Subject: BARN CAT/WORKING CAT ADOPTION PROGRAM
From: Todd Bodem, Town Manager
Submitted by: Adriana Atteberry Animal Services Manager Animal Services Department
Budgeted Item: Yes No N/A
RECOMMENDED ACTION
Staff recommends that the Town Council approve the Barn Cat/Working Cat Adoption Program
BACKGROUND
The Apple Valley Town Council has placed a high priority on meeting State mandates for animal services and sheltering by providing a municipal animal shelter that has raised the bar for humane treatment/housing of stray and unwanted animals in our community. The level of care we provide is not only expected by our residents, but it has also been demanded by the citizens we serve and animal welfare advocates across the nation.
SUMMARY
On average Apple Valley Animal Services receives 800 fractious cats (i.e., a cat that is easily irritated, quarrelsome, and shows aggressive behaviors like hissing, swatting, or biting, often due to fear, stress, or pain in unfamiliar situations like a vet visit or grooming, making them difficult to handle). Historically, 70% of these cats are being euthanized.
These fractious cats that enter our facility are not suitable for indoor pets, but they are looking for a job!
Staff is proposing a Barn Cat/Working Cat Adoption Program –These cats can be successful in barns, workshops, and warehouses that are prone to rodents. Through the program, all barn cat / working cats will be sterilized, vaccinated, ear tipped, and treated for parasites. This program can help increase the live release and reduce euthanasia at our shelter.
The current rate for cat adoption is $40.00 per cat. Through the Barn Cat / Working Cat Adoption Program, the $40.00 adoption fee will be waived.
FISCAL IMPACT
The discounted adoption fees will be covered by fundraising dollars. This will ensure that there is no impact to the operating budget of the Animal Services Department.

Barn Cat / Working Cat Adoption Program
What is a Barn Cat / Working Cat?
These types of cats typically display unsocial characteristics, minimal to no human contact and are not suitable for indoor pets.
What is the Barn Cat / Working Cat Adoption Program?
Apple Valley Animal Services is offering this adoption program for cats that are not accustomed or suitable to living indoors. Barn Cats / Working Cats will provide pest control for barns, garages, businesses, and warehouses.
What is the adopters commitment?
While this cat can mainly live outdoors, the caretakers should provide safe housing such as a barn, garage, or a building where the cat can sleep or escape from predators. Caretakers must also provide continuing water, food, and veterinarian care as needed.
What is included in the Barn Cat / Working Cat Adoption Program? The barn cat / working cat will be spayed or neutered, vaccinated, treated for parasites and ear-tipped.
The adoption fee will be waived for qualified adopters. It is recommended to adopt two cats, this will help the cats with the transition of their new environment which can increase the likelihood that they will stay in the area.
22131 Powhatan Rd. Apple Valley CA 92308 (760)240-7555 AVAnimals.org How do I introduce my barn cat / working cat to it’s new home? To ensure the barn cat / working cat success, you must allow a 2-4 week transition period. The cat should be confined in an enclosed area where they will be living, this will give the cat time to adjust to the new surroundings. It is important for the enclosed area not to be too hot or too cold and that it can protect the cat from the elements. If adopting more than one cat, each cat should initially have its own space and after 2 weeks, it can be released. Additionally, food, water, and a litter box must be provided and remember, it is common for barn cats / working cats to hide until they feel secure with their surroundings.

FOUNDATION PARTNERSHIP
From: Todd Bodem, Town Manager
Submitted by: Adriana Atteberry, Animal Services Manager Animal Services Department
Budgeted Item: Yes No N/A
RECOMMENDED ACTION
Approve the partnership between the Lange Foundation and the Town of Apple Valley Animal Services.
SUMMARY
Animal Services has experienced an increase in the number of pets being impounded or surrendered at the Apple Valley Animal Shelter. Staff believe the increase in animals impounded at the shelter is a result of the lack of spay/neuter resources and increased veterinary costs.
Apple Valley Animal Services and the Lange Foundation share the same goal, and that is to reduce the number of pets being surrendered or impounded at the shelter.
Partnering with the Lange Foundation will assist Town residents with spay/neutering vouchers, pet supplies, pet food, veterinary cost, return to owner fees if the pet was impounded at the shelter, and other associated costs. This program can help reduce our euthanasia rate and promote responsible pet ownership.
BACKGROUND

Subject: ACCEPTANCE OF WORK FOR THE YUCCA LOMA ELEMENTARY
SAFE ROUTES TO SCHOOL PROJECT
From: Todd Bodem, Town Manager
Submitted by: Richard Pedersen, Town Engineer
Engineering Division
Budgeted Item: Yes No N/A
RECOMMENDED ACTION
That the Town Council:
A. Accept the work completed by LCR Earthwork & Engineering, Corp. for the Yucca Loma Elementary Safe Routes to School project for a total contract cost of $2,538,375.47.
B. Direct the Town Clerk to file the Notice of Completion for the contract work.
C. Direct the Finance Director to release the retained funds 30 days after the Notice of Completion has been filed, provided no claims are filed against the contractor.
BACKGROUND
The Town of Apple Valley was awarded an Active Transportation Program grant from the State for the Yucca Loma Elementary Safe Routes to School project which is a continuation of a previous project that added curb, gutter, and sidewalk to the frontage of the school. This next phase added accessible pathways from residential areas where students and their families live by closing a sidewalk gap and along Powhatan Road west of Navajo Road, and at the school’s southerly driveway approach on Rancherias Road.
The project was advertised and awarded to LCR Earthwork & Engineering, Corp. for a project cost of $2,523,370.00. During the course of construction, plan revisions were essential to ensure proper drainage and ADA compliance increasing the overall project cost to $2,552,260.50.
On December 13, 2024, during paving operations, the Contractor failed to properly cover a wastewater manhole on Powhatan Road causing asphalt to fall into the hole. On
December 15, 2024, Public Works staff were notified that the sewer in the area was backing up which was a result of the asphalt blocking the flow of wastewater. Staff worked diligently into the evening to repair the blockage which resulted in a total man hour cost to the Town of $13,884.05. The contractor was made aware of the incident, accepted responsibility, and agreed to cover the staff time.
ANALYSIS
Engineering staff inspected the project area and deemed the work to be complete and acceptable.
FISCAL IMPACT
The approved budget for the project at the time of award was $2,688,000.00 consisting of a combination of grant funds ($647,000), Drainage Impact Fees ($391,000), Local Transportation Funds ($700,000), and Measure I ($950,000). With the deduction of $13,884.05 due to the forced staff time for repairs, the final contract cost is $2,538,375.47.

Notes
I received a call from Bret at 10:30 AM that there was a sewage backup on Powhatten and also Mohawk. I arrived on site at 10:45 AM. Town crews were clearing AC from Manhole lids to find obstruction. Found that a MH was filled with 3+ feet of AC base course from the prior days paving operation. After a site inspection it determined that during the base paving of the street the contractor’s paving crew hit the MH ring and lid moving it and allowing the AC to deposit inside MH. Someone on the contractor’s crew must have repositioned the frame and lid without informing anyone. Paving the streets AC base course was completed on Friday 12/13/24 5:00 PM. I was not aware of what had taken place until the Town PW crew was called out on Sunday 12/15/24 at 10:30 AM. The town PW crews were on site from approximately 10:30 AM until 9:00 PM working with contractor to find blockage and run sewage bypass and handle Traffic Control. After a discussion with Ricardo Perez the foreman- LCR he also said that who ever had replaced the frame and lid didn’t inform anyone and in his discussion with the owner of LCR that they were going to find out who was involved. They also both admitted that this situation was their company’s fault and that they acknowleged they would be receiving a bill from the town for cost reimbursements and possibly any damage caused to residents property.

RECOMMENDED ACTION
Adopt Resolution No 2026-01 authorizing submittal of a claim form to the San Bernardino County Transportation Authority (SBCTA) for the Transportation Development Act (TDA) Article 3 funds for the Bear Valley Road Pathway Project.
BACKGROUND
On June 4, 2025, the SBCTA Board of Directors authorized the release of the Transportation Development Act (TDA) Local Transportation Fund (LTF) Article 3 Call for Bicycle and Pedestrian Facilities and Transit Stop Access Improvements. Local jurisdictions and transit agencies were notified of this opportunity through the SBCTA’s website and Transportation Technical Advisory Committee (TTAC) email list. The amount of Article 3 funds to be available for the award is $5,977,000. The closing date for the Call for Projects was August 6, 2025.
The TDA provides that two percent of the State of California Local Transportation Funds (LTF) be made available to counties and cities for facilities for the exclusive use of bicyclists and pedestrians, known as the TDA Article 3 Program. In August 1999, the SBCTA Board (Board) approved a policy that 80 percent of TDA Article 3 funds would be made available for projects that implement or improve bicycle and pedestrian facilities.
The remaining 20 percent of the TDA Article 3 program would be made available for projects that improve access to transit stops for pedestrians and persons with disabilities.
On November 5, 2025, the SBCTA Board of Directors approved funding from the TDA Article 3 Bicycle and Pedestrian Facilities Program for the Bear Valley Road Pathway:
Apple Valley High School to Singh Center for the Arts Project in the amount of $605,906.
The total estimated cost of the project is $1,211,812.50. This infrastructure project will construct a 3,700-foot long, 10-foot wide, 4-inch-thick Class I multi-use concrete pathway on the south side of Bear Valley Road, connecting two major community destinations— Apple Valley High School and the Singh Center for the Arts.
As a requirement of the TDA Article 3 grant, agencies are required to adopt a resolution authorizing submittal of a claim form to SBCTA.
FISCAL IMPACT
The Town’s General Fund will be reimbursed in the amount of $605,906.
