WHEREAS, youth development experts agree that mentoring is critical to the social, emotional and cognitive development of youth, helping them navigate the path to adulthood more successfully; and WHEREAS, our community has a number of community volunteers, teachers and many others who support the mentoring movement and work selflessly to improve our children’s odds for success.

NOW, THEREFORE, BE IT PROCLAIMED that the City Council of the City of Arcata hereby recognizes January 2025 as NATIONAL MENTORING MONTH and thanks all our local heroes who participate in quality mentoring programs to equip our youth with the tools to lead healthy and productive lives. The City Council also calls on residents to help close the gap between the availability of mentors and the number of children facing challenging circumstances who would love to spend time with a Big Brother, Big Sister, CASA Advocate, or Boys and Girls Club of the Redwoods Mentor.

Planning Commission Annual Report for 2024
This Planning Commission Annual Report to the City Council is intended to provide information regarding progress on various goals, how community needs are being met, how the Commission’s responsibilities are being fulfilled, the effectiveness of the policies and procedures, and any recommendations for change. The Council adopted the content of the report by resolution, which was most recently adopted in 2019. The Planning Commission approved this report on November 12, 2024.
Goals
The Commission assists in implementing City Council Goals. In addition, the Commission sets goals for itself. This section outlines the Commission’s and Council’s goals and progress during 2023. It also sets goals for 2024.
Planning Commission Goals
1) Update the General Plan and Associated Ordinances.
2024 Accomplishments. The Commission continued its work on the General Plan and targeted rezoning, including the Arcata Gateway Area Plan, through June of 2024. The Council approved the General Plan update and targeted zoning updates in July and October of 2024. 2025 Goal. The Commission anticipates working on the zoning amendments to the Land Use Code to create consistency between the General Plan and implementing zoning. In addition, the Commission is looking forward to working on objective design standards for the Valley West neighborhood, as well as the Accessory Dwelling Unit ordinance. This planning work is funded by the HUD PRO Housing Grant. 2) Finalize the Local Coastal Program.
2024 Accomplishments. The Commission continues to await revised documents to review. Staff has been working with Coastal Commission staff to complete their review. The Commission did not work on the Local Coastal Program in 2024. However, some Commissioners did attend an engagement event held for the update.
2025 Goal. Complete review of the comprehensive update of the Local Coastal Program, including the Gateway Area Plan certification in the coastal zone.
3) Streamline Permitting Appropriately.
2024 Accomplishments. The Commission has an ongoing goal to ensure the public’s resources are best used to achieve appropriate planning efficiently. The Planning Commission continues to work towards improving the process, making necessary code amendments, and reviewing policy to ensure it aligns with community goals and vision. While there were few discretionary project to review in 2024, the projects that came before the Commission were completed in one hearing typically. 2025 Goal. With the adoption of the General Plan comprehensive update, the Commission looks forward to concentrating on the necessary amendments to the Land Use Code, the City’s zoning ordinance, to implement the new vision and goals. The Commission will review the effectiveness of the ministerial hearings called for in the Gateway Code and make recommendations to Council in 2025.
4) Regional Planning.
2024 Accomplishments. The Commission had no activity in this area in 2024. The Commission was focused on internal work in 2024.
2025 Goal. The Commission looks forward to reviewing and recommending adoption of the Climate Action Plan in 2024. In addition, the Commission would like to pursue regional sea level rise work in 2025
5) Targeted Redevelopment.
2024 Accomplishments. The Commission recommended adoption of the Gateway Area Plan and Code.
2025 Goal. The Commission will shift its focus to the remaining Infill Opportunity Zones in 2025. While the Craftsmans’ Mall Infill Opportunity Zone has less potential with the development of the student housing project, the other opportunity zones still have considerable development potential. Adopting new standards in these zones will help spread the impact of development throughout the City. The Commission would like to see Form-Based Codes or codes based on objective design standards in the Infill Opportunity Zones, starting with the Valley West Opportunity Zone, and then the Downtown/Uniontown Opportunity Zone.
6) Historic Preservation.
2024 Accomplishments. The Commission was not provided the opportunity to work with the Historic Landmarks Committee to identify effective programs for historic preservation in planning this year but looks forward to this as a future goal.
2025 Goal. The Commission would like to hold a joint study session with the Historic Landmarks Committee to learn more about historic preservation and how to best implement the updated General Plan Historic Preservation Element, including how to amend the zoning ordinance to more effectively implement historic preservation. In addition, the Commission is interested in pursuing adoption of the Plaza as a state historic place.
7) Training.
2024 Accomplishments. The Commission was offered the opportunity to attend CEQA updates training in _____. Initially, the City anticipated a training by Strong Towns, but that training has not materialized. The City’s training budget still is underfunded for the types and number of trainings the Commission requests.
2025 Goal. The Commission would like more formal training to better understand its roles and responsibilities, as well as technical capacity, for the decisions it makes. Specifically, the Commission requests training on coastal planning, adaptation planning, and climate change. Training and subscription services, electronic or otherwise, will need to be budgeted to accomplish this goal. The Planning Commission would like the Council to consider a regional collaboration for high-impact training for Planning Commissioners. The Commission would like to see a dedicated Commission training budget of at least $7,500.
City Council Goals
The City Council Goals and Priority Projects are adopted on a fiscal year, while the Commission reports on a calendar year. For that reason, this report references the Council’s 2023/24 and its 2024/25 Goals and Priority Projects.
[Update this section at the meeting.]
As stated above, the Commission has not been able to work on the Local Coastal Program.
Community Needs
The Commission has been very responsive to the community. The Commission has committed several study sessions and special meetings to ensure interested community members have access to the General Plan decision making process.
While the Commission’s work was largely focused on long-range planning, the Commission did hold public hearings on discretionary permits. _____ design review permits were before the Commission this year. That number is down relative to prior years. The Commission provided open public hearings with opportunities for public comment at these hearings.
Commission’s Responsibilities
As outlined in the Arcata Municipal Code (Sec. 2208), the Planning Commission’s responsibilities include:
A. To serve in an advisory capacity to the City Council and City staff on all matters pertaining to planning and the physical development of the City and surrounding areas.
B. To provide recommendations to the City Council regarding the preparation, adoption, amendment, administration, and implementation of the General Plan and its various elements, the Local Coastal Plan, and Specific Plans.
C. To provide recommendations to the City Council regarding preparation, adoption, amendment and implementation of the City’s land use, zoning, subdivision, development review, design review, environmental review, and other related policies, ordinances, and standards.
D. To review and take action to approve, approve subject to conditions or modifications, or to deny various applications for development or use of land as provided in the City’s zoning ordinances codified at Title IX.
E. To review and make decisions or recommendations on Negative Declarations, Environmental Impact Reports, and other environmental documents prepared for private and public projects.
F. To review and make decisions regarding the consistency of proposed acquisition or disposition of real property by the City with the General Plan and any applicable Specific Plans, as provided by state law.
G. To review and make decisions with respect to the consistency of proposed capital improvement projects and programs with the General Plan and any applicable Specific Plans, as provided by state law.
H. To exercise any other powers and duties as may be assigned by state law or by the zoning ordinances codified at Title IX.
I. To conduct all powers, duties and functions of the Historic and Design Review Commission as codified in the City’s Land Use Code, Title IX, including the implementation of the Historic Preservation Element of the General Plan.
The Commission has been dutifully exercising these responsibilities over 2023. The Commission made the consistency finding for the Capital Improvement Program updates, held four design review hearings, and has focused hundreds of hours collectively providing recommendations to the Council on the General Plan and
Gateway Area Plan. The Commission looks forward to finalizing recommendations on the Environmental Impact Report in the coming months to support the Council’s adoption of the updated General Plan and Gateway Code.
Effectiveness of Policies and Procedures
The Commission is subject to the Brown Act and conducts its hearings pursuant to City practice and protocol using parliamentary procedures for most of its work. These procedures are effective at managing public meetings to ensure fairness and transparency. But the Commission recognizes that they also place limits on public engagement and involvement to balance input with accomplishments.
Recommendations
The Commission has several new members. The composition of the Commission has changed over the last two years with a majority of Commissioners being newly appointed since the beginning of the long-range planning work. This is a great opportunity for the new members to become familiar with the new General Plan and to work on updates the Commission would like support building its knowledge and understanding of its role and the legal and procedural tenants it must adhere to. Specifically, the Commission could benefit from training in the Brown Act, CEQA, planning law, coastal policy, climate change and adaptation planning, and engagement training.

NEW BUSINESS
A. Conduct a Public Hearing to Receive Input Regarding Unmet Transit Needs and Direct Staff to Forward All Comments to the Humboldt County Association of Governments.
City Engineer Khatri introduced Michelle Nielsen with the Humboldt County Association of Governments (HCOAG) who explained the process of evaluating an unmet transit need. She noted that this was an annual process where compiled comments from a series of public hearings throughout the county would be used in a report which would go to a council that advised the HCOAG Board of Directors. She gave a presentation on regional transit touching on ridership trends, unified branding, and the North State Express which had been launched in early 2024.
Mayor Stillman opened the public hearing.
Joanne McGarry spoke in favor of promoting collective travel to destinations such as bars, plays, and events.
Jenna Boyse spoke in favor of the Arcata and Mad River Transit System providing Sunday service and removing winter breaks from the Arcata Marsh transit service. She advocated for service being added to South Arcata.
Mike Mulderig expressed concern that bus stops were inaccessible due to people living out of them, he spoke in favor of them getting help too.
Richard Jeremy Needham spoke against the disconnect between the transit system and the homeless population.
Kelsey Martin with the Coalition for Responsible Transportation Priorities spoke in favor of faster and more direct options between towns, better weekend hours, more busses during peak times, and increased frequency of popular routes.
Councilmember Schaefer spoke in favor of express routes and service out to Bayside.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Emily Sinkhorn, Director of Environmental Services PREPARER: Emily Benvie, Deputy Director of Environmental Services––Community Services DATE: January 8, 2025
TITLE: Approve a Memorandum of Agreement between the City of Arcata and Centro del Pueblo for Management and Operations of the Bayside Park Farm; and Authorize the City Manager to Execute all Applicable Documents.
RECOMMENDATION:
It is recommended that the Council approve a Memorandum of Agreement between the City of Arcata and Centro del Pueblo for Management and Operations of the Bayside Park Farm; and Authorize the City Manager to Execute all Applicable Documents.
INTRODUCTION:
The City of Arcata has managed the three-acre Bayside Park Farm using a Community Supported Agriculture model, which has provided experience for emerging farmers as well as regular opportunities for community members to volunteer. Centro del Pueblo is a nonprofit that creates spaces for the Indigenous Peoples of the South, Immigrants and Latine community. They currently manage Sanctuary Garden as a multigenerational, multicultural community gathering space and garden in Arcata. Both the City and Centro del Pueblo have shown a commitment to promoting food sovereignty, operating a model of community supported agriculture, supporting emerging farmers, and creating agricultural volunteer opportunities. The purpose of this Memorandum of Agreement (MOA) is to formalize a non-exclusive partnership between the City and Centro del Pueblo for operation and management of the Bayside Park Farm.
BACKGROUND:
The City of Arcata has managed the Bayside Park Farm for 30 years. Although the model has been successful for many decades, the City acknowledges that its long-term fiscal impact to the general fund may not be sustainable and has recognized an opportunity to shift management to a community group or groups dedicated to traditional knowledge and food sovereignty. One of Centro del Pueblo’s aims is to collaborate as heirs of traditional knowledge to achieve food sovereignty, which has been furthered through its management of Sanctuary Garden. While Centro del Pueblo has demonstrated their leadership and success within the community, they have been limited by the lack of a larger space for agricultural food production. City staff have been in discussions with Centro del Pueblo to understand shared interests in continuing community-oriented agricultural use of Bayside Park Farm.
DISCUSSION:
Environmental Services staff have been exploring potential alternative models for the management of the Bayside Park Farm for the last two years. Staff engaged with several local organizations and institutions involved in sustainable agricultural production, food sovereignty and/or engagement with historically marginalized communities to understand their potential interest in additional agricultural space and continuing the community-oriented agricultural learning and food production opportunities present at Bayside Park Farm. While staff engaged with several entities, Centro del Pueblo demonstrated a keen interest to pursue the opportunity and put forward a thorough proposal for a partnership with the City.
Both the City and Centro del Pueblo have shown a commitment to promoting local food sustainability and sovereignty, operating a model of community supported agriculture, supporting emerging farmers, and creating agricultural volunteer opportunities. Centro del Pueblo can provide a continued community supported agriculture program, unique volunteer opportunities, outdoor programs and workshops, economic development and growth for local farmers, and low- or no-cost food resources for community members who are food insecure. Centro del Pueblo is also committed to partnerships and collaborations with groups representing historically marginalized community members, such as the Rou Dalagurr Food Sovereignty Lab and BIPOC Food Club at Cal Poly Humboldt. Through its collaboration with Centro del Pueblo, the City will be able to better serve segments of the community who have been historically underserved. Centro del Pueblo will cultivate a space for bridging different cultures and lifestyles, empowering youth, and creating exchange between the community and students.
Through this MOA, a partnership between the City and Centro del Pueblo will formalize a two-year pilot of a sustainable, community-focused farm collaboration that works effectively to continue to implement a community supported agriculture program, provide affordable local food resources, foster a learning space and volunteer opportunities, and work toward greater local food sovereignty.
This MOA also establishes site access and communication protocols between the City and Centro del Pueblo, as well as parameters for liability and insurance coverage. Centro del Pueblo will be responsible for the overall operation and management of Bayside Park Farm. The City will support Centro del Pueblo through providing water service, providing one day of tractor tilling at the start of the growing season, maintaining the exterior perimeter fence line, and conducting major repairs of significant infrastructure or irrigation lines, if needed. At the end of the harvest season, Centro del Pueblo will provide the City with an annual report to help evaluate efficacy of this pilot MOA. The City will continue to actively manage the Community Garden, with multiple garden plots rented to individual community members, located adjacent to the farm.
POLICY IMPLICATIONS:
This MOA for Management and Operations of the Bayside Park Farm is consistent with the City’s agriculture-related general plan policies and is consistent with the land use and zoning designations of the Bayside Park Farm.
Additionally, this MOA furthers the following FY 24/25 City Council Policy Objectives:
Develop policies and support community organizations that provide services that improve the quality of life in Arcata and events that promote Arcata as a “livable community.” Strengthen partnerships with Cal Poly Humboldt, College of the Redwoods, local schools, civic and professional organizations.
ENVIRONMENTAL REVIEW (CEQA):
This action is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines, because it can be seen with certainty that there is no possibility that continuing to operate and manage the Bayside Park Farm consistent in scale and scope with past operational practices will have an effect on the environment.
BUDGET/FISCAL IMPACT:
This MOA will reduce the impact to the City’s general fund because the City will no longer be providing seasonal staffing of two part time farmers or annual seed and supplies purchases.
Although the City will no longer receive revenue from the Community Supported Agriculture program, the reduction of costs to the City will outweigh the loss of revenue.

MEMORANDUM OF AGREEMENT BETWEEN
THE CITY OF ARCATA AND CENTRO DEL PUEBLO
FOR MANAGEMENT AND OPERATIONS AT BAYSIDE PARK FARM
This Memorandum of Agreement (MOA) is hereby made and entered into by and between the City of Arcata, a municipal corporation, hereinafter referred to as “City,” and Centro del Pueblo, a 501(c)(3) nonprofit, hereinafter referred to as “Centro del Pueblo.”
1. Purpose
The purpose of this MOA is to formalize a non-exclusive partnership between the City and Centro del Pueblo for operation and management of the Bayside Park Farm, at 930 Old Arcata Road. Centro del Pueblo is a nonprofit that creates space for the Indigenous Peoples of the South, Immigrants and Latin community; and currently manages Sanctuary Garden as a multigenerational, multicultural community gathering space and garden in Arcata, California.
Its aim is to collaborate as heirs of traditional knowledge to achieve food sovereignty. The City of Arcata has managed the three-acre Bayside Park Farm for 30 years using a Community Supported Agriculture model, and has provided experience for emerging farmers as well as regular opportunities for community members to volunteer. Although this model has continued for many years, the City acknowledges that its long-term fiscal impact to the general fund is not sustainable, and has expressed a desire to shift management to a community group(s) that is (are) dedicated to traditional knowledge and food sovereignty. Formalizing this MOA will allow the City to continue its goal of providing a community supported farm that allows for emerging farmers to develop their skillset, and supports volunteers learning how to grow food, and provides educational opportunities for community members to connect with sustainable agriculture. This MOA will also establish site access and communication protocols between the City and Centro del Pueblo, as well as parameters for liability and insurance coverage.
2. Statement of Mutual Benefit and Interest
Both the City and Centro del Pueblo have shown a commitment to promoting food sovereignty, operating a model of community supported agriculture, supporting emerging farmers, and creating agricultural volunteer opportunities. While Centro del Pueblo has demonstrated their leadership and success within the community, they have been limited by the

lack of a larger space for agricultural food production. Therefore, it is in the best interest of both parties to work together, piloting a sustainable, community-focused farm collaboration that works effectively to continue to implement a community supported agriculture program, provide affordable local food resources, fosters a learning space and volunteer opportunities, and works toward greater local food sovereignty.

E. It is understood that in the event another complementary community-based agriculture need arise in the community, the City and Centro del Pueblo shall discuss in good faith the potential for joint use of Bayside Park Farm.

K. In the performance of its obligation hereunder, Centro del Pueblo shall act as an independent contractor and shall have control of their work and the manner in which it is performed. Centro del Pueblo is not to be considered an agent, employee or officer of the City.
L. This MOA supersedes any and all other agreements between the parties.

Since 1993, the City of Arcata and Friends of the Arcata Marsh have had successful relationship in providing educational and interpretive services at the Arcata Marsh Interpretive Center and throughout the Arcata Marsh & Wildlife Sanctuary. The contract would continue this successful relationship for an additional five years (starting January 1, 2025, and terminating on December 31, 2030). This agreement is consistent with the City's goals for education and outreach related to environmental stewardship and the unique Arcata Wastewater Treatment Facility which utilizes natural treatment processes through constructed wetlands.
ENVIRONMENTAL REVIEW (CEQA):
This action is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines, because it can be seen with certainty that there is no possibility that extension of the ongoing service agreement will have an impact on the environment.
Any projects that may stem from this relationship will be required to separately comply with CEQA review.
BUDGET/FISCAL IMPACT:
As part of this agreement, Friends of the Arcata Marsh coordinate volunteer staffing of the Arcata Marsh Interpretive Center during weekends and on an as-needed basis during weekdays, in addition to leading group tours of the Arcata Marsh and Wildlife Sanctuary. Additionally, FOAM often sponsors purchases for materials, projects, and displays that further enhance Arcata Marsh and Wildlife Sanctuary interpretive opportunities. Thus, FOAM provides support to help alleviate fiscal impacts to the City.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Emily Sinkhorn, Director of Environmental Services PREPARER: Emily Benvie, Deputy Director of Environmental Services––Community Services DATE: January 15, 2025
TITLE: Approve an Amended Mariculture Lease Extension through December 31, 2026, with Scott Sterner, dba North Bay Shellfish, for a Portion of Tide and Submerged Land in Arcata Bay.
RECOMMENDATION:
It is recommended that the Council approve an amended mariculture lease extension through December 31, 2026, with Scott Sterner, dba North Bay Shellfish, for a portion of tide and submerged land in Arcata Bay.
INTRODUCTION:
Aquaculture takes place on public lands and resources held in trust by the State of California. The cities of Eureka and Arcata and the Humboldt Bay Harbor, Recreation and Conservation District (the District) handle leases of trust lands within Humboldt Bay. In addition to leases, local growers must get permits from their leasing authority, as well as from the U.S. Army Corps of Engineers, the California Coastal Commission, the California Water Quality Control Board and Humboldt County.
Their operations also must meet the requirements of a number of local, state and federal entities, such as the state Department of Fish and Game and the National Marine Fisheries Service.
Scott Sterner, dba North Bay Shellfish, has been leasing tide and submerged land under the trusteeship of the City since 1982. The lease confers the right and privilege to locate and maintain shellfish culture apparatus and associated equipment on a small portion of the City’s tide and submerged lands for the purpose of conducting a commercial operation for the cultivation of oysters and clams. The City’s lease requires the operator to secure all necessary permits for this activity.
Mr. Sterner has proven himself a responsible, consistent lessee.
BACKGROUND:
In 2018, the Lease was amended to reduce the leased area to 80.2 acres (Parcel #1), to reflect the smaller area permitted by the State for mariculture activities. The proposed Lease extension continues to maintain the footprint of the 2018 lease.
DISCUSSION:
The annual rent shall be 2.5 percent of the net annual profits or $2,232.00, whichever is greater. The rent shall be paid by April 15 each year and must be submitted with a copy of the Lessee’s tax return showing net revenue for the previous calendar year.
Annually on July 1, the rent shall be adjusted by the Consumer Product Index (CPI). The CPI for such increases is the All Urban Consumers U.S. City Average, All Items, 1982-1984=100 annual CPI from the prior calendar year.
POLICY IMPLICATIONS:
This activity is consistent with the City’s General Plan.
ENVIRONMENTAL REVIEW (CEQA):
This action is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines, because it can be seen with certainty that there is no possibility that extension of the ongoing lease confined to a smaller area will have an impact on the environment.
All permitting obligations for mariculture operational activities are the responsibility of the lessee.
BUDGET/FISCAL IMPACT:
Pursuant to the specific requirements of the State Lands Commission, revenue from this lease is deposited into a dedicated account within the City’s Trust Fund.

STAFF REPORT – CITY COUNCIL MEETING

FROM: Tabatha Miller, Finance Director
PREPARER: Tabatha Miller, Finance Director
DATE: January 15, 2025
TITLE: Adopt Resolution No. 245-29 Authorizing Examination of Sales or Transactions Use Tax Records.
RECOMMENDATION:
It is recommended that the Council adopt Resolution No. 245-29 authorizing examination of sales or transactions and use tax records and superseding all prior Resolutions pursuant to subdivision (b) of Revenue and Taxation Code Section 7056.
INTRODUCTION:
On December 18, 2024, the City Council adopted Resolution No. 245-22, authorizing named City Officials to access confidential tax records of Measure H. The California Department of Tax and Fee Administration (CDTFA) requested a revision to the wording of the first WHEREAS of Resolution No. 245-22 and recommended consolidation for authorization to examine the three City taxes administered by CDTFA. Resolution 245-29 makes these changes.
BACKGROUND:
On June 12, 2024, the City Council voted to placed Measure H, the ¾ of a cent additional Transactions and Use Tax on the November 5, 2024, General Election ballot. Subject to approval by a majority of the Arcata electorate, the ordinance adds the supplemental Transactions and Use Tax to the Arcata Municipal Code and authorizes administration of the tax by the California Department of Tax and Fee Administration (CDTFA).
The November 5, 2024, General Municipal Election was held Measure H received 65.188% approval and on December 12, 2024, the vote was declared by the City Council. On December 18, 2024, the City Council adopted Resolution No. 245-21, authorizing the City Manager to execute agreements with the CDTFA for administration of Measure H and Resolution No. 245-22, authorizing named City Officials to access confidential tax records for governmental purposes.
DISCUSSION:
CDTFA already administers and collects the Bradley Burns Sales Tax for Arcata and the City’s Measure “G” existing ¾ of a cent Transactions and Use Tax, passed by voters in November of 2008.
As of April 1, 2025, the CDTFA will begin collection and administration of the additional ¾ of a cent Measure H Transactions and Use Tax.
California Revenue and Taxation Code Section 7056 forbids divulging information contained in or derived from, sales tax or transactions and use tax records. Local government officials may use sales and/or transactions use tax information if it is related to the tax collection or for other governmental purposes, such as economic development, revenue management or business license administration.
The CDTFA requires jurisdictions to adopt a resolution officially designating certain City Officials and financial consultants authorized to review these confidential tax records.
Resolution No. 245-29 supersedes Resolution No. 245-22, Resolution No. 089-48 and Resolution No. 089-15 to replace a reference to sales and use taxes in the first WHEREAS statement of Resolution No. 245-22, and to consolidate into one resolution authorization of named City Officials who may review the confidential Bradley Burns, Measure G and Measure H sales tax records.
ENVIRONMENTAL REVIEW (CEQA):
The adoption of Resolution No. 245-29 is not a “project” subject to the requirements of the California Environmental Quality Act (CEQA) (Public Resources Code Section §§ 21000 et seq.).
CEQA Guideline § 15378(b)(4) provides that the creation of government funding mechanisms or other government fiscal activities that do not involve any commitment to a specific project that may result in a potentially significant physical impact on the environment are not projects subject to the requirements of CEQA.
BUDGET/FISCAL IMPACT:
There is no direct budget or fiscal impact associated with adopting Resolution 245-29 and providing access to confidential tax records to named City Officials, although such access may lead to enforcement and collections actions that increase revenues.

TITLE: Adopt Resolution No. 245-28 Transferring All Management, Functions, and Assets of the Arcata & Mad River Transit System Services Including Dial-A-Ride to Humboldt Transit Authority; and Authorize the City Manager to Execute all Applicable Documents.
RECOMMENDATION:
It is recommended that the Council:
1) Adopt Resolution No. 245-28 transferring all management, functions, and assets of the Arcata & Mad River Transit System Services including Dial-A-Ride to Humboldt Transit Authority; and 2) Authorize the City Manager to Execute all Applicable Documents.
INTRODUCTION:
The City currently contracts with Humboldt Transit Authority (HTA) to provide all operations and maintenance services for the Arcata and Mad River Transit System (A&MRTS), including scheduling and staffing drivers for A&MRTS routes, parking A&MRTS buses in the HTA yard, and providing regular preventive maintenance, inspections, repair services, and refueling of A&MRTS vehicles.
On October 16th, the City Council authorized staff to continue communication with HTA regarding transfer of A&MRTS assets and services. City staff have been in conversation with management staff at HTA and are working on an agreement of transfer which will be executed in the coming months; this resolution is one of the requirements of the transfer.
DISCUSSION:
Historically, the A&MRTS had been able to operate on a small budget partly by employing part-time drivers. Currently, the City does not have adequate staffing resources to implement cost-effective operation of the A&MRTS on its own. Therefore, in 2023, the City expanded its contract with HTA for parking, maintenance and repair services to include administration and management of A&MRTS operations. This has been a successful partnership that ensured the continued provision of frequent and economical bus services to Arcata residents and students of Cal Poly Humboldt (CPH). The City also partnered with CPH last year to add a new “Green and Gold” route to provide a reliable transit route for all users, including CPH students.
HTA operates transit services through a joint powers authority (JPA) between the County of Humboldt and the cities of Arcata, Eureka, Fortuna, Rio Dell and Trinidad. The City of Arcata
holds one board seat on the JPA, currently held by Councilmember Stillman. HTA provides riders with affordable fixed routes and dial-a-ride transportation options that allow access throughout Humboldt County. Services span from Trinidad, south along Hwy 101 to Benbow, and east on Hwy 299 from Arcata to Willow Creek, including the Arcata–Eureka Airport, and the communities of McKinleyville, Eureka and Fortuna, with Blue Lake Rancheria providing service to Blue Lake.
This larger operation places HTA in the position to attract and secure full-time bus drivers and to build a larger pool from which to provide staffing for efficient public transit throughout the region.
HTA also operates all public transit busses for the City of Eureka. For the past year and half, HTA has successfully managed operations for the City of Arcata’s A&MRTS routes, and it is in the City’s best interest to transfer ownership of the vehicles comprising the A&MRTS fleet to HTA.
POLICY IMPLICATIONS:
Public Utility Code section 99288 authorizes a City to contract for transit operation services. HTA possesses the power under California Government Code section 6502 and the joint exercise of powers agreement under which it is constituted to provide this kind of service and receive payment for it.
BUDGET/FISCAL IMPACT:
No impact to the current budget. Starting FY 25-26 Transit budget will not be included in the City budget.

WHEREAS, since 2001, City has contracted with Humboldt Transit Authority (HTA) for parking of, and receiving regular maintenance services and repairs of A&MRTS transit vehicles; and
WHEREAS, in 2023, to provide frequent and economical bus service, City and HTA entered into an amended and restated agreement by which City contracted with HTA to administer and manage the operation and maintenance of the A&MRTS, including scheduling and staffing drivers for A&MRTS routes, with a contract term ending June 20, 2029; and WHEREAS, the City of Arcata does not have the staffing nor the transit expertise within the City to efficiently run the transit system; and
WHEREAS, HTA is currently contracted to manage Arcata's Dial-a-Ride (DAR) program, which is a required program of the A&MRTS system; and

WHEREAS, the City of Arcata through the Transportation Development Act (TDA) and as a recipient of local, state, and federal funds needed to financially support the transit system will contribute these said funds to HTA, as needed to efficiently run the transit system; and WHEREAS, City is willing to relinquish the A&MRTS duties, and associated vehicles to HTA effective May 1, 2025;

3. After acceptance by HTA of the A&MRTS transfer, the City Manager is authorized to execute any and all documents to implement the transfer.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Emily Sinkhorn, Director of Environmental Services PREPARER: Emily Sinkhorn, Director of Environmental Services DATE: January 15, 2025
TITLE: Approve Purchase of Badger Remote Read Water Meters from PACE Supply for $306,016; Authorize City Engineer to Increase Purchasing Amount by up to $30,602 (10%, for Total of $336,618); Authorize City Manager to Sign Necessary Agreements and Documents.
RECOMMENDATION:
It is recommended that the Council:
1) Authorize the purchase of Badger remote read water meters from PACE Supply in the amount of $306,016;
2) Authorize the City Engineer to increase the purchasing amount by up to $30,602 (10%, for a total of $336,618) to allow for any unforeseen contingencies and additional equipment as necessary; and
3) Authorize the City Manager to execute all applicable agreements and documents.
BACKGROUND:
The City has been advancing the Waterline Replacement Project for several years in order to replace old and unreliable steel and asbestos cement waterlines with new pipes in order to decrease the annual costs and effort associated with repairing defective waterlines and extend the life of the City’s water distribution system. The project scope also includes replacement of older water meters within the project area with remote-read water meters in order to modernize the City’s water distribution system, enhance efficiency for water meter reading and reduce water loss. To expedite the project and reduce overall costs, staff recommends to pre-purchase ahead of construction bidding priority equipment that has longer lead times for delivery. Last September the City Council approved the pre-purchase of three Cla-Val valve/vault systems which will be also installed as part of the Waterline Replacement Project.
DISCUSSION:
The Waterline Replacement Project is a high priority project under the City’s Capital Improvement Program. City staff has been planning and designing this project for several years and anticipates a release of construction bid in early 2025. Pre-purchasing larger equipment pieces will expedite construction of the Waterline Replacement Project. When the construction contractor is onboard, the valve/vault systems will have already be ordered, rather than including the items in the construction bidding and waiting for delivery.
The City is moving towards standardizing water meter infrastructure through planned retrofitting and purchasing of one brand (Badger) of remote read water meters. The City has installed Badger remote read water meters in other areas of the water distribution system. These meters have been reliable, save time and cost to read, enable real-time data review to detect potential water leaks early, and staff are content with the performance and service support provided. The purpose of purchasing water meters from the same manufacturer is to ensure operating equipment that will save time and operational costs by creating a consistent system which can be maintained with minimal like parts and similar maintenance/repair requirements. Additionally, the City’s remote water meter read software is programmed to function and operate with Badger meters. PACE Supply is the regional supplier of Badger brand water meters.
ENVIRONMENTAL REVIEW (CEQA):
The California Environment Quality Act (CEQA) determination for the project is a categorical exemption pursuant to CEQA Guidelines:
Section 15301 (b) existing facilities of both investor and publicly-owned utilities used to provide electric power, natural gas, sewerage, or other public utility services and 15302 (c) replacement or reconstruction of existing utility systems and/or facilities involving negligible or no expansion of capacity.
BUDGET/FISCAL IMPACT:
The budget for this equipment purchase is within the budget allocation in the 2024/25 Fiscal Year to implement the Waterline Replacement Project. While this large capital improvement project is still being finalized, it is currently estimated to cost $14.5 million. The anticipated cost to implement this project has increased since the project was envisioned in the 2019/20 fiscal year and when the 2020 Water Rate Study was implemented. The impacts of COVID-19, subsequent supply chain issues and inflation have increased the anticipated cost of the Waterline Replacement Project. Due to the increase in estimated cost, staff continue to refine funding options for full project implementation across multiple fiscal years. Staff is in the process of issuing an RFP for a Rate Study and Cost Allocation Plan of the Water Fund to better inform a financial plan for the Water Fund Capital Improvement Program (CIP) including this project.
The budget for pre-purchase of this equipment needed for the Waterline Replacement Project is as follows:

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Keira Vink, Human Resources and Administrative Services Director PREPARER: Keira Vink, Human Resources and Administrative Services Director DATE: January 15, 2025
TITLE: Consider City Council Salary Adjustment and Introduction of Ordinance No. 1574 Amending the Arcata Municipal Code Title II (Administration), Chapter 1 (Council), Section 2010 (Salaries of the City Council Members).
RECOMMENDATION:
It is recommended that the Council:
1) Consider a salary adjustment for Councilmembers as provided under State law; and 2) If a salary adjustment is made, identify the amount of the salary increase in Ordinance No. 1574, and Introduce Ordinance No. 1574, An Ordinance of the City Council of the City of Arcata Amending the Arcata Municipal Code to Adjust Councilmember Salary, Title II (Administration), Chapter 1 (Council), Section 2010 (Salaries of the City Council Members); waive reading of the ordinance text and consent to read by title only.
INTRODUCTION:
Ordinance No. 1574 proposes an adjustment to Councilmember salaries as permitted by State law.
Options of the amount of the Council salary adjustment are provided in the staff report for the Council’s consideration. Council salary is currently eligible for adjustment as a result of one or more members beginning a new term following the November 2024 election.
BACKGROUND:
Salary for City Councilmembers is set by state law (Gov. Code § 36516) and the Arcata Municipal Code (§ 2010). The Council may, by ordinance, increase its current salary by five percent (5%) each year from the operative date of the prior adjustment following an election when at least one Council Member begins a new term (Gov. Code §§ 36516(a)(4), 36516.5,). Section 36516.5(a)(4) states the following:
“The salary of council members may be increased beyond the amount provided in this subdivision by an ordinance or by an amendment to an ordinance, but the amount of the increase shall not exceed the greater of either of the following:
(A) An amount equal to 5 percent for each calendar year from the operative date of the last adjustment of the salary in effect when the ordinance or amendment is enacted.
(B) An amount equal to inflation since January 1, 2024, based upon the California Consumer Price Index, which shall not exceed 10 percent for each calendar year.” DISCUSSION:
Council made its last salary adjustment effective March 31, 2023, to $849.51 per month. Applying the statutory per year limit of five percent (5%) for the prior complete calendar years (2023 and 2024) since the last “operative date of the prior adjustment” would allow a maximum monthly salary of $934.46 ([$849.51 X 5% X 2] + $849.51), or up to an additional $84.95/mo. adjustment.
The following table shows sample salary adjustment options up to the five percent (5%) maximum for the calendar years since the Council’s last adjustment. If the Council desires to increase its salary, prior to introducing the ordinance, it will need to identify the specific amount of the increase it wishes to recover since the last ability to adjust. The Council may elect any percentage adjustment between 0%–5%. The following table represents the increases in whole percentages for the maximum two-year adjustment allowed:
Current 1% 2% 3% 4% 5%

adjustment
(849.51 X [%] X 2 years)
$16.99 $33.98 $50.97 $67.96 $84.95
The following table shows the sample salary adjustment option reflecting inflation since January 1, 2024, which was calculated at 3.12% based upon the California Consumer Price Index:

BUDGET/FISCAL IMPACT:
If salary is adjusted, the additional cost for all Councilmembers is estimated to be up to $5,000 annually, depending on the percentage applied. Additional salary costs will be reprioritized within the various department budgets, if needed.

AMENDING THE ARCATA MUNICIPAL CODE TO ADJUST COUNCILMEMBER SALARY TITLE II: ADMINISTRATION
CHAPTER 1: COUNCIL
SECTION 2010
The City Council of the City of Arcata does ordain as follows:
Section 1: Title II (Administration), Chapter 1 (Council), Section 2010, of the Arcata Municipal Code is hereby amended as shown by the following with deletions shown as strike-through and additions as underscore:
SEC. 2010. Salaries of City Council Members.
The members of the Arcata City Council shall receive as compensation that amount authorized by Section 36516 of the Government Code of California, equal to eight hundred fortynine dollars and fifty-one cents ($849.51) [PRIOR TO INTRODUCTION, INSERT $ AMOUNT] per month, which represents an increase of five percent (5%) [PRIOR TO INTRODUCTION, INSERT % AMOUNT] for each calendar year from the operative date of the last salary adjustment. Said compensation shall become effective the first pay period after the effective date of this ordinance.
Section 2. Findings. The City Council finds that adjusting councilmember salaries would account for cost of living increases and support diversity in local government participation as increased compensation can assist individuals from across different income levels to receive sufficient income for their service.
Section 3. Severability. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, the decision shall not affect the validity of the remaining portions of the Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid under law.
Section 4. Limitation of Actions. Any action to challenge the validity or legality of any provision of this ordinance on any grounds shall be brought by court action commenced within thirty (30) days of the date of adoption of this ordinance.
Section 5. CEQA. This ordinance is exempt from the California Environmental Quality Act (CEQA) Guidelines pursuant to Section 15061(b)(3) of the CEQA Guidelines.
Section 6. Effective Date. This ordinance shall become effective thirty (30) days from and after its final passage, provided it is published pursuant to Government Code section 36933 in a newspaper of general circulation within fifteen (15) days after its adoption.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Merritt Perry, City Manager
PREPARER: Danielle Allred, Contracts and Special Projects Manager DATE: December 26, 2024
TITLE: Introduce Ordinance No. 1576, An Ordinance of the City Council of the City of Arcata Amending the Arcata Municipal Code Relating to Purchasing Procedures, Title II (Administration), Chapter 4 (Fiscal Administration).
RECOMMENDATION:
It is recommended that the Council introduce Ordinance No. 1576, An Ordinance of the City Council of the City of Arcata Amending the Arcata Municipal Code Relating to Purchasing Procedures, Title II (Administration), Chapter 4 (Fiscal Administration); waive reading of the text and consent to read by title only.
INTRODUCTION:
The City’s purchasing procedures are a combination of Arcata Municipal Code provisions found at Title II, Chapter 4, Article 2, and the City’s Administrative Purchasing Policy and Procedures. The Municipal Code describes the City’s purchasing system and determines the City’s practices for purchasing materials and supplies, contracting for services and public projects, and for the disposal of obsolete surplus assets. This Code section was last updated in December 2021 to reflect general cost increases in materials, supplies, and contracted services since the previous update, 12 years earlier in 2009. The 2021 updates also enabled the City to utilize more modern methodologies for government agencies to accept bids and to auction surplus assets over the internet.
The revisions proposed under Ordinance No. 1576 would reflect increased bid limits authorized under the California Uniform Public Construction Cost Accounting Act, which went into effect on January 1, 2025, to improve efficiency and increase flexibility for public agencies in the execution of budgeted City projects and to keep up with rising construction costs.
BACKGROUND:
In 2001, pursuant to Resolution No. 012-09, the City Council elected to become subject to public works contracting limits and procedures described in the California Uniform Public Construction Cost Accounting (CUPCCA) Act, as set forth in the California Public Contract Code, Section 22000 et seq. Every five years, the CUPCCA Commission reviews the informal bid limits for inflation and other factors to determine whether adjustments should be made.
On September 29, 2024, Governor Newson approved Assembly Bill 2192 which, effective January 1, 2025, increased the limits in described Public Contract Code §22032, which is part of “Article 3.
Public Projects: Alternative Procedure.” The proposed ordinance revisions are intended to bring the City’s purchasing limits more in-line with State guidelines for public projects DISCUSSION:
The proposed revisions to the City’s purchasing limits for materials, supplies and services are intended to be consistent with the limits currently established by the Commission for public projects.
The revisions to the City’s Municipal Code Purchasing provisions as proposed in Ordinance No. 1576 are summarized as follows:
1. Increase the bid threshold for equipment, materials and supply purchased from $60,000 to $75,000. Purchases over $75,000 would be subject to a bid process, as set out in the Municipal Code Purchasing provisions and the City’s Administrative Purchasing Policies and Procedures.
2. Modify the threshold values that determine how professional consultant services agreements are awarded. Projects less than $75,000 may be negotiated and approved by the City Manager. Projects between $75,000 and $220,000 may be negotiated by the City Manager; however, the contract would be subject to City Council approval. And projects in excess of $220,000 would be awarded through a Request for Proposal or Request for Qualifications process.
3. Modify the threshold values that determine how informally bid public projects are awarded.
Informally bid projects in the amount of $75,000 or less may be awarded by the Purchasing Agent (i.e. the City Manager). Informally bid projects in an amount greater than $75,000 shall be awarded by the City Council.
If introduced, the Ordinance would be brought back for adoption by the Council at the next regular meeting. It would go into effect 30 days thereafter.
BUDGET/FISCAL IMPACT:
No specific budgetary impact. Overall, these revisions will enable increased efficiency for City purchases.

The Purchasing Agent shall also solicit bids from all responsible prospective suppliers whose names are on the Bidders' List or who have requested their names to be added thereto.

A successful bidder shall forfeit the bid security upon the bidder’s failure or refusal to execute a contract within ten (10) days after the issuance of the notice of award. The City Council may, upon failure or refusal of the successful bidder to execute the contract, award it to the next lowest responsible bidder. If the City Council awards the contract to the next bidder, the amount of the successful bidder's security shall be applied by the City to the difference between the successful bid and the next lowest responsible bid, and the surplus, if any, shall be returned to the successful bidder. (e) Bid Submittal and Opening Procedure. Bids shall be submitted to the Purchasing Agent as specified in the Notice Inviting Bids. Bids that are solicited over the internet shall be submitted as required in Public Contract Code section 1601. Bids shall be opened in public at the time and place stated in the Notice Inviting Bids. A tabulation of all bids received shall be open for public inspection during regular business hours for a period of not less than thirty (30) calendar days after the bid opening.
(f) Rejection of Bids. The City Council shall have the authority to reject all bids, parts of bids, or all bids for any one or more materials, supplies, services or equipment included in the proposed contract, when the public interest would be served thereby and may re-advertise for bids. (g) Award of Contracts. Contracts shall be awarded by the City Council to the lowest responsible bidder. In determining "lowest responsible bidder" in addition to price, the following shall be considered:

(4) The bidder's record of performance of previous contract or services;
(5) The previous and existing compliance by the bidder with laws relating to the bid;
(6) The sufficiency of the financial resources and ability of the bidder to supply the materials, supplies or equipment;
(7) The quality, availability and adaptability of the equipment, materials, or supplies to the particular use required;
(8) The ability of the bidder to provide future maintenance and service for the use of the subject of the bid;
(9) The number and scope of the conditions attached to the bid; (10) The estimated cost monthly, quarterly, semi-annually or annually for maintenance of said equipment;
(11) The factors specified in Paragraph 5906(A) of the Arcata Nuclear Weapons Free Zone Act.
(h) Tie Bids. If two or more bids received are for the same total amount or unit price, quality and service being equal, and if the public interest will not permit the delay of readvertising bids, the Council may accept the one it chooses or accept the lowest bid made by negotiation with the tie bidders.
SEC. 2407.5. Splitting bids.
Where bids are received for multiple goods or merchandise, the City may split the bid and award different contracts to the various lowest responsible bidders.
SEC. 2408. Open market procedure for materials, supplies and equipment.
Purchases of and contracts for materials, supplies and equipment of less than the estimated value of sixty seventy-five thousand dollars ($60,000.00$75,000.00), and all sales of personal property no longer required for the use of the City of less than the estimated value of fifteen thousand dollars ($15,000.00), shall be made by the Purchasing Agent pursuant to the Open Market Procedure prescribed herein.
(a) Notice Inviting Bids. The Purchasing Agent shall solicit bids by written requests to prospective bidders by readily available means including but not limited to social media, online platforms, and electronic list serves.
(b) Minimum Number of Bids. Open Market purchases shall, whenever possible, be based on at least three (3) competitive bids, and shall be awarded to the lowest responsible bidder in accordance with the standards set forth in Section 2407(g). (c) Bids when required, shall be submitted to the Purchasing Agent who shall keep a record of all Open Market orders and bids for a period of one (1) year after the submission of bids or the placing of orders. This record, while so kept, shall be open to public inspection.

SEC. 2425. Performing, bidding and awarding contracts for public projects.
The City shall perform, bid, or award contracts for public projects in a manner consistent with Public Contract Code section 22032 of the California Uniform Public Construction Cost Accounting Act (CUPCCAA), including monetary limits for formal, informal, and exempted bid processes.

Section 4: This ordinance is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines, because it can be seen with certainty that there is no possibility that revisions to purchasing procedures in a manner consistent with state law may have a significant effect on the environment.
