Town Council Agenda Report
Date: March 14, 2023
To: Honorable Mayor and Town Council
Subject: APPROVE PURCHASE OF FLOORING FOR PUBLIC SAFETY

BUILDING

From: Douglas Robertson, Town Manager
Submitted by: Joshua Conley, Sheriff’s Lieutenant
Apple Valley Sheriff Station
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
Approve the purchase and installation of new flooring for the Town Public Safety Building.

BACKGROUND
The Public Safety building is in desperate need of new flooring to replace currently stained, dilapidated, and mismatched flooring throughout the building. The police department moved into the building in 2004, making the existing flooring approximately 18 years old. At the time, the building was shared with Code Enforcement. As each department realized a need for more space, Code Enforcement moved out and the Sheriff’s Department took over the entire building. As we expanded into the space occupied by Code Enforcement, the flooring became an assortment of different types and styles. The sheet vinyl flooring in our locker rooms and holding areas is run-down and coming apart. The carpeted areas are heavily stained and worn.

The 24-hour, 7 days a week, wear and tear caused by police work demands a durable and dependable flooring product that allows for easier maintenance and cleaning. This project will serve to restore the station’s professional appearance and provide continuity of the space.

ANALYSIS
The Town of Apple Valley contracts with the San Bernardino County Sheriff’s Department for law enforcement services. When the police department has vacant positions due to attrition, injury, or transfers, the Town receives a credit from the County for the personnel costs associated with those vacancies. Over the course of the last two full fiscal years,

Page 40 of 75 ends

the Town has been refunded roughly $1.3 million from the County. A review of the current fiscal year’s budget reveals nearly $1 million in personnel credits to date. The police department wishes to use approximately $154,000 to complete the flooring project.

Three project proposals were sought during the bid process. The lowest bid of $153,843 was provided by New Image Interior Flooring. New Image is a known vendor to the Sheriff’s Department as they completed the flooring renovation of our Headquarters building in San Bernardino.

FISCAL IMPACT
The is no fiscal impact to the Town. The project will be funded using unspent monies already dedicated to the Public Safety contract.

Town Council Agenda Report
Date: March 14, 2023
To: Honorable Mayor and Town Council
Subject: ADOPT RESOLUTION OPPOSING THE TAXPAYER PROTECTION

AND GOVERNMENT ACCOUNTABILITY ACT

From: Douglas Robertson, Town Manager
Submitted by: Julie Ryan, Special Projects Manager
Town Manager
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
Adopt Resolution No. 2023-08 opposing Initiative No. 21-0042A1, the Taxpayer Protection and Government Accountability Act.

BACKGROUND
In 2018, the “Tax Fairness, Transparency and Accountability Act” (California Attorney General File #17-0050 amdt. #1), was being circulated to qualify for the November 2018 ballot. This initiative would have drastically limited local revenue authority. Through the successful work and advocacy of the League of California Cities (Cal Cities) and its coalition, the measure’s proponents withdrew the initiative from the ballot in June 2018.

On January 4, 2022, the California Business Roundtable filed the Taxpayer Protection and Government Accountability Act” or Attorney General File (AG) No. 21-0042A1. This measure is far more detrimental to cities than the measure filed in 2018, because it would decimate vital local and state services to the benefit of wealthy corporations. On February 1, 2023, the measure qualified for the November 2024 ballot.

Cal Cities, along with a broad coalition of local governments, labor and public safety leaders, infrastructure advocates, and businesses, strongly opposes this initiative, which would limit voters’ authority, adopt new and stricter rules for raising taxes and fees, and make it more difficult to hold violators of state and local laws accountable.

ANALYSIS
The Taxpayer Protection and Government Accountability Act would amend the California Constitution with provisions that limit voters’ authority and input, adopt new and stricter rules for raising taxes and fees, and may make it more difficult to impose fines and

Page 46 of 75 ends

penalties for violation of state and local laws. The measure would put billions of local government tax and fee revenues at risk statewide with related core public service impacts and have significant negative impacts on Town of Apple Valley operations and core service delivery.

Cal Cities further notes that this initiative would do the following:

Major Provisions
Fees and Charges
 Except for licensing and other regulatory fees, fees and charges may not exceed the “actual cost” of providing the product or service for which the fee is charged. “Actual cost” is the “minimum amount necessary.” The burden to prove the fee or charge does not exceed “actual cost” is changed to “clear and convincing” evidence.
 Requires fees and charges paid for the use of local and state government property and the amount paid to purchase or rent government property to be “reasonable.” These fees and charges are currently allowed to be market-based. Whether the amount is “reasonable” (introducing a new legal standard aiming to force below market fee and charge amounts) must be proved by “clear and convincing evidence.” The standard may significantly reduce the amount large companies (e.g., oil, utilities, gas, railroads, garbage/refuse, cable, and other corporations) will pay for the use of local public property.
 Prohibits fees on new development based on vehicle miles traveled.

Taxes
 Taxes and fees adopted after January 1, 2022, that do not comply with the new rules, are void unless reenacted.
 Expressly prohibits local advisory measures which allow local voters to express a preference for how local general tax dollars should be spent.  Requires voter approval to expand existing taxes (e.g., Utility, Transient Occupancy) to new territory (e.g., annexations) or to expand the tax base (e.g., new utility service).
 New taxes can only be imposed for a specific time period.

Fines and Penalties
 May require voter approval of fines, penalties, and levies for corporations and property owners that violate state and local laws unless a new, undefined adjudicatory process is used to impose the fines and penalties.

Page 47 of 75 ends

FISCAL IMPACT
There is no direct fiscal impact associated with the adoption of the proposed resolution.

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN

OF APPLE VALLEY, CALIFORNIA, OPPOSING
INITIATIVE 21-0042A1, THE TAXPAYER PROTECTION

AND GOVERNMENT ACCOUNTABILITY ACT
WHEREAS, an association representing California’s wealthiest corporations and developers is spending millions to push a deceptive proposition aimed for the November 2024 statewide ballot; and
WHEREAS, the measure includes undemocratic provisions that would make it more difficult for local voters to pass measures needed to fund local services and infrastructure, and would limit voter input by prohibiting local advisory measures where voters provide direction on how they want their local tax dollars spent; and WHEREAS, the measure creates new constitutional loopholes that allow corporations to pay far less than their fair share for the impacts they have on our communities, including local infrastructure and our environment; and WHEREAS, the measure may make it much more difficult for state and local regulators to issue fines and levies on corporations that violate laws intended to protect our environment, public health and safety, and our neighborhoods; and WHEREAS, the measure puts billions of dollars currently dedicated to local services at risk, and could force cuts to fire and emergency response, law enforcement, public health, parks, libraries, affordable housing, services to support homeless residents, mental health services, and more; and

NOW THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF APPLE VALLEY AS FOLLOWS:

Section 1. That the Town Council opposes Initiative 21-0042A1.

Section 2. That the Town Council will join the NO on Initiative 21-0042A1 coalition, a growing coalition of public safety, education, labor, local government, and infrastructure groups throughout the state.

Section 3. That the Town Council directs staff to email a copy of this adopted resolution to the League of California Cities at [email protected].

Section 3. That the Town Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.

Town Council Agenda Report
Date: March 14, 2023
To: Honorable Mayor and Town Council
Subject: APPROVE FUNDING TO STUDY AND FORM VARIOUS

INFRASTRUCTURE FINANCING DISTRICTS IN NORTH APPLE
VALLEY

From: Douglas Robertson, Town Manager
Submitted by: Orlando Acevedo, Assistant Town Manager
Economic Development
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
That the Mayor and Town Council approve a budget amendment and authorize an expenditure in an amount not to exceed $100,000 to conduct feasibility studies and to establish and implement various infrastrcture financing districts in north Apple Valley.

SUMMARY
The Town of Apple Valley is experiencing unprecedented real estate demand for industrial zoned parcels in north Apple Valley for the entitlement and development of industrial projects including distribution centers, fulfillment centers, and other related land uses. In addition, the Town is also experiencing renewed demand for commercial projects in north Apple Valley along the I-15 freeway frontage due to the planned Brightline West train station, the recent annexation of the Golden Triangle area, as well as the recent adoption of an industrial overlay district in regional commercial zoned areas.

Though the market demand is creating synergy for these projects, project proponents continue to raise concerns regarding the feasibility of certain projects due to the enormous costs to extend infrastructure, chiefly water line extensions and increased volume and storage capacity.

Page 51 of 75 ends

The purpose of the Town’s interest in studying and potentially establishing and implementing infrastructure financing districts, specifically Enhanced Infrastructure Financing District(s) and Community Facilities District(s), is to coordinate property owner participation and to create economies of scale so that no one project carries the full cost burden of financing infrastructure improvements that benefit regional areas and properties.

The goal of Town staff is to establish these districts within the next 12-18 months, in time to set baseline property values before projects are constructed in order to capture future tax increment revenues and to generate future revenues to bond for infrastructure projects.

Town staff will work with several financing consultant firms as well as bond counsel to complete legally required feasibility studies, implementation and financing plans, district boundaries, public financing authorities, etc.

This evening the Town Council is requested to approve a budget amendment to begin the district(s) formation process. Future action items and public hearings will be brought before the Town Council during the formation phase, expected to occur in late 2023.

FISCAL IMPACT
The Town has established a North Apple Valley Specific Plan fund for expenditures related to the development of infrastructure in north Apple Valley. Expenses associated with the formation of an EIFD and CFD(s) will be allocated to this fund account.

Appropriations of $100,000 from this funds balance is being requested with the attached budget amendment.

Pursuant to the Professional Services Agreement between the Town of Apple Valley (“Town” or “Client”) and Kosmont Companies (“Kosmont” or “Consultant”) dated October 10, 2022, Kosmont has prepared an analysis of the feasibility of an Enhanced Infrastructure Financing District (“EIFD”) as part of an infrastructure financing strategy to catalyze economic development and private sector investment within the North Apple Valley area of the Town.

Based on analysis findings and discussions between Kosmont and Town staff thus far, staff has indicated potential interest in assistance from Kosmont for the implementation of an EIFD and/or Community Facilities District (“CFD”) consistent with the analysis findings, beginning first with discussions with the Apple Valley Fire Protection District (“Fire District”) regarding potential partnership in the EIFD and/or CFD. Kosmont proposes the following Work Plan accordingly.

II. WORK PLAN
PHASE ONE: FISCAL ANALYSIS AND POTENTIAL TAXING AGENCY PARTNERSHIP Task 1: Fiscal and Economic Impact Analysis
Kosmont will evaluate fiscal revenues (e.g., property tax, sales tax) and fiscal expenditures (e.g., public safety, community service costs) and the resulting net fiscal impact to the Town from district implementation over time. It should be noted that such fiscal impact analysis is required by EIFD legislation as part of district formation.

Task 2: Stakeholder Outreach
Kosmont will assist the Town with outreach to public and private sector entity stakeholders, potentially including, but not limited to:
• Fire District Chief and Administrative Staff
• Fire District Board of Directors
• County Administrative Office / Auditor-Controller / Treasurer / Tax Collector / Property Tax Manager / Economic Development / Public Works staff
• County Board of Supervisors
• Major district area property owners, developers, businesses, and/or registered voters.

Kosmont will accordingly assist with preparation and presentation of EIFD and CFD analysis materials as appropriate for such outreach. Based on stakeholder feedback, Kosmont will refine preliminary tax increment and special tax projections and related funding and financing analysis.

The goal of this Task is to receive direction/confirmation on which taxing entities would proceed with EIFD and CFD formation initially, recognizing that other taxing entities may join in a subsequent year. Kosmont will prepare a detailed timeline through district formation accordingly.

The Town could also determine not to proceed with either EIFD or CFD.

Kosmont will not proceed to Phase Two work until Client provides such direction in writing.

Additionally, please note that Kosmont is not a CFD special tax consultant, and we would recommend that, if the Town seeks to implement CFD in addition to EIFD, the Town separately engages a CFD special tax consultant prior to initiating Phase Two tasks below to assist in drafting of requisite CFD governing documentation (Kosmont would provide oversight). Kosmont can suggest multiple firms for Town consideration, if desired.

PHASE TWO: IMPLEMENTATION
Task 2: Resolution of Intention (ROI) and Establishment of the Public Financing Authority Kosmont will assist with determination of refined district boundaries and governing Public Financing Authority (“PFA”) board composition as required for adoption of the Resolution of Intent (“ROI”) to initiate EIFD formation proceedings.

Kosmont will assist Town staff and the Town Attorney’s office (and potentially Fire District and/or County staff and legal counsel) with the preparation of required documentation for the ROI.

Kosmont will assist with coordination and presentation at the required meeting(s) of the Town Council (and potentially also Fire District Board of Directors and/or County Board of Supervisors) to adopt the ROI and will assist with required noticing of the ROI following the legislative body actions.

If the Town wishes to pursue CFD formation in parallel, Kosmont will additionally work collaboratively with the CFD special tax consultant and legal counsel to prepare the required resolution of intention for CFD formation.

Task 3: Infrastructure Financing Plan (IFP) Preparation Kosmont will collaborate with Town staff and appropriate third-party consultants (e.g., special counsel, engineering / surveying consultants) on the preparation of the required Infrastructure Financing Plan (“IFP”) and related appendices. The IFP must include a legal description of district boundaries, public improvements to be implemented, location, timing, and costs of development and financial assistance, finalized tax increment projections, intention to incur debt (e.g., bonds), district termination date, taxing entity fiscal impact analysis, and replacement housing obligations.

Kosmont will assist Town staff (e.g., Clerk’s office) in the required distribution of the IFP to property owners within the EIFD and to affected taxing entities. Kosmont will assist the Town in drafting and coordinating the required noticing (e.g., website, mailing, newspaper notices) of the PFA meeting and hearings for IFP approval and EIFD formation.

If the Town wishes to pursue CFD formation in parallel, Kosmont will provide input and review governing CFD Rate and Method of Apportionment (“RMA”) documentation to ensure alignment in the overall EIFD/CFD financing plan.

Task 4: IFP Approval and EIFD Formation Hearings
Kosmont will assist in coordination, preparation, and presentation of required materials at the required Town Council and PFA meetings and hearings to approve the IFP and form the EIFD. While Kosmont is not a law firm / attorney, we will provide draft content for required resolutions for review by the Town Attorney and/or special counsel. Kosmont anticipates two PFA public meetings, three PFA public hearings, and one Town Council meeting as part of this task (this budget assumes that Kosmont will participate in-person for some meetings and virtually for others, as deemed mutually appropriate by the Town and Kosmont). Once the EIFD is successfully formed, Kosmont will assist Town staff in completing the required EIFD filings with the State Board of Equalization.

If the Town wishes to pursue CFD formation in parallel, Kosmont will provide input and review CFD formation documentation (e.g., resolution of formation, authorization to issue debt) to ensure alignment in the overall EIFD/CFD financing plan.

Potential Future Phase Tasks (Not Part of this Work Plan) • Municipal Advisory activities related to potential EIFD/CFD debt issuances to be provided by Kosmont Financial Services, registered Municipal Advisor

III. SCHEDULE AND REQUIRED DATA
Consultant is prepared to commence work upon receipt of this executed Work Plan agreement.

Kosmont anticipates a district formation timeline of approximately 12 months. Among the first tasks for Kosmont following authorization of this work plan is a detailed timeline through district formation.

It is assumed that the Town Attorney’s office or third-party special counsel will assist with review of all legal documentation (e.g., resolution of intention, resolution of formation). It is also assumed that the Town will assist via public works / engineering staff or third-party engineering / surveying consultant for the preparation of the required map and legal description of EIFD boundaries.

Kosmont is able to recommend qualified firms as desired.

BACKGROUND
On March 22, 2022, the Town Council initiated a Development Code Amendment to modify the Religious Institution regulations to provide more options for the placement of churches and other places of worship. On November 2, 2022, the Planning Commission reviewed the modifications proposed under Development Code Amendment No. 2022- 005. Upon presentation of the staff report and subsequent Commission discussion, Planning Commission Resolution No. 2022-005 was unanimously approved recommending the Town Council modify the Development Code.

CURRENT DEVELOPMENT STANDARDS: All new Religious Institutions in the Town of Apple Valley require approval of a Conditional Use Permit (CUP) to be approved by the Planning Commission. Currently, Religious Institutions are allowed to be placed in all Residential zoning designations, as well as Office Professional and Mixed-Use zoning designations. Religious Institutions require frontage and access on a major arterial, major or secondary road, as designated on the Streets and Roads Plan; shall be on lots 1 acre or more in size; and shall have a 1,200-foot separation shall be provided from General Commercial (C-G), Service Commercial (C-S), Regional Commercial (C-R) and Village Commercial (C-V) zoned properties and all industrially zoned properties. Religious institutions are also held to all other site development standards of their respective zones, such as setbacks, height limitations, as well as parking and landscape requirements.

ANALYSIS
As requested by Council, a review of the development standards relating to Religious Institutions has been completed. The Planning Commission recommends amendments to Title 9 of the Development Code to modify land use regulatory systems in relation to Religious Institutions in a manner that is consistent with the Town’s General Plan and State Constitution. Elements of the Development Code Amendment include the following:
 Allow Religious Institutions within the General Commercial (C-G) zoning designation with approval of a CUP within the following areas:
o On the north and south sides of Bear Valley Road, east of Deep Creek Road (Attachment 2).
o On the north and south side of Highway 18, west of Rancherias Road; and (Attachment 3)
o North of Thunderbird Road and east of Dale Evans Parkway Road (Attachment 4).
 Remove the 1,200-foot separation requirement from the General Commercial (CG), Service Commercial (C-S), and Village Commercial (C-V) zoning designations.

Such changes are necessary to be able to accommodate Religious Institutions within the C-G (Attachments 2 & 3). The C-V designation was completely eliminated upon adoption of the Village Specific Plan. The Amendments propose the following language (deleted language in strikethrough):

Page 61 of 75 ends

“A 1,200-foot separation shall be provided from General Commercial (C-G), Service Commercial (C-S), Regional Commercial (C-R), and Village Commercial (C-V) zoned properties and all industrial zoned properties.

Relief from this separation requirement shall be reviewed and approved by the Planning Commission.”
With an increase in interest in developing Religious Institutions within the Town, it is believed that this Amendment will assist in minimizing impacts on surrounding developments and residential developments caused by noise, traffic, and parking, while helping to ensure neighborhood compatibility with surrounding areas. This also serves to provide flexibility for Religious Institutions in finding properties to develop, or potentially re-purpose. Sites to be avoided in this amendment include those near large nonresidential areas, such as industrial or freeway properties, as it is envisioned that Religious Institutions shall be near the center of neighborhood activity and are encouraged to have a natural travel pattern within the community.

FINDINGS
An amendment to the Development Code requires that the Planning Commission and Town Council address two (2) required “Findings”, as listed within Development Code Section 9.06.060. For Council consideration, the Planning Commission recommends adoption of the required Findings as listed below, along with a comment addressing each.

1. The proposed amendment is consistent with the General Plan; and Comment: The General Plan is the blueprint for the community’s future growth. Specific Goals and Objectives are provided within each of the adopted General Plan’s State Mandated Elements. Many of these stated Goals and Objectives address the community’s desire to establish and maintain high standards for the quality, aesthetic appearance, and safety for all new and existing development. The proposed Development Code Amendment establishes new criteria specifically addressing Religious Institutions within the Town relative to new development and re-purposing of existing commercial centers. This change is consistent with the Goals and Objectives of the adopted General Plan; and

2. The proposed amendment will not be detrimental to the public health, safety or welfare of the Town or its residents.

Comment: The proposed Development Code Amendment will allow for Religious Institutions to be developed across various areas within the Town of Apple Valley. These standards will not be detrimental to the health, safety or general welfare of the citizens or visitors of the Town of Apple Valley.

ENVIRONMENTAL REVIEW
Staff has determined that the project is not subject to the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the State Guidelines to Implement CEQA,

where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.
