STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Keira Vink, Human Resources and Administrative Services Director PREPARER: Keira Vink, Human Resources and Administrative Services Director DATE: February 5, 2025
TITLE: Adopt Ordinance No. 1574, An Ordinance of the City Council of the City of Arcata Amending the Arcata Municipal Code to Adjust Councilmember Salary, Title II (Administration), Chapter 1 (Council), Section 2010 (Salaries of the City Council Members).
RECOMMENDATION:
It is recommended that the Council adopt Ordinance No. 1574, An Ordinance of the City Council of the City of Arcata Amending the Arcata Municipal Code to Adjust Councilmember Salary, Title II (Administration), Chapter 1 (Council), Section 2010 (Salaries of the City Council Members).
INTRODUCTION:
Adopt Ordinance No. 1574 approving an adjustment to Council Member salaries as permitted by State law for a total of a ten (10) percent increase above current salary. Council salary is currently eligible for adjustment as a result of one or more members beginning a new term following the November 2024 election.
BACKGROUND:
Salary for City Council Members is set by state law (Gov. Code § 36516) and the Arcata Municipal Code (§ 2010). The Council may, by ordinance, increase its current salary by five percent (5%) each year from the operative date of the prior adjustment following an election when at least one Council Member begins a new term (Gov. Code §§ 36516(a)(4), 36516.5,). Section 36516.5(a)(4) states the following:
“The salary of council members may be increased beyond the amount provided in this subdivision by an ordinance or by an amendment to an ordinance, but the amount of the increase shall not exceed the greater of either of the following:
(A) An amount equal to 5 percent for each calendar year from the operative date of the last adjustment of the salary in effect when the ordinance or amendment is enacted. (B) An amount equal to inflation since January 1, 2024, based upon the California Consumer Price Index, which shall not exceed 10 percent for each calendar year.
DISCUSSION:
As approved on January 15, 2025, by the City Council, in compliance with the State Government Code, 36516, and Arcata Municipal Code, to increase by ten (10) percent (five percent each year for two years = ten percent) effective the first full pay period after Council approval.
Current 5% Per Year
2 Year Adjustment
Monthly Amount $849.51 $934.46
Monthly increase from last
adjustment
(849.51 X [%] X 2 years)
$84.95
BUDGET/FISCAL IMPACT:
The additional cost, of the ten (10) percent increase, for all Council Members’ salaries is approximately $5,000 annually. Additional salary costs will be absorbed within the City Manager’s current budget.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ARCATA
AMENDING THE ARCATA MUNICIPAL CODE TO ADJUST COUNCILMEMBER SALARY TITLE II: ADMINISTRATION
CHAPTER 1: COUNCIL
SECTION 2010
The City Council of the City of Arcata does ordain as follows:
Section 1: Title II (Administration), Chapter 1 (Council), Section 2010, of the Arcata Municipal Code is hereby amended as shown by the following with deletions shown as strike-through and additions as underscore:
SEC. 2010. Salaries of City Council Members.
The members of the Arcata City Council shall receive as compensation that amount authorized by Section 36516 of the Government Code of California, equal to eight hundred fortynine dollars and fifty-one cents ($849.51) nine hundred thirty-four dollars and forty-six cents ($934.46) per month, which represents an increase of five percent (5%) for each calendar year from the operative date of the last salary adjustment. Said compensation shall become effective the first pay period after the effective date of this ordinance.
Section 2. Findings. The City Council finds that adjusting councilmember salaries would account for cost of living increases and support diversity in local government participation as increased compensation can assist individuals from across different income levels to receive sufficient income for their service.
Section 3. Severability. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, the decision shall not affect the validity of the remaining portions of the Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid under law.
Section 4. Limitation of Actions. Any action to challenge the validity or legality of any provision of this ordinance on any grounds shall be brought by court action commenced within thirty (30) days of the date of adoption of this ordinance.
Section 5. CEQA. This ordinance is exempt from the California Environmental Quality Act (CEQA) Guidelines pursuant to Section 15061(b)(3) of the CEQA Guidelines.
Section 6. Effective Date. This ordinance shall become effective thirty (30) days from and after its final passage, provided it is published pursuant to Government Code section 36933 in a newspaper of general circulation within fifteen (15) days after its adoption.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Merritt Perry, City Manager
PREPARER: Danielle Allred, Contracts and Special Projects Manager DATE: January 29, 2025
TITLE: Adopt Ordinance No. 1576, An Ordinance of the City Council of the City of Arcata Amending the Arcata Municipal Code Relating to Purchasing Procedures, Title II (Administration), Chapter 4 (Fiscal Administration).
RECOMMENDATION:
It is recommended that the Council adopt Ordinance No.1576, an Ordinance of the City Council of the City of Arcata Amending the Arcata Municipal Code Relating to Purchasing Procedures, Title II (Administration), Chapter 4 (Fiscal Administration); waive reading of the text and consent to read by title only.
INTRODUCTION:
The Council received a presentation on Ordinance No. 1576, when it was introduced on January 15, 2025.
BACKGROUND:
Following the California Uniform Public Construction Cost Accounting (CUPCCA) Commission’s review and recommendation regarding limits established in California Public Contract Code §22000 et seq., Governor Newsom approved Assembly Bill 2192 which, effective January 1, 2025, increased the limits described in Public Contract Code §22032, pertaining to “Article 3. Public Projects:
Alternative Procedure.”
Revisions within the proposed ordinance are intended to bring the City’s purchasing limits more inline with State guidelines for public projects.
DISCUSSION:
The substantive updates to the City’s Municipal Code purchasing provisions implemented by Ordinance No. 1576 are summarized as follows:
1. Increase the bid threshold for equipment, materials and supply purchased from $60,000 to $75,000. Purchases over $75,000 would be subject to a bid process, as set out in the Municipal Code Purchasing provisions and the City’s Administrative Purchasing Policies and Procedures.
2. Modify the threshold values that determine how professional consultant services agreements are awarded. Projects less than $75,000 may be negotiated and approved by the City
Manager. Projects between $75,000 and $220,000 may be negotiated by the City Manager; however, the contract would be subject to City Council approval. And projects in excess of $220,000 would be awarded through a Request for Proposal or Request for Qualifications process.
3. Modify the threshold values that determine how informally bid public projects are awarded.
Informally bid projects in the amount of $75,000 or less may be awarded by the Purchasing Agent (i.e. the City Manager). Informally bid projects in an amount greater than $75,000 shall be awarded by the City Council.
BUDGET/FISCAL IMPACT:
No specific budgetary impact. Overall, these revisions will enable increased efficiency for City purchases.

If there is a conflict between legal provisions and generally accepted accounting principles applicable to governmental units, legal provisions must take precedence. Insofar as possible, however, the City's accounting system should make possible the full disclosure and fair presentation of financial position and operating results in accordance with generally accepted principles of accounting.
SEC. 2305. Budget.
A current operating budget must be adopted by the City, on or before the first day of July of each year, and the accounting system must provide budgetary control over all City revenues and expenditures. Recurring expenditures should not substantially exceed recurring revenues for any fiscal year.

ARTICLE 2—PURCHASING
SEC. 2400. Adoption of purchasing system.

SEC. 2401. Purchasing Agent.
There is hereby created the position of Purchasing Agent. The City Manager shall be the Purchasing Agent, or in the absence of the City Manager, the Acting City Manager shall so serve. The City Manager may delegate any of the powers and functions of Purchasing Agent to any other officer or employee of the City. The Purchasing Agent, or designee, shall have authority to:

(e) Prepare and recommend to the City Council rules governing the purchase of supplies, equipment, materials and services for the City. (f) Prepare and recommend to the City Council revisions and amendments to the purchasing rules.
(g) Keep informed of current developments in the field of purchasing, prices, market conditions and new products.

All resolutions adopted by the Council creating specialized purchasing policies shall be automatically incorporated into said Administrative Purchasing Policies and Procedures.
SEC. 2402. Exemption from centralized purchasing.
The Purchasing Agent may authorize, in writing, any department to purchase or contract for supplies, materials, services and equipment independently of the Purchasing Agent; but the Purchasing Agent shall require that such purchases or contracts shall be made in conformity with the procedures established by this Article and may further require periodic reports from the department on the purchases and contracts made under such written authorization.
SEC. 2403. Estimate of requirements.
All using departments shall file detailed requisitions or estimates of their requirements in equipment, materials, supplies, and services in such manner, at such time, and for such future periods as the Purchasing Agent shall prescribe. Such requisitions and estimates shall be filed with the Purchasing Agent on such forms as prescribed by the Purchasing Agent SEC. 2404. Bidding for supplies, materials, equipment and services. (a) Purchases of new supplies, materials, equipment and services shall be by competitive bid procedures pursuant to Sections 2407, Formal competitive bid procedure, and 2408, Open market procedure. lowest responsible bidder after due notice inviting proposals and pursuant to the procedure provided herein.
(c) All sales of personal property no longer required for the use of the City, when the estimated value shall exceed fifteen thousand dollars ($15,000.00), shall be sold by formal competitive bid to the highest responsible bidder, after due notice inviting proposals and pursuant to the procedure provided herein.
SEC. 2405. Purchase orders.
Purchases of supplies, materials, services and equipment shall be made only by purchase order, except:
(a) Services provided by public utilities;
(b) Services provided pursuant to an approved contract or agreement; (c) Group health or life insurance or general liability, property damage or other insurance; (d) Legal advertising;
(e) Cash advances for training and travel purposes;
(f) Gasoline credit and purchases;
(g) Memberships, dues and subscriptions; and
(h) Small purchases made through the use of a petty cash fund or a City-issued credit card.
SEC. 2406. Encumbrance of funds.

ARTICLE 3—BIDDING FOR PUBLIC PROJECTS
SEC. 2420. Informal bidding.
(a) Purposes. Pursuant to Resolution No. 012-09 (eff. 8/2/2001), the City Council duly elected to become subject to uniform construction cost accounting procedures as set forth in the California Public Contracts Code, Section 22000 et seq., the Uniform Public Construction Cost Accounting Act. By making such election, the City may follow an informal bid process to award contracts for public projects, as defined in the Uniform Public Construction Cost Accounting Act, for contracts up to the monetary limits as set forth in the Uniform Public Construction Cost Accounting Act. The purpose of Section 2420 is to implement the authorized informal bidding protocol. (b) Qualified Contractors.
(1) List of Contractors. The Purchasing Agent shall maintain a list of qualified contractors, identified according to categories of work. Minimum criteria for development and maintenance of the contractor’s list shall be determined in accordance with criteria established by the California Uniform Construction Cost Accounting Commission. Informal contracts for public project contracts in an amount greater than sixty seventy-five thousand dollars ($60,000.00$75,000.00) shall be awarded by the City Council.
SEC. 2425. Performing, bidding and awarding contracts for public projects.
The City shall perform, bid, or award contracts for public projects in a manner consistent with Public Contract Code section 22032 of the California Uniform Public Construction Cost Accounting Act (CUPCCAA), including monetary limits for formal, informal, and exempted bid processes.
CUPCCAA monetary limits in place as of the effective date of this Ordinance are set out below. These monetary limits are subject to periodic adjustment by State legislative amendment to Public Contract Code section 22032, and the intent of this Section 2425 is to allow the City’s process for performing,
bidding or awarding public projects to follow the CUPCCAA monetary limits as amended from time to time. The Purchasing Agent shall maintain current records of the CUPCCAA monetary limits. (a) Public projects of sixty seventy-five thousand dollars ($60,000.00$75,000.00) or less may be performed by the employees of a public agency by force account, by negotiated contract, or by purchase order, and may be awarded by the Purchasing Agent. Section 2: Severability.
Section 3: Limitation of Actions. Any action to challenge the validity or legality of any provision of this ordinance on any grounds shall be brought by court action commenced within thirty (30) days of the date of adoption of this ordinance.
Section 4: This ordinance is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines, because it can be seen with certainty that there is no possibility that revisions to purchasing procedures in a manner consistent with state law may have a significant effect on the environment.
Section 5: Effective Date.

FROM: Emily Sinkhorn, Director of Environmental Services PREPARER: Emily Benvie, Deputy Director of Environmental Services—Community Services DATE: January 29, 2025
TITLE: Approve a Ground Lease and Memorandum of Understanding with Redwood Coast Energy Authority for Electric Vehicle Supply Equipment at Carlson Park; and Authorize the City Manager to Execute all Applicable Documents.
RECOMMENDATION:
It is recommended that the Council approve a Ground Lease and Memorandum of Understanding with Redwood Coast Energy Authority for electric vehicle supply equipment at Carlson Park; and authorize the City Manager to execute all applicable documents.
INTRODUCTION:
The City of Arcata recently completed several improvements to Carlson Park, including a new playground, pickleball courts and parking lot. Redwood Coast Energy Authority (RCEA) received grant funding to construct, operate, and maintain electric vehicle charging stations throughout Humboldt County, including at Carlson Park. The two charging stations at Carlson Park will be able to serve up to four vehicles at a time, including an ADA-accessible van charging stall.
BACKGROUND:
In March 2023, RCEA executed a Grant Agreement with the California Energy Commission (CEC) for the North Coast Plug-in Electric Vehicle Charging Network Phase 2 project focused on placing Level 2 electric vehicle (EV) supply equipment at 10 strategic community hubs in Humboldt County by 2026. Carlson Park was identified as one of the strategic hubs, given its close proximity to Highway 101 and State Route 299, and because there are no EV charging stations on City-owned property in the Valley West neighborhood.
As part of this work, the City and RCEA staff have developed a Memorandum of Understanding (MOU) and Ground Lease to install, operate, and maintain Electric Vehicle Supply Equipment (EVSE) at Carlson Park.
DISCUSSION:
The installation of Electric Vehicle chargers at Carlson Park has required the installation of new metered electric service from Pacific Gas & Electric (PG&E) to serve the charging stations. The City, as property owner of Carlson Park, is considered a “site host” and PG&E requires an agreement between the City and RCEA to install, operate, and maintain Electric Vehicle Supply Equipment (EVSE) at Carlson Park. RCEA and the City of Arcata have developed the attached MOU and Ground Lease which delineate roles and responsibilities of each party in the agreement
and will serve as a vehicle for easement language required by PG&E that will allow PG&E to service the new metered electric service equipment over the life of the project.
POLICY IMPLICATIONS:
Installation of additional EV charging stations in Arcata is consistent with the City of Arcata’s Greenhouse Gas Reduction Plan and General Plan in that it prioritizes electric vehicle charging infrastructure.
ENVIRONMENTAL REVIEW (CEQA):
This project is exempt under CEQA Guidelines Section 15303 New Construction or Conversion of Small Structures because it involves minimal ground disturbance located at an existing City-owned parking lot, and no exceptions to the exemption apply.
BUDGET/FISCAL IMPACT:
Minor costs to support the project have been incorporated into the City’s overall Carlson Park Improvement Project. All additional construction costs are encompassed by RCEA’s grant funding, and RCEA will cover all costs associated with future operation and maintenance of the EV charging stations.

TO INSTALL, OPERATE, AND MAINTAIN
ELECTRIC VEHICLE SUPPLY EQUIPMENT (EVSE)
AT CARLSON PARK
This Ground Lease to Install, Operate, and Maintain Electric Vehicle Supply Equipment (EVSE) at Carlson Park (“Lease”) is made and entered into on _______________________________ (“Effective Date”), by and between the City of Arcata (“CITY” and “Landlord”) and the Redwood Coast Energy Authority (“RCEA” and “Tenant”) and is based on the following recitals of fact:
RECITALS
A. The City is the owner of real property known as “Carlson Park,” located at 5285 Carlson Park Drive, Arcata, CA 95521, APN 507-141-050, operated as a public park that provides vehicle parking for use by the general public (“Property”).
B. RCEA promotes the adoption of electric vehicles in its region, and actively seeks funds to plan, implement, and manage an electric vehicle public charging infrastructure. To further this goal, RCEA seeks relationships with site hosts in order to expand the network of public electric vehicle charging stations and ensure consistent driver and site host satisfaction.
C. RCEA received funding through the California Energy Commission (CEC) California Electric Vehicle Infrastructure Project, to fund the installation of electric vehicle supply equipment (“EVSE”) in the Northern California region. The Property is a desirable site for public electric vehicle charging infrastructure and the parties seek to collaborate to install and operate two (2) EVSE at this location.
D. With Arcata’s agreement to act as a site host, RCEA intends to install by March 14, 2025, two (2) plug-in vehicle charging stations at parking spots available for use by the general public at the Property.
E. The Parties enter into this Lease Agreement to define their respective rights and responsibilities by which RCEA is allowed to install, operate, and maintain the EVSE on the Property, and to ensure that the electricity transmission utility supplier, Pacific Gas and Electric Company (“PG&E”), has the right to the access the Property in order to properly operate and maintain its appurtenant electricity infrastructure.
NOW THEREFORE, for good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the Parties agree as follows:

Subject to prior notice to the CITY, PG&E may trim or cut down any vegetation within 5’ feet underground of PG&E utility facilities, or within 16’ overhead of PG&E utility facilities, as shown in Attachment A: Site Plans.
b) Electric Meter for EVSE, Parking Lot Lighting. The City will install an electric meter to service the EVSE. Upon completion of the installation, the electric meter shall be owned by RCEA as part of the EVSE infrastructure. In addition, the City shall install and own parking lot lighting for the EVSE on the Leased Premises (“EVSE Lighting”).
For purposes of this Lease, “EVSE Lighting” is expressly defined to mean up to three (3) parking lot pole lights, which may not exceed 120 watts total, and which are intended to serve the EVSE and no other purpose. The EVSE Lighting will be serviced by the electric meter as incidental EVSE load. The City’s use of the electric meter may not be expanded for any purpose without advance written agreement from RCEA.
c) Payments for Electric Service. RCEA will pay the electricity costs for the EVSE including the incidental EVSE load from EVSE Lighting. If applicable, RCEA shall pay for the following EVSE network costs for EVSE owned by RCEA: a one-time ‘Site Activation Fee,’ and annual network software fees while the stations are active.
In the event RCEA agrees to the City’s use of the electric meter for purposes other than the EVSE Lighting, the City shall reimburse RCEA for the additional cost of electricity.
4. Term. The term of this Lease shall commence on the Effective Date recited above and shall run concurrently with the MOU. This Lease shall terminate upon termination of the MOU.
5. Rent. The parties recognize and acknowledge the public benefit from installing and operating EVSE, including the EVSE Lighting, at the Property. As long as the Leased Premises are used for this purpose, no rent shall be owed.

FROM: Merritt Perry, City Manager
PREPARER: Merritt Perry, City Manager
DATE: February 5, 2025
TITLE: Approve Councilmember Atkins-Salazar’s Remote Participation at the March 5, 2025, City Council Meeting Pursuant to A.B. 2449 so that she can Represent the City at the California Association of Councils of Governments’ Regional Leadership Forum.
RECOMMENDATION:
It is recommended that the Council approve remote participation for Councilmember Atkins-Salazar at the regular council meeting on March 5, 2025, in accordance with Assembly Bill No. 2449 so that she can represent the City at the California Association of Councils of Governments’ Regional Leadership Forum in Sacramento, CA.
INTRODUCTION:
Council approval is required for the remote participation by Councilmember Atkins-Salazar at the March 5, 2025, Council Meeting Pursuant to Assembly Bill No. 2449. Councilmember AtkinsSalazar will be unable to attend this meeting in-person, due to a commitment to representing the City of Arcata at the California Association of Councils of Governments meeting in Sacramento, CA.
Therefore, she is unable to attend the regular council meeting in person but is able to attend remotely through both audio and visual technology.
BACKGROUND:
The Ralph M. Brown Act, requires, with specified exceptions, that all meetings of a legislative body of a local agency, as those terms are defined, be open and public and that all persons be permitted to attend and participate. Pursuant to Assembly Bill No. 2449, a member of the legislative body shall only participate in the meeting remotely pursuant to this subdivision (Government Code section 54953(f)(1)), if all the following requirements are met:
“(A) One of the following circumstances applies:
(i) The member notifies the legislative body at the earliest opportunity possible, including at the start of a regular meeting, of their need to participate remotely for just cause, including a general description of the circumstances relating to their need to appear remotely at the given meeting. The provisions of this clause shall not be used by any member of the legislative body for more than two meetings per calendar year.
(ii) The member requests the legislative body to allow them to participate in the meeting remotely due to emergency circumstances and the legislative body takes action to approve the request. The legislative body shall request a general description of the circumstances relating to their need to appear remotely at the given meeting. A general description of an item generally need not exceed 20 words and shall not require the member to disclose any medical diagnosis or disability, or any personal medical information that is already exempt under existing law, such as the Confidentiality of Medical Information Act (Chapter 1 (commencing with Section 56) of Part 2.6 of Division 1 of the Civil Code). For the purposes of this clause, the following requirements apply:
(I) A member shall make a request to participate remotely at a meeting pursuant to this clause as soon as possible. The member shall make a separate request for each meeting in which they seek to participate remotely.
(II) The legislative body may take action on a request to participate remotely at the earliest opportunity. If the request does not allow sufficient time to place proposed action on such a request on the posted agenda for the meeting for which the request is made, the legislative body may take action at the beginning of the meeting in accordance with paragraph (4) of subdivision (b) of Section 54954.2.
(B) The member shall publicly disclose at the meeting before any action is taken, whether any other individuals 18 years of age or older are present in the room at the remote location with the member, and the general nature of the member’s relationship with any such individuals. (C) The member shall participate through both audio and visual technology. (3) The provisions of this subdivision shall not serve as a means for any member of a legislative body to participate in meetings of the legislative body solely by teleconference from a remote location for a period of more than three consecutive months or 20 percent of the regular meetings for the local agency within a calendar year, or more than two meetings if the legislative body regularly meets fewer than 10 times per calendar year.”
“Just cause” includes travel while on official business of the legislative body or another state or local agency pursuant to Government Code section 54953(j)(2)(D).
DISCUSSION:
Approval of this request for remote participation at the regular council meeting on March 5th, 2025, will allow Councilmember Atkins-Salazar to represent the City at the California Association of Councils of Governments Regional Leadership Forum in Sacramento, CA from March 5-7, 2025.
Her attendance at that meeting is consistent with Assembly Bill No. 2449 as it is being considered at the earliest time possible, the cause for her remote participation is just, and it is in the interest of the City that she participate in both meetings, this request is her first and will not exceed the two remote meeting threshold allowed, and her participation will be both by audio and visual technology.

CHAPTER 285
An act to amend, repeal, and add Sections 54953 and 54954.2 of the Government Code, relating to local government.
[Approved by Governor September 13, 2022. Filed with
Secretary of State September 13, 2022.]
legislative counsel’s digest
AB 2449, Blanca Rubio. Open meetings: local agencies: teleconferences.
Existing law, the Ralph M. Brown Act, requires, with specified exceptions, that all meetings of a legislative body of a local agency, as those terms are defined, be open and public and that all persons be permitted to attend and participate. The act generally requires posting an agenda at least 72 hours before a regular meeting that contains a brief general description of each item of business to be transacted or discussed at the meeting, and prohibits any action or discussion from being undertaken on any item not appearing on the posted agenda. The act authorizes a legislative body to take action on items of business not appearing on the posted agenda under specified conditions. The act contains specified provisions regarding providing for the ability of the public to observe and provide comment. The act allows for meetings to occur via teleconferencing subject to certain requirements, particularly that the legislative body notice each teleconference location of each member that will be participating in the public meeting, that each teleconference location be accessible to the public, that members of the public be allowed to address the legislative body at each teleconference location, that the legislative body post an agenda at each teleconference location, and that at least a quorum of the legislative body participate from locations within the boundaries of the local agency’s jurisdiction. The act provides an exemption to the jurisdictional requirement for health authorities, as defined.
Existing law, until January 1, 2024, authorizes a local agency to use teleconferencing without complying with those specified teleconferencing requirements in specified circumstances when a declared state of emergency is in effect, or in other situations related to public health.
This bill would revise and recast those teleconferencing provisions and, until January 1, 2026, would authorize a local agency to use teleconferencing without complying with the teleconferencing requirements that each teleconference location be identified in the notice and agenda and that each teleconference location be accessible to the public if at least a quorum of the members of the legislative body participates in person from a singular physical location clearly identified on the agenda that is open to the public and situated within the local agency’s jurisdiction. Under this exception,
92 STATE OF CALIFORNIA
AUTHENTICATED
ELECTRONIC LEGAL MATERIAL
the bill would authorize a member to participate remotely under specified circumstances, including participating remotely for just cause or due to emergency circumstances. The emergency circumstances basis for remote participation would be contingent on a request to, and action by, the legislative body, as prescribed. The bill, until January 1, 2026, would authorize a legislative body to consider and take action on a request from a member to participate in a meeting remotely due to emergency circumstances if the request does not allow sufficient time to place the proposed action on the posted agenda for the meeting for which the request is made. The bill would define terms for purposes of these teleconferencing provisions.
This bill would impose prescribed requirements for this exception relating to notice, agendas, the means and manner of access, and procedures for disruptions. The bill would require the legislative body to implement a procedure for receiving and swiftly resolving requests for reasonable accommodation for individuals with disabilities, consistent with federal law.
Existing constitutional provisions require that a statute that limits the right of access to the meetings of public bodies or the writings of public officials and agencies be adopted with findings demonstrating the interest protected by the limitation and the need for protecting that interest.
This bill would make legislative findings to that effect.
The California Constitution requires local agencies, for the purpose of ensuring public access to the meetings of public bodies and the writings of public officials and agencies, to comply with a statutory enactment that amends or enacts laws relating to public records or open meetings and contains findings demonstrating that the enactment furthers the constitutional requirements relating to this purpose.
This bill would make legislative findings to that effect.
The people of the State of California do enact as follows:
SECTION 1. Section 54953 of the Government Code, as amended by Section 3 of Chapter 165 of the Statutes of 2021, is amended to read:
54953. (a) All meetings of the legislative body of a local agency shall be open and public, and all persons shall be permitted to attend any meeting of the legislative body of a local agency, except as otherwise provided in this chapter.
(b) (1) Notwithstanding any other provision of law, the legislative body of a local agency may use teleconferencing for the benefit of the public and the legislative body of a local agency in connection with any meeting or proceeding authorized by law. The teleconferenced meeting or proceeding shall comply with all otherwise applicable requirements of this chapter and all otherwise applicable provisions of law relating to a specific type of meeting or proceeding.
92 Ch. 285 — 2 —
(2) Teleconferencing, as authorized by this section, may be used for all purposes in connection with any meeting within the subject matter jurisdiction of the legislative body. If the legislative body of a local agency elects to use teleconferencing, the legislative body of a local agency shall comply with all of the following:
(A) All votes taken during a teleconferenced meeting shall be by rollcall. (B) The teleconferenced meetings shall be conducted in a manner that protects the statutory and constitutional rights of the parties or the public appearing before the legislative body of a local agency. (C) The legislative body shall give notice of the meeting and post agendas as otherwise required by this chapter.
(D) The legislative body shall allow members of the public to access the meeting and the agenda shall provide an opportunity for members of the public to address the legislative body directly pursuant to Section 54954.3. (3) If the legislative body of a local agency elects to use teleconferencing, it shall post agendas at all teleconference locations. Each teleconference location shall be identified in the notice and agenda of the meeting or proceeding, and each teleconference location shall be accessible to the public. During the teleconference, at least a quorum of the members of the legislative body shall participate from locations within the boundaries of the territory over which the local agency exercises jurisdiction, except as provided in subdivisions (d) and (e).
(c) (1) No legislative body shall take action by secret ballot, whether preliminary or final.
(2) The legislative body of a local agency shall publicly report any action taken and the vote or abstention on that action of each member present for the action.
(3) Prior to taking final action, the legislative body shall orally report a summary of a recommendation for a final action on the salaries, salary schedules, or compensation paid in the form of fringe benefits of a local agency executive, as defined in subdivision (d) of Section 3511.1, during the open meeting in which the final action is to be taken. This paragraph shall not affect the public’s right under the California Public Records Act (Division 10 (commencing with Section 7920.000) of Title 1) to inspect or copy records created or received in the process of developing the recommendation.
(d) (1) Notwithstanding the provisions relating to a quorum in paragraph (3) of subdivision (b), if a health authority conducts a teleconference meeting, members who are outside the jurisdiction of the authority may be counted toward the establishment of a quorum when participating in the teleconference if at least 50 percent of the number of members that would establish a quorum are present within the boundaries of the territory over which the authority exercises jurisdiction, and the health authority provides a teleconference number, and associated access codes, if any, that allows any person to call in to participate in the meeting and the number and access codes are identified in the notice and agenda of the meeting. 92 — 3 — Ch. 285
(2) Nothing in this subdivision shall be construed as discouraging health authority members from regularly meeting at a common physical site within the jurisdiction of the authority or from using teleconference locations within or near the jurisdiction of the authority. A teleconference meeting for which a quorum is established pursuant to this subdivision shall be subject to all other requirements of this section.
(3) For purposes of this subdivision, a health authority means any entity created pursuant to Sections 14018.7, 14087.31, 14087.35, 14087.36, 14087.38, and 14087.9605 of the Welfare and Institutions Code, any joint powers authority created pursuant to Article 1 (commencing with Section 6500) of Chapter 5 of Division 7 for the purpose of contracting pursuant to Section 14087.3 of the Welfare and Institutions Code, and any advisory committee to a county-sponsored health plan licensed pursuant to Chapter
2.2 (commencing with Section 1340) of Division 2 of the Health and Safety Code if the advisory committee has 12 or more members.
(e) (1) The legislative body of a local agency may use teleconferencing without complying with the requirements of paragraph (3) of subdivision (b) if the legislative body complies with the requirements of paragraph (2) of this subdivision in any of the following circumstances:
(A) The legislative body holds a meeting during a proclaimed state of emergency, and state or local officials have imposed or recommended measures to promote social distancing.
(B) The legislative body holds a meeting during a proclaimed state of emergency for the purpose of determining, by majority vote, whether as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees.
(C) The legislative body holds a meeting during a proclaimed state of emergency and has determined, by majority vote, pursuant to subparagraph (B), that, as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees.
(2) A legislative body that holds a meeting pursuant to this subdivision shall do all of the following:
(A) In each instance in which notice of the time of the teleconferenced meeting is otherwise given or the agenda for the meeting is otherwise posted, the legislative body shall also give notice of the means by which members of the public may access the meeting and offer public comment. The agenda shall identify and include an opportunity for all persons to attend via a call-in option or an internet-based service option.
(B) In the event of a disruption that prevents the legislative body from broadcasting the meeting to members of the public using the call-in option or internet-based service option, or in the event of a disruption within the local agency’s control that prevents members of the public from offering public comments using the call-in option or internet-based service option, the legislative body shall take no further action on items appearing on the meeting agenda until public access to the meeting via the call-in option or internet-based service option is restored. Actions taken on agenda items 92 Ch. 285 — 4 —
during a disruption that prevents the legislative body from broadcasting the meeting may be challenged pursuant to Section 54960.1.
(C) The legislative body shall not require public comments to be submitted in advance of the meeting and must provide an opportunity for the public to address the legislative body and offer comment in real time. (D) Notwithstanding Section 54953.3, an individual desiring to provide public comment through the use of an internet website, or other online platform, not under the control of the local legislative body, that requires registration to log in to a teleconference may be required to register as required by the third-party internet website or online platform to participate. (E) (i) A legislative body that provides a timed public comment period for each agenda item shall not close the public comment period for the agenda item, or the opportunity to register, pursuant to subparagraph (F), to provide public comment until that timed public comment period has elapsed.
(ii) A legislative body that does not provide a timed public comment period, but takes public comment separately on each agenda item, shall allow a reasonable amount of time per agenda item to allow public members the opportunity to provide public comment, including time for members of the public to register pursuant to subparagraph (F), or otherwise be recognized for the purpose of providing public comment. (iii) A legislative body that provides a timed general public comment period that does not correspond to a specific agenda item shall not close the public comment period or the opportunity to register, pursuant to subparagraph (F), until the timed general public comment period has elapsed. (3) If a state of emergency remains active, or state or local officials have imposed or recommended measures to promote social distancing, in order to continue to teleconference without compliance with paragraph (3) of subdivision (b), the legislative body shall, not later than 30 days after teleconferencing for the first time pursuant to subparagraph (A), (B), or (C) of paragraph (1), and every 30 days thereafter, make the following findings by majority vote:
(A) The legislative body has reconsidered the circumstances of the state of emergency.
(B) Any of the following circumstances exist:
(i) The state of emergency continues to directly impact the ability of the members to meet safely in person.
(ii) State or local officials continue to impose or recommend measures to promote social distancing.
(4) This subdivision shall not be construed to require the legislative body to provide a physical location from which the public may attend or comment. (f) (1) The legislative body of a local agency may use teleconferencing without complying with paragraph (3) of subdivision (b) if, during the teleconference meeting, at least a quorum of the members of the legislative body participates in person from a singular physical location clearly identified on the agenda, which location shall be open to the public and situated within the boundaries of the territory over which the local agency 92 — 5 — Ch. 285
exercises jurisdiction and the legislative body complies with all of the following:
(A) The legislative body shall provide at least one of the following as a means by which the public may remotely hear and visually observe the meeting, and remotely address the legislative body:
(i) A two-way audiovisual platform.
(ii) A two-way telephonic service and a live webcasting of the meeting. (B) In each instance in which notice of the time of the teleconferenced meeting is otherwise given or the agenda for the meeting is otherwise posted, the legislative body shall also give notice of the means by which members of the public may access the meeting and offer public comment. (C) The agenda shall identify and include an opportunity for all persons to attend and address the legislative body directly pursuant to Section 54954.3 via a call-in option, via an internet-based service option, and at the in-person location of the meeting.
(D) In the event of a disruption that prevents the legislative body from broadcasting the meeting to members of the public using the call-in option or internet-based service option, or in the event of a disruption within the local agency’s control that prevents members of the public from offering public comments using the call-in option or internet-based service option, the legislative body shall take no further action on items appearing on the meeting agenda until public access to the meeting via the call-in option or internet-based service option is restored. Actions taken on agenda items during a disruption that prevents the legislative body from broadcasting the meeting may be challenged pursuant to Section 54960.1.
(E) The legislative body shall not require public comments to be submitted in advance of the meeting and must provide an opportunity for the public to address the legislative body and offer comment in real time. (F) Notwithstanding Section 54953.3, an individual desiring to provide public comment through the use of an internet website, or other online platform, not under the control of the local legislative body, that requires registration to log in to a teleconference may be required to register as required by the third-party internet website or online platform to participate. (2) A member of the legislative body shall only participate in the meeting remotely pursuant to this subdivision, if all of the following requirements are met:
(A) One of the following circumstances applies:
(i) The member notifies the legislative body at the earliest opportunity possible, including at the start of a regular meeting, of their need to participate remotely for just cause, including a general description of the circumstances relating to their need to appear remotely at the given meeting.
The provisions of this clause shall not be used by any member of the legislative body for more than two meetings per calendar year. (ii) The member requests the legislative body to allow them to participate in the meeting remotely due to emergency circumstances and the legislative body takes action to approve the request. The legislative body shall request a general description of the circumstances relating to their need to appear 92 Ch. 285 — 6 —
remotely at the given meeting.
(3) The provisions of this subdivision shall not serve as a means for any member of a legislative body to participate in meetings of the legislative body solely by teleconference from a remote location for a period of more than three consecutive months or 20 percent of the regular meetings for the local agency within a calendar year, or more than two meetings if the legislative body regularly meets fewer than 10 times per calendar year. (g) The legislative body shall have and implement a procedure for receiving and swiftly resolving requests for reasonable accommodation for individuals with disabilities, consistent with the federal Americans with Disabilities Act of 1990 (42 U.S.C. Sec. 12132), and resolving any doubt in favor of accessibility. In each instance in which notice of the time of the meeting is otherwise given or the agenda for the meeting is otherwise posted, the legislative body shall also give notice of the procedure for receiving and resolving requests for accommodation.
(h) The legislative body shall conduct meetings subject to this chapter consistent with applicable civil rights and nondiscrimination laws. (i) (1) Nothing in this section shall prohibit a legislative body from providing the public with additional teleconference locations. (2) Nothing in this section shall prohibit a legislative body from providing members of the public with additional physical locations in which the public may observe and address the legislative body by electronic means. (B) A contagious illness that prevents a member from attending in person. (C) A need related to a physical or mental disability as defined in Sections 12926 and 12926.1 not otherwise accommodated by subdivision (g). shall comply with all otherwise applicable requirements of this chapter and all otherwise applicable provisions of law relating to a specific type of meeting or proceeding.

This paragraph shall not affect the public’s right under the California Public Records Act (Division 10 (commencing with Section 7920.000) of Title 1) to inspect or copy records created or received in the process of developing the recommendation.
(d) (1) Notwithstanding the provisions relating to a quorum in paragraph (3) of subdivision (b), if a health authority conducts a teleconference meeting, members who are outside the jurisdiction of the authority may be counted toward the establishment of a quorum when participating in the teleconference if at least 50 percent of the number of members that would establish a quorum are present within the boundaries of the territory over which the authority exercises jurisdiction, and the health authority provides a teleconference number, and associated access codes, if any, that allows 92 — 9 — Ch. 285
any person to call in to participate in the meeting and the number and access codes are identified in the notice and agenda of the meeting.
(e) (1) The legislative body of a local agency may use teleconferencing without complying with paragraph (3) of subdivision (b) if, during the teleconference meeting, at least a quorum of the members of the legislative body participates in person from a singular physical location clearly identified on the agenda, which location shall be open to the public and situated within the boundaries of the territory over which the local agency exercises jurisdiction and the legislative body complies with all of the following:
Actions taken on agenda items 92 Ch. 285 — 10 —
during a disruption that prevents the legislative body from broadcasting the meeting may be challenged pursuant to Section 54960.1.
(B) The member shall publicly disclose at the meeting before any action is taken whether any other individuals 18 years of age or older are present in the room at the remote location with the member, and the general nature of the member’s relationship with any such individuals. (C) The member shall participate through both audio and visual technology.
92 — 11 — Ch. 285
(f) The legislative body shall have and implement a procedure for receiving and swiftly resolving requests for reasonable accommodation for individuals with disabilities, consistent with the federal Americans with Disabilities Act of 1990 (42 U.S.C. Sec. 12132), and resolving any doubt in favor of accessibility. In each instance in which notice of the time of the meeting is otherwise given or the agenda for the meeting is otherwise posted, the legislative body shall also give notice of the procedure for receiving and resolving requests for accommodation.
(g) The legislative body shall conduct meetings subject to this chapter consistent with applicable civil rights and nondiscrimination laws. (h) (1) Nothing in this section shall prohibit a legislative body from providing the public with additional teleconference locations. STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Tabatha Miller, Finance Director
PREPARER: Tabatha Miller, Finance Director
DATE: February 5, 2025
TITLE: Receive an Update on the Financial Status of the Water Fund and Steel Waterline Replacement Project and Direct Staff, as Appropriate.
RECOMMENDATION:
It is recommended that the Council receive an update on the financial status of the Water Fund and Steel Waterline Replacement Project and direct staff, as appropriate.
INTRODUCTION:
The Steel Waterline Replacement Project is the removal and replacement of approximately 33,600 linear feet (LF) of aging steel water main, 300 new valves, 680 laterals, and 700 meter boxes, within the City’s water service area. This project has been in the City’s 5-year Capital Improvement Program (CIP) since at least 2005 and is a critical project. Many of the City’s water lines have exceeded their useful life resulting in regular breaks and failures. The current Steel Waterline Replacement Project addresses the most deteriorated pipe infrastructure.
BACKGROUND:
There are numerous sections of the Arcata waterline distribution system that are comprised of steel waterlines; these waterline sections are old and unreliable and therefore must be replaced. The problem posed by these aging steel waterlines is that they frequently break or fail, and the resulting water leaks then require the City to devote significant resources towards the maintenance and repair of these lines. Repairing these defective waterlines is expensive for the City, because a typical water leak requires excavation in the roadway to gain access to the line so that repairs can be made.
Additionally, regular maintenance of the lines consumes City staff work hours, which could be better spent on other projects/tasks. These steel waterlines in Arcata can be between 50-100 years old and have exceeded their useful lifetimes. Currently, approximately five to ten major defects in steel waterlines requiring significant maintenance and repair arise each year. It is expected that if these existing steel waterlines are not replaced with new piping, the rate at which defects occur will increase drastically over the next 5-10 years.
In 2005, the steel waterline replacement project carried an estimated cost of $1 million. In the August 2020 Water Rate Study, the project was estimated to cost $5 million with an expected offset of $2.5 million in grant proceeds. Today following the impacts of COVID-19 and subsequent supply chain issues and cost increases, the engineer’s estimate for the total project is $14.5 million without any expected offset from grants. Unfortunately, current Water Fund resources are not
sufficient to pay for the $14.5 million project, or to address the additional ongoing water infrastructure replacement needs.
DISCUSSION:
With estimated current financial resources of approximately $10.2 million, the Water Fund could afford the 2020 estimated cost of $5 million, even without the grant offset, but not the current $14.5 million price tag for the Steel Waterline Replacement. More so, with the last approved rate increase implemented on July 1, 2024, of 1.5 percent, going forward the water fund is unlikely to accumulate additional resources that can be used to pay for the increased cost of the Steel Waterline Replacement. To add to the challenge, without additional operating revenue the Water Fund will likely start to operate at a deficit as early as this current fiscal year (FY).
This means that the Water Fund cannot support outside borrowing to bridge the gap between current available resources and the expected price of $14.5 million. The City was turned down by the California State Water Resources Control Board (SWRCB) for a low-interest loan for this project because the Water Fund falls short of the required debt service coverage ratio of 1.2 times the new debt service amount.1
Despite the fiscal challenges, staff does not recommend delaying the Steel Waterline Replacement Project. As the water lines continue to deteriorate, the breaks and failures only increase each year and require more financial resources to repair and maintain the system. Moreover, the cost of this project and the additional water line and infrastructure replacements are likely to continue to increase in cost, at rates higher than inflation, further exasperating the challenges.
To address the Water Fund’s financial shortfall in the short term and to develop a plan for the long term, staff recommends:
1. Continuing with the issued bid notice (Jan. 21, 2025) for the Steel Waterline Replacement Project, to confirm the engineer’s estimate is reasonably close to expected cost of the project.
If the most responsive bid is within the expectations of the engineer’s estimate, award the contract.
2. Hiring a Rate Consulting Firm to conduct a rate study, including a connection fee study and development of an indirect cost allocation plan. Reviewing connection fees will be important to evaluate how the cost of infrastructure maintenance and expansion is paid by the City’s customer base and new development. The indirect cost allocation plan will allow the City to confirm (or not) that the indirect costs allocated to the City’s Enterprise Utilities (Water, Wastewater, Storm Water and Solid Waste) are appropriate for the services provided.
The rate study will provide a neutral third-party evaluation of the costs and revenues needed to efficiently and responsibly operate the City’s water system and to develop a longer-term financial plan. A longer-term plan will likely include progressive rate increases, an updated CIP, and evaluation of financial options for implementing the updated CIP.
To assist with timely address of the financial shortfalls in the Water Fund, staff have already requested and received a proposal from Bartle Wells Associates for a Water and Wastewater Rates and Capacity Charge Study and a Citywide Indirect Cost Allocation Plan. Bartle Wells Associates conducted the August 2020 Water and Wastewater Rate Study for Arcata with
1 Debt Service Coverage Ratio is a metric that measures an entity’s ability to pay its debts and is calculated by dividing the entity’s net operating income by the annual debt service. Typically, a minimum of debt service coverage of 1.2 to 1.25 is required.
good results. Staff anticipate presenting a contract for approval with Bartle Wells Associates to City Council at a future meeting.
3. The City Council, by future Resolution, approve a 10-year $8.5 million loan from the City’s Wastewater Fund, with annual interest cost set equal to the investment earnings rate (4.43% in December, 2024). The loan would compensate the Wastewater Fund at the same earnings other invested funds will receive, and allow for early repayment if other funding becomes available and is more beneficial to the City. But in the interim, it will allow the much delayed and necessary Steel Waterline Replacement Project to proceed.
The loan from the Wastewater Fund will utilize reserve funds not required by the Wastewater utility within the term of the loan, and provide some rate increase relief to the Water Fund.
However, it is important to note that it is almost assured that water rates will need to be increased, even if phased in, to cover repayment of the Wastewater loan and other needed capital improvements in future years.
POLICY IMPLICATIONS:
The City does not currently have an Interfund Loan Policy. Prior to approving a loan for more than one-year between City Funds, staff strongly recommend that the City adopt a policy to ensure that interfund loans comply with best practices and with state law.2 Good Interfund Loan Policies, require that the borrowing fund have the financial ability to repay the loan amounts, are approved by the City Council by resolution, require clear repayment terms such as length of loan, payment amounts, and interest charged. The Rate Study will inform the City of what level of water rate changes will be needed to ensure that the Water Fund has the ability to repay the Wastewater Fund.
BUDGET/FISCAL IMPACT:
The fiscal impacts of completing the $14.5 million Steel Waterline Replacement Project are set forth in detail on the attached Water and Wastewater Fund 10-year Long Range Plans. To avoid a significant cash deficit in the Water Fund and to complete the Steel Waterline Replacement Project, water rate increases are projected and an $8.5 million interfund loan from the Wastewater Fund is proposed.
Please note that the rate increases presented in the 10-year Water Fund plan are illustrative estimates and not based on a rate study or any City Council direction or action. Actual water rate increases would need to complete a Proposition 218 notice and process, following a full Rate Study.
No rate increases are presented in the Wastewater Fund and based on current information not expected in the near future, but the 10-year plans are only illustrative estimates and not based on a rate study or any City Council direction or action.
