Town Council Agenda Report
Date: June 23, 2026
To: Honorable Mayor and Town Council
Subject: RESOLUTION 2026-19 ADOPTING FISCAL YEAR 2026-2027 SENATE BILL 1 (SB 1) ROAD MAINTENANCE AND REHABILITATION
ACCOUNT (RMRA) PROJECT LIST
From: Guy Eisenbrey, Town Manager
Submitted by: Richard Pedersen, Town Engineer
Engineering Department
Budgeted Item: Yes No N/A
RECOMMENDED ACTION
Adopt Resolution 2026-19 Identifying the project(s) to be funded by Senate Bill 1 Road Maintenance Rehabilitiation Account (RMRA) funding.
SUMMARY
Pursuant to the requirements of Senate Bill 1 (SB 1), each local jurisdiction receiving funds must submit a list of street maintenance projects each year to be eligible for RMRA funds. Fiscal Year 2026-2027’s RMRA allocation for the Town of Apple Valley is estimated to be $2,136,020.
BACKGROUND
On April 28, 2017, the Governor signed SB 1 (Beall, Chapter 5, Statutes of 2017), which is known as the Road Repair and Accountability Act of 2017. To address basic road maintenance, rehabilitation and critical safety needs on both the state highway and local streets and road system, SB 1: increases per gallon fuel excise taxes; increases diesel fuel sales taxes and vehicle registration fees; and provides for inflationary adjustments to tax rates in future years.
Beginning November 1, 2017, the State Controller began depositing various portions of this new funding into the newly created RMRA. A percentage of this new RMRA funding will be apportioned by formula to eligible cities and counties pursuant to Streets and Highways Code section 2032(h) for basic road maintenance, rehabilitation, and critical safety projects on the local streets and roads system.
The goal of SB 1 is to bring all streets up to an average pavement condition index of 80 (80 out of 100). Currently, the average pavement condition index for the Town’s roads is
72. Per the SB 1 guidelines, the Town’s Pavement Management System is the tool used to identify roadway segments for inclusion in RMRA funded projects.
For Fiscal Year 2026-2027, Engineering staff recommends funds go towards the Chip Seal 2026 project which includes the Desert Knolls area east of Apple Valley Road, north of Yucca Loma Road, and southwest of Highway 18 South as shown in the attached project map. The heavily traveled segments were selected based on their current condition and anticipated traffic volumes.

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN
OF APPLE VALLEY, CALIFORNIA, ADOPTING A LIST OF
PROJECTS FOR FISCAL YEAR 2026-2027 FUNDED BY
SB 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT
OF 2017
WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and signed into law by the Governor in April 2017 to address the significant multi-modal transportation funding shortfalls statewide; and
WHEREAS, SB 1 includes accountability and transparency provisions that will ensure the residents of the Town of Apple Valley are aware of the projects proposed for funding in our community and which projects have been completed each fiscal year; and WHEREAS, the Town of Apple Valley must adopt by resolution a list of projects proposed to receive fiscal year funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB 1, which must include a description and the location of each proposed project, a proposed schedule for the project’s completion, and the estimated useful life of the improvement; and
WHEREAS, the Town will receive an estimated $2,136,020 in RMRA funding in Fiscal Year 2026-2027 from SB 1; and
WHEREAS, this is the tenth year in which the Town of Apple Valley is receiving SB 1 funding and will enable the Town of Apple Valley to continue essential road maintenance and rehabilitation projects, safety improvements, repairing and replacing aging bridges, and increasing access and mobility options for the traveling public that would not have otherwise been possible without SB 1; and WHEREAS, the Town of Apple Valley has undergone a robust public process to ensure public input into our community’s transportation priorities/the project list; and WHEREAS, the Town of Apple Valley used a Pavement Management System to develop the SB 1 project list to ensure revenues are being used on the most high-priority and cost-effective projects that also meet the community’s priorities for transportation investment; and
Resolution 2026-19
WHEREAS, the funding from SB 1 will help the Town of Apple Valley maintain and rehabilitate residential, collector, and arterial roads throughout the Town of Apple Valley this year with similar projects into the future; and
WHEREAS, the 2023 California Statewide Local Streets and Roads Needs Assessment found that the Town of Apple Valley’s streets and roads are in “good” condition, and this revenue will help us increase the overall quality of our road system and over the next decade will bring our streets and roads into a “very good” condition; and
WHEREAS, the SB 1 project list and overall investment in our local streets and roads infrastructure with a focus on basic maintenance and safety, investing in complete streets infrastructure, and using cutting-edge technology, materials and practices, will have significant positive co-benefits statewide.
NOW, THEREFORE BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF APPLE VALLEY AS FOLLOWS:
SECTION 1. The above recitals are true and correct and are incorporated herein by this reference.
SECTION 2. The following list of newly proposed projects will be funded in-part or solely with Fiscal Year 2026-27 Road Maintenance and Rehabilitation Account revenues:

SECTION 5. CEQA. The Mayor and Town Council finds this Resolution is not subject to the California Environmental Quality Act (CEQA) in that the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty, as in this case, that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. At this stage, the proposed projects are simply proposed for funding. Environmental impacts will be assessed during the design and prior to the construction phase.
SECTION 3. Effective Date. This Resolution shall become effective immediately.
SECTION 4. Certification. The Town Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions.
SECTION 5. Severability. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications, and to this end the provisions of this Resolution are declared to be severable.
APPROVED AND ADOPTED by the Town Council of the Town of Apple Valley this 23rd day of June 2025.

Subject: PROPOSITION 218 PUBLIC HEARING FOR SOLID WASTE
COLLECTION SERVICES
From: Guy Eisenbrey, Town Manager
Submitted by: Pamela Quick, Special Projects Manager
Municipal Services Department
Budgeted Item: Yes No N/A
RECOMMENDED ACTION
Consider the approval of new or increased solid waste service charges:
A. Open Public Hearing to hear public comments.
B. Close Public Hearing after all public comments have been heard, and determine if written protests have been received from the owners of the majority of parcels which are subject to the solid waste service rate increases.
C. If no majority protest exists, adopt Resolution No. 2026-20 Adopting Increases to the Rates for Solid Waste Service Charges.
BACKGROUND
Burrtect Waste Industries (“Burrtec”) provides solid waste services to single-unit residential, multi-family residential, and commercial customers within the Town pursuant to an exclusive franchise agreement. The franchise agreement further provides that the Town may permit Burrtec to adjust its rates each year in accordance with a specified cost index, with a maximum adjustment cap of four percent.
DISCUSSION
The rate structure for the solid waste service fees has three customer classes — residential, multi-family, and commercial. For residential customers, the solid waste service fees are calculated based on the size (e.g., gallons or cubic yards) of containers used. For multi-family and commercial customers, the solid waste service fees are calculated on the basis of the size (e.g., gallons or cubic yards) of the containers (i.e., barrels, bins or roll-off compactors) used and the number of pick-ups per week.
Customers may also request the delivery of temporary extra bins to their property. A
separate, temporary “bin delivery fee” is a fixed charge imposed on any customer who requests these services.
Proposed Rate Increases:
The proposed increases to rates are necessary to maintain existing solid waste services provided by Burrtec under the franchise agreement and to further allow adjustments based on CPI for the next five fiscal years, capping the total annual rate increases at 4% as defined herein.
If adopted, the proposed rates will take effect July 1, 2026, for all customer accounts as defined herein. The current and proposed bi-monthly and monthly rates and supporting rate worksheets for the solid waste service fees are set forth in Attachment “B”.
Proposition 218 Public Hearing:
Proposition 218 was approved by California voters in November 1996. Proposition 218 requires a majority protest proceeding before imposing or increasing any property-related fees, and includes procedural and substantive requirements.
Proposition 218 requires the Town to hold a public hearing and mail a notice of the public hearing to the owner of record and any tenant who is directly liable for the payment of the proposed fees. The Town must mail the notice at least forty-five (45) days prior to the date of the public hearing regarding the proposed fees. Property owners and affected tenants may protest the proposed fees by submitting their comments in writing to the Town. If the Town receives protests from more than half of the affected parcels, the Town may not approve the proposed fees. While some jurisdictions maintain that privately held solid waste service is not subject to Proposition 218, the Town conducts majority protest hearings in an abundance of caution.
In May 2026, the notices for today’s public hearing were mailed in compliance with Proposition 218.
Option 1 – Adopt Resolution No. 2026-20
First, the Town Council must hold the public hearing and, if no majority protest exists, the Town Council may adopt Resolution No. 2026-20 and approve the solid waste rate increases.
Option 2 – Take No Action
Second, the Town Council may opt to take no action and not make rate adjustments, but Burrtec would not be obligated to perform services to comply with state diversion requirements. Additionally, failure to implement statewide waste diversion requirements could result in the issuance of an enforcement action against the Town. Alternatively,
Council could provide direction to subsidize solid waste functions with general fund dollars, directly and negatively impacting the own’s ability to provide other vital services that are reliant on the same general funds.
FISCAL IMPACT
No expected fiscal impact.
CONCLUSION
Staff recommends that the Town Council adopt Resolution No. 2026-20 and approve the solid waste rate increases.

TOWN OF APPLE VALLEY
NOTICE OF PUBLIC HEARING
REGARDING PROPOSED INCREASE TO
SOLID WASTE RATES
June 23, 2026, at 6:30 P.M.
Town Hall Council Chambers
14955 Dale Evans Parkway
Apple Valley, CA 92307
NOTICE IS HEREBY GIVEN that the Town of Apple Valley (the “Town”) will hold a Public Hearing on June 23, 2026, at 6:30 p.m., at the Town Hall Council Chambers, located at 14955 Dale Evans Parkway, Apple Valley, CA 92307, to consider adopting proposed rate increases for the collection, handling, and disposal of solid waste services within the Town (“solid waste services”). The meeting can also be viewed on Frontier Channel 29, Charter Spectrum Channel 186 and online at applevalley.org.
Persons wishing to address the Council remotely may submit written comments or speak. To submit written comments, please email the Town Clerk at [email protected] by 12 p.m. on June 23, 2026. To speak on the item at the Council meeting, please complete a request to speak card upon arrival to the meeting and at the time of the requested agenda item, the Town Clerk will allow the person to speak to the Council for up to 3 minutes. This 45-day notice is hereby given in accordance with Section 6(a) of Article XIII D of the California Constitution.
Proposed Rate Increases
Burrtec Waste Industries (“Burrtec”) provides solid waste services within the Town pursuant to an exclusive franchise agreement. All properties within the Town are required to subscribe to the solid waste services provided by Burrtec unless they are expressly exempt under the Apple Valley Municipal Code. Pursuant to the franchise agreement, solid waste service fees are imposed on customers within the Town who receive solid waste services from Burrtec. The revenues from the fees are used to pay Burrtec for the solid waste services provided under the franchise agreement.
The rate structure for the solid waste service fees has three customer classes – residential, multifamily, and commercial. For residential customers, the solid waste service fees are calculated based on the size (e.g., gallons or cubic yards) of containers used, including containers for trash, recycling and organics. For multi-family and commercial customers, the solid waste service fees are calculated on the basis of the size (e.g., gallons or cubic yards) of the containers (i.e., barrels, bins or roll compactors) used, including containers for trash, recycling and organics, and the number of pick-ups per week. All costs for solid waste service fees are calculated to proportionately allocate the cost of providing solid waste services for each parcel based on the estimated amount of solid waste generated.
28314.00001\44912656.1
The franchise agreement allows Burrtec to recover increased costs of providing solid waste services due to inflation.
Annual CPI Adjustments and Future Automatic Increases
The proposed maximum solid waste service fees in Exhibit A account for inflation (as described below) effective July 1, 2026. Beginning July 1, 2027, and each July 1 thereafter, through and including July 1, 2031, the maximum solid waste service fees in Exhibit A shall be adjusted by an amount not to exceed the 12-month average change for the previous calendar year, if any, in the Consumer Price Index for All Urban Consumers (CPI-U), Not Seasonally Adjusted, All Items, Riverside-San Bernardino-Ontario, CA (“CPI”), as maintained and published by the Bureau of Labor Statistics, United States Department of Labor. This adjustment shall not exceed four percent (4%).
Public Hearing and Protests
The owner of record of any parcel upon which the proposed solid waste service fees are imposed or any tenant directly responsible for the payment of solid waste service fees (i.e., customer of record) may submit a written protest to the proposed rate increase; however, only one protest will be counted per identified parcel. Any written protest must: (1) state the protest is being submitted in opposition to the proposed rate increase; (2) provide the location of the identified parcel (by assessor’s parcel number or street address); and (3) include the name and signature of the property owner or tenant directly responsible for the payment of the solid waste service fees submitting the protest. Written protests may be submitted by mail or in person to the Town Clerk at Town of Apple Valley, 14955 Dale Evans Parkway, Apple Valley, CA 92307. The Town Clerk must receive written protests delivered by mail no later than 12 p.m. on the date of the Public Hearing, or if delivered in person, prior to the close of the public comment portion of the Public Hearing (date, time, and location noted above). Any written protests received following the close of the Public Hearing will not be counted. Please identify on the front of the envelope for any protest, whether mailed or submitted in person to the Town Clerk, Attn: Public Hearing on Rate Increases.
The Town Council will consider all written protests and oral comments to the proposed rate increases and annual rate adjustments at the Public Hearing. Oral comments at the Public Hearing will not qualify as formal protests unless accompanied by a written protest. Upon the conclusion of the Public Hearing, the Town Council will consider adoption of the rate increases to the Town’s solid waste service fees as described herein. If written protests against the proposed rate increases are not presented by a majority (50% + 1) of the property owners of the identified parcels upon which the proposed rates are to be imposed and tenants directly responsible for the payment of the solid waste service fees, the Town Council will be authorized to impose the rate increases as outlined above. If adopted, the proposed rates take effect July 1, 2026. The Town is conducting this Proposition 218 majority protest proceeding out of an abundance of caution and without conceding the applicability of Proposition 218 to the franchise agreement or to solid waste service provided by Burrtec.
If you have questions regarding this notice or how your rates will be affected, you may contact Pamela Quick at (760) 240-7000 ext. 7569 or visit https://applevalley.org/residents/trash-solidwaste.

RESOLUTION NO. 2026-20
RESOLUTION OF THE TOWN COUNCIL OF THE TOWN
OF APPLE VALLEY, CALIFORNIA, ESTABLISHING
RATES FOR SOLID WASTE SERVICE FEES
WHEREAS, Burrtec Waste Industries (“Burrtec”) provides solid waste services to single-unit residential, multi-family residential and commercial customers within the Town pursuant to a franchise agreement (the Agreement); and
WHEREAS, Burrtec is required to provide such solid waste services (“Services”) as set forth in the Agreement; and
WHEREAS, Burrtec has requested an adjustment for inflation and additional increases in disposal and administration costs related to the collection and processing of solid waste across all customer classes; and
WHEREAS, the proposed rates are designed to produce the minimum revenue needed to cover projected operating and administrative costs for Burrtec to provide solid waste services; and
WHEREAS, the revenues derived from the solid waste fees will be used exclusively for the provision of Services; and
WHEREAS, the solid waste service fees will not be imposed on a parcel unless the services are actually used by, or immediately available to, the owner of the parcel; and
WHEREAS, California Constitution article XIII D, section 6 (“Article XIII D”) requires that prior to imposing any increase to the property-related fee such as the solid waste service fees, the Town shall provide written notice (the “Notice”) by mail of: (1) the proposed increases to such rates and charges to the record owner of each parcel upon which the rates and charges are proposed for imposition and any tenant directly liable for payment of the rates and charges; (2) the amount of the rates and charges proposed to be imposed on each parcel; (3) the basis upon which the rates and charges were calculated; (4) the reason for the rates and charges; and (5) the date, time, and location of a public hearing (the “Hearing”) on the proposed rates and charges; and WHEREAS, pursuant to Article XIII D such Notice is required to be provided to the affected property owners and any tenant directly liable for the payment of the rates and charges not less than forty-five days prior to the Hearing on the proposed rates and charges; and
WHEREAS, the Town did provide such Notice to the affected property owners and tenants of the proposed solid waste service fees in compliance with Article XIII D; and WHEREAS, the Hearing was held on this day, June 23, 2026; and
Resolution No. 2026-20
WHEREAS, at the Hearing the Town Council heard and considered all oral testimony, written materials, and written protests concerning the establishment and imposition of the proposed rate increases for the solid waste service fees, and at the close of the Hearing the Town did not receive written protests against the establishment and imposition of the proposed rate increases for the service fees from a majority of the affected property owners; and
WHEREAS, the Town Council of the Town now desires to establish and impose the proposed rates for the solid waste service fees.
NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF APPLE
VALLEY, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. The Town Council finds and determines that the foregoing Recitals are true and correct and incorporates the Recitals herein.

SECTION 3. This Resolution is not subject to the requirements of the California Environmental Quality Act (“CEQA”). This Resolution is not a “project” within the meaning of Section 15378 of Title 14 of the California Code of Regulations (“State CEQA Guidelines”) because it has no potential for resulting in direct or indirect physical change in the environment. This Resolution is not a “project” within the meaning of Section 15378(b)(4) of the State CEQA Guidelines because it involves the creation of government funding mechanisms or other government fiscal activities, which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. This Resolution is also exempt under Section 15061(b)(3) because it can be seen with certainty that there is no possibility that the activity in question will have a significant effect on the environment.

If any section, subsection, subdivision, sentence, clause, or phrase in this Resolution or any part thereof is for any reason held to be unconstitutional or invalid, ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Resolution or any part thereof.
The Town Council hereby declares that it would have adopted each section irrespective of the fact that any one or more subsections, subdivisions, sentences, clauses, or phrases be declared unconstitutional, invalid, or ineffective.
