Moreover, the policy section does not clearly address what happens to Holiday hours when an employee is required to work on a designated holiday. Therefore, the Human Resources Department recommends adding language to the policy section to clarify the options available to employees that work on an approved Holiday.

Additionally, the current language in Section 6.6 does not address the number of Floating Holidays available to regular employees. The amendment to the section will move the “Three Floating Holidays” listed in section 6.5, into the correct section.

FISCAL IMPACT
There will be a minimal cost increase associated with the recommended amendments to the Personnel Policies and Procedures Manual. This increase to personnel costs is dependent on the variables surrounding scheduled leave time and staffing.

Section 6.6 Floating Holiday
A floating holiday shall be a holiday on a workday of the employee’s choice, which is earned during the fiscal year. All regular full-time employees of the Town are eligible for three floating holidays annually. Employees are not eligible for a floating holiday until successful completion of six (6) months of continuous service. The floating holiday may be used in conjunction with other vacation and holidays. Employees hired after July 1 will accrue floating holidays on a pro-rata basis based on the remaining number of pay periods in the fiscal year. The minimum charge against a floating holiday shall be fifteen (15) minutes. Requests for a floating holiday shall be subject to the approval of the employee’s immediate supervisor and at such time as will not impair the work schedule and efficiency of the department.

Employees shall be prohibited from using a floating holiday during their last two weeks of employment with the Town. Accrued, unused floating holidays shall be paid off at termination at the employee’s rate of pay in effect at the time of termination. Accrued, unused floating holidays remaining on the books on June 30th will be paid on the next payroll using the employee’s rate of pay as of June 30th of the year the floating holiday was earned.
