Submitted by: Mike Podegracz, Town Engineer
Engineering Department
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
A. That the Town Council adopt the design of the project represented by the Plans and Specifications for Apple Valley Road Bus Turnout - Project No. 2023-03; B. That the Town Council award a contract to CT&T Concrete Paving Inc. for Apple Valley Road Bus Turnout - Project No. 2023-03 in the amount of $100,343.00 and a 10% contingency of $10,034, for a total amount not to exceed of $110,377.

BACKGROUND
In November of 2021, the San Bernardino County Transportation Authority (SBCTA) awarded Victor Valley Transit Authority (VVTA) a TDA Article 3 grant for the Apple Valley Road Bus Turnout project. The project includes design and construction of a new bus turnout to the north of the existing bus stop. The new stop will improve the line of sight for motorists leaving the adjacent shopping center and allow buses to leave the travel lane while stopped. The work will provide the necessary labor, equipment, and materials to construct a concrete transit bus pad, concrete curb, concrete sidewalk, relocate existing bus shelter, and associated work in accordance with the project plans, standard specifications, special provisions, and as directed by the Town Engineer.

ANALYSIS
The Town Clerk’s Office received four sealed bids for Apple Valley Road Bus Turnout -

Page 37 of 65 ends

The Contractor and its surety shall be liable to the Town for any damages arising as a result of the Contractor’s failure to comply with this obligation.

ARTICLE 2. CONTRACT TIME. Time is of the essence in the performance of the Work. The Work shall be commenced on the date stated in the Town’s Notice to Proceed. Because of the nature of the Project, it would be impracticable or extremely difficult to determine the Town’s actual damages. Accordingly, as provided in Government Code section 53069.85, it is agreed that the Contractor will pay the Town the sum of $750.00 for each and every Working Day of delay in completing the Work beyond the Contract Time, as Liquidated Damages and not as a penalty or forfeiture. In the event the Liquidated Damages are not paid, Town may deduct that amount from any money due or that may become due the Contractor under the Contract. This Article does not affect the Town’s rights to other damages or remedies specified in the Contract Documents or allowed by law.

Should Contractor be inexcusably delayed in the performance of the Work, Town may deduct liquidated damages based on its estimate of when Contractor will achieve Final Completion or other Milestones. Town need not wait until Final Completion to withhold liquidated damages from Contractor.

Liquidated damages are not a penalty but an agreed estimate of the actual damages that would be sustained by the Town for delay, including but not limited to loss of revenue, inconvenience to the Town and the public, and increased Project administration expenses such as extra inspection, construction management, staff time, and architectural and engineering expenses. Liquidated

Town Council Agenda Report
Date: March 26, 2024
To: Honorable Mayor and Town Council
Subject: AMENDMENT NO. 4 TO JOINT EXERCISE OF POWERS AUTHORITY

AGREEMENT WITH THE SAN BERNARDINO COUNCIL OF

GOVERNMENTS

From: Douglas Robertson, Town Manager
Submitted by: Julie Ryan, Special Projects Manager
Town Manager
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
That the Town Council approve and authorize the Mayor to sign Amendment No. 4 to the Joint Exercise of Powers Agreement relative to the San Bernardino Associated Governments (SANBAG), now referred to as the San Bernardino Council of Governments (SBCOG), to increase membership dues by $23,345 for a total new assessment of $40,848.

BACKGROUND
The Town of Apple Valley is a member of the SBCOG, a joint powers authority that includes an elected official from each of San Bernardino County’s 24 cities and towns and the San Bernardino County Board of Supervisors. The SBCOG provides a forum for member agencies to exchange information and collaborate on regional issues. This collaboration helps member agencies to leverage resources to improve coordination and reduce duplication.

In 2018, the SBCOG Board adopted a five-year work and funding plan. The work plan included creation and implementation of the Emergency Communication Nurse System, research and preparation for creation of a Housing Trust, and grant research and writing.

Funding for the 2018 work plan came from two primary sources: (1) member dues; and (2) fund balance from the Property Assessed Clean Energy (PACE) / Home Energy Renovation Opportunity (HERO) programs. Each member agency pays dues as specified in the Agreement for the Joint Exercise of Powers (“Agreement”). Apple Valley’s current

Page 57 of 65 ends

membership dues total $17,503 per year, and SBCOG’s current annual budget is $658,000.

On July 5, 2023, as the SBCOG Board received a report on the 2018 work plan, and based on the information provided, specifically that the HERO funds are expended and there looms a budget deficit in 3 years due to lack of funding, the Board created an ad hoc committee to discuss expanding the capacity of the SBCOG and increasing the dues paid by the member agencies to fund it operations. After reviewing other Council of Government organizations, the ad hoc committee determined that the SBCOG’s budget and staffing level are far below sister agencies. The ad hoc committee identified opportunities to enhance the capacity of SBCOG to better serve its member agencies.

After months of deliberation, the ad hoc committee presented to the Board its recommendations to increase SBCOG staffing and budget. This recommendation includes increasing staff to 3 full-time equivalents (FTE) from 1.3 FTE and increasing the annual budget from $658,000 to $1.5 million. The additional staffing and budget will go to support regional collaboration on housing, homelessness, public safety, and grant writing.

ANALYSIS
For the last several years, fund balances from the PACE and HERO programs helped supplement membership dues. However, the funds have been depleted. To fund a new work plan and provide stability for the future of SBCOG, the Agreement must be amended to allow for an increase in membership dues. The Agreement specifies the particular method by which member agencies are to be assessed for membership dues. Currently, that method is to utilize a formula of 50% member agency population and 50% assessed valuation, and two flat fees adopted in 2016 and 2022, $5,337 and $8,000, respectively (Attachment A).

The ad hoc committee explored several funding options. It recommended to the Board the option it felt had the fairest impact on member agencies. The recommendation was to add to the membership dues a new assessment based on each member agency’s population (50%) and General Fund Tax Revenues (50%). Attachment A outlines the new membership dues for each member agency. For the Town of Apple Valley, this represents an increase of $23,345 per year, for a total of $40,848.

This amendment to the SBCOG funding structure will fund the implementation of the Emergency Communication Nurse System, and research and preparation for creation of a Housing Trust. It will also provide grant writing for the Regional Early Action Program

2.0 (REAP 2.0) being funded through the California Department of Housing and Community Development (HCD) and the Southern California Association of Governments (SCAG).

FISCAL IMPACT
The proposed amendment will modify the formula to calculate membership dues. The estimated membership dues for the Town of Apple Valley would increase from $17,503 to $40,848. Fiscally, the impact would be on the FY 2024-25 budget.

Town Council Agenda Report
Date: March 26, 2024
To: Honorable Mayor and Town Council
Subject: REJECT THE PROPOSAL FOR THE JAMES WOODY BALLFIELD

RENOVATION PROJECT

From: Douglas Robertson, Town Manager
Submitted by: Debbie Rivera, Parks & Recreation Manager Parks and Recreation
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
Reject the proposal for the James Woody Ballfield Renovation Project.

BACKGROUND
The Parks and Recreation Division published a Request for Proposal on January 23, 2024, and hosted a job walk on February 15, 2024, with four vendors in attendance. At the submittal deadline on February 29 at 5 p.m., the Town had received only one responsive bid for the project. As a result, the Town is revising the scope and readvertising as a Formal Notice Inviting Bids.

ANALYSIS
The initial Requst for Proposal included James Woody Park, Fields 1-3 with Fields 4-9 as bid alternates. Fields 1-3 were funded in the FY2023-24 Town Budget and on February 13, 2024, the Town Council approved allocating Quimby parks funds to provide funding for Fields 4-9. Due to the large increase in the scope after the RFP was already posted, staff feels this may have impacted the response from vendors. Staff will readvertise the project as a Formal Notice Inviting Bids to include the full scope, Fields 1-9.

To: Honorable Mayor and Town Council
Subject: REJECT THE PROPOSALS FOR THE MULTI-PARK BALLFIELD

BACKSTOP REPLACEMENT PROJECT

From: Douglas Robertson, Town Manager
Submitted by: Debbie Rivera, Parks & Recreation Manager Parks and Recreation
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
That the Town Council reject the current proposals for the Multi-Park Ballfield Backstop Replacement Project.

BACKGROUND
The Parks and Recreation Division published a Request for Proposal (RFP) on February 14, 2024 for the Multi-Park Ballfield Backstop Replacement Project. This project included replacement of two baseball backstops at Sycamore Rocks Park and replacement of the backstop on Field 9 at James Woody Park.

ANALYSIS
Recreation staff received proposals from two vendors for the Multi-Park Ballfield Backstop Replacement Project. After further review and discussion, staff determined a need to readvertise and issue a Formal Notice Inviting Bids due to the construction services and the bid amounts of the vendors proposals. This is necessary to comply with the Town’s purchasing policy.

FISCAL IMPACT
None.
