That the Town Council:
Award a contract to Ames Construction, Inc. for the Bear Valley Road Bridge over Mojave River Rehabilitation – Project No. 2023-05 in an amount of $43,758,051.37 (forty-three million seven hundred fifty-eight thousand fifty-one dollars and thirty-seven cents) and authorize a ten percent (10%) contingency in the amount of $4,375,805.14.
Authorize the Town Manager to execute all documents necessary to enter into the contract including any necessary amendments or change orders.

7.1 SUBSTANTIAL AMENDMENT TO THE 2025-2026 ACTION PLAN

It is recommended that the Town Council conduct a public hearing and upon accepting public testimony; Approve a Substantial Amendment to the Community Development Block Grant (“CDBG”) 2025-2026 Annual Action Plan (“Action Plan”) by repurposing $120,092.73 in unspent prior year funds and current year program income to one (1) new and three (3) existing CDBG eligible activities; and Authorize the Town Manager, or designee, to execute and transmit all necessary documents, including the Substantial Amendment to the Action Plan, and any additional amendments, to assure the Town’s timely expenditure of CDBG funds.

REQUIREMENTS
That the Town Council open the public hearing and take testimony; and close the public hearing; and Determine
that, in accordance with the California Environmental Quality Act (CEQA), the recommended action is exempt from CEQA per Section 15061(b)(3), the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question, the proposed Code Amendment, may have a significant effect on the environment, the activity is not subject to CEQA; and Find
that the facts presented within the Agenda Report, including the attached Planning Commission Agenda Report, support the required Findings for approval of the proposed Development Code Amendment and adopt the Findings; and Move
to waive the reading of Ordinance No. 575 in its entirety and read by title only.
