Town Council Agenda Report
Date: October 10, 2023
To: Honorable Mayor and Town Council
Subject: AWARD A PROFESSIONAL SERVICES AGREEMENT TO FEHR AND PEERS, FOR THE TOWN’S CIRCULATION ELEMENT UPDATE
From: Douglas Robertson, Town Manager
Submitted by: Mike Podegracz, Town Engineer
Engineering
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
A. That the Town Council award a Professional Services Agreement to Fehr and Peers for the Town’s Circulation Element Update in the amount of $189,000 subject to "Approval as to Form" by the Town Attorney and "Approval as to Content" by the Town Manager.

B. Approve Budget Amendment Request to supplement the $150,000 budgeted item with an additional $39,000 from unprogrammed Traffic Impact Fee funds to cover potential optional items as listed in Fehr and Peers’ proposal.

BACKGROUND
The last comprehensive update of the Town’s Circulation Element occurred in 2012.

Though the southern portion of Apple Valley has maintained consistent residential and commercial growth, the Town recently received an influx of applications for High Cube Warehousing in the industrial zoned properties in the north half of the Town. Because of increased interest for this type of use, it became apparent that the current circulation element did not anticipate projects with single warehouse campuses that are as much as one mile long and a half a mile wide. Another recent development in the area impacting the Town’s Circulation Element is the Brightline West high speed train station, also located in the north part of Apple Valley.

Page 29 of 85 ends

ANALYSIS
On August 1, 2023, staff issued a Request for Proposals seeking a traffic engineering consultant to assist the Town to identify new roads and modifiy existing roads identified in the current circulation plan in areas that were impacted by several large High Cube Warehousing applications. Although the update will focus on the northern area of the Town, the entire Town circulation element will be evaluated.

Four consultants submitted their technical proposals prior to the date specified in the Request for Proposals. Staff reviewed the four consultant submissions and concluded that Fehr and Peers is the most qualified to proceed with the project for the following reasons:
 Project approach and general understanding of the Town’s intent;  Ability to provide value engineering and alternative designs while maintaining continuity with local design standards; and
 Strength of the project team members and performance on previous projects.

Fehr and Peers is currently completing the City of Barsow’s Circulation Element Update which also inlcudes High Cube Warehousing. The firm also assisted the Town with the implemenation of Senate Bill 743 and is very familiar with the issues affecting the Town.

Fehr and Peers identifed two optional studies, emissions and noise analysis, that may be required should it be determined that the vehicle miles traveled (VMT) of the Update exceed the baseline General Plan VMT. Staff recommends that the cost of these two optional studies be included in the agreement should it be determined that the studies are required.

FISCAL IMPACT
The adopted FY 2023-24 budget includes $150,000 for the circulation element. Staff is requesting an additional $39,000 for optional studies that may or may not be required depending on the changes to the plan. This would require a Budget Amendment transfer in the amount of $39,000 from unprogrammed Traffic Impact Fees.

Request for Proposal: Circulation Element Update

Page 2 of 9 ends

I. INVITATION
The Town of Apple Valley (Town) is seeking to retain the services of a qualified and experienced transportation planning consultant (Consultant) to provide the professional and technical services required to update the Town’s Circulation Element. As part of the update, the consultant/firm must develop and incorporate SB 743 guidelines and assess the impacts to comply with the California Environmental Quality Act (CEQA).

II. BACKGROUND
The Town’s circulation system consists of freeways, Arterials, streets, bicycle routes, sidewalks, and trails, as well as modes of transportation, including cars, buses, trucks, and bicycles. As part of the update, the consultant/firm must develop and incorporate SB 743 guidelines and assess the impacts to comply with the California Environmental Quality Act (CEQA).

The last comprehensive update of the Circulation Element occurred in 2012, by Urban Crossroads. This model will be provided for the 2023 update. Though the southern portion of Apple Valley has maintained consistent residential and commercial growth, the Town recently received an influx of applications for High Cube Warehousing in the industrial zoned properties in the north half of the Town. Though the Circulation Element update is for the entire street network of the Town, an emphasis should be directed towards updates in the north half of the Town and perhaps a revalidation of the transportation networks for the southern portion of the Town.

III. SCOPE OF WORK
The following is a general outline of the scope of work to be provided by Consultant. It is intended as a guide only and the specific scope of work to be provided by Consultant must be included in the proposal.

While it is believed that the requirements set forth in this Request for Proposal (RFP) are in a logical sequence and include all elements essential for a comprehensive evaluation, analysis and technical services, those submitting proposals are advised to include any subject or procedure they believe may have been overlooked. They may also note any required items they believe to be excessive or extraneous. The cost of such items shall be noted in the proposal.

Similarly, any additional costs that must be expended to make the project complete shall be identified in the proposal. The contract will be awarded based on respondent qualifications determined to be the most advantageous to the Town. Town reserves the right to accept, reject, and evaluate all proposals, and to change the scope of this RFP. Any proposal that is submitted becomes the property of the Town. The Town will not be liable for nor pay any costs incurred by Consultant in preparation of a response to this RFP or any other costs involved including travel. No State or Federal Funds are programed for this project.

The Scope of Work should include the following:

Traffic Analysis and Roadway Classifications. This task will analyze alternative circulation networks. The Consultant will define alternatives for testing, use the regional models, Town wide traffic and land use forecasts to test alternatives, and propose revised roadway networks, with emphasis in the north portion of the Town and revalidation of the southern

portion of the Town. The Attached exhibits show a few proposed modifications to the current Town’s Circulation Element Street system. The listed items are not intended to be a comprehensive listing of potential changes to the street system. Additional input from Town staff is expected.

The existing classification system will be reviewed and updated as appropriate using previous traffic studies, plans and models in conjunction with new information collected in the Circulation Element update process. The concept of functional operations and mobility within existing classifications will be reviewed and recommendations for changes will be identified to be consistent with public feedback, State Laws, and the Circulation Element goals and policies.

MAP LEGEND

1. Brightline Train Stop is planned to be constructed at this location. How does this affect the Circulation Element?

2. Quarry Road is a private 2-lane paved street on its own property lot. It currently serves as private driveway than a potential public street. It is owned by the CEMEX Company and is used to haul materials from the mine to facilities west of the freeway. On the north side of the road is a private railway. On the south side of Quarry Road there are power poles.

Suggest downgrading to local road.

3. The location of a freeway interchange may not be a good choice at Quarry Road considering the issues as listed in item #2.

4. Johnson Road may be a better road to select to connect to the Freeway with an interchange.

Johnson Road currently services the Walmart Distribution Center and future potential high cube warehouses.

5. Dachshund Road may not be needed as a Secondary Road considering the types of large high cube warehouse proposed to be constructed in this area. Suggest downgrade to a local road.

6. A large project is proposed to be located at this location and proposes to realign and eliminate/downgrade various arterials as needed within this area. See Detail #6, attached, originating from a traffic impact report page the shows proposed network modifications.

7. The circulation element shows a Freeway-to-Freeway interchange at the intersection of I-15 and the proposed E220 freeway. Currently, the final determination and viability for the E220 is in question. It is probable that the E220 will not proceed east of the I-15 freeway.

The current circulation element indicates that right of way “shall” be reserved for the E220 within the Town Boundaries. This provision, “shall”, should be reviewed for removal or changed to “should.”

8. Prior to the E220, the realignment of Highway 18 was shown on the circulation element as the same alignment. The realignment of Highway 18 was proposed to be a limited access highway with plans to become the new Highway 18 realignment. A realignment study was completed and detailed plans for right-of-way were created. The Town works with large development projects to plan for its alignment, though no right of way has been dedicated to the Town. If a small project on a small lot is proposed, the Town doesn’t require dedication and projects are allowed to be constructed within the proposed alignment. For long-term planning it is recommended that the alignment be retained on the Circulation Element.

Town Council Agenda Report
Date: October 10, 2023
To: Honorable Mayor and Town Council
Subject: ACCEPTANCE OF WORK FOR THE MICROSURFACE 2023

PROJECT
From: Douglas Robertson, Town Manager
Submitted by: Mike Podegracz, Town Engineer
Engineering
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
A. Accept the work completed by VSS International as part of the Microsurface 2023 project for a total contract cost of $472,737.00.

B. Direct the Town Clerk to file the Notice of Completion for the contracted work.

C. Direct the Director of Finance to release the retained funds 30 days after the Notice of Completion has been filed, provided no claims are filed against the contractor.

BACKGROUND
As part of the Town’s annual paving priorities, staff evaluated local roadways and determined priority areas in need of maintenance. The Project generally consisted of providing the necessary labor, equipment and materials for the application of microsurface and replacement of new thermoplastic striping and raised pavement markers on local roads within the Town of Apple Valley. The selected areas included in this project were previously included in a roadway repair project where large roadway gaps and other damaged areas were repaired and prepped for resurfacing.

During the course of work, staff requested additional resurfacing and striping at James Woody Park which also included providing and installing new wheel stops at each parking space. The striping work was required to make the parking area ADA compliant after the installation of a new modular restroom and fencing.

Page 64 of 85 ends

ANALYSIS
Engineering staff inspected the project area and deemed the work to be complete and acceptable.

FISCAL IMPACT
The total cost for the roadway portion of work is $426,305.00, and the additional parking lot portion of work is $46,432.00 making the total project cost $472,737.00. Funding for the roadway resurfacing portion of this project has been appropriated in the adopted FY 2023-2024 budget under Paving Priorities using RMRA funds (2011-5010-9525-0000).

The remainder of the work will be paid for out of the Parks & Recreation Grounds fund (1001-6190-9300-0000).

Subject: FEE WAIVER FOR NO DRUGS AMERICA

From: Douglas Robertson, Town Manager
Submitted by: Debbie S. Rivera, Parks & Recreation Manager Parks and Recreation
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
For good cause shown, and finding a waiver will serve a public purpose, approve the waiver of the Park Rental Fees of $1276.00.

BACKGROUND
On 8-14-01, the town council adopted a policy stating fees can be administratively waived for a local public agency, a utility company or service district, or a similar entity providing an essential service to the general community, whereas, non-profit requests for fee waivers must go before the town council for consideration and analysis.

SUMMARY
No Drugs America is requesting use of the Amphitheater at Civic Center Park on October 14, 2023, in order to provide education and discussion to the youth in the community about abstaining from drug use. They anticipate reaching out to around 200 youth and their family members. The organization will still be required to provide a Certificate of Insurance, Security Deposit, and submit a completed Facility Use Agreement for approval through the Parks & Recreation Department.

FISCAL IMPACT
Although there is not an ongoing demand that is displaced with the request on this particular day, the waiving of these fees will result in the loss of potential revenue in the amount of $1276.00.

RECOMMENDED ACTION
Approve purchase of a 14 x 54 Manufactured Commercial Dog Kennel from Horizon Structures in the amount of $133,700.00 plus an estimated $40,110.00 for taxes and utility hookups.

BACKGROUND
Apple Valley Animal Services has experienced an increase of incoming animals into the facility. In order to deal with the capacity demands and meet the goal of positive outcomes, staff presented a plan to increase holding capacity to the Town Council. The proposed modular kennel unit is the first phase of renovations and additions that will provide an additional 12 kennels. The Town currently has one hundred and two (102) dog kennels and ninety three (93) cat kennels. This would increase our holding capacity by 12 dog kennels.

ANALYSIS
The Town received two quotes, one from Horizon Structures and one from Trailside Structures. The lowest quote the Town received was from Horizon Structures in the amount $133,700.00 plus an estimated 40,110.00 for taxes and utility hookups.

FISCAL IMPACT

Page 73 of 85 ends

The price quote attached for a new Manufactured Commercial Kennel is $133,700.00 plus an estimated 40,110.00 for taxes and utility hookups.
