May 20, 2026 - City Council Agenda
In Honor of
KINETIC Sculpture Racing May 23, 2026
WHEREAS, the art and sport of Kinetic Sculpture Racing, difficult to truly comprehend but easy to enjoy, is a Humboldt tradition originating in Ferndale and spreading gloriously to other parts of Planet Earth; and WHEREAS, the Kinetic tradition has been a part of Humboldt County life since 1969, with at least one Kinetic race starting on the Arcata Plaza for the last 50 years, not counting those two years when we were thwarted by a global pandemic; and
WHEREAS, the Glorious Founder of all Kinetic Sculpture Racing, Hobart Brown, a Ferndale artist, envisioned a three-day “Triathlon of the Art World” from Arcata through Eureka to Ferndale, over land, sand, mud and water; and coined many a phrase, such as “Adults having fun so children will want to grow older,” and “If you’re not living on the edge, you are taking up too much space!”; and WHEREAS, the Kinetic Grand Championship is a tribute to the rich history of kinetic racing in Humboldt County. Kinetic Universe, the Kinetic Grand Championship’s non-profit organizing body, works to promote the tradition and values of kinetic sculpture racing in Humboldt County and spread the good word that “kinetics is for everyone;” and
WHEREAS, several other cities across the world have kinetic sculpture races inspired by Humboldt County’s “mother” race (un)usually held every Memorial Day weekend, recognizing that this art event involves the whole family and community while also promoting tourism, sustainability, bicycling and silliness. The race enhances our community’s image both nationally and internationally; and WHEREAS, Kinetic Sculpture Racing encourages the recycling of junk and tidying up of our environment while exploring sustainable transportation as a creative solution to greenhouse gas-emitting vehicles, thus fighting global climate change; and
WHEREAS, Kinetic Universe presents the Kinetic Grand Championship that will challenge creativity, provide opportunities for artists and artistic discovery, and lift community spirit and pride, resulting in the most glorious weekend of the year.
NOW, THEREFORE, BE IT PROCLAIMED that the City Council of the City of Arcata hereby congratulates Kinetic Universe on its glorious and dedicated stewardship of the uniquely Humboldtian tradition of KINETIC SCULPTURE RACING. The Council encourages everyone to attend the kick-off of the 2026 Kinetic Grand Championship on Saturday, May 23, 2026, on the Arcata Plaza at the sound of the noon whistle. FOR THE GLORY!

STAFF REPORT – CITY COUNCIL MEETING
May 20, 2026
TO: Honorable Mayor and City Council Members
FROM: Netra Khatri, City Engineer
PREPARER: Mara Grow, Administrative Specialist
DATE: May 11, 2026
TITLE: Make a Finding that it is Necessary to Continue Emergency Procurement to Repair Failed Culverts at 4700 West End Road; and Authorize the City Manager to Execute All Applicable Documents.
RECOMMENDATION:
It is recommended that the Council:
1) Make a finding that it is necessary to continue emergency procurement to repair failed culverts at 4700 West End Road; and
2) Authorize the City Manager to execute all applicable documents.
BACKGROUND:
City staff recently identified the failure of existing 30-inch and 18-inch culverts located at 4700 West End Road, which is City-owned property that serves as the City’s ancillary corporation yard.
The failure has resulted in the formation of two sinkholes, posing a potential risk to public safety, nearby infrastructure, and aquatic resources within North Fork Janes Creek.
Due to the nature of the failure, immediate action is necessary to prevent further deterioration and to ensure safe conditions at the site.
DISCUSSION:
City staff conducted a site evaluation and confirmed that both culverts have structurally failed and are no longer functioning as intended. The resulting sinkhole indicates subsurface instability that may worsen if not addressed promptly.
These culverts convey a segment of North Fork Janes Creek under the City property and were likely installed many decades ago as part of prior lumber and plywood mill development.
City staff met with the applicable permitting agencies on April 22, 2026, to discuss the proposed emergency repairs. The agencies expressed support for expediting the work under emergency permits given the urgency and potential risks associated with delay.
Due to the emergency nature of the project, a streamlined procurement process is being utilized in accordance with City policies. This staff report serves as the recorded explanation required pursuant to the City’s emergency procurement policy. Staff requests the Council receive this report and make a determination that the proposed emergency repairs are necessary.
Update as of May 11, 2026:
Last week, crews completed the downstream creek channel excavation (Phase 1) and advanced excavation of the new channel (Phase 2) up to the culvert location. No work is planned this week, with culvert installation anticipated to begin next Monday. Following culvert installation, work is expected to pause until Granite Construction installs the bridge footings in mid-June. Remaining excavation for Phases 2 and 3 is anticipated to occur early to mid-July, approximately two to three weeks after the footings are poured. Coordination efforts will continue, including working with City consultants to ensure any required fish relocation is completed before final plugging and grouting of the old storm drains (Phase 4).
To date, nesting birds have not been impacted by construction activities. Once birds have fledged, vegetation within the work area will be trimmed or removed to prevent future nesting conflicts.
Additionally, the project team is considering removal of a large concrete slab adjacent to the downstream channel and creating a streamside alcove in its place to provide supplemental offchannel habitat.
ENVIRONMENTAL REVIEW (CEQA):
The proposed action qualifies for an exemption under the California Environmental Quality Act (CEQA) under 14 CCR § 15269(c) Emergency Repair: Specific actions to prevent or mitigate an emergency, including those necessary to prevent imminent loss of life or property.
BUDGET/FISCAL IMPACT:
There are currently no funds allocated in the adopted Fiscal Year 2025-26 budget for this repair.
Staff are requesting authorization to utilize reserve funds to cover the cost of the emergency repair.
The final cost will be determined upon receipt of bids; however, staff will make efforts to ensure cost-effective delivery of the project.
Use of reserve funds is justified due to the unforeseen nature of the infrastructure failure and the need for immediate corrective action.
RECOMMENDED COUNCIL ACTION:
Motion to:
1. Make a finding that it is necessary to continue emergency procurement to repair failed culverts at 4700 West End Road; and
2. Authorize the City Manager to execute all applicable documents.
Consent Calendar vote.

It is recommended that the Council approve a letter of support for Assembly Bill 1821, California Public records Act: Agency Response Time; and authorize the Mayor to sign the letter.
INTRODUCTION:
The California Public Records Act (CPRA) is a vital tool that promotes the public’s access to maximum disclosure of the conduct of governmental operations. Assembly Bill (AB) 1821 provides an important and practical clarification to CPRA response deadlines. The bill’s shift from “calendar days” to “business days” for initial determinations and extensions is a common-sense update that reflects the operational realities of local agencies.
As a smaller agency that has seen a sharp increase in requests for public records, the City of Arcata would benefit from this proposed clarification.
BACKGROUND/DISCUSSION:
In 2025, the City of Arcata (the City) processed approximately 167 requests for public records (a 100% increase from 67 requests in 2023) and is on track to process at least 200 requests by the end of 2026. The City does not have a designated full-time employee allocated specifically for processing Public Records Act requests. Public records responsibilities are carried out by the City Clerk in coordination with staff members from citywide departments.
Government agencies across the state of California are seeing a trending rise in the volume of requests received paired with increased complexity of said requests. On April 7, 2026, the California State Association of Counties (CSAC), League of California Cities (Cal Cities), California Municipal Clerks Association (CMCA), Rural County Representatives of California (RCRC), and Urban Counties of California (UCC) co-signed a letter of support for AB 1821 by Assemblymember Blanca Pacheco. The letter (linked here: ab_1821_coalition_support_4..pdf) recognized that agencies are committed to transparency and providing timely access to public records, while at the same time, the volume, complexity, and format of public records have changed significantly.
Locally, CPRA requests received by the City now routinely involve large volumes of emails, and other electronic files that are required to be reviewed closely for responsiveness and applicable legally exempted information before applying needed redactions and producing records. Complying
with the existing CPRA 10-calendar-day deadline to make an initial determination is a challenge for staff because the timeframe includes weekends and holidays, limiting actual working days that can be utilized to make the required determination.
This bill supports the important balance of promptly providing public access to requested records while exercising careful legal compliance. The letter to be signed for Council’s consideration is enclosed as Attachment A.
POLICY IMPLICATIONS:
This item is being brought to the Council for approval as it does not fall under a category for our legislative platform.

Re: Assembly Bill 1821 — California Public Records Act: Agency Response Time — SUPPORT (As Amended April 6, 2026)
Dear Assemblymember Pacheco:
On behalf of the City of Arcata, I write in support of Assembly Bill 1821, which would make a narrow but important clarification to the California Public Records Act by calculating certain agency response periods in business days rather than calendar days.
Public agencies are committed to transparency and providing timely access to public records. At the same time, the volume, complexity, and format of public records have changed significantly.
Requests now routinely involve large volumes of email, text messages, electronic files, audio and video recordings, body-worn camera footage, and other digital records that must be searched, reviewed, and, when legally required, redacted before release. This work often requires coordination among multiple departments, information technology staff, legal counsel, and records personnel.
Current law requires an agency to make its initial determination within 10 calendar days, with a possible 14-calendar-day extension under unusual circumstances. Because those timeframes include weekends and holidays, agencies may not receive the full number of working days needed to conduct a careful and legally compliant review. AB 1821 would provide a more practical and consistent framework by changing those periods to 10 business days and 14 business days.
This adjustment is especially important for local agencies where staffing is limited and public records responsibilities are often carried out by employees who also support public meetings, elections, boards and commissions, agenda management, contract routing, records management, and other core services. A business-day standard would not reduce an agency’s obligation to respond to records requests or make disclosable records available. Rather, it would help ensure that agencies have a reasonable opportunity to identify responsive records, determine whether exemptions apply, protect confidential or legally protected information, and provide accurate responses.
For the City of Arcata (the City), public records requests have increased significantly while becoming
City of Arcata
Letter of Support for Assembly Bill 1821
more complex in recent years. In 2025, the City received approximately 167 requests (a 100% increase from 67 requests in 2023), and many requests required review of emails, text messages, permits, contracts, inspections, and draft materials for ongoing projects. The City is on track to process at least 200 requests by the end of 2026. Even when staff work diligently, weekends and holidays can materially reduce the actual time available to complete the required review.
The City does not have a designated full-time employee allocated specifically for processing Public Records Act requests. Public records responsibilities are carried out by the City Clerk in coordination with staff members from citywide departments. As a smaller agency that has seen a significant increase in requests for public records, the City of Arcata would benefit from this proposed clarification in timeline. AB 1821 would provide a more realistic timeline while preserving the public’s right to access disclosable public records.
California’s local agency clerks, records managers, and other public records professionals see firsthand how important it is to balance prompt public access with careful legal compliance. AB 1821 supports that balance. It recognizes that public records work is not simply a matter of locating a document; it frequently requires thoughtful review to protect privacy, privileged communications, confidential information, and other records exempt from disclosure under state or federal law.
For these reasons, City of Arcata supports AB 1821, and we thank you for your leadership on this most important issue.
Please do not hesitate to contact Merritt Perry, City Manager, at [email protected] should you have any questions or wish to discuss our position.
Sincerely,
Kimberley White

TITLE: Adopt Resolution No. 256-64 Proclaiming June as Lesbian, Gay, Bisexual, Transgender, Queer + Pride Month in the City of Arcata and Authorizing the Two-Spirit Pride Flag to be Flown on the Flagpole at Arcata City Hall During the Month of June.
RECOMMENDATION:
It is recommended that the Council adopt Resolution No. 256-64 proclaiming June as Lesbian, Gay, Bisexual, Transgender, Queer + Pride Month in the City of Arcata and authorizing the Two-Spirit Pride Flag to be flown on the Flagpole at Arcata City Hall during the month of June.
INTRODUCTION:
As part of the City’s continued advocacy for Lesbian, Gay, Bisexual, Transgender, Queer + (LGBTQ+) rights amidst the rise of anti-LGBTQ+ and anti-trans legislation, City Councilmembers have requested that the City increase the City’s visible presence to stand in solidarity with our TwoSpirit, Lesbian, Gay, Bisexual, Transgender, Queer, Intersex, Asexual + (2S/LGBTQIA+) community members through the flying of the Two-Spirit and Intersex Inclusive Progress Pride Flag during the month of June. This flag was chosen because it honors the diversity that exists within the 2S/LGBTQIA+ community.
BACKGROUND/DISCUSSION:
In 2019, the State of California made a pivotal decision to fly the pride flag from the Capitol for the first time as a symbol of support for the LGBTQ+ community. This was in direct response to the decision issued by the U.S. Administration to ban flying such flags at all U.S. Embassies. The origins of the Pride movement can be traced back to the Stonewall riots in 1969, which ignited the first pride marches and a rapid increase in LGBTQ+ advocacy groups across the United States.
President Joe Biden issued a proclamation recognizing LGBTQ+ Pride Month in 2021. For the past few years, the Arcata City Council has participated in ways to show support and recognize June as Pride month in Arcata. In 2025, the City Council adopted Resolution No. 245-45 authorizing the Two-Spirit and Intersex Inclusive Progress Pride Flag to be flown on the flagpole at City Hall during the month of June.
As part of the City’s continued advocacy for LGBTQ+ rights amidst the rise of anti- LGBTQ+ and anti-trans legislation and hateful actions that persist, City Councilmembers have requested that the City increase the City’s visible presence to stand in solidarity with our 2S/LGBTQIA+ community
members through again flying the Pride Flag during the month of June, this time flying the TwoSpirit and Intersex Inclusive Progress Pride Flag, which is an evolution of the original Pride flag that was created by Gilbert Baker in 1978. It incorporates black and brown lines to honor people of color, as well as elements of the trans pride flag, intersex pride flag, and Two-Spirit pride flag. This flag celebrates cultural diversity within the queer liberation movement.
Displaying commemorative flags at City facilities can raise First Amendment Free Speech issues.
This depends on whether the flag is treated as government speech or private speech on public property. Under the government speech doctrine, the City may advance its own Government speech without requiring viewpoint neutrality when the government itself is the speaker, so long as the City does not show religious preference or encourage a certain vote in an election.
This item requests that the Council proclaim June as Lesbian, Gay, Bisexual, Transgender, Queer + Pride Month and authorize the Two-Spirit Pride Flag to be flown on the City Hall flagpole.
POLICY IMPLICATIONS:
None.
BUDGET/FISCAL IMPACT:
The City operational budget can absorb the cost of the flag.
RECOMMENDED COUNCIL ACTION:
Adopt Resolution No. 256-64 proclaiming June as Lesbian, Gay, Bisexual, Transgender, Queer + Pride Month in the City of Arcata and authorizing the Two-Spirit Pride Flag to be flown on the flagpole at Arcata City Hall during the month of June. Consent Calendar vote.

TITLE: Receive an Update on the Current Status of the City’s Residential Rental Inspection Program and Next Steps.
RECOMMENDATION:
It is recommended that the Council:
1) Receive an update on the current status of the Residential Rental Inspection Program and Next steps; and
2) If deemed appropriate, provide direction to staff.
INTRODUCTION:
The purpose of the Residential Rental Inspection Program (RRIP) is to address the issue of substandard, long-term rental properties, promote greater compliance with existing health and safety standards, and preserve the quality of Arcata’s available housing. The program provides greater oversight for compliance of health, safety and welfare code violations in/on residential rental properties that can become a threat to the occupant's safety, damaging to the long-term structural integrity of the building, and a negative impact to the surrounding neighborhoods.
BACKGROUND:
For years there has been public concern about the City of Arcata’s aging rental housing stock as well as concerns about substandard dwelling units and unpermitted construction which could pose health and safety risks. The current Housing Element adopted by the City Council in 2019 encourages the maintenance of existing housing to prevent deterioration and promotes dwelling lifespan.
Implementation Measure 2 of the Housing Element calls for the City to identify neighborhoods with housing requiring rehabilitation through a rental inspection program and code enforcement.
As part of efforts to address enforcement and nuisance property issues within the City of Arcata in a proactive and organized manner, the RRIP is an important tool to meet the City goal of providing housing that meets minimum health and safety standards.
Ordinance No. 1552 was first brought before the City Council on September 15, 2021. Upon the second reading on October 20, 2021, the Council directed staff to form a Working Group to ensure the ordinance had greater community input and better meets the needs of the City. On February 15, 2023, the Ordinance was introduced for a first reading and adopted unanimously upon the second reading on March 1, 2023.
Registration for the RRIP opened on July 3, 2023, giving property owners six (6) months to register their properties before the January 3, 2024, deadline. Using tax data from the Humboldt County Assessor’s office, 1,614 letters were sent in September of 2023 to property owners of non-owner occupied residentially zoned parcels within the City limits informing them of the RRIP. 1,060 letters were sent in November of 2023 informing property owners of the coming January 3, 2024, deadline for registration. In February of 2024, 583 past due letters were sent to property owners informing them of potential late fees and fines.
On April 14, 2024, Council was given a status update on the RRIP. In October of 2024 the Council adopted Ordinance No. 1571 which corrected minor issues in the original ordinance language.
DISCUSSION:
July 3 will mark the end of the “Initial Phase” of the program and three (3) years since the RRIP went into effect.
To date 1,623 unique parcels have registered with the RRIP. Of those parcels, 282 are exempt from RRIP inspections because they receive an inspection from the Arcata Fire District or another governmental authority. The remaining 151 parcels are exempt for various other reasons, i.e. shortterm rentals, inside a mobile home park, etc. This leaves a total of 1,190 parcels that are subject to inspection.
As of May 8, 2026, 588 Inspections have been performed with 34 resulting in formal code enforcement. The most common reasons for failure include missing smoke and carbon monoxide alarms, improperly installed electrical work, missing water heater straps, and missing address numbers. Owners/Operators have generally complied with corrections. Over 269 RRIP certificates have been issued, representing a completion rate of 22.61%.
During the implementation this program for three (3) years staff has identified aspects of the program that work well and aspects that would improve with changes to the ordinance. The program has achieved a relatively high level of compliance thanks to affordability of the fees, the simple/focused checklist, and the online application portal. However, currently the program is not meeting its goal of being revenue neutral due to the low fees. Additionally, the program does not inspect a significant portion of the City’s rental stock due to the exemption for units under the purview of the Arcata Fire District.
Staff is preparing to introduce changes to the RRIP at a future Council meeting. Some of the proposed changes include:
Raising the annual registration and inspection fees, charging registration fees per unit instead of per parcel;
Allowing owner/operators to pay fees in bulk instead of annually; Allowing for a special assessment for delinquent fees; Requiring self-certification to be uploaded every year; Clearing up language around tenant refusal to entry; and Changing the self-certification inspections to a sample of units.
After the end of the “Initial Phase” staff will shift focus to enrolling eligible properties into the selfcertification program and commencing code enforcement on properties that remain out of compliance with the RRIP.
ENVIRONMENTAL REVIEW (CEQA):
The proposed program has been determined to be exempt from the California Environmental Quality Act (CEQA) in that the activity is covered under the general rule that CEQA applies only to projects which have the potential for causing significant effect on the environment. Additionally, establishing fees for the purposes of meeting operating expenses by a public agency is statutorily exempt per CEQA Section 15273. And inspection activities are categorically exempt from CEQA per Section 15309.
RECOMMENDED COUNCIL ACTION:
1. Receive an update on the status of the Residential Rental Inspection Program and Next steps;
2. Open public comment;
3. Close public comment; and
4. If deemed appropriate, provide direction to staff.
