Town Council Agenda Report
Date: September 24, 2024
To: Honorable Mayor and Town Council
Subject: FY 2026-30 CAPITAL PROJECT NEEDS ANALYSIS
From: Douglas Robertson, Town Manager
Submitted by: Richard Pedersen, Town Engineer
Engineering Division
Budgeted Item: Yes No N/A
RECOMMENDED ACTION
A. Approve Fiscal Year 2025-26 through 2029-30 Capital Project Needs Analysis B. Adopt Resolution No. 2024-29, Adopting the Measure I Five Year Capital Project Needs Analysis
SUMMARY
Measure I is the half-cent sales tax collected throughout San Bernardino County for transportation improvements. San Bernardino County voters first approved the measure in 1989 and in 2004 approved the extension through 2040. The Town of Apple Valley is included in the Mountain/Desert region, and Measure I funds collected in this region are distributed as follows:
68% Local Streets Program
25% Major Local Highway Program
5% Senior and Disabled Transit Program
2% Project Development and Traffic management System Program To qualify for Major Local Highway Program funds, a local jurisdiction is required to provide the San Bernardino County Transportation Authority (SBCTA) an updated master list of projects on a bi-annual basis to be included in SBCTA’s Capital Project Needs Analysis (CPNA). These projects are typically major streets and highways serving as primary routes of travel within the Victor Valley subarea and may include freeway interchanges.
This requirement is in addition to the Measure I Five Year Plan, which was approved by the Town Council on June 11, 2024. The Measure I Five Year Plan identified the local Town street and road construction, repair and maintenance projects anticipated to occur for fiscal years 2024-25 through 2028-29.
BACKGROUND
The Victor Valley Major Local Highways Program (MLHP) requires that a master list of projects eligible for funding shall be maintained and periodically updated. The list of eligible projects must be approved by the SBCTA Board, based on a recommendation of the Victor Valley subarea representatives and the Mountain/Desert Committee. The current list of approved projects was included in the 2024 update to the 10-Year Delivery Plan. Eligible project expenditures in the Victor Valley MLHP are also subject to an equitable distribution among the five member jurisdictions.
The CPNA includes estimates of project costs to be incurred by funding type, fiscal year, and phase for the five-year period following the beginning of the subsequent fiscal year.
It also demonstrates the availability of development mitigation fair share funds for the projects as assigned by the SBCTA Nexus Study.
SBCTA staff will use the CPNA submittals to develop a cash-flow analysis. The cash-flow analysis informs SBCTA staff of the availability of Program funds for loans and advances or of the need to bond for particular programs. Future revenue assumptions used in the CPNA, however, are not a guarantee of fund availability.
FISCAL IMPACT
The CPNA shows proposed expenditures for fiscal years 2025-26 through 2029-30.
Adoption of the attached CPNA and Resolution will assist SBCTA who is assisting the Town with Victor Valley MLHP funds. However, approval of the CPNA does not commit Town funding for these projects. Funding allocations will be recommended and included during the annual budget process.

RESOLUTION NO. 2024-29
RESOLUTION OF THE TOWN OF APPLE VALLEY, STATE OF

WHEREAS, the Strategic Plan requires each local jurisdiction applying for revenue from certain Measure I Programs to annually adopt and update a Five-Year Capital Project Needs Analysis; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the Town of Apple Valley, State of California, that the Measure I Five-Year Capital Project Needs Analysis for Fiscal Years 2025/2026 through 2029/2030, attached to this Resolution as Exhibit A, is hereby adopted.

Town Council Agenda Report

To: Honorable Mayor and Town Council
Subject: PY 2023-2024 CONSOLIDATED ANNUAL PERFORMANCE
EVALUATION REPORT (CAPER)
From: Douglas Robertson, Town Manager
Submitted by: Silvia Urenda, Housing and Community Development Supervisor Housing and Community Development Division
Budgeted Item: Yes No N/A
RECOMMENDED ACTION
It is recommended that the Town Council:
A. Conduct a public hearing and accept public testimony on the Program Year (PY) 2023-2024 Consolidated Annual Performance Evaluation Report (CAPER).
B. Approve the PY 2023-2024 CAPER.
C. Authorize the Town Manager or his designee to submit the PY 2023-2024 CAPER to the U.S. Department of Housing and Urban Development (HUD), along with any public testimony and changes thereto as directed by the Town Council.
BACKGROUND
HUD requires the Town to prepare and submit a CAPER to describe the Town’s progress in meeting the goals established in the PY 2023-2024 Action Plan that was approved by the Town Council on April 25, 2023, and subsequently amended on November 13, 2023.
The CAPER is required to be submitted to HUD no later than 90 days after the end of the program year to comply with HUD regulations found at 24 Code of Federal Regulations
91.520. The PY 2023-2024 CAPER was prepared and made available for the HUDrequired 15-day public review and comment period, which began on September 9, 2024, and concluded on September 24, 2024.
During the 2023-2024 PY, the Town received $652,733 in Community Development Block Grant (CDBG) funds. In addition, the Town of Apple Valley and the City of Victorville
Consortium received $911,188 in HOME Investment Partnerships (HOME) funds.
Through a Substantial Amendment to the PY 2023-2024 Action Plan, the Town allocated $102,603 in prior year CDBG funds and $778,642 in program income received during the program year for a total budget of $1,533,978 to be allocated to activities designed to meet the Town’s Five-Year Consolidated Plan – Strategic Plan goals. The PY 2023-2024 Action Plan is the third year of the five-year 2022-2026 Consolidated Plan cycle for the Town’s CDBG and HOME programs.
ANALYSIS
Prior to the commencement of the 15-day public review period, the Town published a notice in the Valleywide Newspaper (English and Spanish) informing the public that the Town had prepared the Draft PY 2023-2024 CAPER and its availability for review and comment. The public was informed of the opportunity to provide oral and/or written comments on the CAPER. To date, no public comments have been received.
The accomplishments for the 2023-2024 PY included:
Providing shelter and shelter services to a total of 28 unduplicated residents. Providing food baskets to 665 unduplicated residents. Providing emergency utility assistance to 88 unduplicated residents. Furthering Fair Housing Objectives in Consortia by providing fair housing services to a total of 15 unduplicated residents.
Providing Affordable Housing assistance to six (6) owner-occupied eligible households with financial assistance to rehabilitate their single-family residence under the Town’s Residential Rehabilitation Loan Program (RRLP). Providing Economic Opportunities to one (1) eligible microenterprise businesses, with financial assistance through the Town’s Microenterprise Assistance Program (MAP).
Completed the ADA golf course improvement project which assisted 9,801 unduplicated residents.
Commencing the design of the ADA Village North Sidewalk Improvement Project. In response to Covid-19 the Town provided one (1) eligible small business who has economically impacted by COVID-19 and who have more than five (5) employees, including the owners(s), with financial assistance through the Emergency Business Assistance Program (EBAP). This business was able to create or retain one (1) full-time equivalent employee.
A more detailed explanation of accomplishments can be found in the attached Draft PY 2023-2024 CAPER.
FISCAL IMPACT
Presently, there is no fiscal impact. The Town is required to submit the PY 2023-2024 CAPER to HUD to report on the annual accomplishments and expenditures during the program year. Although the submittal of the CAPER has never resulted in a fiscal impact
to the Town, failure to submit the CAPER to HUD in a timely manner could possibly result in non-compliance with CDBG regulations, which has the potential to lead to future financial sanctions.
