STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: David Loya, Community Development Director
PREPARER: Mari Pepper, Program Assistant
DATE: April 15, 2026
TITLE: Introduce Ordinance No. 1586, An Ordinance of the City Council of the City of Arcata Amending the Arcata Municipal Code Relating to Cannabis Consumption Lounge Permits, Standards, and Restrictions.

RECOMMENDATION:

It is recommended that the Council introduce Ordinance No. 1586, An ordinance of the City Council of the City of Arcata Amending the Arcata Municipal Code Relating to Cannabis Consumption Lounge Permits, Standards, and Restrictions; waive reading of the text, and consent to read by title only.

INTRODUCTION:

The proposed ordinance amends provisions of Title V of the Arcata Municipal Code to clarify and codify the City’s authority to permit cannabis consumption lounges in accordance with State law.

The ordinance updates definitions and exceptions related to the city’s existing smoking restrictions to authorize onsite cannabis consumption and ensure consistency with the Arcata Land Use Code and alignment with Division 10 of the California Business and Professions Code.

The amendments also clarify the City’s authority to permit temporary cannabis consumption activities (i.e. special events) when authorized in compliance with State licensing requirements and local approval processes.

DISCUSSION:

The city previously adopted ordinances allowing the commercial cultivation, manufacturing, distribution, and retail sale of recreational cannabis within certain zoning districts. These regulations established the City's initial regulatory framework for commercial cannabis activities. A prior ordinance updated the city’s Land Use Code, creating a pathway for cannabis consumption; however, updates to the Municipal Code were deferred in order to evaluate the level of local interest and potential demand for such uses. The City is now beginning to receive interest from local businesses, including one existing operator and one prospective applicant seeking authorization for onsite consumption. Additionally, the proposed amendments would allow for temporary onsite cannabis consumption at events such as Cannifest, consistent with State law.

Page 192 of 286 ends

Division 10 (Cannabis) of the California Business and Professions Code, Chapter 20 (Local Control), expressly authorizes local jurisdictions to permit the smoking, vaporizing, or ingesting of cannabis or cannabis products on the premises of a licensed retailer or microbusiness, provided the licensee has received authorization from the local jurisdiction. Several nearby jurisdictions allow cannabis consumption lounges, reflecting a growing trend among local governments to regulate onsite cannabis consumption through licensed and designated facilities.

The ordinance advances several City objectives, including:
 Enhancing public safety and livability by providing regulated, enclosed locations for cannabis consumption.
 Reducing conflicts and impacts associated with unregulated or public cannabis smoking.  Supporting responsible economic development and small local cannabis businesses.  Improving consistency and enforceability of City regulations.

The proposed ordinance relies on this statutory framework to clarify Arcata’s local regulations and ensure that onsite cannabis consumption permitted in a controlled and locally authorized manner.

However, this ordinance does not create new controls beyond existing use permits and does not update the Land Use Code. The draft guidelines (attachments C & D) are intended to provide further clarity to applicants. The guidelines may be amended periodically by the city council.

Ordinance No. 1586 establishes and clarifies standards by:
 Defining “Cannabis Consumption Lounge” consistently across Title V, Chapters 7 and 10 of the Municipal Code.
 Limiting cannabis consumption lounges to enclosed areas located in or attached to licensed retail or microbusiness cannabis establishments.
 Requiring that onsite cannabis consumption be expressly authorized by the city.  Aligning local exceptions to smoking restrictions with State law allowances and the Arcata Land Use Code.

These standards are intended to provide clear guidance to applicants, enforcement staff, and the public regarding where and under what conditions onsite cannabis consumption may occur and are further intended to support local cannabis businesses in exploring ways to diversify and expand their operations.

The ordinance does not expand City services or require new staffing or infrastructure. It clarifies existing regulatory authority and definitions, which may improve administrative efficiency and enforcement consistency. Any cannabis consumption lounges temporary consumption license permitted under the ordinance would remain subject to applicable State licensing requirements and the City’s local authorization process.

Ordinance No. 1586 clarifies and aligns the Arcata Municipal Code with the Arcata Land Use Code and State cannabis laws by defining and permitting cannabis consumption lounges only where expressly authorized by the city.

Page 193 of 286 ends

POLICY IMPLICATIONS:

This ordinance ensures consistency with the Arcata Land Use Code, which already provides a pathway for Cannabis Consumption Lounges.

COMMITTEE/COMMISSION REVIEW:

The policy of allowing consumption was previously reviewed by the Planning Commission when the City adopted its first cannabis regulations. This amendment removes a conflict between the Land Use Code and sections of the Arcata Municipal Code. No additional review is necessary.

ENVIRONMENTAL REVIEW (CEQA):

The proposed amendments clarify existing policy consistent with State law. The regulatory changes do not have the potential to cause a direct or indirect physical change to the environment. As such, the amendments are not a “project” as defined by California Environmental Quality Act (CEQA).

Additionally, a Negative Declaration (State Clearinghouse Number 2016012039) was prepared and circulated prior to the adoption of Ordinance No. 1472, which first adopted Chapter 10 (Cannabis Use and Regulations) of the Arcata Municipal Code. The amendments set forth in Ordinance No. 1586 are consistent with that previously adopted Negative Declaration.

BUDGET/FISCAL IMPACT:

The permitting program is funded through permit fees.

RECOMMENDED COUNCIL ACTION:

1. Receive a staff report and review questions with staff.

2. Open the public hearing and receive public comment.

3. Close the hearing.

4. Motion to introduce Ordinance No. 1586 An Ordinance of the City Council of the City of Arcata Amending the Arcata Municipal Code Relating to Cannabis Consumption Lounge Permits, Standards, and Restrictions; waive reading the text, and consent to read by title only.

STAFF REPORT – CITY COUNCIL MEETING
April 15, 2026
TO: Honorable Mayor and City Council Members
FROM: Netra Khatri, City Engineer
PREPARER: Mara Grow, Administrative Specialist
DATE: April 15, 2026
TITLE: Public Hearing to Approve Annual Engineer's Report and Declare City's Intention to Continue to Levy and Collect Assessments of Three Existing Landscape Maintenance Assessment Districts.

RECOMMENDATION:

It is recommended that the Council:
1) Approve the Annual Engineer's Reports; and
2) Adopt three resolutions declaring the City’s intention to continue to levy and collect assessments including: the Mad River Parkway Business Center Landscape Maintenance Assessment District Resolution No. 256-44; the Janes Creek Meadow Landscape Maintenance Assessment District; Resolution No. 256-43; and the Windsong Landscape Maintenance Assessment District Resolution No. 256-42.

INTRODUCTION:

The City has three assessment districts that are billed annually as part of their property tax assessments. Under the Landscape and Lighting Act of 1972, annual Engineer’s Reports and Resolutions of Intent to continue to levy assessments are required. The Resolutions of Intent are incorporated into the City’s annual budget process. This action directs the City Engineer to complete the required reports and notices in preparation of the budget adoption.

BACKGROUND:

The City is allowed under the Landscaping and Lighting Act of 1972 to create assessment districts to install, maintain and service public landscaping and lighting. All three of the districts were legally created based on an Engineer’s Report which clearly describes the improvements, work, and costs.

Several specific parts (A-F) are required to be prepared under the Engineer’s Report, including:

Part A—plans and specifications for the improvements are filed with the City Clerk. Although separately bound, the plans and specifications are a part of this report and are included in it by reference.

Part B—an estimate of the cost of maintaining the improvement.

Part C—an assessment of the estimated cost of maintaining the improvement on each benefited parcel of land within the assessment district.

Page 213 of 286 ends

Part D—a statement of the method by which the undersigned has determined the amount proposed to be assessed against each parcel.

Part E—a list of the names and addresses of the owners of real property within the assessment district, as shown on the last equalized assessment roll for taxes, or as known to the Clerk.

The list is keyed to Part C by assessment number.

Part F—a diagram showing all of the parcels or real property within this assessment district. The diagram is keyed to Part C by assessment number.

On April 1, 2026, The Council reviewed the three assessment districts’ annual levies and directed staff to publish the required public notices and hold public hearing during the annual budget approval process. The public hearing date was directed by the Council to occur on April 15, 2026.

The notice for public hearing was published in the Mad River Union on March 25, 2026, and April 1, 2026.

DISCUSSION:

Annually, an Engineer’s Report is required to be prepared to report to the City Council so they may adopt a resolution proposing any new improvements or substantial changes in existing improvements. There are no changes recommended within the Windsong and Janes Creek Meadow Assessment Districts. The Mad River Parkway will see a Consumer Price Index (CPI) increase of

2.7% per the approved conditions of the district. City forces will continue to perform the work/improvements and maintenance as per the original Engineer’s Report and request the continued assessment of the benefited parcels.

Please refer to the three attached reports for the districts, including the funds required and expended.

A public notification was published in the local paper on April 1, 2026, and April 8, 2026, and following a public hearing the Council will be asked to approve the Engineer’s Reports and to adopt a resolution for each individual district, declaring the continued collection of assessments. The proposed resolutions are included in the three Engineer’s Reports, attached as Resolution Nos. 256- 42, -43 and -44.

BUDGET/FISCAL IMPACT:

Failure to approve the continued assessments would result in a reduction of funds to maintain the grounds and lighting within the three assessment districts. The total funding recommended in the Engineer’s Reports for the three districts is $39,403.61 RECOMMENDED COUNCIL ACTION:

1. Open the Public Hearing.

2. Receive a staff report and review questions with staff.

3. Open public comment.

4. Close public comment/the public hearing.

5. Motion to approve the Engineer’s Report and Adopt Resolution Nos. 256-42, 256-43, and 256-44 continuing to levy and collect assessments of existing assessment districts.

2026/2027

A: OVERVIEW
The City of Arcata (“City”) annually levies and collects special assessments on parcels within the Landscape Assessment District Titled Windsong Landscape Maintenance Assessment District (WLAD) in order to continue the maintenance of landscape improvements within the “District”.

The District was formed in October 1995 and is levied annually, pursuant to the Landscape and Lighting Act of 1972, Part 2 of Division 15 of the California Streets and Highways Code (the “1972 Act”) and the provisions of the California Constitution Article XIIID, added by Proposition 218. This Engineer’s Annual Report (“Report”) describes the District, any changes to the District, modifications to the improvements or zones, and the proposed assessments for fiscal year 2026/2027.

The budgets and annual assessments are based on the City’s estimated cost to maintain the improvements that provide special benefits to properties within the District. The word “parcel”, for the purposes of this Report, refers to an individual property assigned its own Assessment Parcel Number by the Humboldt County Assessor’s Office. The Humboldt County Auditor/Controller uses Assessment Parcel Numbers and specific Fund Numbers to identify properties assessed for special district benefit assessments on the tax roll.

Each fiscal year, an Engineer’s Report is prepared and presented to the City Council describing the District any changes to the District or improvements and the proposed budget and assessments for that fiscal year and the City Council shall hold a noticed public hearing regarding these matters prior to approving and ordering the proposed levy of assessments.

Following final approval of the Report the Council orders the levy and collection of assessments for the fiscal year pursuant to the 1972 Act. In such case, the assessment information will be submitted to the County Auditor/Controller, and included on the property tax roll for each parcel in fiscal year 2026/2027.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Tabatha Miller, Assistant City Manager/Finance Director PREPARER: Tabatha Miller, Assistant City Manager/Finance Director DATE: April 15, 2026
TITLE: Public Hearing to Consider Adopting Resolution No. 256-53, Updating the Master Fee Schedule for Fiscal Year 2026-2027.

RECOMMENDATION:

It is recommended that the Council:
1) Open the Public Hearing;
2) Receive a staff report and review questions with staff; 3) Open public comment;
4) Close public comment and the public hearing; and
5) Adopt Resolution No. 256-53, Updating the Master Fee Schedule for Fiscal Year (FY) 2026- 2027.

INTRODUCTION:

The City reviews and updates the City’s fees, consistent with the goal of ensuring, with only a few exceptions, that fees for City services are sufficient to recover the cost of providing those services.

California Government Code requires that changes to the City’s fees be presented to the City Council at a public hearing in accordance with Sections 66016 and 6062a.

BACKGROUND:

Typically, as part of the budget preparation process, city staff review current fees to determine whether such fees and charges are sufficient to recoup costs associated with providing services to the public. Attachment B (Exhibit A to the Resolution) sets forth the proposed changes to the existing Master Fee Schedule, which was adopted on April 16, 2025, and became effective July 1, 2025.

The Master Fee Schedule (Schedule) consolidates all City fees and charges into one schedule.

Therefore, the Schedule includes already adopted rates for certain fees, including the City’s Water and Wastewater Utilities and Business License Tax Fees. When fees and charges are newly implemented or increased, a public hearing is required by CA Government Code Section 66018. The public hearing notice was published on April 1, 2026, and April 8, 2026, in the Mad River Union and was posted at City Hall in accordance with CA Government Code Sections 66016 and 6062.

DISCUSSION:

Staff time and other costs incurred in conducting City business (such as processing of development and other applications, inspections, providing classes, renting facilities, and most other services) are

Page 251 of 286 ends

generally measurable and are provided for the benefit of individuals as opposed to the benefit of the community as a whole. Hence, fees for these activities are not taxes, but rather, they are fees for services. Cities have the general authority to impose fees (as charges and rates) under the cities’ police powers granted by the state Constitution (Article XI, Sections 7 and 9).

Miscellaneous fees and charges are limited to the amount necessary to cover the cost of providing the service. If fees in excess of cost are collected, they must be used to reduce the service charge cost. Excess fees cannot become a source of revenue for the General Fund. To avoid annual ups and downs in fees and to ensure that the City recoups the reasonable costs, the City applies a cost-ofliving index most years and only calculates the estimated actual costs periodically.

The proposed fee schedule has incorporated the annual change in CPI-U West to adjust most fees and charges for City Services, excluding utilities, transportation charges and other fees tied to taxes, or county, state or federal standards. The annual change in CPI-U for All West Urban Consumers from calendar year 2024 to 2025 was a 2.7% increase.

The City Council set the Public Hearing on the possible adoption of the Water and Wastewater Rate Adjustments for Fiscal Year (FY) 2025-2026 through FY 2029-2030 for April 15, 2026. Water and Wastewater Rate adjustments are subject to the Proposition 218 process, which includes its own separate public hearing and notice requirements. Absent a majority protest on the proposed rates, as tallied by the City Clerk just prior to closing that public hearing, the City Council may adopt those adjustments. If adopted, those rate adjustments for the FY 2026-27 will be reflected in the Fee Schedule for reference purposes.

Fees and charges for a “development project,” as defined by CA Government Code section 66000, may take effect no less than 60 days after approval. A “development project” is any project undertaken for the purpose of development and includes the issuance of a permit for construction, or reconstruction. For consistency in implementing the fee changes and to ensure that the City complies with all waiting periods, staff recommend that all the proposed fee changes become effective on July 1, 2026, which coincides with the start of the new FY 2026-27.

POLICY IMPLICATIONS:

The adoption of this Resolution is exempt from the California Environmental Quality Act (“CEQA,” Public Resources Code Sections 21000 et seq.), because it approves and sets forth a procedure for determining fees for the purpose of meeting the operating expenses of City departments, as set forth in Public Resources Code Section 21080(b)(8)(A) and Section 15273 of the California Environmental Quality Act Guidelines.

ENVIRONMENTAL REVIEW (CEQA):

The adoption of this Resolution is exempt from the California Environmental Quality Act (“CEQA,” Public Resources Code Sections 21000 et seq.), because it approves and sets forth a procedure for determining fees for the purpose of meeting the operating expenses of City departments, as set forth in Public Resources Code Section 21080(b)(8)(A) and Section 15273 of the California Environmental Quality Act Guidelines.

BUDGET/FISCAL IMPACT:

Enterprise Funds
Including the enterprise funds, user fees and charges account for $18.27 million of the City’s total budgeted annual revenue of $74.61 million in FY 2025-26. Water and Wastewater charges account for $15.61 million or 85% of the total user fees and charges. There are no increases included in this Fee Schedule for Water, Wastewater or Stormwater charges. However, as mentioned above, the City

Page 252 of 286 ends

Council is scheduled to take possible action on proposed water and wastewater rate adjustments during the separate Public Hearing also scheduled for April 15, 2026.

General Fund
If you exclude the enterprise funds, $1.31 million or 7.2% of the user fees and charges revenue is expected to be generated in the General Fund for FY 2025-26. Approximately $596k from development permits and fees, $130k from Police Department charges, $358k from recreation classes and programs, and $224k from rental of city facilities. This is just 6.1% of the FY 2025-26 General Fund Budgeted Revenues of $21.41 million. The estimated decrease in user fees and charges for the General Fund in FY 2025-26, assuming FY 2024-25 actual revenue levels, is approximately $121k.

RECOMMENDED COUNCIL ACTION:
1) Open the Public Hearing.
2) Receive a staff report and review questions with staff. 3) Open public comment.
4) Close public comment and the public hearing.
5) Motion to Adopt Resolution No. 256-53, Updating the Master Fee Schedule for Fiscal Year 2026-27.
