Town Council Agenda Report
Date: May 26, 2026
To: Honorable Mayor and Town Council
Subject: APPROVAL OF ADDENDUM 3 TO THE JOINT USE AGREEMENT

WITH THE APPLE VALLEY UNIFIED SCHOOL DISTRICT TO REVISE

INTERSESSIONAL DAY CAMP SCHEDULE
From: Guy Eisenbrey, Town Manager
Submitted by: Debbie Rivera, Director of Parks and Recreation Parks and Recreation Department
Budgeted Item: Yes No N/A

RECOMMENDED ACTION
That the Town Council approve Addendum 3 to the existing Joint Use Agreement with the Apple Valley Unified School District for Intersessional Day Camp Services, revising the Day Camp schedule previously approved in Addendum No. 1 dated November 29, 2023, to update the operating schedule for the Day Camp program.

BACKGROUND
The original Joint Use Agreement between the Town of Apple Valley and the Apple Valley Unified School District was approved and executed on December 23, 2009 for the purpose of providing the After-School Activity Programs (ASAP) and Day Camp programming during school intersessional breaks. The agreement established a partnership to support recreational services for youth during periods when school is not in session.

Addendum 1, dated November 29, 2023, established the approved intersessional Day Camp schedule. The School District has since requested a revised schedule to better align with its operational needs and intersessional programming priorities.

Addendum 3 reflects this requested adjustment and revises the approved Day Camp schedule to provide programming during the following intersessional periods annually:
 Fall Break – 5 days
 Spring Break – 5 days
 Summer Break – 20 days

Page 15 of 53 ends

Addendum 3 provides for a total of 30 Day Camp days annually. The revised schedule removes Winter Break Day Camp from the approved intersessional schedule provided by AVUSD. All other terms and conditions of the Joint Use Agreement remain unchanged.

ANALYSIS
The proposed Addendum 3 to the Joint Use Agreement with the Apple Valley Unified School District reflects an operational adjustment to the intersessional Day Camp schedule to better align programming with school district needs and seasonal demand.

The revision maintains the overall structure of the partnership while refining the distribution of service days across the year.

From an operational standpoint, the shift to 30 total Day Camp days annually concentrated within Fall Break, Spring Break, and Summer Break is consistent with typical peak demand periods for youth programming. The removal of Winter Break programming suggests lower historical participation during that period.

The Town’s cost recovery model remains unchanged, as staffing and supply expenditures are scaled based on actual enrollment. As such, the amendment does not introduce new fiscal obligations or staffing commitments beyond existing practices.

FISCAL IMPACT
There is no fiscal impact to the Town associated with the approval of Addendum 3 to the Joint Use Agreement with the Apple Valley Unified School District for Intersessional Day Camp Services.

The Day Camp program is operated on a variable-cost basis, with staffing levels and program supplies adjusted in direct relation to participant enrollment and program demand. As a result, program expenditures are offset by program revenues, and the proposed schedule revision does not result in any additional net cost to the Town.

1. Revised Intersessional Day Camp Schedule
This addendum revises the approved intersessional Day Camp Schedule previously outlined in Addendum 1 dated November 29, 2023.

The Day Camp program shall be operated during the following intersessional periods:
 Fall Break: 5 Days
 Spring Break: 5 Days

BACKGROUND
Staff inspected and approved the construction of Parcel Map 20473 improvements and recommends that the Town accept the improvements as complete and reduce the performance security to 50% and release of the labor and materials security. The remaining 50% of the performance security will be retained by the Town for one year as a warranty/maintenance bond.

To: Honorable Mayor and Town Council
Subject: INTRODUCE, READ BY TITLE ONLY, AND WAIVE FURTHER READING OF ORDINANCE NO. 576 AMENDING TITLE 11 OF THE
APPLE VALLEY MUNICIPAL CODE BY ADDING CHAPTER 11.130

FOR RECOVERY OF EXPENSES INCURRED BY THE TOWN OF

APPLE VALLEY RELATED TO PERSONS DRIVING UNDER THE

INFLUENCE
From: Guy Eisenbrey, Town Manager
Submitted by: Monica Camacho, Interim Code Enforcement Manager Code Enforcement Division
Budgeted Item: Yes No N/A
RECOMMENDED ACTION:

Staff recommends that the Town Council take the following actions pertaining to Ordinance No. 576 adding Chapter 11.130 to the Town Municipal Code relating to DUI Emergency Response Cost Recovery:

A. Find that the proposed Ordinance No. 576 is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15061(b)(3), as it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment.

B. Move to waive the reading of Ordinance No. 576 in its entirety and read by title only.

C. Move to introduce Ordinance No. 576, adding Chapter 11.130 to the Town Municipal Code related to DUI Emergency Response Cost Recovery.

D. Direct Staff to file a Notice of Exemption.

SUMMARY:

California Government Code Sections 53150 through 53159 authorize local municipalities to recover costs of emergency response services resulting from incidents caused by persons driving under the influence of alcohol or drugs. The Town’s current fee schedule

Page 40 of 53 ends

(Exhibit “A”) includes provisions for recovery of emergency response costs related to DUI incidents. The Town now seeks to adopt corresponding municipal code sections establishing an administrative process for the recovery of DUI-related emergency response costs, including cost calculation, notice, administrative review, appeal, and collection procedures.

BACKGROUND:

The California Government Code Sections 53150 through 53159 allows municipalities to recover costs arising from emergency responses involving individuals operating vehicles under the influence of alcohol or drugs (DUI).

Section 53150 provides that a person who is under the influence of alcohol and/or drugs and whose operation of a motor vehicle proximately causes an incident resulting in an emergency response is liable for the expense of that response. Court interpreting the statute have identified five elements that must be present prior to cost recovery:
“Any person who is [1] under the influence of an alcoholic beverage or any drug, . . . [2] whose negligent operation of a motor vehicle [3] caused by that influence [4] proximately causes any incident [5] resulting in an appropriate emergency response, . . . is liable for the expense of an emergency response by a public agency to the incident.”
Routine traffic stops that do not involve an emergency response generally do not qualify for cost recovery under California law.

Section 53155 provides that a municipality may recover reasonable costs associated with police, rescue, and emergency medical services provided at the scene of an incident.

Recoverable costs may include field investigation, victim transportation, report preparation, and other activities directly related to the emergency response. State law limits the maximum amount recoverable to $12,000 per incident.

To implement this statutory authority, local agencies must establish procedures for determining, billing, and collecting such costs. The proposed ordinance provides this framework and ensures consistency with due process requirements, including notice and an opportunity for administrative review and appeal.

ISSUES/ANALYSIS:

The Town’s current fee schedule includes provisions allowing recovery of actual costs associated with emergency responses resulting from DUI-related incidents. However, the adoption of a supporting municipal code section is necessary to establish the legal framework necessary to implement and enforce the recovery process.

Page 41 of 53 ends

State law allows the recovery of actual costs incurred by the Town in responding to incidents involving individuals suspected of driving under the influence. These costs may include salaries and benefits of responding personnel, equipment usage, and materials required to investigate, arrest, and detain the involved individuals.

In addition, the Town may recover costs associated with medical assistance, traffic control, vehicle removal, and other emergency response activities. Police service costs are based on the hourly contract rate for law enforcement services provided through the County of San Bernardino, which includes personnel salaries and benefits.

Because emergency responses vary widely depending on the severity of the incident, cost recovery amounts will differ for each case and will be calculated based on the personnel time, equipment, and resources utilized during the response.

During calendar year 2025, there were 121 arrests related to driving under the influence of alcohol or drugs within the Town. Of those arrests, approximately 39 % involved traffic collisions and 3 incidents resulted in fatalities. Only incidents requiring emergency response services are eligible for cost recovery under state law. For 2025, 47 incidents would have qualified for cost recovery.

Exhibit B provides a sample Emergency Response Cost Recovery log and cost estimate from a DUI arrest resulting from a two vehicle traffic collision that occurred on February 28, 2026, where minor injuries were sustained. Based on the time spent by Apple Valley Police personnel responding to and investigating the incident, the estimated cost recovery would be approximately $3,557.03.

In more severe incidents involving serious injury or fatalities, the Major Accident Investigation Team (MAIT) may be required to conduct a detailed investigation. These investigations can involve 50 to 60 combined personnel hours, including initial response, investigative analysis, witness interviews, report preparation, and review of autopsy findings. In such cases, response costs may approach the statutory maximum recovery limit of $12,000 per incident.

Costs associated with Public Works personnel supporting the emergency response, including traffic control, roadway closure, and debris removal, may also be included in the recovery calculation, subject to the statutory maximum.

Under Government Code Section 53154, recovery of emergency response costs related to DUI incidents is considered a civil matter. The Town will be responsible for billing and

Page 42 of 53 ends

collecting the costs from the responsible party in accordance with procedures established through the adoption of the proposed ordinance.

FISCAL IMPACT:

Currently, the Town absorbs all costs associated with emergency responses to DUIrelated incidents. California Government Code Sections 53150 through 53159 provide municipalities the authority to recover these costs from the responsible party.

Police response cost reimbursement will be based on the contract rates for law enforcement services provided by the County of San Bernardino. Reimbursement rates for Town employees will be based on the actual hourly rates of responding personnel.

Equipment and material costs will be calculated based on actual replacement or usage costs incurred by the Town.

Adoption of the proposed ordinance will allow the Town to recover a portion of the public funds currently expended on preventable DUI-related emergency responses.

NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF APPLE VALLEY, CALIFORNIA, DOES ORDAIN AS FOLLOWS:

Section 1. The recitals above are true and correct and are hereby incorporated herein by this reference.

Section 2. Chapter 11.130 of the Apple Valley Municipal Code is hereby amended in its entirety to read as follows:
“CHAPTER 11.130 – DUI Emergency Response Cost Recovery
Sections:

11.130.010 – Purpose.

This Chapter is adopted pursuant to California Government Code Sections 53150 et seq. for the following purposes:
(a) To provide for the recovery of costs incurred by the Town in the apprehension and arrest or citation of persons who are convicted of an offense involving driving under the influence of alcohol or drugs; and

Page 45 of 53 ends

Ordinance No. 576
-3-
The Town Council finds as follows:
(a) That persons who drive a vehicle while under the influence of alcohol or drugs create a serious hazard to themselves and others; (b) That the Town’s law enforcement and emergency response personnel are required to spend a significant amount of time in the apprehension and arrest of persons who drive while under the influence of alcohol or drugs and in responding to incidents caused by such persons;
(c) That the time spent for that purpose is costly and detrimentally affects the ability of such personnel to respond to other calls or incidents; (d) That, although California Government Code Sections 53150 et seq. provide for cost recovery related to emergency responses, the apprehension and arrest of persons driving under the influence is also costly and time-consuming, even when an emergency response is not required; and
(e) That persons who are apprehended or arrested for driving under the influence, as well as those who cause an incident and are subsequently convicted, should reimburse the Town for such costs.

11.130.030 – Civil Liability.

Any person who is arrested or cited by the Town for driving a vehicle while under the influence of alcohol or drugs and who is subsequently convicted of such an offense shall be assessed a cost recovery fee to reimburse the Town for costs incurred which are related to the making of that arrest or issuance of that citation. In addition, if such person caused an incident while under the influence, the cost recovery fee shall include additional costs incurred in responding to that incident.

11.130.040 – Liability Upon Conviction.

The civil liability imposed herein shall arise upon the conviction of a person for an offense involving driving under the influence of alcohol or drugs. Convictions giving rise to such liability include violations of California Vehicle Code Section 23152, Section 23103 as specified in Section 23103.5, or any other law requiring a finding that the person drove under the influence. A conviction includes a plea of guilty or no contest or a finding of guilt by a court.

11.130.050 – Notice of Assessment of Cost Recovery Fees.

Upon the conviction of an offense giving rise to liability under this Chapter, the Town Manager or designee shall cause a notice of assessment to be mailed to the person

Page 46 of 53 ends

Ordinance No. 576

convicted. The notice shall include the amount of the cost recovery fee and inform the person of the right to request administrative review as provided in this Chapter.

11.130.060 – Payment of Cost Recovery Fees.
(a) Any cost recovery fee assessed pursuant to this Chapter shall be due and payable on or before the last day of the month in which the notice of assessment was mailed.
(b) If the fee is not paid when due, a delinquent penalty of ten percent (10%) shall be added on the last day of each month after the due date, not to exceed fifty percent (50%) of the original fee.
(c) Interest shall accrue on the unpaid balance at the rate of one percent (1%) per month from the date the fee became delinquent until paid.

11.130.070 – Administrative Review.
(a) Any person aggrieved by the determination to assess a fee or the amount of the fee may apply in writing to the Town Manager for administrative review within fifteen (15) days from the date the notice of assessment was mailed. (b) The application shall state the reasons for the review and the relief requested.
(c) The Town Manager shall review the application and may affirm, reverse, or modify the determination. The Town Manager may, in discretion, conduct a hearing. (d) Written notice of the decision shall be mailed to the applicant. (e) If the determination is upheld, payment shall not be due until the last day of the month following the mailing of the decision, unless an appeal is filed.

11.130.080 – Appeal.

Any person aggrieved by a decision made pursuant to Section 11.130.070 may appeal to the Town Council in accordance with Chapter 2.04 of this Code. If the Town Council affirms the assessment, payment shall be due immediately following the Council’s decision.”
Section 3. Compliance with California Environmental Quality Act. This Ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA) and the State CEQA Guidelines and it has been determined that approval of the Ordinance is exempt from further environmental review under the general rule in California Environmental Quality Act (CEQA) Guidelines

Page 47 of 53 ends

Ordinance No. 576
-5-
Section 15061(b)(3) that CEQA only applies to projects that have the potential for causing a significant effect on the environment. As a series of text amendments and additions without any physical project being approved, it can be seen with certainty that there is no possibility that the amendments to the Municipal Code will have a significant effect on the environment. The Town Council concurs in these findings and adopts them as its own.

Section 4. Notice of Adoption. The Town Clerk of the Town of Apple Valley shall certify to the adoption of this ordinance and cause publication to occur in a newspaper of general circulation and published and circulated in the Town in a manner permitted under Section 36933 of the Government Code of the State of California.

Section 5. Effective Date. This Ordinance shall become effective thirty (30) days after the date of its adoption.

Section 6. Severability. If any section, sentence, clause or phrase of this Ordinance or the application thereof to any entity, person or circumstance is held for any reason to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect other provisions or applications of this Ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this Ordinance are severable. The Town Council of the Town of Apple Valley hereby declares that it would have adopted this Ordinance and each section, sentence, clause or phrase thereof, irrespective of the fact that any one or more section, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.

APPROVED and ADOPTED by the Town Council of the Town of Apple Valley and signed by the Mayor and attested by the Town Clerk this 9th day of June, 2026.
