Subject: APPROVE PURCHASE OF PUMP REBUILD AND INSTALLATION SERVICES AT LIFT STATION 3A-2
From: Douglas Robertson, Town Manager
Submitted by: Guy Eisenbrey, Director of Municipal Services Public Works
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
Approve purchase of pump rebuild and installation services from Flo-Services, Inc. in the amount of $76,110.61.

BACKGROUND
The Town currently has three (3) pumps at lift station 3A-2 on Riverise Drive and one of the pumps is the primary emergency backup pump for this lift station. Wastewater staff discovered an abnormal vibration in pump 3 and contacted Flo-Services for a service call.

Flo-Servcies advised that they needed to remove the pump to perform a more detailed inspection of the pump at their shop. Flo-Services disassembled the pump to diagnose the problem(s) and discovered the pump needed to be completely rebuilt.

ANALYSIS
The Town received a quote from Flo-Services, Inc. in the amount of $76,110.61 for services to rebuild pump 3 at lift station 3A-2 on Riverside Drive, including reinstallation.

The cost of this rebuild and reinstallation qualifies for an exception to the Town’s bidding procedures under Section 3.12.270 (2) of the Apple Valley Municipal Code as FloServices has historically been the only company that has worked on mechanical issues at the Town’s lift stations and, after removal and breakdown, it would have been unreasonable and cost prohibitive to have another company pick up the pieces and rebuild it. Their historic stellar performance and working knowledge of our lift stations and that pump specifically is a key factor in the Town’s decision to continue using FloServices for emergency repairs and service calls. Lastly, this purchase will ensure the

Town Council Agenda Report
Date: June 13, 2023
To: Honorable Mayor and Town Council
Subject: ADOPT FISCAL YEAR 2023-2024 SB1 ROAD MANTENANCE AND

REHABILITATION ACCOUNT (RMRA) PROJECT LIST RESOLUTION
From: Douglas Robertson, Town Manager
Submitted by: Mike Podegracz,
Engineering
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
Adopt Resolution 2023-17 Identifying the project(s) to be funded by SB1 RMRA funding.

SUMMARY
Pursuant to the requirements of Senate Bill One (SB 1), each local jurisdiction receiving funds must submit a list of street maintenance projects each year to be eligible for Road Maintenance and Rehabilitation Account (RMRA) funds. Fiscal year 2023-2024’s RMRA allocation for the Town of Apple Valley is estimated to be $1,841,793.00.

BACKGROUND
On April 28, 2017, the Governor signed Senate Bill One (SB 1) (Beall, Chapter 5, Statutes of 2017), which is known as the Road Repair and Accountability Act of 2017. To address basic road maintenance, rehabilitation and critical safety needs on both the state highway and local streets and road system, SB 1: increases per gallon fuel excise taxes; increases diesel fuel sales taxes and vehicle registration fees; and provides for inflationary adjustments to tax rates in future years.

Beginning November 1, 2017, the State Controller (Controller) began depositing various portions of this new funding into the newly created Road Maintenance and Rehabilitation Account (RMRA). A percentage of this new RMRA funding will be apportioned by formula to eligible cities and counties pursuant to Streets and Highways Code (SHC) Section 2032(h) for basic road maintenance, rehabilitation, and critical safety projects on the local streets and roads system.

Page 59 of 123 ends

The goal of SB 1 is to bring all streets up to an average pavement condition index of 80 (80 out of 100). Currently, the average pavement condition index for the town’s roads is

72. Per the SB 1 guidelines, the Town’s Pavement Management System is the tool used to identify roadway segments for inclusion in RMRA funded projects.

For Fiscal Year 2023-2024, Engineering staff proposes the inclusion of three projects:

Microsurface 2023 will provide an overlay on roadway segments in the Sycamore Rocks neighborhood east of Central Road and in the neighborhood adjacent to Rio Vista School of Applied Learning. Both areas were prepped for Microsurface in previous years by repairing large, transverse gaps and other distressed areas. The second project is the Cold Mix Overlay 2023 which will occur in colder months and consists of applying cold mix asphalt to selected segments that require a heavier surface treatment than a microsurface. The final project is the Central Road and Other Roads Chip Seal and Overlay project which is a Cooperative Agreement project with San Bernardino County. This project is a carryover from last fiscal year and includes segments shared by the Town and County. This project has been ongoing and is scheduled to be completed by the end of 2023.

FISCAL IMPACT
The Town’s anticipated revenue from SB1 for this fiscal year’s RMRA allocation is estimated to be $1,841,793.00.

Town Council Agenda Report
Date: June 13, 2023
To: Honorable Mayor and Town Council
Subject: AWARD OF CONTRACT, LANDSCAPE MAINTENANCE SERVICES

From: Douglas Robertson, Town Manager
Submitted by: Guy Eisenbrey, Director of Municipal Services Public Works
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
Award a contract to BrightView Landscape Services, Inc. for Landscape Maintenance Services, subject to “Approval as to Form” by the Town Attorney and “Approval as to Content” by the Town Manager.

BACKGROUND
The project consists of providing the labor, equipment and materials necessary to perform landscape maintenance at various locations throughout the Town, including Landscape Assessment Districts, Highway 18 and Apple Valley Road, Navajo Road Medians, Apple Valley Road Medians, Highway 18 Medians in the Village, and other areas as directed by the Town. The initial contract period is from July 1, 2023 to June 30, 2024 and includes the potential to extend the contract up to an additional four (4), one (1) year extensions.

On May 24, 2023, the Town received and opened bids for the subject project in response to the Notice Inviting Sealed Bids issued by the Public Works Department on May 3, 2023.

The bid results are as follows:

Contractor Base Bid Price

1. Five Star Landscape Maintenance, Inc. $233,116.52

2. BrightView Landscape Services, Inc. $240,308.00

3. Numero Uno Landscaping $254,263.52

4. Lasting Images Landscape $272,472.00

5. Exterior Designs Custom Landscape LLC $374,184.00

Page 66 of 123 ends

ANALYSIS
This is an annual contract that previously went out to bid in 2021 and was extended for one (1), one (1) year extension. The current contract expires on June 30, 2023. During the bid review process, staff discovered the low bidder, Five Star Landscape Maintenance (Five Star), did not submit a bid bond with their bid submission and therefore deemed their submission non-responsive. Staff reviewed the remaining bid submissions for completeness and considers BrightView Landscape Services to be the lowest qualified, responsible and responsive bidder.

FISCAL IMPACT
The Street Maintenance budget account code 2010-5010-7935-0000 includes funding for maintenance and utility costs associated with the Navajo Road and Apple Valley Road Medians and the intersection of Highway 18 and Apple Valley Road. The Apple Valley Village Property Business Improvement District (PBID) account code 8110-4210-7760- 0000 includes funding for maintenance and utility costs for the Highway 18 medians in the Village. The Lighting and Landscape Assessment District revenues proportionately fund the maintenance and utility costs generated by the district areas under account code 2810-3310-7935-0000.

Town and Contractor agree, for valuable consideration, as follows:

ARTICLE 1. SCOPE OF WORK. The Contractor shall perform all Work and provide all labor, materials, equipment, tools, utility services, and transportation to complete all of the Work required in strict compliance with the Contract Documents (specified in Article 5 below) for the public work of improvement titled:

The Contractor and its surety shall be liable to the Town for any damages arising as a result of the Contractor’s failure to comply with this obligation.

ARTICLE 2. CONTRACT TIME. Time is of the essence in the performance of the Work. The Work shall be commenced on the date stated in the Town’s Notice to Proceed. The Contractor shall complete all Work required by the Contract Documents by June 30, 2024. By its signature hereunder, Contractor agrees the Contract Time is adequate and reasonable to complete the Work.

Upon successful and satisfactory completion of contractor performance for the initial base contract period ending June 30, 2024, the Town, at its option, may offer to extend the contract period up to four (4), one (1) year extensions of extended maintenance. If the Town’s offer of an annual extension is accepted by the contractor, the Town shall adjust for the term of that extension by the Engineering News Record (ENR), construction cost index, 20 cities average, March to March.

In the event the Liquidated Damages are not paid, Town may deduct that amount from any money due or that may become due the Contractor under the Contract. This Article does not affect the Town’s rights to other damages or remedies specified in the Contract Documents or allowed by law.

Should Contractor be inexcusably delayed in the performance of the Work, Town may deduct liquidated damages based on its estimate of when Contractor will achieve Final Completion or other Milestones. Town need not wait until Final Completion to withhold liquidated damages from Contractor.

Page 68 of 123 ends

Liquidated damages are not a penalty but an agreed estimate of the actual damages that would be sustained by the Town for delay, including but not limited to loss of revenue, inconvenience to the Town and the public, and increased Project administration expenses such as extra inspection, construction management, staff time, and architectural and engineering expenses. Liquidated damages do not include damages the Town incurs on account of claims by third parties against the Town on account of any delay.

Should money due or to become due to Contractor be insufficient to cover liquidated damages or other offsets due, then Contractor forthwith shall pay the remainder of the assessed liquidated damages to Town.

Town Council Agenda Report
Date: June 13, 2023
To: Honorable Mayor and Town Council
Subject: LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT #1 - ENGINEER’S ANNUAL REPORT AND LEVY OF ASSESSMENT FOR
FY 2023-2024

From: Douglas Robertson, Town Manager
Submitted by: Mike Podegracz, Town Engineer
Engineering Department
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
A. Adopt Resolution No. 2023-18, a Resolution of the Town Council of the Town of Apple Valley Directing the Filing of the Annual Report for the Town of Apple Valley Landscaping and Lighting Assessment District.

B. Receive and approve the engineer's report as filed, or as amended.

C. Adopt Resolution No. 2023-19, a Resolution of the Town Council of the Town of Apple Valley Declaring its Intention to Order Improvements and to Levy and Collect Assessments for Fiscal Year 2023-2024.

D. Direct the Town Clerk to publish the Resolution of Intention at least 10 days prior to the date of the public hearing.

BACKGROUND
The Landscaping and Lighting Act of 1972 permits the installation, maintenance and servicing of landscaping and lighting through annual special assessments on real property benefiting from the improvement. Currently, the Apple Valley Lighting and Landscaping District includes 19 locations.

For levying annual assessments, it is necessary that the Town Council adopt the initial resolution describing improvements and ordering the engineer to file a report. Second, the Town Council should approve and/or modify the report, as filed with the Town Clerk and made

Page 78 of 123 ends

part of this agenda, and; third, adopt a resolution of intention to levy assessments and set a date for a public hearing.

The resolution of intention declares to the affected property owners that the Town intends to levy and collect assessments within the district for next fiscal year. The resolution also gives notice of the time and place for the public hearing of the proposed assessment.

ANALYSIS
The annual assessments for each annexed territory of the Assessment District are indicated in Part B of the Engineer’s Report. For next fiscal year, there are three recommended increases in annual assessments for L-10, L-13 and L-26. The Public Works Department recently put the Landscape Maintenance contract out to bid and the new contractor’s cost for L-10, L-13, and L-26 has increased. It is recommended that the levy for L-10, which was $309 per lot last year, be increase to $365.00 per lot per year; for L-18 from $224.18 per lot per year to $240 per lot per year, and for L-26 from $369.62 per lot per year to $400.00 per lot per year.

For locations L-15, L-17, L-19, and L-20, the current levy amounts exceed the existing and projected maintenance costs. Because there are sufficient reserve funds in each of these locations to accommodate large capitol replacement costs, if needed, it is recommended to lower the annual levy. The detailed reduced levy amounts are shown on Exhibit B of the attached Engineer’s Report. The recommended procedures to increase or decrease the annual levy comply with all requirements of Proposition 218.

FISCAL IMPACT
The attached report summarizes the revenues and expenditures of the Assessment District, the estimate of cost and the proposed cost per lot per tract. The costs are borne by the property owners within each identified tract. There is no direct budgetary impact to the Town.

ATTACHMENTS
This is for attachments, if your report does not have attachments then delete this heading.

RECOMMENDED ACTION
Council to approve Resolution No. 2023-20 naming of Pahute Park to Joseph McConnell Jr., Park.

SUMMARY:

In December of 2021, the Town of Apple Valley was awarded a Competitive Grant through Proposition 68 funding. The grant funding will be used for the creation of a new park on Pahute Road. Absent a formal name, this project was simply called the, “Pahute Park Project.”; however, as the project progressed there is now a need for a permanant name.

On June 1, 2023 the Park and Recreation Commission met and unanimously recommended that the Town Council approve naming Pahute Park as Joseph McConnell Jr. Park.

Air Force Captain Joseph McConnell Jr., was a local resident of Apple Valley, California in the 1950’s. His life of valor and service in the Air Force was nothing short of extraordinary. Captain McConnell has the distinction of being the first triple jet ace, shooting down 16 enemy aircraft during the Korean War. He was awarded the Distinguished Service Cross by Dwight Eisenhower as well as the Silver Star and Air Medal for aerial combat.

While stationed at George Air Force Base, residents and organizations of Apple Valley built the Appreciation House to honor of Captain Joseph McConnell. This house was built just north of hwy 18 and east of what is now Dale Evans Parkway. Captain Joseph McConnell Jr., left a legacy of unparalleled commitment and duty to his country, his community and his family. His skill and fierce determination was evident throughout his

career in the Air Force, and he has left an indelible mark in Apple Valley. The naming of Pahute park as the Joseph McConnell Jr. Park is another way to Honor his legacy, and the legacy of all who have served from Apple Valley.
