Proclamation
in Honor of
Older Americans month MAY 2025
WHEREAS, it is time to flip the script on aging by transforming how society perceives, discusses, and approaches aging—challenging outdated stereotypes, dispelling misconceptions, and embracing the opportunities for purpose, exploration, connection, and continued engagement that aging brings; and WHEREAS, the Area 1 Agency on Aging (A1AA) brings more than $3 million in state and federal funding to Humboldt and Del Norte counties to support programs and services that promote independence, health, security, and choice for older adults and their families; and WHEREAS, A1AA’s vital services include Enhanced Information and Assistance, the Volunteer Driver Program to access medical appointments, and Aging in Place services such as Fall Prevention, Homemaker assistance, and Northcoast Homeshare to provide housing support, safety, and advocacy; and promotes health and wellness through SAIL (Stay Active and Independent for Life) exercise classes and CalFresh Healthy Living nutrition and exercise programs; and provides funding for local Meals on Wheels and congregate meal sites, legal assistance for older adults, and family caregiver support services; and WHEREAS, the Long-Term Care Ombudsman Program safeguards the rights and dignity of residents in skilled nursing, assisted living, and other long-term care settings by advocating for quality care and respectful treatment; and the Health Insurance Counseling and Advocacy Program (HICAP) provides unbiased, accurate information about Medicare and assistance in accessing medical resources; and WHEREAS, the Aging and Disability Resource Connection—a partnership with Tri-County Independent Living and the North Coast Health Improvement and Information Network—works to streamline and coordinate services for older adults, people with disabilities, caregivers, and families; and WHEREAS, any reduction in federal or state funding would jeopardize the health, safety, and independence of those served—putting them at greater risk of injury, hospitalization, isolation, institutionalization, and homelessness—outcomes that run counter to the spirit of flipping the script on aging; NOW, THEREFORE, BE IT PROCLAIMED that the City Council of the City of Arcata recognizes MAY 2025 to be OLDER AMERICANS MONTH. This year's theme, "Powered by Connection," emphasizes the profound impact of meaningful interactions and social connection on the well-being and health of older adults in our community and urges residents to join in promoting programs and activities that foster connection, inclusion, and support for older adults.

STAFF REPORT – CITY COUNCIL MEETING
May 7, 2025
TO: Honorable Mayor and City Council Members
FROM: Netra Khatri, City Engineer
PREPARER: Mara Grow, Administrative Specialist
DATE: April 30, 2025
TITLE: Approve an Amendment to the Contract for Phase 1 of the Arcata Wastewater Treatment Facilities Upgrade Project with Carollo Engineers, Inc. in the Amount of $434,843; and Authorize the City Manager to Execute all Applicable Documents.

RECOMMENDATION:

It is recommended that the Council:
1) Approve an amendment to the contract for Phase 1 of the Arcata Wastewater Treatment Facilities Upgrade Project with Carollo Engineers, Inc., for construction and inspection services in the amount of $434,843; and
2) Authorize the City Manager to execute all applicable documents INTRODUCTION:

The City of Arcata began construction of one of the largest capital improvement projects in the City’s history— the Arcata Wastewater Treatment Facilities Upgrade Project. The total project cost for Phase 1 of the improvements is approximately $67 million— $2.4 million funded via the Community Development Block Grant (CDBG) program, a small portion via City’s Wastewater Fund, and the remainder funded via the State Water Resources Control Board Clean Water State Revolving Fund (SRF) program.

In December 2021, the City solicited a Request for Proposals (RFP) from qualified consulting firms to provide construction management and inspection services for the project.

The City received only one proposal in response to the RFP from Carollo Engineers. The proposal was reviewed by City staff and was deemed to be technically sound and to meet the funding source and City requirements for completion of the work. Carollo’s design team has been assisting with the project since 2016. When the contract for Construction Management Services was awarded, the completion date was early December 2025, however due to supply and demand issues the construction period extended to March 2026. The total additional funds of $434,843, which will bring our total contract to $3,345,455 is to cover Construction Management staff time for the extended period and additional services requested by the City staff that includes:

A. Operations and Maintenance Manual Preparation for the Equipment B. Project Start-up Support
C. Additional Geotechnical Inspection Support for Headworks Pile Installation

BACKGROUND:

The City of Arcata (City) Wastewater Treatment Facility (AWTF) currently discharges treated wastewater to Humboldt Bay in conjunction with enhanced treatment occurring in the Arcata Marsh Wildlife Sanctuary (AMWS). Discharges are regulated by the North Coast Regional Water Quality Control Board (RWQCB) through application of the National Pollutant Discharge Elimination System (NPDES) permit.

The AWTF operates under NPDES permit, which includes requirements for operation and maintenance, treatment standards, monitoring, discharge location, and water quality standards. In the 2012 NPDES permit, the RWQCB included requirements to make changes to the treatment system due to compliance problems associated with discharge water quality. The intent of the required changes is to improve wastewater treatment, protect beneficial uses, and reduce chemical usage for disinfection. The City completed a Facilities Plan in 2017 for the AWTF that developed four potential options for upgrading the AWTF. Following a number of public meetings, the City Council chose to pursue an upgrade project that retained the natural treatment systems of the current AWTF.

The RWQCB adopted and issued the City’s latest NPDES permit for wastewater discharge that became effective on December 1, 2019. Concurrently, the RWQCB issued the City a Time Schedule Order with compliance schedules to complete the AWTF Facilities Upgrade Project to address ongoing discharge violations and treatment deficiencies at the AWTF, which mostly arise from disinfection byproducts associated with chlorine disinfection and new water quality standards. Phase 1 of the AWTF Upgrade Project will address these immediate needs by replacing aging treatment plant infrastructure and installing a new UV disinfection system.

ENVIRONMENTAL REVIEW (CEQA):

City staff completed the required environmental review documents pursuant to both State (CEQA) and Federal (NEPA) requirements. The Notice of determination was filed in December 2020 (Clearing house 2020100483).

BUDGET/FISCAL IMPACT:

The cost associated with this contract amendment is eligible for reimbursement through SRF. The contract amendment amount will not be expended until FY 25-26 and staff has requested budget for this amount for FY 25-26 as follows:

STAFF REPORT – CITY COUNCIL MEETING
May 9, 2025
TO: Honorable Mayor and City Council Members
FROM: Netra Khatri, City Engineer
PREPARER: Mara Grow, Administrative Specialist
DATE: April 29, 2025
TITLE: Approve Plans and Award Contract for Former Little Lake Industries Mill Cleanup Project to Innovative Construction Solutions in the Amount of $406,514; and Approve Necessary and Associated Related Actions.

RECOMMENDATION:

It is recommended that the Council:
1) Adopt a California Environmental Quality Act Categorical Exemption for the Former Little Lake Industries Mill Cleanup Project pursuant to CEQA Guidelines Section 15330; 2) Approve the project plans and award a construction contract for the Former Little Lake Industries Mill Cleanup Project to Innovative Construction Solutions in the amount of $406,514;
3) Authorize the City Engineer to approve change orders and increase the Contract amount by up to $81,302.80 (for a total not to exceed $487,816.80) to allow for any unforeseen contingencies and additional work as necessary; and
4) Authorize the City Manager to execute all applicable documents.

INTRODUCTION:

The City of Arcata received a U.S. Environmental Protection Agency (EPA) grant to prepare a site cleanup plan (SCP) for remediation activities at the former Little Lake Industries mill site (LLI).

Previous investigation activities conducted at the site to assess contamination associated with historical use have identified dioxins at concentrations above permissible thresholds in the former kiln area. Local consulting firm SHN prepared the SCP for the site in 2022. The SCP summarized current conditions and outlined methods planned for implementation during site cleanup activities.

This award of contract is for the contractor to implement portions of the SCP.

BACKGROUND:

From 1950 to 1988, the project site was primarily used for timber-related operations that included log storage, milling, and drying. The Johnson Structures on the site consisted of a remanufacturing complex, kilns, maintenance shed, boiler building, drying shed, conical burner, and office building.

No report of wood treatment occurred at the LLI site; however, chemicals associated with treated wood have been identified. Prior to 1950, the area was used for agricultural purposes. The City of Arcata acquired the property in 2001, and by 2010, all structures located on the property had been removed. The site currently consists of foundations and footings, bare ground, vegetated areas, and various stockpiles of soil and gravel.

Page 38 of 84 ends

The goal of the project is to prevent contaminant exposure to potential receptors above the identified screening levels and restore beneficial use of the site under the current zoning. The SCP outlined three options:

1. Detailed Risk Assessment

2. Excavation and Disposal of Contaminated Soils

3. Soil Cap and/or Access Control
DISCUSSION:

The City issued a formally noticed Invitation for Bids on February 26, 2025, and held a mandatory pre-bid meeting on March 6, 2025. Sealed bids were received until 11:00 a.m. on March 27, 2025.

Five sealed bids were received from Contractors as follows:

No. Name of the Contractor Total
1 Innovative Construction Solutions $406,514.00
2 Kernen Construction $417,180.00
3 Wahlund Construction, Inc. $539,230.00
4 G R Sundberg, Inc. $566,190.00
5 Mercer Fraser Company $537,500.00
Please see Attachment A, an itemized bid tabulation sheet, for full a summary of bids received.

Following the opening of bids, the bid range was evaluated for consistency.

If the Contract is presently awarded, work will commence on or after May 27, 2025, and should be completed within 60 working days after the start of work. Prior to issuing the Notice to Proceed to the Contractor, public notifications will be made by the City and the Contractor to potentially impacted residents to inform them of construction activities, the potential for traffic impacts and possible parking restrictions (that will be minimized to the extent possible).

ENVIRONMENTAL REVIEW (CEQA):

The project, including the award for construction oversight, the remediation, and the end hauling for disposal are exempt from the California Environmental Quality Act pursuant to CEQA Guidelines Sec. 15330, Minor Actions to Prevent, Minimize, Stabilize, Mitigate, or Eliminate the Release or Threat of Release of Hazardous Waste or Hazardous Substances. This exemption is for removal actions costing $1MM or less that do not use an onsite incinerator.

BUDGET/FISCAL IMPACT:

Staff had initially planned to use an EPA grant to complete the work. However, the bids received were higher than anticipated. As a result, to complete the Little Lake cleanup project, staff are requesting that City Council approve an allocation of $212,816.80 from redevelopment funds. This additional funding is necessary to bridge the gap between the amount secured through the EPA grant and the actual costs required to complete the environmental cleanup. Without these funds, the City will be unable to proceed with the final cleanup activities needed to prepare the site for future community use. The current project budgeted is as follows:

Account Number Amount Account Name
265-30-13-58211 $275,000.00 EPA
245-30-35-58500 $212,816.80 Redevelopment Fund
If contingency or extra work funds are needed, they will be funded out of the same account.

INTRODUCTION:

The City’s Management and Confidential employee classifications consist of both sworn and general employees that are unrepresented, which means they do not engage in collective bargaining with the City on matters related to wages, benefits, and other terms and conditions of employment. As such, the City Council provides directions to address wages, benefits, and other terms and conditions of employment that pertain to the City’s unrepresented classifications.

BACKGROUND:

The Supplemental Compensation and Benefits Resolution is how Council authorizes changes to the supplemental compensation and benefits for these unrepresented classifications.

DISCUSSION:

With direction from the City Council, the City Manager’s Office has made the appropriate changes to the attached authority documents to initiate the actions necessary to update the health insurance benefits available for Management, Confidential, and Appointed Employees.

The following is a summary of the main changes:
 A medical, high-deductible health plan (HDHP) will be made available during open enrollment in Plan Year 2025/2026.
 For Plan Year 2025/2026, the City will contribute ninety percent of the HDHP premiums with employees in this bargaining unit contributing ten percent of the total HDHP premiums.  The City will authorize the contracted administrator to create a Health Savings Account (HSA) for all employees who are enrolled in the HDHP, and for the Plan Year 2025/2026, on

Page 42 of 84 ends

or before July 1, 2025, the City will make a contribution to the employees’ HSA. After July 1, 2025, employees will also be able to make contributions to their Health Savings Account.  All other changes are considered housekeeping/cleanup items.

10 While City contributions will not continue past Medicare eligibility, a retiree or spouse may choose, if eligible, to continue the Medicare coverage available, if any, under the City’s group plan at the retiree’s or spouse’s own cost. (revised 7/2013) Note: For REMIF plans, per its eligibility guidelines, an employee, who has at least ten (10) years of continuous employment with a member entity before retirement and retires under CalPERS, may choose to continue medical, dental, and/or vision coverage. This will be at the retiree’s own cost if he/she does not also meet the criteria above to be eligible for a City contribution towards the premium(s). For example, if the employee had 5 years service at another REMIF member entity and 6 years with the City of Arcata, the employee would not qualify for a percentage of the retiree premium to be paid by the City as outlined above, but would be able to continue coverage as a retiree (vs. COBRA) at the retiree’s own cost. See Appendix A for additional information on City and REMIF plan eligibility guidelines.

C. COBRA Premium Payments for Survivors: For the survivors of an employee who dies while employed by the City of Arcata, who elect to continue medical and dental benefits through COBRA coverage, the City will contribute two percent (2%) of the COBRA premium cost for each year of service achieved by the deceased employee rounded to the nearest whole year. Such contributions will not continue past the COBRA eligibility period.

D. Life insurance is provided for full-time City employees under the Redwood Empire Municipal Insurance Fund with the City contributing the amount of premium paid under REMIF’s plan of $50,000 term life insurance per employee.

E. The City will provide short-term disability insurance coverage, as described in the City of Arcata Personnel Rules and Regulations.

F. Supplemental insurance policies are available for employee purchase through AFLAC.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Merritt Perry, City Manager
PREPARER: Rhiannon Lewis-Stephenson, Executive Assistant/Deputy City Clerk DATE: May 7, 2025
TITLE: Approve Signing on to a Digital Letter of Community Support Calling for the Right to Sanctuary and Safety for Migrants, Both Documented and Undocumented, in Humboldt County; and Authorize the Vice Mayor to Execute All Applicable Documents.

RECOMMENDATION:

It is recommended that the Council approve signing on to a digital Letter of Community Support calling for the right to sanctuary and safety for migrants, both documented and undocumented, in Humboldt County; and authorize the Vice Mayor to sign a letter indicating the City’s support for sanctuary laws and human rights protections for immigrant community members.

INTRODUCTION:

A letter of support for the protection and dignity of immigrant persons residing and working in Humboldt County has been requested for Council consideration by Vice-Mayor Kimberley White.

This letter affirms the right to seek asylum and safety, denounces criminalization of undocumented immigrants, and supports the upholding of Humboldt County’s sanctuary law.

BACKGROUND/DISCUSSION:

On April 9th, the Humboldt County Democratic Central Committee adopted a Letter of Community Support that outlines a strong stance in favor of migrant rights, recognition of their essential contributions to our local economy—particularly in the agricultural sector—and the importance of upholding sanctuary protections.

The letter emphasizes the inaccessibility of the legal immigration process for many people fleeing violence or seeking economic opportunity and condemns the targeting of undocumented individuals by U.S. Immigration and Customs Enforcement (ICE) when no crimes have been committed. It calls on communities, including local governments, to stand against such unjust practices and uphold human rights standards.

Council's endorsement of this letter would align with community values of inclusivity, equity, and the protection of vulnerable populations. The letter to be signed for Council’s consideration is shown as a link (Attachment B). A fact sheet detailing the language included in the letter of support has been provided as well (Attachment A).

Page 59 of 84 ends

POLICY IMPLICATIONS:

This item is being brought to the Council for approval as it does not fall under a category for our legislative platform.

RECOMMENDED COUNCIL ACTION:

Motion to approve signing on to a digital Letter of Community Support Calling for the Right to Sanctuary and Safety for Migrants, Both Documented and Undocumented, in Humboldt County; and authorize the Vice Mayor to execute all applicable documents. Consent Calendar vote.

Dear Humboldt Community,
We the undersigned recognize the human rights of all persons in the United States and support the upholding of those rights including the right to seek asylum and the right to sanctuary and safety for migrants, both documented and undocumented.

We understand that the legal immigration process can be expensive and challenging for people fleeing violence or simply seeking a place to earn a decent living and support themselves and their families. Immigration should not be limited to people of ample financial means. Furthermore, characterizing people as criminals simply because they migrated to this country without being able to attain legal documents is harmful, dangerous, and wrong.

Humboldt County has a large and successful agricultural sector that provides healthy food to the entire region. A significant number of farm families have a great appreciation for the work ethic and skill sets many migrants bring with them to this country. We have a long history in this country of dependence upon the hard work of migrant labor to ensure our access to fresh produce, meat, and dairy products.

We believe the people doing these jobs, and many other important jobs, deserve respect, dignity, and fair working conditions. People who commit crimes, whether native-born or otherwise, are already subject to our laws. The attacks on people who are here to improve their own lives, and the communities they live and work in, are unacceptable. These are our neighbors and friends, our coworkers, and community members who help keep our economy running. They should not be treated as criminals for seeking a better life.

We hereby express our support and our insistence that our sanctuary law, which prohibits our law enforcement from assisting ICE when ICE unlawfully persecutes migrants who have committed no crimes, be upheld and recognized as essential to upholding human rights in Humboldt County.

Signed,

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Tabatha Miller, Finance Director
PREPARER: Tabatha Miller, Finance Director
DATE: May 7, 2025
TITLE: Authorize the City Manager to Execute a Six-Month Lease of the Transit Building Office, Conference Room, and Shared Space to Occupational Medicine Specialist Doctor Eileen Moy.

RECOMMENDATION:

It is recommended that the Council authorize the City Manager to execute a six-month lease for the City of Arcata’s Transit Building vacant office, conference room and shared space, to Occupational Medicine Specialist Doctor Eileen Moy.

INTRODUCTION:

The City of Arcata and other municipal members of the California Intergovernmental Risk Authority (CIRA) have utilized the services of the Mad River Occupational Medicine for workers’ compensation claim visits and examinations, and pre-employment physicals. Recent changes at Mad River have greatly reduced the availability and capacity of those services. To fill the vacancy in services and ensure that CIRA members, including Arcata, can meet the timely needs of its employees, CIRA representatives reached out to potential local providers. Dr. Eileen Moy was leasing office space from Mad River Occupational Medicine but recently received a 30-day notice to vacate. This left Dr. Moy without office space in the Arcata area to provide services.

DISCUSSION:

CIRA representatives asked local cities if they could assist Dr. Moy in locating temporary office space to continue to see patients locally, including CIRA entities and the City of Arcata. Dr. Moy has space in the Rio Dell area but was in need of space in the McKinleyville/Arcata area. City staff suggested that the City’s Transit Center is closing to the public and, subject to approval by the City Council, could possibly be available as a temporary solution to the need for local Occupational Medicine services.

Dr. Moy and her staff are very interested in leasing the Transit Building Conference Room for medical visits and examinations and the vacant office just off of the lobby in the building. The lobby and restrooms would continue to be a shared space with the City’s IT staff, who are located in other offices in the building, and with Humboldt Transit Authority bus drivers, who occasionally use the facility restroom and lobby area for breaks. The doors to the building would remain closed to the general public to keep the building secure.

Page 69 of 84 ends

The proposal is to rent Dr. Moy the space for a six-month period, with an option to renew for an additional six-month period, if both parties agree. This would allow Dr. Moy and her team some time to identify a more permanent space in the Arcata area going forward. The rent would be $941 per month and include basic utilities, janitorial service, and separate internet connectivity. Use of the space would be limited to nonprocedural examinations and visits. All lab activity would be performed offsite. Standard CIRA insurance requirements for Dr. Moy would be included in the lease agreement.

The arrangement would allow the City, other CIRA members and the Community access to a much needed Occupational Medicine Specialist to alleviate long wait periods for workers’ compensation examinations and pre-employment physicals.

BUDGET/FISCAL IMPACT:

The initial 6-month lease would gross $5,646 that would be used to offset costs associated with operating and maintaining the Transit Building Facility.

RECOMMENDED COUNCIL ACTION:

Motion to authorize the City Manager to execute a six-month lease for the City of Arcata’s Transit Building vacant office, conference room and shared space to Occupational Medicine Specialist Doctor Eileen Moy. Consent Calendar vote.

TITLE: Approve an Agreement with the County of Humboldt for Animal Shelter Services with a Term of Four (4) Years, and a Rate for Services for Fiscal Year 2025/26 in the Amount of $168,260; and Authorize the Mayor and City Manager to Execute the Agreement.

RECOMMENDATION:

It is recommended that the Council: 1) Approve an agreement with the County of Humboldt for the provision of animal shelter services with a term of four (4) years, ending June 30, 2029, and a rate for services for Fiscal Year 2025/26 in the amount of $168,260; and 2) authorize the Mayor and City Manager to execute the agreement.

INTRODUCTION:

The City has an existing agreement with the County of Humboldt, which maintains and operates an animal shelter, under which the City may deliver domestic animals to the shelter for impoundment services, in accordance with the California Food and Agriculture Code. The County has proposed a replacement to the outdated agreement, which would become effective July 1, 2025.

BACKGROUND:

The City has had an ongoing, automatically renewing agreement with the County for animal shelter services since the shelter’s development in 2004. Last year, the County contacted City staff with a proposal for a new agreement to replace the prior agreement, which includes a modified contract term with a four-year period, and a modified computation methodology for determining the annual allocation for service rates among the cities and populations served by the County Animal Shelter.

DISCUSSION:

City staff has reviewed the terms and conditions in the new agreement and finds them to be reasonable. City staff recommends approving the proposed agreement for animal shelter services through the County.

POLICY IMPLICATIONS:

The City relies on the provision of animal shelter services through the County to be able to enforce certain sections of the the Arcata Municipal Code, including Title V – Sanitation & Health, Chapter 2 – Animals, Article 3.

Page 71 of 84 ends

BUDGET/FISCAL IMPACT:

The County’s revised methodology for computing allocations of annual service rates among the cities served under its agreements has resulted in an approximately 285% increase in the City’s contract price from the prior fiscal year, which was $58,884 in FY 2024/25 and is proposed to be $168,260 in FY 2025/26.

The contracted services are budgeted under GL account # 101-40-25-52528 and if approved by City Council will be reflected in the FY 2025/26 Proposed Budget.

RECOMMENDED COUNCIL ACTION:

Motion to 1) Approve an agreement with the County of Humboldt for the provision of animal shelter services with a term of four (4) years, ending June 30, 2029, and a rate for services for Fiscal Year 2025/26 in the amount of $168,260; and 2) authorize the Mayor and City Manager to execute the agreement. Consent Calendar vote.

8 Exhibit A – Charges for Services
Annual Computation:

The Sheriff’s Office (“SO”) shall prepare an annual computation utilizing the prior fiscal year’s financial data and present the computation to the CITY Manager and designated CITY council member by email on or before February 15th of each year. In the event the SO is unable to provide the computation by February 15th due to delays in the annual financial data being completed, then the CITY Manager and designated council member will be notified by email of an updated timeline.

The CITY shall have fourteen (14) days from date of delivery of the computation email to notify the SO if a meeting is needed to discuss the updated charges for services or if the new computed amount is acceptable.

Provided a meeting is needed to review and discuss the charges, both the CITY and SO shall make every effort to meet and confer with the intent to finalize the new rate by March 30th, so that both parties can plan accordingly for their annual budget. The participants in the meeting to review the charges for services shall include the City Manager, a designated city council member, the SO Operations Division Commander, and the SO Finance Director.

For the period of July 1, 2025, through June 30, 2026, the CITY and SO have met and agreed that the charges for services rate will be $168,260.00 for fiscal year (FY) 2025-26.

For all subsequent fiscal years, the new rate shall be agreed to by both parties by an amendment to the agreement effective July 1st of each year.

Methodology for the Annual Computation:

The SO shall use the following methodology for assessing the charges for services for the CITY.

A) The SO will calculate its Total Net Expenses to provide Animal Shelter Services to the county. The methodology for calculating Total Net Expenses for Animal Shelter Services is as follows:
1) The below SO charges shall NOT be included in the Total Net Expenses:
• Internal Service Fund Information Technology Charges
• Internal Service Fund Purchasing & Disposition Charges • Internal Service Fund ADA Charges
• Internal Service Fund Communications/Radio Infrastructure Charges • COUNTY General Liability, Property, or Bond Insurance • COUNTY Cost Plan Charges (aka A87 Charges)
• Fixed Assets
• Grants

Page 80 of 84 ends

9 2) The below SO charges shall be included in the Total Net Expenses:
• The direct expenses for the Animal Shelter division.
• 80% of the salary and benefits of the Animal Shelter/Control Manager. • Interfund Expenditures. These are charges to the SO from other county departments (ie. Public Works) for direct services and/or supplies for the Animal Shelter division.
• The SO Indirect Costs that are allocated to Animal Shelter will be included. As of FY2024-25 the SO indirect cost centers include the following:

Administration Operations Command Team
Backgrounds/Recruitment Training
Main Station (through its allocation to
Admin, Training, and Operations
Command Team)
3) Revenue for spay/neuter fees, adoption fees, donations, or other miscellaneous revenue that supports the operations of the Animal Shelter will be included in calculating the Total Net Expenses.

B) The CITY will pay its pro-rata share of the Total Net Expenses based on population. 1) Data from the US Census 2020 will be used for calculating population and is as follows:

2) The City of Trinidad has a US Census 2020 population of 307. Trinidad has a higher proportion of short term rentals compared to other incorporated cities in our area and therefore Trinidad has agreed to a population adjustment of an additional 120 to account for this. That brings the total remaining population covered by the SO to 119,290 resulting in the below pro-rata share for each contract city currently using Animal Shelter services.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: David Loya, Community Development Director
PREPARER: David Loya, Community Development Director
DATE: May 7, 2025
TITLE: Provide Policy Guidance on the Short-Stay Vacation Rental Program.

RECOMMENDATION:

It is recommended that the Council receive a report on the Short-Stay Vacation Rental program, receive public comment, and provide direction to staff.

INTRODUCTION:

The City adopted a regulatory program for vacation rentals on February 17, 2021. The program ordinance has been amended twice since that time. Council expressed a desire to review the program from time to time. This item provides the opportunity for Council to give policy direction on the program. While changes to the program cannot be made at this meeting, if directed, staff will return to Council with a revised ordinance or implementing resolution, as applicable.

BACKGROUND:

The Short-Stay Vacation Rental program (Program) includes regulations in the Arcata Municipal Code starting at Section 6300. These regulations were last updated by Ordinance No. 1559, which was adopted on February 1, 2023. The regulations can be reviewed in full by visiting the Arcata Municipal Code at https://www.codepublishing.com/CA/Arcata/#!/Arcata06/Arcata0602.html#6200 (Title VI, Chapter 2, Article 3.)
The Council previously considered the Program on November 11, 2019; on January 20, February 3, and February 17, 2021; on April 21 and May 5, 2021; on June 22 and October 19, 2022; and on January 18 and February 1, 2023. Readers may wish to research the staff reports for those dates for additional background.

DISCUSSION:

The Program was established to place limitations on converting the City’s housing stock from residential use to commercial use. The Council wished to allow a reasonable amount of business activity in short-stay vacation rentals while preventing unregulated conversion from residential use.

The Program requires all short-stay operators to obtain a permit from the City. There is a limit of 100 permits that the City will issue to non-exempt operators. Exemptions from the limitation are provided to operators who occupy the property or who rent for fewer than 30 days in a year. There is

Page 83 of 84 ends

also an exemption for properties that are designated historic landmarks. Operators that are exempt from the 100-permit limitation must still obtain a permit to operate.

The program has been dynamic. While several operators have maintained their permits since the program’s introduction, others have allowed the permits to expire. Initially, there were more than 100 non-exempt permits issued since the Council allowed all existing operators to obtain a permit when the Program was introduced. Since that time, non-exempt permits have dropped below the limit multiple times. Currently, there are 99 non-exempt and 55 exempt active permits. This represents about 1.8 percent of the City’s housing stock.

There are also several operators that do not have permits. The Finance and Community Development Departments are collaborating to bring those operators into compliance. While there are software platforms that could assist with compliance monitoring, currently this work is done manually by cross-referencing Transient Occupancy Tax remittances, Business License information, and the Program list. Council may consider directing staff to seek a software solution for compliance monitoring.

POLICY IMPLICATIONS:

Limiting the number of units in short stay use preserves housing for long-term tenancy.

COMMITTEE/COMMISSION REVIEW:

None.

ENVIRONMENTAL REVIEW (CEQA):

None.

BUDGET/FISCAL IMPACT:

None.

RECOMMENDED COUNCIL ACTION:

1. Receive a report on the Short-Stay Vacation Rental program.
