Subject: AWARD YUCCA LOMA ROAD WIDENING PROJECT NO. 2015-06 From: Douglas Robertson, Town Manager
Submitted by: Mike Podegracz, Town Engineer
Engineering
Budgeted Item: Yes No N/A
RECOMMENDED ACTION
A. That the Town Council adopt the design of the project represented by the Plans and Specifications for the Yucca Loma Road Widening Project No. 2015-06; B. That the Town Council award a contract to Onyx Paving Company, Inc. for the Yucca Loma Road Widening project in the amount of $1,468,000.00 and a 10% contingency of $146,800.00, for a total amount not to exceed $1,614,800.00.
C. Approve a Budget Amendment allocating $1,149,620.00 in Traffic Impact Fee funds to cover construction costs and additional staff time.
BACKGROUND
On February 13, 2024, the Town Council directed staff to proceed with the bidding and contact documents for the reconstruction and widening of Yucca Loma Road from Apple Valley Road to approximately 1,200 feet east of Apple Valley Road. The work will include the complete removal of existing paving, grading of a new wider roadway, installation of new curb, gutter and sidewalk, installation of new base material, and asphalt paving resulting in four travel lanes (two in each direction) and a center median.
The project was advertised on March 26, 2024, and the Town received and opened bids on April 18, 2024. The bid results are as follows:
Contractor Base Bid Price
1. Onyx Paving Company, Inc. $1,468,000.00
2. IE General Engineering $1,667,321.20
3. All American Asphalt. $2,219,999.00
ANALYSIS
The bid documents were reviewed by staff for accuracy and completeness. Onyx Paving Company, Inc, successfully completed roadway repair projects previously for the Town.
Staff considers Onyx Paving Company, Inc. to be a qualified, responsible and responsive bidder. The project is tentatively scheduled to begin on June 1, 2024 and is expected to be completed within 50 working days.
This is Phase 1 of a multi-phased project, as presented to the Town Council on February 13, 2024. Phase 2 will involve the acquistion of all necessary right-of-way for construction of improvments in Yucca Loma Road between Phase 1 and Rincon Road, and Phase 3 will involve the study and design of Yucca Loma Road from Rincon Road to Navajo Road/Outer Highway 18. Phases 2 and 3 will be proposed to be included as part of the Town’s Fiscal Year 2024-25 Budget. Future phases will involve the construction of improvements designed during Phases 2 and 3, and will be recommended for inclusion in future budget years.
FISCAL IMPACT
In preparation for the commencement of this project, the Town entered into a Funding Agreement with the San Bernardino County Transportation Authority (SBCTA) to formalize the construction funding commitments between the two agencies. The Funding Agreement includes a pledge of 45% with a maximum of $1,350,000.00 from SBCTA using Measure I Major Local Highway Program funds. The Town is responsible for the remaining cost. The Contractor and its surety shall be liable to the Town for any damages arising as a result of the Contractor’s failure to comply with this obligation.

This Article does not affect the Town’s rights to other damages or remedies specified in the Contract Documents or allowed by law.
Should Contractor be inexcusably delayed in the performance of the Work, Town may deduct liquidated damages based on its estimate of when Contractor will achieve Final Completion or other Milestones. Town need not wait until Final Completion to withhold liquidated damages from Contractor.
Liquidated damages are not a penalty but an agreed estimate of the actual damages that would be sustained by the Town for delay, including but not limited to loss of revenue, inconvenience to the Town and the public, and increased Project administration expenses such as extra inspection, construction management, staff time, and architectural and engineering expenses.

Town Manager
Budgeted Item: Yes No N/A
RECOMMENDED ACTION
Accept grant award from the 2023 Edward Byrne Memorial Justice Assistance Grant Program in the amount of $25,971 and authorize the Town Manager to execute award Agreements.
BACKGROUND
The U.S. Department of Justice (DOJ), Office of Justice Programs, Bureau of Justice Assistance announced the availability of grant funds to state and local units of government through the Edward Byrne Memorial Justice Assistance Grant (JAG) Program annually. This program provides funding to state and local governments to support a broad range of activities intended to prevent and control crime and improve the criminal justice system. Distribution of funds by the federal government is calculated using a formula, which considers both population and crime statistics.
The County submitted a grant application to the DOJ for the JAG program. Pursuant to the grant requirements, the County executes Memorandums of Understanding (MOU) with the 16 cities participating in the program, to share with each, the respective JAG grants. The agreements designate the County to serve as the applicant/fiscal agent for the administration of the joint funds.
ANALYSIS
The JAG program requires participating jurisdictions receiving grant funds to execute Sub-Award grant agreements to acknowledge receipt of the federal award information and applicable compliance requirements, including special conditions. By entering into the Sub-Award grant agreement, the Town agrees to undertake and carry out activities delineated by the grant award.
The Town has received several JAG awards for Public Safety purposes over the past several years.
FISCAL IMPACT
Staff is requesting the Town Council accept 2023 JAG Grant funds in the amount of $25,971.
