The maximum rate for the Fees set forth in the Schedules, unless otherwise stated, shall be adjusted each July 1, commencing July 1, 2021, by the percentage increase in the Consumer Price Index for All Urban Consumers (CPI-U) for the Riverside-San Bernardino-Ontario Area as of March of such year, provided that if such index shall cease to exist, the City may determine the appropriate increase based on a comparable index.
Section 5. The Town Council finds and determines that:
(a) The Fees established by this resolution:
(1) are imposed for a specific government service provided directly to the payor, or for reasonable regulatory costs of the Town for issuing licenses and permits, performing investigations, inspections, and administrative enforcement of the Town’s Municipal Code or other rules or ordinances; (2) are no more than necessary to cover the reasonable costs of the governmental activity for which the Fee is imposed; and (3) the manner in which those costs are allocated to a payor bear a fair or reasonable relationship to the payor’s burdens on, or benefits received from, the governmental activity for which the Fee is imposed; and (b) The Fees are not taxes within the meaning of California Constitution article XIII C, section 1(e)..
Section 6. The Town Council finds and determines that:
(a) the proposed Fees are not subject to environmental review under CEQA. First, the proposed Fees, in and of themselves, do not have potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment and therefore are not considered a “project” under CEQA. (Pub. Resources Code, § 21065, 14 Cal. Code Regs., § 15378, subd. (a).) Second, the Fees are covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment; here, there is no possibility that the proposed Fees, in and of themselves, may have a significant effect on the environment. (14 Cal. Code Regs., § 15061, subd. (b)(3).) And third, the proposed Fees are considered a government funding mechanism that does not involve any commitment on behalf of the Town to any specific project which may result in a potentially significant physical impact on the environment. (14 Cal. Code Regs., § 15378, subd. (b)(4).)
(b) The determination that the proposed Fees are not subject to CEQA review reflects the Town Council’s independent judgment and analysis. (c) The documents and materials that constitute the record of proceedings on which these findings have been based are located at Town Hall, 14955 Dale Evans Parkway, Apple Valley, California 92307. The custodian for these records is the Town Clerk.
Section 7. Severability. If any provision of this Resolution or the application thereof to any person or circumstances held invalid, such invalidity shall not affect other provisions or applications and, to this end, the provisions of this Resolution are declared to be severable. In the event any fee increase herein is determined by the final judgment of a court of competent jurisdiction to be invalid, then the fee in effect as to that item prior to the adoption of the said invalidated fee by this Resolution shall be construed hereby to remain in effect.

From: Douglas Robertson, Town Manager
Submitted by: La Vonda M-Pearson, Director of Government Services Town Clerk
Budgeted Item: Yes No N/A
RECOMMENDED ACTION
Nominate one Council Member as voting delegate and three (3) Council Members as voting alternates representing the Town of Apple Valley at the League of California Cities’ 2023 Annual Conference.
SUMMARY:
The League’s 2023 Annual Conference is scheduled for Wednesday, October 16 through Friday, October 18, 2024 in Long Beach, California.
One very important aspect of the conference is the Annual Business Meeting where the membership takes action on conference resolutions. Annual conference resolutions guide cities and the League in our efforts to improve the quality, responsiveness and vitality of local government in California.
Each city has one vote at any League membership meeting. Accordingly, the Town must designate one voting delegate and three voting alternates for the Annual Business Meeting to be held on Friday, October 18, 2024, at the Sacramento Convention Center.
Based on the foregoing, staff recommends adoption of the form motion.
Town Council Agenda Report
Date: July 23, 2024
To: Honorable Mayor and Town Council
Subject: CONSIDER PLACING A ONE CENT TRANSACTIONS AND USE (SALES) TAX MEASURE ON THE NOVEMBER 5, 2024 GENERAL
MUNICIPAL ELECTION BALLOT
From: Douglas Robertson, Town Manager
Submitted by: Julie Ryan, Special Projects Manager
Town Manager’s Office
Budgeted Item: Yes No N/A
RECOMMENDED ACTION
That the Town Council
A. Adopt Resolution No. 2024-23 calling for the placement of a General Tax Measure on the ballot for the November 5, 2024 General Municipal Election for the submission to qualified voters of an Ordinance to enact a Transactions and Use (Sales) Tax at the rate of one cent (1¢).
B. Adopt Resolution No. 2024-24 requesting the Board of Supervisors of the County of San Bernardino to consolidate a General Municipal Election to be held on November 5, 2024 with the Statewide General Election to be held on that date pursuant to Elections Code Section 10403.
C. Adopt Resolution No. 2024-25 providing for the filing of the primary and rebuttal arguments and setting rules for the filing of written arguments regarding a Town Measure to be submitted at the November 5, 2024 General Municipal Election.
BACKGROUND
The Town of Apple Valley has faced repeated budget deficits since 2016 and projects increasing shortfalls that may result in cuts to Town programs and services, including those impacting public safety and infrastructure. To maintain Town services and to avoid
drawing down on its financial reserves, the Town has financed some of these services with American Rescue Plan Act (“ARPA”) funds, but these are no longer available.
On April 9, 2024, the Town Council approved a Professional Services Agreement to conduct public opinion research and community engagement regarding current and projected Town budgets, anticipated shortfalls, Town services, and community priorities.
Based on the findings of that research, projected budget deficits, and potential for cuts to Town programs and services, staff recommends the Town Council consider the placement of a 1¢ general transactions and use (sales) tax measure on the November 5, 2024, ballot.
If approved by a majority of the voters, the ballot measure would authorize a 1¢ sales tax within the Town of Apple Valley. A 1¢ sales tax equates to an extra 1¢ per $1 purchased of taxable goods. Exempted from sales tax are unprocessed groceries, rent, prescription medicine and personal services such as medical, dental, and legal. It is estimated that the measure will provide an additional $9 million in general fund revenues per fiscal year that could be used for maintaining general town services. All revenues raised by the tax would remain in the Town and would not be shared with the State, County, or any other agency
ANALYSIS
The Constitution (Proposition 218), and California Revenue and Taxation Code Section 7285.9, gives the Town authority to enact a local sales tax for general purposes with the approval of voters in the Town voting in an election on the issue. In addition, under Proposition 62, the Town Council must approve the placing of any tax measure on the ballot by a two-thirds (2/3) vote (four affirmative votes). The Town Council does not have the authority to approve a new tax, only to place the measure on the ballot for voters to approve.
If approved, the proposed sales tax measure would generate approximately $9 million annually. The funds could be used for Town services and programs, such as maintaining 911 response times, safe routes to school programs, responding to property crimes, thefts, and burglaries, hiring and retaining sheriff’s deputies, repairing streets and potholes, retaining and attracting local businesses, addressing homelessness, cleaning and maintaining public areas and parks, and other general Town services.
The Town of Apple Valley has experienced budget deficits in six of the previous eight years, including deficits of approximately $1,363,133 in 2016, $4,011,651 in $2017, $990,764 in 2018, $6,326,434 in 2020, $3,420,013 in 2022, and $3,179,551 in 2023.
It should be noted that the following charts show actual revenues and expenditures absent ARPA funds as these were extraordinary one-time monies.
In FY 2023-24, the General Fund was budgeted for $35,798,600 in revenue and $41,260,585 in expenditures, resulting in a projected deficit of $5,461,985. In FY 2024- 25, the General Fund is budgeted for $39,392,490 in revenue and $42,512,813 in expenditures, resulting in a projected deficit of $3,120,323.
While the Town has used ARPA funds to bridge these deficits while maintaining Town services and not drawing down on reserves, ARPA funds are no longer available.
Therefore, the Town is exploring other revenue options to address its long-term financial issues, or it will likely be required to either draw down on reserves and/or make cuts to Town services and programs.
Based upon the budget forecast, the Town has the following options:

Revenue Expenditures
1. Draw down on General Fund reserves to balance the budget,
2. Make budget cuts by reducing Town programs and services, which the Town has already done in previous years, or
3. Consider raising additional revenue, such as a voter-approved local sales tax.
Staff recommends a proposed 1¢ sales tax increase that, if approved by voters, would incorporate provisions for audits and public spending disclosures, with local funding staying in Apple Valley and not be taken by the State or the County.
It is recommended the Council adopt the Resolutions and approve the Ballot Argument as presented for placement on the November 5, 2024, ballot.
Adoption of Resolution No. 2024-23, Resolution No. 2024-24, and Resolution No. 2024- 25 will place a one cent (1¢) transactions and use (sales) tax on the November 5, 2024, General Municipal Election ballot so, voters in the Town of Apple Valley may consider a tax that would support the General Fund and general Town services and programs, including but not limited to public safety, roads and infrastructure. It should be noted that, if the tax measure passes, the proposed Ordinance in Resolution No. 2024-23 will add Chapter 3.26 to the Town’s Municipal Code.
If a sales tax is not presented to the voters at the November 5, 2024, General Municipal Election, the Town’s next opportunity to place such a measure on the ballot would generally be at the November 2026 General Municipal Election. Under Proposition 218, a special election held in 2025 or early 2026 for a general tax measure may only be called by a unanimous Council vote declaring an emergency. If the measure is not called or Apple Valley voters do not approve it this November, the Town foresees deficit spending to a projected amount of $3,120,323 in 2025 if it were to maintain its current service levels.
FISCAL IMPACT
Sales Tax is imposed on retailers selling tangible personal property in California. The Use Tax is imposed on the user of a product purchased out-of-state and delivered for use in California. The Sales & Use Tax rate for the Town of Apple Valley is 7.75% and is broken down as follows:
State General Fund 5.00%
City/County Local Tax 1.00%
Countywide Transportation Tax 0.25%
County Mental Health 0.50%
Public Safety Augmentation Fund (Prop 172) 0.50%
County Transactions Tax (Measure I) 0.50%
Total Rate 7.75%
Sales Tax represents a significant revenue source for Apple Valley and is estimated at $9.3 million or 24% of the total General Fund revenues estimated for FY 2024-25. An additional 1¢ would double this amount for the Town’s General Fund. The General Fund may be appropriated by the Town Council for non-enterprise government projects and
services such as police, parks, and Town’s Capital Improvement Program (CIP) and allow for additional funding in streets, storm drains, parks, crime prevention infrastructure, and youth and senior services.
The cost of Council approving placement of a sales tax measure on the November 5, 2024 is estimated to cost $27,000.
If approved by Town of Apple Valley voters, the 1¢ sales tax would generate approximately $9,000,000 per year for the General Fund.
ALTERNATIVES
1. Modify and adopt the Resolutions and Ordinance; make changes to and approve the Ballot Argument.
2. Provide other direction to staff.

3.26.010. – Title.
This ordinance shall be known as the “Town of Apple Valley General Transactions and Use Tax Ordinance”. The Town of Apple Valley hereinafter shall be called “Town.” This ordinance shall be applicable in the incorporated territory of the Town.
3.26.020. – Purpose.
This ordinance is adopted to achieve the following, among other purposes, and directs that the provisions hereof be interpreted in order to accomplish those purposes:
A. To impose a retail transactions and use tax in accordance with the provisions of Part
1.6 (commencing with Section 7251) of Division 2 of the Revenue and Taxation Code and Section 7285.9 of Part 1.7 of Division 2 which authorizes the Town to adopt this tax ordinance which shall be operative if a majority of the electors voting on the measure vote to approve the imposition of the tax at an election called for that purpose.
B. To adopt a retail transactions and use tax ordinance that incorporates provisions identical to those of the Sales and Use Tax Law of the State of California insofar as those provisions are not inconsistent with the requirements and limitations contained in Part 1.6 of Division 2 of the Revenue and Taxation Code.
C. To adopt a retail transactions and use tax ordinance that imposes a tax and provides a measure therefore that can be administered and collected by the California Department of Tax and Fee Administration in a manner that adapts itself
Ordinance 570
as fully as practicable to, and requires the least possible deviation from, the existing statutory and administrative procedures followed by the California Department of Tax and Fee Administration in administering and collecting the California State Sales and Use Taxes.
D. To adopt a retail transactions and use tax ordinance that can be administered in a manner that will be, to the greatest degree possible, consistent with the provisions of Part 1.6 of Division 2 of the Revenue and Taxation Code, minimize the cost of collecting the transactions and use taxes, and at the same time, minimize the burden of record-keeping upon persons subject to taxation under the provisions of this ordinance.
3.26.030. - Contract With State.
Prior to the operative date, the Town shall contract with the California Department of Tax and Fee Administration to perform all functions incident to the administration and operation of this transactions and use tax ordinance; provided, that if the Town shall not have contracted with the California Department of Tax and Fee Administration prior to the operative date, it shall nevertheless so contract and in such a case the operative date shall be the first day of the first calendar quarter following the execution of such a contract.
3.26.040. - Transactions Tax Rate.
For the privilege of selling tangible personal property at retail, a tax is hereby imposed upon all retailers in the incorporated territory of the Town at the rate of one percent (1%) of the gross receipts of any retailer from the sale of all tangible personal property sold at retail in said territory on and after the operative date of this ordinance.
3.26.050. - Place of Sale.
For the purposes of this ordinance, all retail sales are consummated at the place of business of the retailer unless the tangible personal property sold is delivered by the retailer or his agent to an out-of-state destination or to a common carrier for delivery to an out-of-state destination. The gross receipts from such sales shall include delivery charges, when such charges are subject to the state sales and use tax, regardless of the place to which delivery is made. In the event a retailer has no permanent place of business in the State or has more than one place of business, the place or places at which the retail sales are consummated shall be determined under rules and regulations to be prescribed and adopted by the California Department of Tax and Fee Administration.
3.26.060. - Use Tax Rate.
An excise tax is hereby imposed on the storage, use or other consumption in the Town of tangible personal property purchased from any retailer on and after the operative
Ordinance 570
date of this ordinance for storage, use or other consumption in said territory at the rate of one percent (1%) of the sales price of the property. The sales price shall include delivery charges when such charges are subject to state sales or use tax regardless of the place to which delivery is made.
3.26.070. - Adoption of Provisions of State Law.
Except as otherwise provided in this ordinance and except insofar as they are inconsistent with the provisions of Part 1.6 of Division 2 of the Revenue and Taxation Code, all of the provisions of Part 1 (commencing with Section 6001) of Division 2 of the Revenue and Taxation Code are hereby adopted and made a part of this ordinance as though fully set forth herein.
3.26.080. - Limitations on Adoption of State Law and Collection of Use Taxes.
In adopting the provisions of Part 1 of Division 2 of the Revenue and Taxation Code:
A. Wherever the State of California is named or referred to as the taxing agency, the name of this Town shall be substituted therefor. However, the substitution shall not be made when:
1. The word “State” is used as a part of the title of the State Controller, State Treasurer, California Victim Compensation Board, California Department of Tax and Fee Administration, State Treasury, or the Constitution of the State of California;
2. The result of that substitution would require action to be taken by or against this Town or any agency, officer, or employee thereof rather than by or against the California Department of Tax and Fee Administration, in performing the functions incident to the administration or operation of this Ordinance.
3. In those sections, including, but not necessarily limited to sections referring to the exterior boundaries of the State of California, where the result of the substitution would be to:
a. Provide an exemption from this tax with respect to certain sales, storage, use or other consumption of tangible personal property which would not otherwise be exempt from this tax while such sales, storage, use or other consumption remain subject to tax by the State under the provisions of Part 1 of Division 2 of the Revenue and Taxation Code, or; b. Impose this tax with respect to certain sales, storage, use or other consumption of tangible personal property which would not be subject to tax by the state under the said provision of that code.
Ordinance 570
4. In reference to Sections 6701, 6702 (except in the last sentence thereof), 6711, 6715, 6737, 6797 or 6828 of the Revenue and Taxation Code.
B. The word “Town” shall be substituted for the word “state” in the phrase “retailer engaged in business in this state” in Section 6203 of the Revenue and Taxation Code and in the definition of that phrase in Section 6203.
1. “A retailer engaged in business in the Town” shall also include any retailer that, in the preceding calendar year or the current calendar year, has total combined sales of tangible personal property in this state or for delivery in the State by the retailer and all persons related to the retailer that exceeds five hundred thousand dollars ($500,000). For purposes of this section, a person is related to another person if both persons are related to each other pursuant to Section 267(b) of Title 26 of the United States Code and the regulations thereunder.
3.26.090. - Permit not Required.

3.26.100. - Exemptions and Exclusions.
A. There shall be excluded from the measure of the transactions tax and the use tax the amount of any sales tax or use tax imposed by the State of California or by any city, town, city and county, or county pursuant to the Bradley-Burns Uniform Local Sales and Use Tax Law or the amount of any state-administered transactions or use tax.
B. There are exempted from the computation of the amount of transactions tax the gross receipts from:

With respect to commercial vehicles, by registration to a place of business out-of-Town and declaration under penalty of perjury, signed by the buyer, that the vehicle will be operated from that address.
3. The sale of tangible personal property if the seller is obligated to furnish the property for a fixed price pursuant to a contract entered into prior to the operative date of this ordinance.
4. A lease of tangible personal property which is a continuing sale of such property, for any period of time for which the lessor is obligated to lease the property for an amount fixed by the lease prior to the operative date of this ordinance.
5. For the purposes of subparagraphs (3) and (4) of this subsection, the sale or lease of tangible personal property shall be deemed not to be obligated pursuant to a contract or lease for any period of time for which any party to the contract or lease has the unconditional right to terminate the contract or lease upon notice, whether or not such right is exercised.
C. There are exempted from the use tax imposed by this ordinance, the storage, use or other consumption in this Town of tangible personal property:
1. The gross receipts from the sale of which have been subject to a transactions tax under any state-administered transactions and use tax ordinance.
2. Other than fuel or petroleum products purchased by operators of aircraft and used or consumed by such operators directly and exclusively in the use of such aircraft as common carriers of persons or property for hire or compensation under a certificate of public convenience and necessity issued pursuant to the laws of this State, the United States, or any foreign government. This exemption is in addition to the exemptions provided in Sections 6366 and 6366.1 of the Revenue and Taxation Code of the State of California.
3. If the purchaser is obligated to purchase the property for a fixed price pursuant to a contract entered into prior to the operative date of this Ordinance.
4. If the possession of, or the exercise of any right or power over, the tangible personal property arises under a lease which is a continuing purchase of such property for any period of time for which the lessee is obligated to lease the
Ordinance 570
property for an amount fixed by a lease prior to the operative date of this Ordinance.
5. For the purposes of subparagraphs (3) and (4) of this subsection, storage, use, or other consumption, or possession of, or exercise of any right or power over, tangible personal property shall be deemed not to be obligated pursuant to a contract or lease for any period of time for which any party to the contract or lease has the unconditional right to terminate the contract or lease upon notice, whether or not such right is exercised.
6. Except as provided in subparagraph (7), a retailer engaged in business in the Town shall not be required to collect use tax from the purchaser of tangible personal property, unless the retailer ships or delivers the property into the Town or participates within the Town in making the sale of the property, including, but not limited to, soliciting or receiving the order, either directly or indirectly, at a place of business of the retailer in the Town or through any representative, agent, canvasser, solicitor, subsidiary, or person in the Town under the authority of the retailer.
7. “A retailer engaged in business in the Town” shall also include any retailer of any of the following: vehicles subject to registration pursuant to Chapter 1 (commencing with Section 4000) of Division 3 of the Vehicle Code, aircraft licensed in compliance with Section 21411 of the Public Utilities Code, or undocumented vessels registered under Division 3.5 (commencing with Section 9840) of the Vehicle Code. That retailer shall be required to collect use tax from any purchaser who registers or licenses the vehicle, vessel, or aircraft at an address in the Town.
D.
