IX. OLD BUSINESS
X. NEW BUSINESS
A. Adopt Resolution Nos. 223-03 and 223-04, Authorizing an Amendment to the Standard Agreements for the 2020 Community Development Block Grant Program Coronavirus Response Act Funding, Moving $50,000 from the Arcata House Partnership Homeless Services Program to the COVID Safe Outdoor Event Program.

The State Department of Housing and Community Development (HCD) released the CDBG-Coronavirus Response Round 2 and 3 Notice of Funding Availability (NOFA) on December 18, 2020. The City Council adopted Resolution No. 201-45 approving a public service activity application for Arcata House Partnership Homeless Services in the amount of $629,410 and a public facility and infrastructure improvement activity application for the COVID Safe Outdoor Event Program in the amount of $114,380.

RECOMMENDATION:

It is recommended that the Council adopt Resolution Nos.

B. Public Hearing on Accomplishments Regarding Arcata’s Community Development Block Grant (CDBG) Grant Numbers 20-CDBG-PI-12006, 20- CDBG-CV1-0089, and 20-CDBG-CV1-00012 for Final Closeout.

The City of Arcata is closing out three Community Development Block Grants. The purpose of this hearing is to inform the Council and public on the accomplishments of these grants and receive public input. The first is the Sorrel Place acquisition-only project that was funded using program income. The second and third are the Arcata House Partnership Boyd Road Sewer Connection Project and the Mobile Intervention Services Program, both grants for which the City was awarded Community Development Block Grant Coronavirus Response Round 1 (CDBG-CV1) funds.

RECOMMENDATION:

It is recommended that the Council:
1) Open the public hearing, consider the accomplishments to be reported to the State Department of Housing and Community Development, Community Development Block Grant program, for the closeout of the Sorrel Place Affordable Housing Acquisition Program Income Award (20-CDBG-PI-12006), Arcata House Partnership Boyd Road Sewer Connection Project (20-CDBG-CV1-0089) and the Mobile Intervention Services Team Program (20-CDBG-00012). 2) Direct staff to submit final reports and closeout package to the state.

C. Consider the Introduction of Ordinance No. 1556 adding Chapter 7— Military Equipment Use Policy to Title III—Public Safety, of the Arcata Municipal Code.

In 2021, the California Legislature approved, and the Governor signed into law, Assembly Bill 481 (“AB 481”), which, among other things, adds Chapter 12.8 to Division 7 of Title 1 to the California Government Code providing certain requirements for the funding, acquisition, and use of military equipment, as defined, by local law enforcement agencies. AB 481 requires that the City Council adopt, by ordinance, a military equipment policy that complies with the requirements of AB 481 and to make said policy publicly available.

RECOMMENDATION:

It is recommended that the Council introduce Ordinance No. 1556, adding Chapter 7— Military Equipment Use Policy to Title III—Public Safety, of the Arcata Municipal Code, waive reading of the text and elect to introduce by title only.

D. Award Purchase Contracts to the Lowest Bidders for Supplying Various Equipment and Materials Needed for the New UV Disinfection System for the Arcata Wastewater Treatment Facility Improvement Project and Authorize the City Manager to Execute All Applicable Documents.

The Arcata Wastewater Treatment Facility Improvement Project (Phase I) involves installation of a new Ultraviolet (UV) Disinfection Equipment System, the supplier for which was selected through a competitive Request for Proposals process in early 2021.

Pre-procurement of the UV System was necessary for the supplier to design the UV system to meet the City’s facility and system needs, and to allow time for the equipment to be fabricated and delivered to Arcata so it was available for installation by the time the City selected a general contractor to complete the Project.

Due to recent significant delays in supply chains, the City elected to pre-procure some additional equipment and materials that will be necessary to complete the installation of the UV System once the general contractor has been selected. Pre-procurement of these items will assist the contractor in meeting the installation deadline necessitated by the City’s Community Development Block Grant—one of the Project’s funding sources.

RECOMMENDATION:

It is recommended that the Council:
1) Award a Purchase Contract to Golden Harvest, Inc., in the amount of $101,557.50 for the UV Disinfection Process Area Fabricated Slide Gates and Actuators; and 2) Award a Purchase Contract to the lowest responsible bidder for the UV Disinfection Process Area Piping and Valves, to be determined upon opening of the bids on 07/19/2022; and
3) Authorize the City Manager to Execute All Applicable Documents.

It is recommended that the Council consider assignments for currently vacant regional boards, commissions, committees, and liaison positions based on newly elected Councilmember Stillman’s schedule.

F. Statement by the City of Arcata of Unity against Anti-Semitic Messages and all Forms of Hate Speech.

Over the past couple of weeks, neighbors in Arcata, Eureka, Scotia and throughout the County were shocked to find plastic sandwich bags on their doorsteps filled with hateful anti-Semitic messaging. The City of Arcata wishes to make it clear that hate speech will not be tolerated by the community and we will continue to work together to make Arcata a welcoming place for everyone.

RECOMMENDATION:

It is recommended that the Council support a Statement of Unity against Anti-Semitic Messages and all Forms of Hate Speech.
