RECOMMENDED ACTION
That the Town Council adopt Resolution No. 2024-19, approving the Levy and Collection of Assessments for Fiscal Year 2024-25 within the Apple Valley Village Property and Business Improvement District (Attachment 1).
SUMMARY:
Each year the Town is required to submit an updated assessment roll (“Exhibit A”) to the County of San Bernardino for the Village PBID Assessment District (PBID).
Accordingly, the Town Council annually adopts a resolution approving the levy and collection of assessments against parcels of real property within the PBID.
The estimated FY2024-25 annual assessment to be levied to private parcel owners is $219,787.38 (272 parcels), $18,758.61 to other public agencies including one privately owned street easement parcel that can’t be placed on the county property tax rolls (17 publicly owned), and $13,741.50 of those funds will be directly charged to the Town (12 parcels). As described in the tiered assessment formula within the adopted Management District Plan, the amount to be levied and collected for each fiscal year is increased where building area is expanded or newly constructed and may be increased up to 6% per year per a majority vote of the PBID Association Board. The PBID Association Board voted to increase assessments for FY2024-25 by 5%.
Public agencies for which the County does not bill a PBID assessment will receive a hand bill. The PBID assessment revenues collected by the County and paid to the Town will be remitted to the PBID as applicable and in accordance with the PBID’s adopted Management District Plan. The PBID assessments are collected by the County with the annual property tax billing. The County returns the PBID assessment funds to the Town, who then either spends them directly for specified PBID programs (i.e. Highway 18 Median Landscape Project; supplemental County Sheriff services) or remits them, as applicable, to the Village PBID Association to pay for and manage other PBID related programs and improvements (i.e. marketing/promotions, administration). The handbills for parcels not on the County’s property tax roll (including 12 Town owned parcels) have been prepared and will be delivered around October 1, 2024, to align with the County Assessor’s property tax bill mailing.
The Village PBID Association remains accountable for all funds it directly administers and is required to submit expense reports and financial statements to the Town annually. An annual Agreed-Upon Procedures Report will be completed by a third-party Certified Public Accountant by October 1, 2024, and subsequently submitted to the Town to receive and file.
Accordingly, staff recommends adoption of the form motion.
BACKGROUND:
The Village PBID Association unanimously adopted its FY2024-25 Budget on May 15, 2024, approving key programs and services consistent with its adopted 2022-2032 Management District Plan, approved as part of the ten-year renewal of the PBID.
The Council will review the PBID Budget under a separate agenda item.
FISCAL IMPACT:
A financial impact in the form of assessments levied on twelve (12) Town-owned properties within the PBID, estimated at $13,741.50 for FY2024-25 ATTACHMENTS:

AND COLLECTION OF ASSESSMENTS FOR FISCAL YEAR
2024-25 WITHIN THE APPLE VALLEY VILLAGE
PROPERTY AND BUSINESS IMPROVEMENT DISTRICT
Pursuant to the Property and Business Improvement District Law of 1994, Part 7 of Division 18 of the California Streets and Highways Code, commencing with Section 36600:
The Town Council of the Town of Apple Valley resolves:
Section 1. The levy and collection of assessments against lots and parcels of real property within the Village PBID for FY2024-25 is ordered as described in the Management District Plan and incorporated herein by reference.
Section 2. The purpose of this Village PBID is to provide and manage supplemental services and improvements for this important business center, including improvement projects along Highway 18 and other streets within the PBID, facade and beautification enhancement projects, supplemental public safety services and other activities which benefit businesses and real property in the Village PBID.
Section 3. The estimated FY2024-25 annual assessment to be levied to private parcel owners is $219,787.38 (272 parcels), with $5,017.11 to be hand billed to other public agencies (5 parcels), and $13,741.50 of directly charged to the Town (12 parcels) for a total of $18,758.61 of additional assessments.
Section 4. The Town of Apple Valley Finance Department is hereby authorized to request the County of San Bernardino to collect assessments for the District for FY2024-25.
Section 5. The Town Clerk’s Office is hereby authorized and directed to transmit a certified copy of the Resolution and the Report to the San Bernardino County Auditor, as may be required to place said assessment on the secured property tax roll for FY2024-25.
