STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Tabatha Miller, Assistant City Manager
PREPARER: Tabatha Miller, Assistant City Manager
DATE: February 18, 2026
TITLE: Adopt Resolution No. 256-38 Extending the Local Emergency Caused by the Downtown Fire on January 2, 2026.

RECOMMENDATION:

It is recommended that the Council adopt Resolution No. 256-38 extending the local emergency caused by the downtown fire on January 2, 2026.

INTRODUCTION:

California Government Code section 8630 and Title II, Chapter 6 (Emergency Operations and Functions) of the City of Arcata Municipal Code authorize the City Manager, in his capacity as Director of Emergency Services, to proclaim the existence or threatened existence of a local emergency. The Arcata Municipal Code defines a “local emergency” as the duly proclaimed existence of conditions of disaster or extreme peril to the safety of persons and property within the territorial limits of the City of Arcata, caused by conditions including fire, which require the combined forces of other political subdivisions to combat.

On January 3, 2026, the City Manager, acting as Director of Emergency Services, proclaimed the existence of a local emergency in the City of Arcata. On January 9, 2026, the City Council ratified the emergency proclamation pursuant to Title II, Chapter 6 (Emergency Operations and Functions) of the City of Arcata Municipal Code, section 2703 (Proclamation of Emergency). Section 2703 C. requires that at least once every forty (40) days, the City Council review the continuing need for a Local Emergency and terminate the Local Emergency at the earliest possible date conditions warrant.

BACKGROUND:

At approximately 2:30 p.m. on January 2, 2026, the Arcata Fire District responded to the 800 block of 10th Street following reports of a large volume of smoke originating from the downtown commercial district. Upon arrival, fire personnel encountered a well-established, rapidly spreading fire in a large, two-story commercial structure containing businesses on the ground floor and residential apartments above.

Due to extreme wind and gust conditions, the fire spread rapidly and ultimately engulfed four buildings located between H Street and I Street and extending to the alley between 9th Street and 10th Street.

Page 24 of 74 ends

Mutual aid was requested, and fire suppression resources responded from throughout Humboldt County, including as far away as Weott in Southern Humboldt. Participating agencies included Arcata Fire District, Humboldt Bay Fire, Samoa Fire, Kneeland Fire, Westhaven Fire, Loleta Fire, Ferndale Fire, Fortuna Fire, Fieldbrook Fire, Blue Lake Fire, Rio Dell Fire, Arcata-Mad River Ambulance, CAL FIRE Trinidad, and CAL FIRE Weott. Every ladder truck in Humboldt County was deployed to this incident. Approximately 80 fire suppression personnel and an additional 20 support personnel were involved.

Multiple buildings were destroyed as a result of the fire and emergency response efforts, leaving substantial debris. Ash and other chemicals were released by the burning structures. In addition, paint and other contaminants from the hardware store were likely washed into storm drains and other waterways, ultimately reaching Humboldt Bay. This runoff may negatively impact water quality in Humboldt Bay and pose potential risks to aquaculture operations, fisheries, and other aquatic habitats.

Seven local businesses and eight residential apartments were destroyed. Several nearby buildings sustained minor damage, and others were affected by the fire incident as well as associated power and gas outages.

DISCUSSION:

Staff recommends that the City Council extend the Local Emergency in order to continue to effectively respond to the ongoing impacts of the fire damage, including assessing actual and potential threats to Humboldt Bay, local waterways, public property, the local economy, local businesses, and the environment, which exceed the capacity of City resources.

ENVIRONMENTAL REVIEW (CEQA):

A city’s declaration of a local emergency is exempt from the California Environmental Quality Act (CEQA) because it constitutes immediate governmental action taken to respond to an unforeseen emergency that threatens public health, safety, or property. CEQA expressly exempts emergency actions intended to prevent or mitigate the effects of emergencies, recognizing that environmental review requirements cannot delay urgent response measures.

Specifically, Public Resources Code section 21080(b)(4) and CEQA Guidelines section 15269 exempt actions necessary to respond to emergencies, including declarations of emergency and related response activities. The declaration itself does not commit the City to a specific project or result in a physical change to the environment and therefore does not constitute a “project” subject to CEQA review.

BUDGET/FISCAL IMPACT:

The City has incurred costs associated with the initial response to the fire, including water used for fire suppression, staff time devoted to emergency response activities, and equipment and supplies used during the incident. In addition, the City has incurred expenses related to securing the site, evaluating damage, mitigating impacts from debris and runoff, and coordinating ongoing emergency recovery efforts.

Damages estimated in excess of $20 million were incurred by property owners, tenants, and local businesses impacted directly by the fire.

RECOMMENDED COUNCIL ACTION:

It is recommended that the Council adopt Resolution No. 256-38 extending the local emergency caused by the downtown fire on January 2, 2026. Consent Calendar vote.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Emily Sinkhorn, Director of Environmental Services PREPARER: Emily Sinkhorn, Director of Environmental Services DATE: February 18, 2026
TITLE: Approve a Lease Agreement with Robert L. Figas for a Portion of the 4700 West End Road Property; and Authorize the City Manager to Execute All Applicable Documents.

RECOMMENDATION:

It is recommended that the Council approve a lease agreement with Robert L. Figas for a portion of the 4700 West End Road property identified by Assessor’s Parcel Numbers 507-121-013 and 507- 081-043; and authorize the City Manager to execute applicable documents.

INTRODUCTION/BACKGROUND:

The City owns approximately 3.53 acres of industrial real property located at 4700 West End Road, identified by assessor’s parcel numbers 507-121-013 and 507-081-043. The City acquired the property in 2012, which includes an enclosed warehouse and paved exterior space. The Environmental Services Department utilizes the warehouse and a portion of the exterior space for public works related operations, including storage of materials and processing of vegetation trimmings from public rights-of-way.

DISCUSSION:

While Environmental Services utilizes 4700 West End Road daily, the southern portion of the property is not conducive to City operations and remains empty. The City currently manages one lease over the northern portion of 4700 West End Road with another construction-related business.

This proposed lease agreement with Robert Figas would include approximately 10,107 square feet at the southern portion of the property and would operate similarly to the other existing lease at 4700 West End: on a month-to-month basis until terminated by either party with 30 days’ written notice.

Robert Figas owns property just to the east of the City’s property. The City is currently developing the Arcata Annie & Mary Trail along the Great Redwood Trail Agency corridor which stretches north-to-south between 4700 West End Road and the Figas property. The lessee proposes to utilize the lease area for storing equipment and for ingress/egress, to decrease potential impacts to the future Annie & Mary Trail.

BUDGET/FISCAL IMPACT:

Revenue from this lease will be programmed in the budget under General Fund activity budget 61 (Corporation Yard), which supports management of corporation yard facilities.

B. Security Deposit. Lessee shall make a deposit in the sum of $1,000.00, which shall be held by the City, without interest, as security for any damages on the Lease Area. It shall be expressly understood and agreed that said deposit amount is not a measure of damages, and Lessee shall pay to the City on demand any additional amount that may be owed for damage in existence at the termination of the Lease. Any remaining balance of the deposit shall be promptly returned to Lessee at the time after termination of this Lease after which all of Lessee’s obligations under this lease have been fulfilled.

C. CPI Adjustment. Annually, on July 1, the rent shall be adjusted by the Consumer Price Index (CPI). The CPI used for such increases is the All Urban Consumers U.S. City Average, All Items, 1982-1984 = 100 annual CPI from the prior calendar year.

6. Alterations. F. General Conditions Pertaining to Insurance:
1) Lessee shall have its insurer endorse the third party general liability coverage to include as additional insureds the City, its officials, employees, volunteers and agents, using standard ISO endorsement CG 20 10.
2) The parties acknowledge that all insurance coverage required to be provided by Lessee is intended to apply first and on a primary, non-contributing basis in relation to any other insurance or self insurance available to the City.
3) Certificates shall contain a statement that the policy will not be cancelled except after thirty (30) days prior written notice to the City.
4) All endorsements must have an original authorized signature. Facsimile or electronic copies are insufficient.
5) Lessee agrees to waive subrogation rights against the City regardless of the applicability of any insurance proceeds, and to require all contractors and subcontractors to do likewise. 6) Proof of compliance with these insurance requirements, consisting of certificates of insurance evidencing all of the coverages required and an additional insured endorsement to Lessee’s general liability policy, shall be delivered to the City at or prior to the execution of the Agreement.
7) All coverage types and limits required are subject to approval, modification and additional requirements by the City, as the need arises. Lessee shall not make any reductions in scope of coverage (e.g. elimination of contractual liability or reduction of discovery period) that may affect the City’s protection without the City’s prior written consent.

The City reserves the right at any time during the term of the Agreement to change the amounts and types of insurance required by giving the Lessee ninety (90) days advance written notice of such change. If such change results in substantial additional cost to the Lessee, the City will negotiate additional compensation proportional to the increased benefit to the City.

9. Indemnity. To the fullest extent permitted by law, Lessee shall, at Lessee’s sole expense and with counsel reasonably acceptable to City, defend, indemnify, and hold harmless City and City’s officers, officials, employees and agents from and against all claims (including demands, losses, actions, causes of action, damages, liabilities, expenses, charges, assessments, fines or penalties of any kind, and costs including Lessee and expert fees, court costs and attorney’s fees) from any cause, arising out of or relating (directly or indirectly) to this Lease, the tenancy created under this Lease, or the Premises, including without limitation:

A. The use or occupancy, or manner of use or occupancy, of the Property; B. Any act, error, omission, or negligence of Lessee or of any of Lessee employee, contractor, invitee or guest in, on or about the Property; or
C. Any breach or default in performance of any obligation on Lessee’s part to be performed under this Lease, whether before or during the Lease Term or after its expiration or earlier termination.

This indemnification extends to and includes, without limitation, claims for injury or death to persons, loss of, injury or damage to, or destruction of property, and all economic losses and consequential or resulting damage. Lessee’s indemnification obligation hereunder shall survive the expiration or earlier termination of this Lease until all claims against the City involving any of the indemnified matters are

fully, finally, and absolutely barred by the applicable statute of limitation.

10. Default. Each of the following shall constitute an event of default under this Agreement (each an “Event of Default”)
A. Failure to pay rent when due.

B. Failure to obtain and/or maintain insurance as required in this Agreement; C. Failure to practice good management so as not to cause erosion or other damage to the Property; D. Failure to perform any of the covenants, conditions, or provisions of this Agreement to be performed by Lessee;
E. The vacation or abandonment of the Lease Area for a period of two (2) months or longer.

11. Remedies. Upon the occurrence of an Event of Default, the City, in addition to any other rights or remedies available to the City at law or in equity, shall have the right to do any one or all of the following:

B. Enter the Lease Area and remove all property from the Lease Area. The City may cause such removed property to be stored at the expense or for the account of the Lessee; and/or C. Cure the breach underlying the Event of Default for the account and at the expense of Lessee; provided that the City shall first allow Lessee a reasonable opportunity to cure, except in cases of emergency, where the City may proceed without prior notice to Lessee. Lessee shall, upon demand, immediately reimburse the City for all costs, including costs of settlements, defense, court costs, and attorney’s fees, that the City may incur in the course of any cure. The parties expressly agree that the City is not required to provide Lessee an opportunity to cure prior to exercising another legal remedy or right, including termination of the Agreement.

Except as inconsistent with or contrary to any provisions of this Agreement, no right or remedy conferred upon or reserved to the City is intended to be exclusive of any other right or remedy given now or later or existing at law or equity or by statute. No waiver by the City of any violation or nonperformance by Lessee of any obligations, subsequent violation or nonperformance of Lessee of any obligations, agreements or covenants shall be deemed a waiver of any subsequent violation or nonperformance of the same or any other covenant, agreement, or obligation, nor shall any forbearance by the City to exercise a remedy for any violation or nonperformance by Lessee be deemed a waiver by the City of rights or remedies with respect to that violation or nonperformance.

12. Termination. Either party may terminate this Agreement upon 30 days’ advance written notice.

Upon termination, Lessee shall return the Lease Area to its original condition subject to inspection and approval by the City’s Environmental Services Director or designee. At a minimum, Lessee shall remove all temporary structures installed by Lessee. Lessee shall be responsible for any and all damages.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Tabatha Miller, Assistant City Manager
PREPARER: Tabatha Miller, Assistant City Manager
DATE: February 18, 2026
TITLE: Approve a $2,500 Sponsorship for Bright and Green to Provide Reusable Dishware at Community Events, Including the Saturday Arcata Farmers’ Markets.

RECOMMENDATION:

It is recommended that the Council approve a $2,500 sponsorship for Bright & Green to provide reusable dishware at Arcata community events, including the Arcata Farmers’ Market.

INTRODUCTION:

Bright & Green is a local reuse and waste-reduction organization that has supported City departments and community partners through reusable dishware, event services, education, and waste-reduction reporting. These services directly support state-mandated waste prevention requirements and align with the City’s adopted Zero Waste and Climate Action priorities.

Reuse and waste-reduction infrastructure provided by Bright & Green is formally listed in Humboldt County’s 2025 Comprehensive Economic Development Strategy (CEDS) under the City of Arcata, identifying this work as an active economic development initiative tied to workforce development, regulatory compliance, and community resilience.

Approval of this funding would allow the City to move from informal reuse participation to a structured, budgeted, and reportable program that can be evaluated annually and adjusted as needed.

BACKGROUND:

California has shifted from a recycling-focused system to a reuse-first approach.  Senate Bill (SB) 54 (Plastic Pollution Prevention Act) requires reductions in single-use packaging and the development of reuse infrastructure.
 SB 1383 (Organics Diversion Law) requires waste prevention, education, and contamination reduction, with reuse recognized as an eligible compliance activity.

The City of Arcata has already demonstrated leadership through its Strategic Plan, Zero Waste Action Plan, and SB 1383 Implementation Plan. Bright & Green provides turnkey reuse services that directly support implementation of these adopted policies.

Page 38 of 74 ends

Program Benefits
A formal partnership would provide:
 Measurable progress toward SB 54 and SB 1383 compliance  Reduced reliance on single-use materials at City and community events  Consistent waste-reduction data and reporting
 Support for nonprofits and free community events
 Local workforce development and green job creation
DISCUSSION:

The proposed $2,500 sponsorship supports the City Council’s goal of providing leadership in environmental stewardship and climate change preparedness by advancing zero-waste initiatives.

The sponsorship also supports progress toward SB 54 and SB 1383 compliance.

Funding would support the provision of reusable dishware at community and nonprofit events in Arcata, including the Saturday Arcata Farmers’ Markets.

BUDGET/FISCAL IMPACT:

The Council has previously expressed support for Bright & Green and discussed allocating American Rescue Plan Act (ARPA) funds to the organization to further its zero-waste goals.

However, those funds were ultimately reallocated to support Police Department staffing in order to expend the funds prior to December 31, 2024. That expenditure was offset by $269,000 in General Fund dollars, which were set aside for City Council-directed projects.

Those projects include the current Economic Strategic Plan, wayfinding signage, and other related economic development initiatives. Staff recommend allocating $2,500 from the Community Projects FY 2025-26 Budget (Account 101-10-01-52104) for an initial sponsorship of Bright & Green to provide reusable dishware at Arcata community events.

If desired future sponsorships could be funded through Solid Waste Franchise Fees to support SB 54 and SB 1383 compliance-related partnership projects.

RECOMMENDED COUNCIL ACTION:

Motion to approve a $2,500 sponsorship for Bright and Green to provide reusable dishware at Arcata community events, including the Arcata Farmers’ Market. Consent Calendar vote.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Emily Sinkhorn, Director of Environmental Services PREPARER: Emily Benvie, Deputy Director of Environmental Services—Community Services DATE: February 18, 2026
TITLE: Approve an Amendment to the Agreement for Franchise Agreement Negotiation Assistance with CSG Consultants, Inc., in the amount of $20,000 with a Term Extended to October 31, 2026; and Authorize the City Manager to Execute All Applicable Documents.

RECOMMENDATION:

It is recommended that the Council approve an amendment to extend the agreement with CSG Consultants, Inc., for assistance with franchise agreement negotiations and increase the contract amount by $20,000; and authorize the City Manager to execute all applicable documents.

INTRODUCTION:

On March 1, 2023, the City entered into a Professional Services Agreement with CSG Consultants, Inc. (CSG) to provide technical and advisory support related to amending and restating the City’s solid waste hauling franchise agreement with Recology. This work is necessary to ensure compliance with the State-mandated Short-Lived Climate Pollutant Reduction Strategy (Senate Bill 1383) and associated CalRecycle requirements.

CSG has provided specialized expertise throughout the negotiation process, including technical expertise and knowledge of statewide industry standards, regulatory compliance analysis, service and rate structure evaluation, and coordination with the City’s Senate Bill (SB) 1383 Compliance Action Plan.

DISCUSSION:

On May 17, 2023, the City Council authorized the City Manager to enter into sole-source negotiations with Recology, recognizing that Recology’s provision of solid waste, recycling, and organics collection services is uniquely integrated with the City’s existing franchise agreement, which remains in effect through 2029.

Since that time, City staff and Recology have engaged in detailed and ongoing negotiations to develop an amended and restated franchise agreement that meets SB 1383 requirements while remaining operationally feasible, fiscally responsible, and consistent with the City’s solid waste community priorities. Given the complexity of aligning regulatory mandates, service standards, cost

Page 40 of 74 ends

structures, and implementation timing, negotiations have required continued technical analysis and refinement.

Throughout this process, CSG has provided critical support to staff, including preparation of draft agreement language, evaluation of service impacts and cost proposals, and coordination to ensure consistency with the City’s CalRecycle-approved SB 1383 Compliance Action Plan. As negotiations have progressed, the City has amended the agreement with CSG to ensure staff continued to have access to the specialized expertise necessary to protect the City’s interests and advance compliance efforts. The current agreement price, as previously amended over the past three years, has a maximum compensation amount of $73,840.

Staff and Recology have made substantial progress toward finalizing the amended and restated franchise agreement and anticipate presenting the franchise agreement for the City Council’s consideration in Spring 2026. To support the final stages of negotiation, including completion and evaluation of the technical cost proposal and preparation of final agreement materials, City staff is seeking Council approval for an amendment to extend the term through October 31, 2026, increasing the contract amount by up to $20,000 for professional services support from CSG. This amendment would increase the total contract price to an amount not to exceed $93,840.

City staff have budgeted for continued SB 1383 compliance support within the Solid Waste activity budget and believe this investment reflects prudent fiscal stewardship given the regulatory complexity, long-term operational implications of the franchise agreement, and the importance of ensuring rates remain fair, competitive, and sustainable for the community. While negotiations extended longer than initially anticipated due to the complexity of the issues involved, staff believe the resulting agreement will be stronger, aligned with Council priorities, and result in long-term operational and financial outcomes that better serve the community.

BUDGET/FISCAL IMPACT:

The full cost of the initial contract, subsequent amendments, and the proposed amendment are funded through the Solid Waste Fund, general ledger accounts 664-60-73-51770 (Professional Services) and 664-60-73-54455, which reflects funding from the CalRecycle SB 1383 Local Assistance Grant Program. It is anticipated that the proposed $20,000 amendment will be eligible for CalRecycle grant reimbursement. Should reimbursement not be available, sufficient funds are available within the Professional Services account to cover the cost.

RECOMMENDED COUNCIL ACTION:

Motion to approve an amendment to the agreement for franchise agreement negotiation assistance with CSG Consultants, Inc., in the amount of $20,000 with a term extended to October 31, 2026; and authorize the city manager to execute all applicable documents. Consent calendar vote.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Director of Community Development David Loya
PREPARER: Sara Cunha, Community Development Specialist
DATE: February 18, 2026
TITLE: Provide Direction on Potential Projects the City May Submit for Funding Under the State Community Development Block Grant (CDBG) 2025 Notice of Funds Availability (NOFA).

RECOMMENDATION:

It is recommended that the Council:
1) Open the Public Hearing and receive public comment on potential projects for funding under the CDBG 2025 NOFA;
2) Provide direction to staff regarding the activities for which the City should draft an application; and
3) Direct Staff to notice a hearing to authorize submission of the City’s 2025 CDBG Application.

INTRODUCTION:

The State Department of Housing and Community Development (HCD) released the amended 2025 CDBG NOFA on December 15, 2025. The 2025 CDBG NOFA has an application deadline of April 3, 2026. This hearing is required to receive public input regarding projects the City should consider applying for. Staff recommend the Council receive public comment, consider the project list (Attachment A), and provide staff direction on which activities to apply for.

BACKGROUND:

The City Council held a hearing on February 4, 2026, to discuss potential programs or projects for the 2025 CDBG NOFA. Staff held a noticed scoping meeting on February 17, 2026. And the Council’s February 18, 2026, meeting is the third opportunity for public input. Staff will provide updates from the February 17 meeting to the Council.

Approximately $27 million in federal funds will be allocated to eligible jurisdictions through the federal Small Cities Community Development Block Grant (CDBG) for the 2025 funding year, with funds provided as grants to Non-Entitlement Jurisdictions. Of this $27 million, $9,250,000 has been set aside for housing and economic development projects and programs, while $ 7,300,000 is set aside for planning and public services. An additional $2,000,000 is set aside for local administration.

Page 63 of 74 ends

The City currently has two active CDBG grants, one for Economic Development and Planning activities, utilizing this funding for its Business Assistance and Microenterprise loan programs, and one for Planning and Technical Assistance for the planning and feasibility of a Valley West Neighborhood Center.

The City is eligible to apply for the 2025 NOFA.

DISCUSSION:

City Council will decide which CDBG activities the City will include in the 2025 CDBG application. At the Public Hearing on February 4, 2026, Council reviewed a number of potential eligible activities the City may submit for funding under the CDBG 2025 NOFA, which encompasses the following eligible activities; Public Service and Planning and Technical Assistance, Housing and Economic Programs, Public Improvement, Community Facilities, and Housing Projects.

The 2025 CDBG NOFA limits are as follows:
 All applications will be eligible under a Competitive Application process, with certain submissions competing under defined set-asides. There are no Over-the Counter (OTC) Applications.
 Each Jurisdiction may submit up to three (3) applications during this NOFA cycle for a total of $3,600,000. Applications may be submitted in the following combinations:
i) One (1) Project + One (1) Program + One (1) Public Service or Planning - OR
ii) One (1) Project + Two (2) Public Service or Planning -OR iii) One (1) Program + Two (2) Public Service or Planning 2 Projects, 2 Programs, 3 Public Service, or 3 Planning applications are NOT allowed  Public Service and Planning activities up to $300,000  Projects up to $3.3 million
 $1.5 million for Housing Programs, and $1.5 million for Economic Development Programs.

Applications are rated and ranked competitively. An applicant’s score will be the total of the points received from all scoring criteria including High Poverty Service Area, Community Need Data, Capacity & Knowledge, CDBG as Gap Funding, Application Corrections (Attachment B). Any activities involving displacement, will require relocation per Federal relocation plan requirements.

Staff will provide a summary of the competitiveness of each potential application at the hearing.

POLICY IMPLICATIONS:

The CDBG program has been used in a variety of projects and programs implementing the City Council’s goals and priority projects over the years. This funding is critical to funding affordable housing, public facilities, the City’s business loan programs, housing rehabilitation programs, and a variety of other public benefit projects. The City must maintain a Certified Housing Element of the General Plan to be eligible for CDBG funds.

Page 64 of 74 ends

ENVIRONMENTAL REVIEW (CEQA):

Environmental review levels are reviewed for each activity. Some projects or programs may be exempt, as noted for each proposed activity (see Attachment A).

BUDGET/FISCAL IMPACT:

The matching funds requirements vary by program and are not required of all activities. Staff will provide a thorough analysis of match and fiscal impact when the projects are determined for the grant.

RECOMMENDED COUNCIL ACTION:

For the Recommended Council Action:

1. Open the public hearing, receive a staff report and public comment on potential projects for funding under the CDBG 2025 NOFA;

High Poverty Service Area – Points are awarded to sub applications for which the service area for the proposed activity occurs in cities, counties or census tracts experiencing a poverty rate of 30 percent or more.

Data is compiled from the most recent ACS 5-Year Estimate and available on: Poverty Status by Census Area.

For activities that occur in multiple census tracts, 50 percent or more of the total number of census tracts for the activity must be above the threshold. i.e.: if an activity occurs in four census tracts, two out of the four census tracts must have a poverty rate of 30 percent or higher.

Where it appears that the service area does not make sense, the CDBG Program Manager may, at their sole and absolute discretion, review and revise the service area.

Applicants will need to define the service area for the activity within the application.

For applications for which the National Objective is Low-Mod Area (LMA), the LMA area used to meet the LMA National Objective must be within the service area.

Additionally, as a reminder Code Enforcement programs may only be used for targeted efforts in deteriorating or deteriorated areas where the enforcement, combined with other actions, is designed to arrest the decline of the area. Therefore, for Code Enforcement programs, the service area will typically not be the entire jurisdiction. 25 Community Need Data – Based on the low- and moderate-income summary data (LMISD) from HUD Exchange 50
Capacity & Knowledge – If applicant has in-house expertise or has already procured or chosen a consultant or subrecipient respectively to operate and/or manage its proposed activity, award up to 10 points. • Fully executed contracts and agreements (up to 10 points) o At least 4 months left on the contract/agreement at the time of application closing date (10 points)
