Subject: PROPOSAL TO CONTINUE THE VILLAGE ENHANCED SECURITY

PROGRAM IN THE APPLE VALLEY VILLAGE PROPERTY AND

BUSINESS IMPROVEMENT DISTRICT (PBID)
From: Douglas Robertson, Town Manager
Submitted by: Captain Visoky, San Bernardino County Sheriff Apple Valley Police Department
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
Approve the San Bernardino County Sheriff’s Department Proposal to continue the Village Enhanced Security Program in the Village Property and Business Improvement District (PBID)

SUMMARY
The PBID Association Board allocated $40,000 for enhanced security services and an additional $5,000 for coverage of special events in its FY 2025-26 budget. At the Board’s request, the Sheriff’s Department submitted a proposal to continue the Program, and the Board subsequently approved it in May 2025. The attached proposal defines the scope of services and costs for the Program entailing approximately 444 deputy sheriff’s hours (including workers compensation) at $90.90 per hour.

The Department will strategically adjust these additional shifts to address the specific needs of the Village. Deputies assigned to this area will participate in Task Force operations through overtime shifts. During the hours when the Task Force is not deployed, regular patrol operations and Citizens on Patrol (COP) Volunteers will supplement additional coverage when available to ensure continued presence and enforcement. The objective is to significantly reduce ongoing issues in the area during the months of the program, followed by sustained enforcement throughout the year. The Program does not entail hiring any additional officers.

BACKGROUND:

The Board has annually approved funding for security, an action consistent with its Annual Budget Reports and Workplans and identified in the renewed PBID Management District

Plan. Due to the limited authority and unsuccessful track record of private security services in the Village area, the Board prefers to obtain the services of sworn officers.

However, because the Town is the sole authority in contracting services with the Sheriff, the Town is requested to act on behalf of the Board to commission additional police services in the PBID area.

FISCAL IMPACT
There is no direct fiscal impact to the Town. The costs associated with this program are funded by the independent Village Property and Business Improvement District.

PROPOSAL TO PROVIDE “THE VILLAGE ENHANCED SECURITY PROGRAM” IN

THE VILLAGE BUSINESS DISTRICT
PREPARED BY THE SAN BERNARDINO COUNTY SHERIFF’S DEPARTMENT

BACKGROUND
The Apple Valley Village Property and Business Improvement District was formed to leverage resources in part to provide enhanced security services within the Village Business District. An added security presence was sought by the property owners before, during and after the formation of the PBID; in fact, one of the first formal acts after the formation of the PBID in 2007 was the dissemination by the PBID of a survey requesting the property owners identify both their real and perceived problems with criminal activity.

The comments the Board received from property owners and the Board’s adoption of a line-item budget for security services further indicated the PBID’s desire to contract for enhanced security services. With the recent renewal of the PBID, the Board wishes to continue these services. Accordingly, the Sheriff’s Department submits this Proposal for Village Enhanced Security Services to address the aforementioned concerns.

SCOPE OF COSTS AND SERVICES
The Village PBID has allocated $40,000 for security services, along with an additional $5,000 designated for special events in the FY 2025–2026 budget. Under the proposed Village Enhanced Security Program, the $40,000 allocation will provide approximately 440 hours of deputy sheriff coverage at a rate of $90.90 per hour. This equates to approximately eight hours of operational coverage per week over a twelve-month period.

The additional $5,000 earmarked for special events will be used to support increased staffing during peak activity periods, community functions, and other high-visibility operations. Any outstanding or uncommitted funds may be utilized at the discretion of the Sheriff’s Department to respond to emergent needs or unforeseen public safety concerns within the Village area.

The objective is to significantly reduce ongoing issues in the area during the months of the program, followed by sustained enforcement throughout the year. The Program does not entail hiring any additional officers.

The Sheriff’s Department will provide the following services:

1. Periodic patrolling of all streets within the PBID boundaries via patrol cars and on foot.

2. Submit quarterly monitoring reports to the Board.

3. Provide training to business owners in the area regarding identity theft, NSF checks,

4. Assist merchants by evaluating the security of their businesses and making recommendations regarding enhancing the safety and security of their buildings, themselves and their clientele.

5. Other miscellaneous policing services on an as-needed basis.

Subject: APPROVE PURCHASE OF TEN (10) AUTOMATED LICENSE PLATE

READERS
From: Douglas Robertson, Town Manager
Submitted by: Captain Visoky, San Bernardino County Sheriff Apple Valley Police Department
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
Approve the purchase and installation of ten (10) Automated License Plate Reader (ALPR) cameras to enhance the Town’s Public Safety.

BACKGROUND
The Automated License Plate Reader (ALPR) cameras/system is designed to scan and process license plates of passing vehicles. The collected data is converted into a searchable format and automatically compared against multiple law enforcement databases, including those identifying stolen vehicles, National Crime Information Center (NCIC) entries, terrorist watch lists, and the Federal Bureau of Investigations (FBI’s) Most Wanted list.

The ALPR system provides real-time alerts to law enforcement personnel, enhancing the ability to quickly apprehend suspects and recover stolen property. In addition to immediate enforcement benefits, ALPR data supports criminal investigations by generating valuable leads and aiding in the detection, prevention, and deterrence of criminal and terrorist-related activities. The system also facilitates improved information sharing with local, state, and federal law enforcement agencies by providing timely, accurate, and actionable intelligence.

The Town of Apple Valley currently contracts with the San Bernardino County Sheriff’s Department (SBSD) for law enforcement services. SBSD currently uses ALPR systems countywide and the addition and purchase of additional camera’s will enhance the County and Town safety efforts.

Page 40 of 141 ends

SUMMARY
Under the current San Bernardino County Sheirff’s contract when the police department has vacant positions due to attrition, injury, or transfers, the Town receives a credit from the County for the personnel costs associated with those vacancies. Over the course of the last (2) two full fiscal years, the Town has been refunded approximately $1.3 million from the County.

A review of the current fiscal year’s budget reveals approximately $900,000 in personnel credits to date. The police department wishes to use approximately $90,000 to acquire the ten (10) ALPR cameras .

Motorola Solutions – ALPR systems are a sole source provider and is the only vendor capabale of suppliying the required services that meet specific needs and comparability with systems already in use county wide . On May 30, 2025, Motoroal Solutions provided staff with a quote in the amount of $85,931.63 for the ten (10) ALPR cameras, system, and warranty.

FISCAL IMPACT
There is no fiscal impact to the Town. The project will be funded using unspent funds already dedicated to the Public Safety contract.

Town Council Agenda Report
Date: June 10, 2025
To: Honorable Mayor and Town Council
Subject: ADOPT RESOLUTION NO. 2025-10 ADOPTING FISCAL YEAR 2025- 2026 SENATE BILL (SB) 1 ROAD MANTENANCE AND

REHABILITATION ACCOUNT (RMRA) PROJECT LIST RESOLUTION
From: Douglas Robertson, Town Manager
Submitted by: Richard Pedersen, Town Engineer
Engineering Division
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
Adopt Resolution No. 2025-10 Identifying the project(s) to be funded by SB1 RMRA funding.

SUMMARY
Pursuant to the requirements of Senate Bill (SB1), each local jurisdiction receiving funds must submit a list of street maintenance projects each year to be eligible for Road Maintenance and Rehabilitation Account (RMRA) funds. Fiscal year 2025-2026’s RMRA allocation for the Town of Apple Valley is estimated to be $2,056,091.00.

BACKGROUND
On April 28, 2017, the Governor signed Senate Bill (SB) 1 (Beall, Chapter 5, Statutes of 2017), which is known as the Road Repair and Accountability Act of 2017. To address basic road maintenance, rehabilitation and critical safety needs on both the state highway and local streets and road system, SB 1: increases per gallon fuel excise taxes; increases diesel fuel sales taxes and vehicle registration fees; and provides for inflationary adjustments to tax rates in future years.

Beginning November 1, 2017, the State Controller (Controller) began depositing various portions of this new funding into the newly created Road Maintenance and Rehabilitation Account (RMRA). A percentage of this new RMRA funding will be apportioned by formula to eligible cities and counties pursuant to Streets and Highways Code (SHC) Section 2032(h) for basic road maintenance, rehabilitation, and critical safety projects on the local streets and roads system.

Page 70 of 141 ends

The goal of SB1 is to bring all streets up to an average pavement condition index of 80 (80 out of 100). Currently, the average pavement condition index for the Town’s roads is

72. Per the SB1 guidelines, the Town’s Pavement Management System is the tool used to identify roadway segments for inclusion in RMRA funded projects.

For Fiscal Year 2025-2026, Engineering staff recommends funds go towards the Chip Seal 2025 project which includes the Desert Knolls area east of Apple Valley Road, west of Rincon Road, north of Yucca Loma Road, and south of outer Highway 18 South as shown in the attached project map. The heavily traveled segments were selected based on their current condition and anticipated traffic volumes.

FISCAL IMPACT
The Town’s anticipated revenue from SB1 for this fiscal year’s RMRA allocation is estimated to be $2,056,091.00.

Town Council Agenda Report
Date: June 10, 2025
To: Honorable Mayor and Town Council
Subject: LIGHTING AND LANDSCAPE ASSESSMENT DISTRICT #1 – ENGINEER’S ANNUAL REPORT AND LEVY OF ASSESSMENT FOR
FY 2025-2026
From: Douglas Robertson, Town Manager
Submitted by: Richard Pedersen, Town Engineer
Engineering Division
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
That the Town Council:

A. Adopt Resolution No. 2025-11, a Resolution of the Town Council of the Town of Apple Valley Directing the Filing of the Annual Report for the Town of Apple Valley Landscaping and Lighting Assessment District.

B. Receive and approve the engineer's report as filed, or as amended.

C. Adopt Resolution No. 2025-12, a Resolution of the Town Council of the Town of Apple Valley Declaring its Intention to Order Improvements and to Levy and Collect Assessments for Fiscal Year 2025-2026.

D. Direct the Town Clerk to publish the Resolution of Intention at least 10 days prior to the date of the public hearing.

BACKGROUND
The Landscaping and Lighting Act of 1972 permits the installation, maintenance and servicing of landscaping and lighting through annual special assessments on real property benefiting from the improvement. Currently, the Apple Valley Lighting and Landscaping District includes 19 locations.

It is necessary that the Town Council adopt the initial resolution describing improvements and ordering the engineer to file a report. Second, the Town Council should approve and/or modify the report, as filed with the Town Clerk and made part of this agenda, and

Page 81 of 141 ends

third, adopt a resolution of intention to levy assessments and set a date for a public hearing.

The resolution of intention declares to the affected property owners that the Town intends to levy and collect assessments within the district for next fiscal year. The resolution also gives notice of the time and place for the public hearing of the proposed assessment.

ANALYSIS
The annual assessments for each annexed territory of the Assessment District are indicated in Part B of the Engineer’s Report. For next fiscal year, there are three recommended increases in annual assessments for L-10, L-11 and L-12. When the Public Works Department put the Landscape Maintenance contract out to bid and the new contractor’s cost for L-10, L-11, L-12 and L-13 increased significantly. Additionally, there were substantial repair costs at L-10 and L-12. It is recommended that the levy for L-10, which was $380.00 per lot last year, be increase to $399.00 per lot per year, for L11 from $304.00 per lot per year to $319.00 per lot per year, for L-12 from $165.00 per lot per year to $173.00 per lot per year and for L-13 from $240.00 to $252.00.

The recommended procedures to increase or decrease the annual levy comply with all requirements of Proposition 218.

FISCAL IMPACT
The attached report summarizes the revenues and expenditure of the Assessment District, the estimate of cost and the proposed cost per lot per tract. The costs are borne by the property owners within each identified tract. There is no direct budgetary impact to the Town.

Town Council Agenda Report
Date: June 10, 2025
To: Honorable Mayor and Town Council
Subject: SAN BERNARDINO COUNTY CONTRACT EXTENSION – ANIMAL SERVICES AMENDMENT NO. TWO (2)

From: Douglas Robertson, Town Manager
Submitted by: Douglas Robertson, Town Manager
Town Manager Department
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
That Council approve the second amendment to the San Bernardino County Contract for Animal Services.

BACKGROUND
After twelve years of service, the Town of Apple Valley has decided to not renew the annual contract to provide shelter services to the County of San Bernardino. The two entities are working on final documents to consider the potential sale of the facility to the County and for the County to assume all employees and provide shelter services to the Town.

Importantly, this matter is still undecided and expected to come before both the Town Council and the County Board of Supervisors within the next 60 days, however the current agreement is set to expire on June 30, 2025. Staff recommends the Council not discuss this future decision until all facts and potential contract terms are completed, and until the item is properly agendized. Discussions with the County have been cordial and encouraging and we are hopeful this matter will be ready for public discussion and deliberation by both boards in the very near future.

This agreement extends the current contract for six (6) months to December 31, 2025.

Should either board ultimately decide against the sale, indicating a preference to move forward separately providing shelter services for our respective populations, either side would have the ability to issue a thirty (30) day notice of termination. Upon termination, all County animals at the Apple Valley Animal Shelter would remain Apple Valley Animal Shelter’s responsibility.

Town Council Agenda Report
Date: June 10, 2025
To: Honorable Mayor and Town Council
Subject: ADOPT RESOLUTION NO. 2025-13 ADOPTING THE OPERATING AND CAPITAL IMPROVEMENT BUDGET FOR FISCAL YEAR 2025-26
From: Douglas Robertson, Town Manager
Submitted by: Adam Cripps, Interim Assistant Director of Finance Finance Department
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
Adopt Resolution No. 2025-13 of the Town Council of the Town of Apple Valley, California, approving a budget appropriation and adopting the budget, including the operating and capital improvement budget for all funds for Fiscal Year 2025-2026.

SUMMARY
The attached budget adoption resolution includes all revenue projections, funds, and departmental appropriations included in the Fiscal Year 2025-26 Proposed Budget.

Adoption of the attached Resolution No. 2025-13 will approve the Fiscal Year 2025-26 Operating and Capital Improvement Budget for all funds with budgetary activity.

BACKGROUND
The proposed budget represents the Town Manager’s recommended financial plan for Fiscal Year 2025-26 to address Council’s spending priorities within current fiscal constraints to fulfill the service expectations of the community. New resources identified through the passage of Measure P now provide for new funding of additional public safety.

This upgrade coupled with normal inflationary increases are noted in the proposed budget.

The lingering impacts of the past recessionary cycle, and the economic impact of the most recent national pandemic are noted factors that continueto place pressure upon existing resources and staff continue to closely monitor these impacts. The focus in this year’s budget process was on additional public safety through additional deputies at the level recommended by the San Bernardino County Sheriff’s Office.

The proposed budget on all Town-wide Funds is summarized in the following table:

TABLE 1 Page 128 of 141
The total FY 2025-26 proposed appropriations for all funds are $140,501,456. The proposed operating budget decreased from $142,895,601 in FY 2024-25, or -2%. The decrease in the proposed operating budget is primarily due to the expected expenditures for some of the ongoing capital project. Inflationary factors continue impacting the cost of living and operating costs to the Town. The proposed budget for the Capital Improvement Program continues the inclusion of the Bear Valley Bridge Rehabilitation (Mojave Desert Bridge) project, which is funded by Measure I, and Federal and State grants.

The total proposed General Fund budget is $49,081,928, an increase of $5,711,190 as compared to the revised budget in Fiscal Year 2024-2025. This increase is due to an increase of public safety personnel specifically for the Town’s contract with the San Bernardino County Sheriff. Added Public Safety in conjunction with accounting for prior year’s shortages along with inflationary factors contribute to this increase. As presented, the proposed General Fund budget for Fiscal Year 2025-2026 is expected to increase fund balance by $1,814,273 this fiscal year. At the March 25, 2025 Council meeting, through staff’s proposed FY2024-25 mid-year budget review, a revised General Fund budget included an estimated additional revenue of $3,000,000 for the first quarter collections of the Measure P sales and ad valorem tax. The estimated sales and ad valorem tax growth for FY 2025-26 is $11,003,000. The following table is a summary of the total resources and requirements for the proposed Fiscal Year 2025-2026 General Fund budget:

TABLE 2
The Fiscal Year 2025-2026 proposed budget represents improvements in the format budget balancing methods from the prior budget submissions to the Town Council. Staff has continued to improve the transparency and understandability of the budget document.

These improvements to the budget format are intended to increase the transparency of the budget process and provide a clear picture of the Town’s spending plan for the next fiscal year.

Town Council Agenda Report
Date: June 10, 2025
To: Honorable Mayor and Town Council
Subject: ADOPT RESOLUTION NO. 2025-14 ADOPTING THE FISCAL YEAR 2025-26 APPROPRIATION LIMIT
From: Douglas Robertson, Town Manager
Submitted by: Adam Cripps, Assistant Director of Finance Finance Department
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
Adopt Resolution No. 2025-14 of the Town Council of the Town of Apple Valley, California, establishing the Fiscal Year 2025-26 Appropriations Limit for the Town at $54,830,187 by using the Town’s population growth for the population adjustment and the California per capita income growth for the inflationary adjustment.

BACKGROUND
Since the addition of Article XIII-B to the Constitution of California in November 1979, the Town has been required to annually establish an Appropriations Limit. The ideology behind establishing an annual appropriation limit is that if an agency’s ability to spend tax proceeds each year is controlled, then the growth in tax revenues can be systematically and incrementally managed to lessen the impact or tax burden upon taxpayers throughout the State. In June 1990, Article XIII-B and its implementing legislation Chapter 1205/80 were modified by Proposition 111 and SB 88. The modifications changed the annual adjustment factors for determining the Appropriations Limit.

Beginning with the calculation of the Appropriations Limit for Fiscal Year 1990-1991, the Town may choose one of the following factors to use for inflationary adjustment:

1. The growth in California per capita income; or

2. The growth in the non-residential assessed valuation due to new construction within the Town.

In addition, the Town may choose to use either the population growth of the Town or the population growth within the County. These two adjustment factors, one for inflation and

Page 136 of 141 ends

one for population, are both annual elections for the Town in determining its Appropriations Limit.

ANALYSIS
The methodology used to determine the Town’s Appropriations Limit is to multiply the inflation and population adjustment factors by the prior year’s Appropriations Limit. For Fiscal Year 2025-26, the inflation and population figures provided by the State Department of Finance are as follows: California Per Capita Income Percentage Change

6.44% Town of Apple Valley’s Population Growth -0.11% Since the growth in nonresidential assessed valuation due to new construction is not available at this time, the growth in California Per Capita Income must be used as the inflationary factor. The Town’s Appropriations Limit for Fiscal Year 2025-26 is calculated at $54,830,187. This amount is the result of applying the 6.44% California per capita personal income factor and the -0.11% Town of Apple Valley population growth factor to the Fiscal Year 2024- 25 adopted Appropriations Limit of $51,569,491. The total estimated revenues generated from general tax proceeds for Fiscal Year 2025-26 is $37,126,990. This estimate is $17,703,197 or 32.29% below the proposed Appropriations Limit for Fiscal Year 2025-26.

FISCAL IMPACT
The Town’s total estimated revenue from general tax proceeds is $37,126,990 or

32.29% below the proposed Fiscal Year 2025-26 Appropriations Limit. Therefore, the Town is well within its Appropriations Limit established pursuant to Section 7910 of the Government Code of the State of California and will not exceed this limit during Fiscal Year 2025-26.
