STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Tabatha Miller, Assistant City Manager
PREPARER: Tabatha Miller, Assistant City Manager
DATE: October 21, 2026
TITLE: Adopt Resolution No. 267-24 Amending the Fiscal Year 2026-27 Budget to Provide Funding of $100,000 for Reconfiguring Certain Offices and Workspace in City Hall.

RECOMMENDATION:

It is recommended that the Council adopt Resolution No. 267-24, amending the fiscal year 2026-27 Budget by $100,000 to provide funding for reconfiguration of certain offices and workspaces in City Hall.

INTRODUCTION:

The City Manager and staff have been working through a reorganization of the Environmental Services, Engineering and Community Development Departments in order to more efficiently and effectively distribute workload and staff supervision.

As a part of the reorganization, certain staff have and will be relocated to different offices within City Hall and underutilized space has been converted into offices. Additionally, long-anticipated improvements to the public restrooms will be completed.

DISCUSSION:

The reconfiguration includes moving several walls, adding doors and dividers to separate spaces, replacing worn carpet, painting, re-wiring, and, where necessary, purchasing workstations and other office furniture.

In addition to moving and creating additional office space, the office that was recently occupied by the prior Community Development Director has been converted into a much-needed conference room to directly support Community Development, Engineering, and Finance, who do not have meeting space within their offices. This conference room also indirectly supports all other departments.

The improvements to the public restrooms in City Hall have been discussed and desired for a long time. The public restrooms serve visitors to City Hall, City staff, and the public at large during business hours and during public meetings outside of business hours. Circulation or lack of it in the public restrooms has long been a complaint from those who use the facilities.

ENVIRONMENTAL REVIEW (CEQA):

Budget amendments are not subject to the California Environmental Quality Act (CEQA) when they constitute government fiscal activities that do not commit the City to a specific project that may have a potentially significant physical impact on the environment, pursuant to CEQA Guidelines Section 15378(b)(4). Any individual project funded through the amendment remains subject to applicable CEQA review.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Tabatha Miller, Assistant City Manager
PREPARER: Tabatha Miller, Assistant City Manager
DATE: October 21, 2026
TITLE: Adopt Resolution No. 267-23 Revising the Fiscal Year 2026-27 Budget to Provide an Appropriation of $36,000 in Funding for Economic Development Consulting with Civic* Possible During the First Year of Implementing the 2026-2031 Economic Strategic Plan.

RECOMMENDATION:

It is recommended that the Council adopt Resolution No. 267-23 revising the FY 2026-27 Budget to provide funding for a contract with Civic* Possible to provide economic development consulting services to the City for the first year implementing the 2026-2031 Economic Strategic Plan (ESP).

INTRODUCTION:

On September 16, 2026, the City Council unanimously adopted the ESP which was developed in partnership with Civic* Possible, a consulting firm. To provide staff with support during the first year of implementation, the City Manager is requesting a budget appropriation of $36,000.

BACKGROUND:

The ESP is Arcata’s first economic development plan since 2014. One of the key reasons for the long delay between plans is the lack of staff resources to provide support for implementation of a plan. Throughout the development of the newly adopted plan, a major concern was whether the City could provide sufficient staffing to be successful in implementing the actions outlined in the ESP.

DISCUSSION:

To bridge the City’s staffing gaps, Civic* Possible proposes to support the City of Arcata during the initial implementation of its adopted ESP through coaching, implementation planning, and advisory services. The engagement focuses on strengthening City staff’s capacity to advance the plan through collaboration across departments and with community partners. Monthly services would include regular check-ins, planning and problem-solving, meeting facilitation, individual advisory calls, research and document review, and a monthly engagement report.

The proposed agreement would run for eight months at $3,000 per month, totaling $24,000 for ongoing support. Additional services, such as workshops, training, program design, and site visits, would require written approval before work begins and would be billed separately or addressed through project-specific sub-agreements.

Page 24 of 61 ends

ENVIRONMENTAL REVIEW (CEQA):

Approval of the budget for Civic* Possible’s implementation support services is not subject to CEQA under CEQA Guidelines Section 15378(b)(4), because it is a government fiscal activity funding coaching, coordination, and advisory services without committing the City to a specific project that could cause a potentially significant physical impact on the environment. Any future development or infrastructure projects advanced through the Economic Strategic Plan would undergo separate CEQA review as applicable
BUDGET/FISCAL IMPACT:

The funds appropriation for the contract with Civic* Possible is proposed to come from the Public Improvement Projects Fund (245).

PROPOSAL
October 8, 2026
Proposal for Implementation Support, Coaching, and Thought Partnership
Arcata Economic Strategic Plan
Prepared for: City of Arcata, Office of the City Manager Prepared by: Jason Schneider, Principal, Civic* Possible

1. Purpose
Following the City Council's adoption of the Economic Strategic Plan (ESP), Civic* Possible proposes to support the City of Arcata through the initial phase of implementation. The plan is grounded in an ecosystem approach, which places collaboration across City departments and with external partners at the center of implementation.

The engagement is intended to strengthen the City's own capacity to carry the plan forward. Civic* Possible will serve as a coach and thought partner to City staff and partners as they advance implementation and hone their skills in collaborative, creative, and community-centered work. A flat monthly fee supports that intent by allowing staff to seek guidance as needs arise, without weighing each conversation against an hourly cost.

2. Scope of Services

2.1 Monthly Support
The monthly fee covers ongoing coaching and thought partnership. Services include:
• Regular check-in meetings
• Implementation planning and problem-solving
• Agenda and team meeting facilitation
• One-on-one advisory calls
• Research and document review
• Monthly engagement report

2.2 Project-Specific Services
Services outside monthly support will be scoped and approved in writing before work begins. Small requests will be billed on a time-and-materials basis. More complex engagements, such as site visits and facilitation, will be established through separate sub-agreements. Examples include:
• Workshop and training facilitation
• Program review and design
• Site visits

3. Contract Structure and Term
The engagement will be governed by a Master Services Agreement (MSA), with sub-agreements executed for project-specific services. The proposed term is eight months from contract execution. Travel expenses will be reimbursed at the City's adopted rates.

4. Compensation
Component Amount
Ongoing support (monthly fee) $3,000 per month
Ongoing support, eight-month total $24,000
Project-specific services and travel As approved in writing Total not-to-exceed $50,000

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Tabatha Miller, Assistant City Manager
PREPARER: Tabatha Miller, Assistant City Manager
DATE: October 21, 2026
TITLE: Approve the Written Report Issued Pursuant to Government Code Section 65858(d) on Measures Taken to Alleviate the Condition that Led to the Adoption of Interim Ordinance No. 1594 Imposing a 45-Day Moratorium on Processing of Data Center Land Use Applications.

RECOMMENDATION:

It is recommended that the Council adopt the written report issued as required by Government Code Section 65858(d) describing the measures taken to alleviate the conditions that led to the adoption of Interim Urgency Ordinance No. 1594 which imposed a 45-day temporary moratorium on processing and approval of new land use applications for data centers.

INTRODUCTION:

On September 16, 2026, the City Council adopted Interim Urgency Ordinance No. 1594, establishing a 45-day moratorium on the processing and approval of application for data center land uses in the City of Arcata. Government Code Section 65858(d) requires the City to issue a written report at least ten (10) days before the expiration or any extension of an interim urgency ordinance describing the measures taken to alleviate the threat to the public health, safety, or welfare that led to its adoption.

BACKGROUND:

The City of Arcata’s temporary moratorium was enacted in response to growing concerns regarding:
 The threats posed by data center utility consumption related to infrastructure capacity and reliability;
 The potential effects of data center operations on land use, air emissions, noise, environmental quality and community aesthetics; and
 The potential health impacts associated with data center development and operations.

DISCUSSION (Government Code Section 65858(d) Report):

In accordance with Government Code Section 65858(d), this report describes the measures taken to alleviate the potential threat to public health, safety, or welfare associated with additional data center development within the City that led to adoption of the temporary moratorium.

Page 29 of 61 ends

Since the adoption of Interim Urgency Ordinance No. 1594, City staff have undertaken the following measures to address the conditions that led to its adoption:

1. Review of Existing Regulations: Staff has conducted a review of Title 9 of the Arcata Municipal Code, as well as other codes that would regulate potential data centers within the City.

2. Research of Best Practices: Staff have reviewed regulatory frameworks used by other California cities to effectively mitigate the impact of data centers on infrastructure, utilities, and public health and safety. Additionally, have reviewed guidance and resources available from the National League of Cities, Urban Land Institute (ULI) and the American Planning Association.

3. Infrastructure/Capacity Considerations: Staff have evaluated the potential effects of data centers on existing infrastructure systems within the City, including water, electrical, and stormwater systems. Studies from the UC Berkley Center for Law, Energy, and the Environment and the Lawrence Berkeley National Laboratory have provided guidance and insight on those effects.

4. Environmental Risks: Staff have determined that data centers could have distinct and potentially significant environmental impacts related to water quality and demand, air quality and emissions, hazardous materials, noise, and other areas of concern.

5. Zoning Analysis: Staff have evaluated zoning strategies to regulate data center development and operations within the City.

6. Coordination with Legal Counsel: Staff will continue to consult with the City Attorney to ensure that any proposed regulations are legally defensible and consistent with California law.

Additional time is necessary for staff to evaluate land use regulations applicable to data centers and obtain community input through public engagement. Accordingly, staff will request that the City Council extend the moratorium for an additional ten (10) months and fifteen (15) days at its special meeting on October 28, 2026, at 4:30 p.m. The moratorium may be rescinded by the City Council upon adoption of zoning regulations addressing data centers.

ENVIRONMENTAL REVIEW (CEQA):

Receipt of the written report required by Government Code Section 65858(d) is not a project subject to CEQA pursuant to CEQA Guidelines Section 15378(b)(5), because it is an administrative activity that will not result in direct or indirect physical changes to the environment. This action does not authorize development, approve land use entitlements, or extend the moratorium.

BUDGET/FISCAL IMPACT:

Adoption of the moratorium will impose additional procedural requirements on the City, including preparation of required reports, publication and notice of public hearings, and preparation of future agenda items for City Council consideration. Compliance with these requirements will require staff time and related administrative expenses. These costs are anticipated to be absorbed within existing departmental budgets.

RECOMMENDED COUNCIL ACTION:

Adopt, as a Consent Calendar item, the written report issued as required by Government Code Section 65858(d) describing the measures taken to alleviate the conditions that led to the adoption of

Interim Urgency Ordinance No. 1594, which imposed a 45-day temporary moratorium on the processing and approval of new land use applications for data centers. Consent Calendar Item.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Tabatha Miller, Assistant City Manager
PREPARER: Tabatha Miller, Assistant City Manager
DATE: October 21, 2026
TITLE: Adopt Resolution No. 267-22 Amending the Fiscal Year 2026-27 Budget to Appropriate $75,000 for the Purchase of Private Property East of B Street and just North of 11th Street, to Facilitate Slope Repairs and Ongoing Maintenance of the Slope and Roadway.

RECOMMENDATION:

It is recommended that the Council adopt Resolution No. 267-22, amending the Fiscal Year (FY) 2026-27 Budget to appropriate $75,000 for the purchase of private property east of B Street, just north of 11th Street, to facilitate slope repairs and ongoing maintenance of the slope and roadway.

INTRODUCTION:

The northbound lane of B Street, just north of 11th Street, has been closed since 2025 because of a landslide and slope failure beneath and immediately east of the roadway. To complete the repairs and provide access for ongoing slope and roadway maintenance, the City needs access to the small, privately owned parcel to the east of the slide. Staff have negotiated a purchase price of $68,785, plus estimated closing costs of up to $6,215, for a total acquisition cost of approximately $75,000.

DISCUSSION:

An evaluation conducted in summer 2026 determined that access to the steep slope east of B Street is necessary to repair and reconstruct the failed slope. The privately owned parcel, Assessor’s Parcel Number (APN) 021-072-006, encompasses approximately 0.17 acres, or 7,545 square feet. The parcel includes wetlands identified by the U.S. Fish and Wildlife Service, and Campbell Creek runs through dense shrubs and trees at the bottom of the ravine.

Given the parcel’s location adjacent to the failed roadway, staff determined that substantial repair work would need to occur on the private property. The City does not currently hold an easement allowing access to the parcel for this work or future maintenance.

The access needed for repairs and ongoing maintenance would also constrain future development of the parcel. Staff therefore negotiated the purchase of the property to secure long-term access. The proposed budget amendment would provide the funding needed to complete the acquisition.

Page 33 of 61 ends

ENVIRONMENTAL REVIEW (CEQA):

Budget amendments are not subject to the California Environmental Quality Act (CEQA) when they constitute government fiscal activities that do not commit the City to a specific project that may have a potentially significant physical impact on the environment, pursuant to CEQA Guidelines Section 15378(b)(4). Any individual project funded through an amendment remains subject to applicable CEQA review.

BUDGET/FISCAL IMPACT:

The proposed amendment would appropriate $75,000 in the Stormwater Fund (666), funded by a $75,000 transfer from the General Fund (101) to the Stormwater Fund. The appropriation includes the negotiated purchase price of $68,785 and estimated closing costs of up to $6,215.

STAFF REPORT – CITY COUNCIL MEETING
TO: Honorable Mayor and City Council Members
FROM: Merritt Perry, City Manager
PREPARER: Nubia Goldstein, City Attorney
DATE: October 21, 2026
TITLE: Adopt Resolution No. 267-26 Approving for the Purchase and Sale Agreement for Purchase of Assessor’s Parcel No. 021-072-006 (11th and B Street) and Ratifying the City Manager’s Execution of the Agreement.

RECOMMENDATION:

It is recommended that the City Council adopt Resolution No. 267-26, approving the Purchase and Sale Agreement for the purchase of APN 021-072-006 (11th Street and B Street) and ratifying the City Manager’s execution of the Agreement.

BACKGROUND / DISCUSSION:

The City is seeking to acquire an approximately 0.17-acre undeveloped parcel at 11th Street and B Street (APN 021-072-006). The parcel is privately owned, and a creek runs through it. Recently a slope failure (slip-out) occurred on the parcel that threatens the adjacent public right-of-way.

Without repairs, continued erosion during the winter rainy season is expected to cause further slope failure and damage to the roadway.

On September 16, 2026, the City Council met in closed session and directed staff to negotiate the purchase of the parcel expeditiously so that the City could enter the property and complete erosion control and slope stabilization work before the onset of the rainy season.

Under that direction, staff negotiated the attached Purchase and Sale Agreement with the property owner. To allow repair work to begin as soon as possible, the City Manager executed the Agreement on October 13, 2026, subject to ratification by the City Council.

Under the Agreement, the City will purchase the parcel for $68,785.00. The Agreement grants the City a right to enter the property before the close of escrow to investigate, design, permit, and construct the slope repair and related grading, drainage, erosion control, and creek bank stabilization work.

Staff has determined that acquiring the parcel is consistent with the City’s General Plan, because it will allow the City to stabilize the slope and protect the adjacent public right-of-way. The proposed resolution includes a finding to that effect.

COMMITTEE/COMMISSION REVIEW:

N/A
ENVIRONMENTAL REVIEW (CEQA):

The proposed action is statutorily exempt from the California Environmental Quality Act (CEQA) under Public Resources Code section 21080(b)(2) and (b)(4) and CEQA Guidelines section 15269(b) and (c). The slope failure is a sudden, unexpected occurrence that, with the onset of the rainy season, poses a clear and imminent danger to the adjacent public right-of-way. Acquiring the parcel and completing the repair work are necessary to maintain that public facility and to prevent or mitigate the emergency. The repair work will be subject to any required permits from state and federal resource agencies.

BUDGET/FISCAL IMPACT:

The purchase price is $68,785.00, plus closing costs. A budget amendment being presented at this same meeting appropriates $75,000 in the Stormwater Fund (666), funded by a $75,000 transfer from the General Fund (101) to the Stormwater Fund. The appropriation includes the negotiated purchase price of $68,785 and estimated closing costs of up to $6,215.

Costs of the repair work are budgeted in 666-70-51-57600 (Stormwater Fund: Capital – Other Improvements).

RECOMMENDED COUNCIL ACTION:

1. Receive a staff report.

2. Open public comment.

3. Close public comment.

4. Motion to adopt Resolution No. 267-26, approving the Purchase and Sale Agreement for the purchase of APN 021-072-006 (11th Street and B Street) and ratifying the City Manager’s execution of the Agreement.

(vii) Effect on this Agreement. The Repair Work, and any change to the Land resulting from it, shall be deemed a change attributable to Buyer for purposes of Sections 6, 7, 11, and 14 and shall not be a failure of any Condition Precedent or a default by Seller. Buyer's entry shall not be deemed possession of the Property for purposes of Section 8(b ), shall not transfer to Buyer any title to or ownership interest in the Land, and shall not relieve Seller of any obligation under this Agreement except as expressly stated in this Section 9(a). The Parties agree that the consideration for this right of entry is included in the Purchase Price and that no additional compensation shall be payable for it.

If termination results from Seller's default, the foregoing shall not limit Buyer's remedies under Section 14.
(x) Survival. Sections 9(a)(iv), (vi), (viii), and (ix) shall survive the Close of Escrow or termination of th is Agreement.
(b) Possession. At Closing, the right to possession of the Property shall transfer to Buyer, and Seller shall deliver to Buyer exclusive possession of the Property, free and clear of occupancy by all persons, firms, or corporations, whether or not under claim of right or color of title.

(c) Buyer's Representations. Buyer makes the following representations and warrantees:
(i) Buyer has the right, power and authority to enter into this Agreement and to purchase the Property in accordance with the expressed terms and conditions hereof. (ii) Each of the persons executing this Agreement on behalf of Buyer is authorized to do so.
(iii) This Agreement constitutes a valid and legally binding obligation of Buyer, enforceable in accordance with its terms.

The above representations and warranties are made by each Party with the knowledge and expectation that the other Party is placing complete reliance thereon, and such warranties shall survive Closing. Each Party shall not cause or permit any action to be taken which will cause any of its representations or warranties to be untrue in any material respects upon Closing. None of the representations and warranties shal I be deemed merged into or superseded by the execution or delivery of any documents or agreements in connectioi1 with this Agreement. Each Party agrees to indemnify, defend and hold the other Party harmless from all liabilities, claims, losses, damages, costs and expenses (including reasonable attorneys' fees and costs) in connection with a breach of these representation? and warranties. This indemnification obligation shall survive the Closing.

11. Risk of Loss. Except for loss caused by Buyer, Seller bears all risk of loss prior to the Closing. If, prior to Closing, any of the Property is materially damaged by any casualty (other than those attributable to Buyer) and such damage is not repaired by Seller or arrangements for the escrow of funds sufficient to pay for necessary repairs are not made prior to Closing, then Buyer will have the option to terminate this Agreement by providing written notice to Seller. If Buyer does not elect to terminate this Agreement, it will remain in full force and effect and Buyer shall purchase the Property "as is".

12. Eminent Domain. If, prior to Closing, condemnation proceedings are commenced or concluded by any entity other than Buyer and, in Buyer's reasonable opinion, such proceedings will or have materially and adversely affected the Prope11y, Buyer will have the option to terminate this Agreement by providing written notice to Seller. If Buyer does not elect to terminate this Agreement, it will remain in full force and effect and, at Closing, Seller shall be deemed to have assigned to Buyer all of Seller's rights, titles and interests in any awards that have been made or may be made for the taking. Any such condemnation proceeds received by Seller prior to Closing shall be credited against the Purchase Price otherwise due at Closing from Buyer.

13. Memorandum of Agreement. 14. Default and Remedies.
(a) Notice and Cure. Except as provided below, a Party shall not be in default under this Agreement unless it fails to cure the breach within five (5) business days after receiving written notice of the breach from the other Party; provided that no notice or cure period shall apply to a Party's failure to deliver the funds or documents required by Section 3(6) or to close by the Closing Deadline.
(b) Seller's Default. If Seller defaults, Buyer may (i) terminate this Agreement by written notice to Seller, in which event the Escrow Deposit shall be returned to Buyer and Seller shall pay all Escrow cancellation costs; or (ii) seek specific performance of Seller's obligations, provided that any action for specific performance is filed within sixty (60) days after Seller's default. If specific performance is unavailable because of Seller's acts after the Effective Date, Buyer shall be entitled, in addition to the return of the Escrow Deposit, to recover its direct outof-pocket expenses reasonably incurred in connection with this Agreement, not to exceed Ten Thousand Dollars ($10,000.00). In no event shall Buyer be entitled to recover consequential, special, punitive, or speculative damages.
(c) Liquidated Damages. IF, AFTER THE EXPIRATION OF THE

INSPECTION PERIOD, THE CLOSE OF ESCROW DOES NOT OCCUR SOLELY

BECAUSE OF BUYER'S DEFAULT, SELLER SHALL BE ENTITLED TO RETAIN $3,000.00 AS LIQUIDATED DAMAGES. THE PARTIES AGREE THAT SELLER'S

ACTUAL DAMAGES IN THAT EVENT WOULD BE IMPRACTICABLE OR
EXTREMELY DIFFICULT TO DETERMINE, AND THAT $3,000.00 IS A

REASONABLE ESTIMATE OF THOSE DAMAGES UNDER THE CIRCUMSTANCES EXISTING ON THE EFFECTIVE DATE. THE PAYMENT OF $3,000.00 SHALL BE

SELLER'S SOLE AND EXCLUSIVE REMEDY FOR BUYER'S FAILURE TO CLOSE, EXCEPT FOR BUYER'S SURVIVAL OBLIGATIONS. THIS SECTION IS INTENDED TO COMPLY WITH CALIFORNIA CIVIL CODE SECTION 1671(b).

(d) Survival Obligations. With respect to a breach of any of the Survival Obligations, the non-defaulting Party shall be entitled to all remedies available under this Agreement and at law or in equity, and the use of any one remedy shall not preclude the use of any other.

15. Survival. Any obi igations, representations and warranties that are expressly provided to survive termination of the Agreement and, if Closing occurs, any provision which by its nature and effect is required to be performed after Closing (collectively, the "Survival Obligations") shall survive the Closing and remain binding and for the benefit of the Parties until fully performed. Upon termination, neither Party shall have any further obligations under the Agreement except for the Survival Obligations.

16. Notices. Except where such other form of notice is expressly permitted by this Agreement, any notice required or permitted to be given in connection with this Agreement must 12
