MEMORANDUM
TO: City Council
FROM: Nicole Valentine, Administrative Services Director BY: Lynda Horejsi, Accounting Manager
SUBJECT: Acceptance of the Annual Comprehensive Financial Report, Single Audit, and Audit Report for the Transportation Development Act Transportation Fund Reports
DATE: January 23, 2024
SUMMARY OF ACTION:

Receive and file the Annual Comprehensive Financial Report (ACFR), Single Audit, and Audit Report for the Transportation Development Act Transportation Fund for the fiscal year that ended June 30, 2023.

IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:

Preparation of the City’s financial reports requires approximately 250 hours per year of personnel resources and auditing services costing approximately $29,820 annually.

RECOMMENDATION:
1) Receive and file the Annual Comprehensive Financial Report (ACFR), Single Audit, and Audit Report for the Transportation Development Act Transportation Fund for the fiscal year ended June 30, 2023; and 2) Determine that receiving and filing the ACFR, Single Audit and Audit Report for the Transportation Development Act Transportation Fund is not a project subject to the California Environmental Quality Act (“CEQA”) because it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.)
BACKGROUND:

State law requires that every general-purpose local government publish an annual report on its financial position and activity, and that the report be audited by an independent firm of certified public accountants (the “ACFR”). The goal of the independent audit is to provide a reasonable assurance that the City’s financial statements are free of material misstatements. In addition, the auditing firm is responsible for providing an independent review of the City’s internal financial controls. The City’s financial statements, internal

documents, and financial controls have been audited by the certified public accountant firm of Moss, Levy & Hartzheim, LLP for the fiscal year ending June 30, 2023.

The Single Audit is an organization-wide audit of a non-federal entity that expends $750,000 or more in federally-awarded funds in one year. In fiscal year 2021-22, the City expended $844,750 in federal funds. The $844,750 was combined funding for the Bridge Street Bridge Habitat project, Traffic Way Bridge project, and American Rescue Plan Act (ARPA) funds. For the 2022-23 fiscal year, the City expended $916,570 in federal funds towards the Traffic Way Bridge project and ARPA funds. As a result, the City has completed a Single Audit for the fiscal year ending June 30, 2023, which is included with this report as Attachment 2.

The Transportation Development Act (TDA) provides a state funding source for use by local jurisdictions at the county level to improve existing public transportation and to encourage regional public transportation coordination. It also provides some funding for bicycle and pedestrian projects and, when certain conditions are met, streets and roads.

The main purpose and priority of TDA, however, is to provide funding for public transportation. The Local Transportation Fund (LTF) is a local fund into which the State deposits sales tax revenue to be used for transportation purposes defined by TDA. The State Department of Tax and Fee Administration, based on sales tax collected in each county, returns the general sales tax revenues to each county’s LTF. The City has completed the TDA Audit report every year and posts the reports on the City’s website.

Though not formally presented to the City Council in some prior years, this audit report contains the results of the TDA audit for Council’s information and review as Attachment

3. ANALYSIS OF ISSUES:

Annual Comprehensive Financial Report (ACFR)
Generally accepted accounting principles (GAAP) provide the criteria for judging whether a financial report is presented fairly. In defining the minimum standard of acceptable basic financial reporting for state and local governments, GAAP mandates a complete set of basic financial statements, including accompanying note disclosures, as well as the presentation of certain required supplementary information. GAAP encourages government agencies to present this information within the ACFR.

The ACFR provides a more detailed financial report beyond the basic financial statements. The ACFR is made up of three sections:
• The introductory section: provides general information on the City which includes the letter of transmittal, list of principal officials, and organizational chart. • The financial section: provides the overall financial information of the City which includes the report of the independent auditor, management’s discussion and

analysis (a narrative of the City finances), the basic financial statements, required supplementary information and other supplementary schedules and statements. • The statistical section: provides a broad range of operational, economic, and historical data that provides a context for assessing the City’s economic condition.

This section provides information about the City’s general financial trends, revenue capacity, debt capacity, economic and demographic trends, and operating information.

The City’s external auditors at Moss, Levy & Hartzheim, LLP conducted testing of the City’s internal financial controls in July 2023, October 2023, and November 2023. The testing included reviewing the City’s procedures for receiving and disbursing cash, the accounting methodology used to record transactions, the separation of duties to avert collusion, and the City’s asset securities. As a result of this testing, there were no internal control issues/events noted by the auditors.

An audit was also conducted on the net position of the City for the financial period ending June 30, 2023. Documentation in support of the assets, liabilities, and fund balance of all the funds in the City were examined and verified. This process assures an impartial review and substantiation of the City’s net position. The result of this review is documented in the City’s ACFR. The City’s ACFR complies with newly effective Government Accounting Standards Board (GASB) pronouncements, as detailed in the Notes to the Financial Statements (see Page B-46 of Attachment 1).

Auditors may issue three different types of opinions at the conclusion of an audit; an unmodified, modified, or adverse opinion. An unmodified opinion assures the reader that the information presented in the ACFR fairly represents the financial position of the City.

A modified opinion states that the information is fairly presented except for a particular issue. An adverse opinion indicates that the agency has major accounting and/or internal control issues and no reliance may be placed on the financial statements. The Administrative Services Department staff is proud to report that for the fiscal year ended June 30, 2023, the City of Arroyo Grande received an unmodified opinion, reflecting that the information presented in the ACFR fairly represents the financial position of the City.

As presented in the ACFR, the City’s combined net position at June 30, 2023, increased by $3.6 million or 3.66% from $99.3 million to $102.9 million. This overall increase is due to an increase in governmental activities ($3.4 million) offset by a smaller decrease in business-type activities ($146,146). The largest portion of the City’s net position, $82.3 million, reflects investments in capital assets net of depreciation (e.g. land, buildings, infrastructure, and machinery & equipment). The City uses these capital assets to provide services to the public; consequently, these assets are not available for future spending.

The description of the City’s net position of all funds reflects all the assets and liabilities of the City. It includes the City’s investment in capital assets such as parks, bridges, and roads as well as the liabilities or obligations to pay vendors, employees, and debt service payments. The net position is the mathematical difference between assets and liabilities, but it does not necessarily reflect the economic health of an organization. In the City’s case, about 80% of the total net position reflects capital assets. While these assets are important, they cannot be used to fund the day-to-day operations of the City and, therefore, may not be the most useful measure of the City’s liquidity.

For financial reporting purposes, the half percent Local Sales Tax revenue approved by voters in 2006 and Other Post-Employee Benefits funds (OPEB) are combined with the General Fund in the ACFR. However, the City’s quarterly and year-end reporting is based on the General Fund exclusively and does not include the Local Sales Tax or OPEB funds. The combined funds, as shown in the table below, reports total revenues of $25.9 million and expenditures of $23.1 million. As a result, there was an overall increase to the fund balance of $2.8 million during the 2022-23 fiscal year.

Page 5 ends

The ACFR reports a General Fund total fund balance of $20.6 million. However, a small amount of the fund balance is considered non-spendable because it is held as inventory ($37,592). Additionally, $4.7 million is designated for completing capital projects or meeting other commitments in the future, including post-employment benefits. This leaves an unassigned balance of $11.8 million in the General Fund and $4.1 million in the Local Sales Tax fund. At the May 23, 2023, City Council meeting, Council assigned $3.1 million of the $11.8 million in unassigned General Fund for additional Pavement Management Program project utilization and for the Community Service Grant Program.

The City’s Fiscal Policy establishes the maintenance of a fund balance reserve goal of 20% of expenditures with a minimum of 15% in the General Fund. At the conclusion of Fiscal Year 2022-23, the reserve, based on available General Funds, was 55% and exceeded the City’s reserve goal. A discussion item related to expending the excess fund balance and a review of the fund balance policy will be brought to the Council at a future meeting.

Single Audit
The City’s independent auditor, Moss, Levy & Hartzheim, LLP, completed the Single Audit of federal awards for fiscal year ended June 30, 2023. The auditors opined that the City complied, in all material respects, with requirements that could have a direct and material effect on each of its major federal programs for the fiscal year ended June 30, 2023.

The City provided the following list of federal funding expenditures as of June 30, 2023:

Audit Report for the Transportation Development Act Transportation Fund The City’s independent auditor, Moss, Levy & Hartzheim, LLP also completed the Audit Report for the Transportation Development Act Transportation Fund Report (the “TDA Transportation Fund Report”). The auditors opined that the City complied, in all material respects, with requirements that could have a direct and material effect on each of its major federal programs for the year ended June 30, 2023. There were no findings issued or questioned costs.

The TDA Transportation Fund Report is for the Transportation Fund, which is a special revenue fund of the City. The California Code of Regulations, Title 21, sections 6661 and 6751, required Local Transportation Fund and State Transit Assistance Fund recipients such as the City to submit a fiscal audit report to the State Controller’s Office annually.

The Transportation Fund Audit reflected that the City’s allocations under Article 8, Section 99400(a), which relates to projects for local streets and other multimodal transportation, for the fiscal year ended June 30, 2023, was $565,513. The City’s allocations under Public Utilities Code Article 3, Section 99233.3, which relates to funding facilities for use of pedestrians and bicycles or other local transportation projects, for the fiscal year ended June 30, 2023, was $24,664. The City's allocation of the TDA Funds are used to support the Streets program that maintains all city streets, rights-of-way, and sidewalks.

Item 9.c.

MEMORANDUM
TO: City Council
FROM: Nicole Valentine, Administrative Services Director BY: Lynda Horejsi, Accounting Manager
SUBJECT: Consider Adoption of a Resolution Approving the Annual Adjustment of Sewer Connection Fees
DATE: January 23, 2024
SUMMARY OF ACTION:

Adoption of a Resolution approving the annual adjustment of Sewer Connection Fees to increase fees by 2.7%, consistent with the Engineering News Record (ENR) Construction Cost Index (CCI).

IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:

Adoption of the Resolution will increase the Sewer Connection Fees charged for new development projects, effective March 25, 2024. The revenue generated from this adjustment is dependent on the amount of new development in the community during the coming year.

RECOMMENDATION:
1) Adopt a Resolution approving the annual adjustment to the City’s Sewer Connection Fees based on changes in the Engineering News Record Construction Cost Index; and 2) Determine that adopting this Resolution is not subject to the California Environmental Quality Act (“CEQA”) because it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, Cal.

Code Regs., tit. 14, §§ 15060, subd. (c)(2)-(3), 15378.).

BACKGROUND:

Ordinance 528 C.S. amended Section 13.12.190 of the Arroyo Grande Municipal Code to provide that, for each connection of a building to a public sewer, a connection fee will be charged and that the amount of the fee shall be set by resolution. Resolution No. 3567 authorized that the sewer connection fees be adjusted each year in accordance with the percentage increase in the annual average ENR CCI.

Page 27 of 56 ends

Item 9.c.

City Council
Consider Adoption of a Resolution Approving the Annual Adjustment of Sewer Connection Fees
January 23, 2024

Page 2 ends

The previous rate increase of 7.2% was approved by Council on January 24, 2023, and became effective on March 27, 2023.

ANALYSIS OF ISSUES:

Sewer Connection Fees, enacted pursuant to Section 13.12.190 of the City Municipal Code, are collected to help pay for improvements and future sewer system capacity as necessary to meet the needs of the City resulting from growth and expansion.

The calculation shown below provides documentation that the ENR CCI warrants a 2.7% increase in the City’s Sewer Connection Fees.

The calculation adjusts the fees as follows:
1 + Current Index – Base Index for Date of Adoption = Factor Base Index for Date of Adoption
For the current year, the calculation is as follows:
1 + 13,358 – 13,007= 1.027 = 2.7%
13,007
The existing and proposed fees implementing a 2.7% ENR CCI increase are set forth in Exhibit A to the attached Resolution. If approved, the effective date of the new fees will be March 25, 2024.

ALTERNATIVES:

The following alternatives are provided for City Council consideration:

1. Adopt the Resolution approving the annual adjustment to the City’s Sewer Connection Fees based on changes in the Engineering News Record Construction Cost Index;

2. Do not adopt the Resolution and request further information; or

3. Provide other direction to staff.

ADVANTAGES:

By approving the recommended fees, the City will be able to recover the estimated cost of providing infrastructure and services to new development.

DISADVANTAGES:

The only disadvantage identified in relation to this recommendation is an increased cost to new development.

MEMORANDUM
TO: City Council
FROM: Nicole Valentine, Administrative Services Director BY: Lynda Horejsi, Accounting Manager
SUBJECT: Consider Adoption of a Resolution to Update City Manager Name for Authorized Personnel for Financial Institutions
DATE: January 23, 2024
SUMMARY OF ACTION:

Update the list of personnel to include the new City Manager’s name as an authorized employee to deposit City funds in various financial institutions and to enter into banking or investment arrangements on behalf of the City.

IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:

There are no significant financial or personnel resource impacts to updating the Resolution.

RECOMMENDATION:
1) Adopt a Resolution authorizing the deposit of City funds in various financial institutions and updating the names of designated employees in certain positions who are authorized to make deposits of City funds and enter into banking or investment arrangements; and 2) Determine that adopting a resolution authorizing the deposit of City funds in various financial institutions and updating the names of designated employees in certain positions who are authorized to make deposits of City funds and enter into banking or investment arrangements is not subject to the California Environmental Quality Act (“CEQA”) because it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, Cal. Code Regs., tit. 14, §§ 15060, subd. (c)(2)-(3), 15378.)
BACKGROUND:

In 2021, the City Council adopted Resolution No. 5122, which authorized the deposit of City funds in various financial institutions and authorized certain employees to act on behalf of the City in banking or investment relationships. Since that time, the Resolution has been updated as position titles and banking regulations have changed.

Page 33 of 56 ends

Item 9.d.

City Council
Consider Adoption of a Resolution to Update City Manager Name for Authorized Personnel for Financial Institutions
January 23, 2024

Page 2 ends

ANALYSIS OF ISSUES:

Regulations for the banking industry require that the City’s Resolution include the names of the employees currently serving in the position, rather than just the titles. This will necessitate a more frequent updating of the Resolution as staffing changes occur; however, it is unlikely to be a significant impact to the City. The City Council appointed a new City Manager, who began work with the City on January 8, 2024. The proposed resolution is to update the list to include the City Manager’s name.

ALTERNATIVES:

The following alternatives are provided for the Council’s consideration:

1. Adopt the Resolution as presented;

2. Modify and adopt the Resolution; or

3. Provide other direction to staff.

ADVANTAGES:

Updating the Resolution will reflect the current names of persons authorized to enter into banking and investment relationships for the City and provides documentation compliant with banking regulations.

DISADVANTAGES:

There are no disadvantages in relation to the recommended action.

ENVIRONMENTAL REVIEW:

Adopting a resolution authorizing the deposit of City funds in various financial institutions and updating the names of designated employees in certain positions who are authorized to make deposits of City funds and enter into banking or investment arrangements is not subject to the California Environmental Quality Act (“CEQA”) because it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, Cal. Code Regs., tit. 14, §§ 15060, subd. (c)(2)- (3), 15378.)

MEMORANDUM
TO: City Council
FROM: Bill Robeson, Assistant City Manager/Public Works Director BY: Shannon Sweeney, City Engineer
SUBJECT: Consideration of the 2024 Pavement Priority Project List and Finding the Project is Not Subject to Environmental Review Under the California Environmental Quality Act, State Guidelines Section 15301 DATE: January 23, 2024
SUMMARY OF ACTION:

Review and approve a priority list of streets to include in the 2024 Pavement Management Program (PMP) and find that action exempt under CEQA 15301.

IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:

Budgeted funds of $5,785,753 are available for the PMP budget in FY 2024-25. See Table 1 for revenue sources. Table 2 lists the expected expenditure breakdown assuming that the final budget for this project is limited to only the existing budgeted funds.

Additional funds may become available for this project as existing streets projects finish and a reserve fund policy is developed. Sufficient funds exist at this time to complete the top three projects listed in Table 3. City staff is requesting the City Council authorize the City Manager or their designee with the ability include additional pavement maintenance elements to maximize the project size and cost efficiency if more funds become available.

Table 2 – FY 2024-25 PMP Expected Expenditure Breakdown RECOMMENDATION:
1) Review and approve a priority list of streets for the 2024 Pavement Management Program; 2) Authorize the City Manager or designee to choose the remaining projects on the list to maximize the project size and cost efficiency of more funds become available, along with other minor work associated with pavement maintenance, such as striping, concrete work, and pedestrian improvements; and 3) Find this project is categorically exempt from the California Environmental Quality Act (“CEQA”) under the Class 2 exemption, which applies to the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. (State CEQA Guidelines, § 15301.)
BACKGROUND:

The City of Arroyo Grande is responsible for over 73 miles of streets within its boundaries.

On February 14, 2017, the City Council adopted the 2016 Update to the Pavement Management Plan (PMP) and endorsed the “Critical Point Strategy” (CPS) methodology for the City’s Pavement Management System (PMS). The CPS approach selects the road segments for repair or resurfacing that are at a “critical point” of deterioration. The critical point is a point located on the pavement deterioration graph that indicates a more expensive maintenance or rehabilitation approach will be needed in the near future.

The focused critical point strategy makes sense when the City has minimal funding and does not have the latitude to consider other project efficiencies like economies of scale, project competitiveness, and project management. Since the adoption of the 2016 PMP and until 2022, the City applied approximately $1.25 million per year to streets maintenance and repair.

City Council
Consideration of the 2024 Pavement Priority Project List and Finding the Project is Not Subject to Environmental Review Under the California Environmental Quality Act, State Guidelines Section 15301
January 23, 2024

Page 3 ends

On April 26, 2022, the City Council adopted the 2022 PMP. The plan identifies recommended street work assuming a continued annual budget of $1.25 million per year and applying the CPS.

On November 22, 2022, City Council approved maintenance and repair work for the 2022 PMP. More than the base amount of $1.25 million was available due to prudent financial stewardship, carryover, and excess reserves. As a result, the City was able to complete additional work, including an overlay of the entire Equestrian Way neighborhood that had not previously been identified for upcoming (within the 10 year planning horizon) repair in the 2022 PMP but that had significantly deteriorated asphalt.

ANALYSIS OF ISSUES:

On May 23, 2023, the City Council directed staff to apply $3 million from excess reserves in addition to the base amount of $1.25 million to pavement maintenance and repair. Staff value engineered the information available in the 2022 PMP to provide a recommended list of work to be done with available funds. In addition to CPS, staff considered other factors, including the cost efficiency of applying only one kind of maintenance treatment, the management and staging efficiency of focusing on locations on a neighborhood-basis rather than a single street-basis, economies of scale that arise as a result of one large single project rather than multiple small ones, and the bidding competitiveness that occurs when the City bids a larger project.

To better align the magnitude of the upcoming pavement project with existing and future potential available funds, City staff secured a contractor at the end of 2023 to perform deflection testing at various locations throughout the city. Testing locations were identified using the map shown in Figure 1. Note that Leisure Gardens and Sunrise Terrace were removed from consideration because they are private streets. The Equestrian Way neighborhood is crossed out because pavement maintenance was completed in 2023.

The remaining locations were identified because there is a significant grouping of deteriorating streets within neighborhoods that appeared to be candidates that may benefit from the same pavement treatment.

The deflection testing indicated that all locations were appropriate for an overlay treatment except for Station Way and a large part of the Woodland neighborhood. Results of testing in both locations indicated the need for heavy rehabilitation in the form of full depth reclamation. The cost estimates reflect the treatment recommended based on deflection testing.

At this time, City staff does not anticipate that a streets project of this magnitude in size or budget will be possible in future years without an infusion of additional revenue that can be allocated to PMP projects. Funding for upcoming years is likely to revert to and be limited to $1.25 million plus any remaining carryover from previous years’ projects.

This year, City staff is recommending that Community Development Block Grant (CDBG) and sidewalk funds be applied to the same project as the street funds. As seen in Table 3, an estimated $1,308,000 of this project will be dedicated to curb ramp improvements.

Applying street and sidewalk funding together will create a more cost-effective project.

Figure 1 – Testing Locations
Table 3 contains the recommended priority for streets work for FY 2024-25. The total cost estimate column includes all facets of project costs including design, inspection, and construction. The top three locations can be funded within the existing available funding for FY 2024-25. City staff requests the latitude to base the next location on the list to maximize the use of available funding. For instance, if $3 million is available, Woodland

should be considered next, whereas if only $1 million available, Station Way would be next.

If the Council approves the PMP, staff will move forward with completion of the Plans, Specifications, and Estimate (PS&E) and return to Council in early 2024 with a request to approve the PS&E and authorize solicitation of bids. Once bids are received and reviewed, staff will present Council with a Bid Award recommendation in winter of 2024.

Construction is anticipated to begin in Spring of 2025 and is estimated to be completed by the end of 2025.

Table 3 – Recommended Priority List
ALTERNATIVES:

1. Approve staff’s recommendation that the City Council review and approve a priority list of streets for the 2024 Pavement Management Program and authorize the City Manager or designee to choose the remaining projects on the list to maximize the project size and cost efficiency if more funds become available, along with other minor work associated with pavement maintenance, such as striping, concrete work, and pedestrian improvements, and find the action exempt from CEQA pursuant to CEQA Guideline Section 15301;

2. Do not approve staff’s recommendation;

3. Modify staff’s recommendation; or

4. Provide other direction to staff.

ADVANTAGES:

The recommended list adheres to the concept of CPS in that projects are prioritized in order of the savings they provide. The top three recommended locations, the Stagecoach neighborhood, Rancho Grande Phase 1, and the Brighton neighborhood, provide Cost Based Cost Based Total Cost Cumulative Savings

significant savings by applying an overlay now rather than waiting until rehabilitation is necessary. Savings to the City by performing this work now are estimated to be $5,444,000. The total cost of proceeding with pavement maintenance in these three neighborhoods is estimated at $5,606,000, which is within the existing available budget of $5,785,753.

This is a sizable project that will take advantage of economies of scale. The top three projects involve only overlay, which reduces the number of subcontractors needed to complete the job and leads to further savings. The projects are grouped by neighborhood to facilitate encroachment permits and traffic control plans. All the work identified can be bid efficiently as a single project rather than multiple small projects. Finally, the size of this project makes it appealing to more potential bidders, which provides greater competitiveness.

Average citywide PCI will rise, as the PCI for all of the streets recommended for treatment are below the 2022 average of 56.

DISADVANTAGES:

Restructuring the program this year to maximize the use of available funding by focusing on a specific treatment type means that some maintenance work previously identified in the 2022 PMP will be deferred for one or more years so that each year’s project maximizes a single treatment application. City staff conferred with the pavement consultant to verify that doing so should not result in additional future treatments for these streets because of the deferment.

ENVIRONMENTAL REVIEW:

The project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline Section 15301 covering the repair and maintenance of existing streets, sidewalks, gutters and similar facilities.

The Agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2.
