Amended and Restated Resolution No. 2026-23, approving the levy and collection of Fiscal Year 2026-27 assessments within the Apple Valley Village Property and Business Improvement District (PBID); Amended and Restated Resolution No. 2026-24, confirming delinquent animal control, utility, and code enforcement fees and costs against real property and directing that the charges constitute liens and be collected on the County property tax roll; and Amended and Restated Resolution No. 2026-25, confirming the diagram and assessment and levying the Fiscal Year 2026-27 assessment for Assessment District No. 1 pursuant to the Landscaping and Lighting Act of 1972.

PROJECT (2.52 MILLION SQ FT INDUSTRIAL WAREHOUSING AND RELATED INFRASTRUCTURE) That the Town Council conduct a public hearing and;
Find
that the environmental impacts of this Project were previously reviewed in conjunction with the Apple Valley 143 Project Environmental Impact Report (State Clearinghouse No. 2022070019) which was certified by the Planning Commission on November 15, 2023. This Development Agreement is consistent with the previously Certified Environmental Impact Report (the “Certified EIR”) and introduces no new significant environmental impacts; and The previous Certified EIR contains a complete and accurate reporting of the environmental impacts associated with the Project; and The previous Certified EIR was completed in compliance with CEQA and the Guidelines promulgated thereunder; and The previous Certified EIR reflects the independent judgment of the Planning Commission; and The proposed Development Agreement for the Project will introduce no new significant environmental impacts beyond those previously analyzed in the previous Certified EIR, and all mitigation measures previously adopted with the Certified EIR, are incorporated herein by this reference.
Find
that the provisions of Development Agreement 2026-002 are:
Consistent with the General Plan or any applicable specific plan; Compatible with the uses authorized in, and the regulations prescribed for the land use district in which the real property is located; and Not detrimental to the public health, safety and welfare.
