Subject: KEEP 3 MIN. PER PERSON PUBLIC COMMENT
Date: Sunday, September 22, 2024 6:16:16 PM
Dear AG City Council,
As a citizen living in Arroyo Grande for over 50 years, I have a concern, along with many others, over the proposed limit of public comment changing from 3 minutes down to 1 minute per person.One minute is not enough time to give your name, express a concern, and give reasons for it.It is a freedom for citizens of AG to express their concerns to council members who they elected to represent them.

The average time in public comments was about 7 minutes for each meeting. The lengthy meeting dealt with a highly controversial issue of flying special interest flags which should have been avoided by the council limiting only the United States, California, and Arroyo Grande flags to be flown.

Please vote for our AG citizens to have their voices heard by keeping the 3 minutes per person for public comments time at the beginning of each AG council meeting,
Blessings,
Karen Miller

Item 9.a.

MEMORANDUM
TO: City Council
FROM: Nicole Valentine, Administrative Services Director BY: Lynda Horejsi, Accounting Manager
SUBJECT: Cash Disbursement Ratification
DATE: September 24, 2024
RECOMMENDATION:

Review and ratify the attached listing of cash disbursements for the period of August 16 through August 31, 2024.

IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:

There is a $1,665,722.15 fiscal impact for the period of August 16 through August 31, 2024, that includes the following items:
 Accounts Payable Checks $1,191,806.13
 Payroll & Benefit Checks $473,916.02
BACKGROUND:

Cash disbursements are made weekly based on the submission of all required documents supporting the invoices submitted for payment. Prior to payment, Administrative Services staff review all disbursement documents to ensure that they meet the approval requirements adopted in the Municipal Code and the City’s Purchasing Policies and Procedures Manual.

ANALYSIS OF ISSUES:

The attached listing represents the cash disbursements required of normal and usual operations during the period. The disbursements are accounted for in the FY 2023-24 and FY 2024-25 budgets.

ALTERNATIVES:

The following alternatives are provided for the Council’s consideration:

1. Approve staff’s recommendation;

2. Do not approve staff’s recommendation; or

3. Provide other direction to staff.

ADVANTAGES:
 The Administrative Services Department monitors payments of invoices for accountability, accuracy, and completeness using standards approved by the City Council.
 Invoices are paid in a timely manner to establish goodwill with merchants.  Discounts are taken where applicable.

DISADVANTAGES:

There are no disadvantages identified in this recommendation.

ENVIRONMENTAL REVIEW:

Ratifying the cash disbursements is not a project subject to the California Environmental Quality Act (“CEQA”) because it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378.)
PUBLIC NOTIFICATION AND COMMENTS:

The Agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2.

MEMORANDUM
TO: City Council
FROM: Jessica Matson, Director of Legislative & Information Services/ City Clerk
SUBJECT: Conflict of Interest Code Biennial Review and Resolution Amending the City of Arroyo Grande Conflict of Interest Code
DATE: September 24, 2024
RECOMMENDATION:

Adopt a Resolution approving an amended Conflict of Interest Code for designated positions.

IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:

There are no fiscal or personnel impacts as a result of the proposed action.

BACKGROUND:

The California Political Reform Act requires every local government agency to adopt a Conflict of Interest Code (“COI Code”). The COI Code designates positions within the City required to file Statements of Economic Interests and assigns disclosure categories specifying the types of financial interests to be reported. Further, the Political Reform Act contains specific provisions setting forth any circumstances under which designated positions or categories of designated positions must disqualify themselves from making, participating in the making, or using their official position to influence the making of any decision.

Certain officials, including the Mayor, members of the City Council, candidates for City offices, members of the Planning Commission, City Manager, City Attorney, and City Treasurer are not governed by the City’s Conflict of Interest Code as they are all otherwise statutorily required to file disclosure statements pursuant to Government Code Section 87200 (commonly known as “87200 filers”). The City’s COI Code and list of designated positions supplement those statutory requirements by including employees, consultants, and members of City advisory bodies who are not 87200 filers. It is important to note that the list of designated positions includes members of the Successor Agency of the Dissolved Arroyo Grande Redevelopment Agency. Because the City Council also serves as board members of this authority, members of the Council are required to include this

position on their Statements of Economic Interest Form 700 when filing their disclosure statements.

ANALYSIS OF ISSUES:

In 1987, the City adopted the State’s standard Conflict of Interest Code by reference which, along with the Appendix of Designated Positions and the Appendix of Disclosure Categories, constitutes the City of Arroyo Grande COI Code.

Under the Political Reform Act, local agencies are required to review its COI Code biennially to determine whether the COI Code is accurate, or if revisions are needed due to organizational changes, including the creation of new positions, elimination of positions, position title changes, and/or relevant changes in the duties assigned to existing positions.

The City’s COI Code was last updated in September 2022. A review of the designated positions has been completed and it has been determined that a revision to the City’s Conflict of Interest Appendix of Designated Positions is required at this time.

In January 2023, the City Council adopted Resolution 5252 (Attachment 2) approving a salary classification for an Assistant Projects Manager position in the Public Works Department.

On October 25, 20221, the City Council modified the Community Service Grant Program Committee to consist of five members appointed by each City Council Member, to serve as an advisory body to the City Council.

It is recommended that these changes be reflected in the City’s COI Code to ensure that it is current and accurate, including the addition of the Assistant Projects Manager position and Community Service Grant Program Committee Member to the list of designated filers.

Staff has completed the biennial review of the current COI Code and has determined that no other amendments are necessary at this time. The City's COI Code accurately designates all positions that make or participate in the making of governmental decisions; the disclosure categories assigned to those positions accurately require the disclosure of all investments, business positions, interests in real property and sources of income which may foreseeably be affected materially by the decisions made by those designated positions; and the COI Code includes all other provisions required by Government Code Section 87302.

not include costs for construction support services. Rather, the original proposal stated, “this optional scope of work could be authorized through contract amendment prior to the start of construction after the scope and magnitude of the final project are understood.

After award of the construction contract, the team will be available to provide construction support services such as reviewing contractor submittals, reviewing shop plans, reviewing scaffolding plans and calculations, preparing and/or reviewing change orders, and making field observations, at the Resident Engineer’s or City’s request. Upon completion of construction, Quincy would prepare as-built plans based on the construction management team plan markups.”
On October 11, 20222, the City Council approved an amendment to Quincy Engineering extending the contract by two years from October 31, 2022 to October 31, 2024.

On September 12, 20233, the City Council approved Amendment No. 3 to increase costs associated with design and environmental services by $157,800. This increase addressed the following:
 Additional project management due to the two-year project delay.  Additional analysis of traffic safety issues recommended by the mitigated negative declaration.
 Public outreach associated with the detour plan.
 Additional CEQA documentation to address the traffic calming mitigation measures.
 Additional site sampling and testing.
 Right-of-way acquisition for 12 temporary construction easements identified during preliminary design.

ANALYSIS OF ISSUES:

The existing design and engineering consultant agreement with Consor expires on October 31, 2024. Staff recommends that the contract time be extended through October 31, 2026, to accommodate the construction and project closeout phases of this project.

A contract price amendment is warranted for the following reasons:

1. Additional project management and Caltrans programming coordination.

2. Additional permit compliance.

3. Additional revegetation plans and bid documents.

4. Additional utility coordination.

5. Additional Caltrans encroachment coordination.

Page 3 ends

6. Additional file design.

7. Restore bid support.

Amendment No. 4, included as Exhibit 1 in Attachment 1, provides detailed justifications for each of the items listed above. Further competitive selection procedures would be contrary to the public’s interest because the consultant has particular knowledge and background relating to the project. If a new consultant were selected, that consultant would need to spend significant time acquiring the same knowledge, adding unnecessary and prohibitive costs to the project.

The length of time to complete negotiations associated with obtaining the last few temporary construction easements and utility agreements increased costs above the budgeted amounts. These lengthy negotiations were unforeseen and not caused by any deficiencies on the part of the design and engineering consultant.

Construction support services were not included in Consor’s original proposal because the full scope of the project was not known at that time. The proposed cost for these services is $181,368.97.

The total requested amendment to the Consor agreement is $300,850.00.

ALTERNATIVES:

The following alternatives are provided for the Council’s consideration:

1. Approve Amendment 4 to Consor;

2. Do not approve Amendment 4; or

3. Provide other direction to staff.

ADVANTAGES:

Consor has been involved with the Traffic Way Bridge Replacement Project since its inception and has been instrumental in delivering design, environmental, grant, and rightof-way documentation.

Approving this amendment to Consor’s Consultant Services agreement will allow Consor to provide engineering and construction support services through the Traffic Way Bridge Replacement Project construction and closeout phases. Their historical perspective and detailed design familiarity will provide a beneficial level of continuity that will help provide a successful completion of this complicated project in a cost-effective manner and in the short time schedule allotted.

DISADVANTAGES:

Amending the contract price increases project costs, for which the City is responsible for paying 11.47% using local funds.

NEXT STEPS:

The Project design phase is complete. The plans have incorporated the hybrid detour plan recommended by the City Council at its September 10, 20244 meeting.

Project construction is expected to go out to bid September 26, 2024. By then, the Caltrans encroachment permit is expected to be issued. Work is still underway on the environmental permits. If final permits are not obtained before the project goes out to bid, an addendum will be issued. Expected permit requirements have already been incorporated into the documents.

A Request for Proposals for Construction Management will be issued in the same timeframe as the construction bidding. The goal is to award the construction project and construction management at the December 10, 2024, City Council meeting.

ENVIRONMENTAL REVIEW:

On September 26, 20235, the City Council adopted a Mitigated Negative Declaration (MND) for the Project (SCH No. 2022060452). The MND analyzed the environmental impacts of the Project in compliance with the California Environmental Quality Act.

MEMORANDUM
TO: City Council
FROM: Brian Pedrotti, Director of Community Development BY: Patrick Holub, Associate Planner
SUBJECT: Temporary Use Permit 24-006 Authorizing Temporary Closure of Branch Street for Halloween in the Village from 3:00 PM to 7:00 PM Tuesday, October 31, 2024; Applicant - Cheers! Arroyo Grande DATE: September 24, 2024
RECOMMENDATION:
1) Adopt a Resolution approving Temporary Use Permit 24-006 authorizing the closure of East and West Branch Streets to accommodate Halloween in the Village; and 2) Determine that this project is categorically exempt per Section 15304(e) of the CEQA Guidelines regarding minor temporary uses of land.

IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:

The applicant is required to pay for all costs associated with the event. The Comprehensive Fee Schedule1that became effective January 16, 2023, includes a fee for a Small Traffic Event of $5,570 and is collected in addition to the Temporary Use Permit application fee of $386. Lastly, a 2% technology fee and a 3% General Plan Update fee are applied, bringing the total amount due for this event to $6,442.80. These costs have been deemed necessary to ensure the safety and security of event attendees.

BACKGROUND:

Halloween in the Village as an event began informally and operated without official permits or City involvement until 2007. The large crowds and corresponding traffic concerns led the City to require the event organizer to obtain a permit that outlined the safety procedures and street closures necessary to ensure the event would foster a secure and organized environment for attendees. One measure that has been implemented is the closure of West Branch to traffic which enables families to safely cross the street. Cheers! Arroyo Grande applied for a permit to continue the annual Halloween

in the Village celebration. The event is intended to provide a safe daytime environment for families to trick or treat while highlighting businesses in the Village.

Staff Advisory Committee (SAC)
The SAC, which is comprised of staff including from the Police, Fire, Public Works, and Community Development departments, discussed the project at its meeting on August 28, 2024. The SAC was supportive of the event and recommended the City Council approve the application with conditions of approval included in the Resolution.

ANALYSIS OF ISSUES:

The Temporary Use Permit authorizes street closures from 3:00pm to 7:00pm on the day of the event, which is proposed from 4:00pm to 6:00pm, and imposes conditions and safety measures to increase pedestrian safety during the event. By limiting occurrences of pedestrian and vehicular interactions during the event, crowds of children and families are able to safely gather and walk on both sides of the four-block core of the Village. Prior to the implementation of street closures, unsafe conditions such as overcrowded sidewalks and crossings of uncontrolled intersections were common. The successful implementation of street closures and safety measures over the previous ten (10) events has led to a positive community celebration and no reported incidences of accident or injury.

The closure of West and East Branch Street from Traffic Way to Mason Street will be implemented through the following measures:
 Physical closure of Branch Street between West Branch at Traffic Way and East Branch at Mason Street with barricades;
 The placement of “No Parking” signs mounted on delineators 48 hours in advance of the event on West and East Branch Streets;
 No parking for a small section at the corner of Mason Street and Nelson Street (to allow turning movement for commercial trucks);
 Closure of intersections or major driveways onto East and West Branch Street, including the Car Corral and Nevada Street;
 Closure of Bridge Street between Olohan Alley and Branch Street;  Implementation of a detour which routes automobile and truck traffic onto Traffic Way, Nelson Street and Mason Street; and
 Delineating a widened turning lane on East Branch Street at Mason Street for commercial trucks.

ALTERNATIVES:

1. Adopt the Resolution approving Temporary Use Permit 24-006;

2. Modify and adopt the Resolution approving Temporary Use Permit 24-006;

3. Do not adopt the Resolution, or

4. Provide other direction to staff.

Page 3 ends

ADVANTAGES:

Full street closure provides a safe environment for participants and allows community members to safely cross the street, thus helping the event to operate efficiently and without incident.

DISADVANTAGES:
“No Parking” restrictions and the closure of sections of Branch Street will have an impact on traffic and parking conditions. Motorists unfamiliar or unaware of the event will have to use detours to travel to their destinations, which may increase travel time.

ENVIRONMENTAL REVIEW:

The project is categorically exempt from the California Environmental Quality Act (“CEQA”) under the Class 4 exemption, which applies to minor public or private alterations in the condition of land, water, and/or vegetation where the project does not involve removal of healthy, mature, scenic trees except for forestry and agricultural purposes. No vegetation removal or other alterations to the environment will occur because the event takes place on Branch Street, a paved street within an urbanized area. This project is categorically exempt per Section 15304(e) of the CEQA Guidelines regarding minor temporary uses of land.

FROM: Brian Pedrotti, Director of Community Development BY: Andrew Perez, Planning Manager
SUBJECT: General Plan Update Progress Report – September 2024 DATE: September 24, 2024
RECOMMENDATION:

Receive an update on the status of the Comprehensive General Plan Update project.

IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:

The financial and personnel impacts associated with this project are included in the budget for the Comprehensive General Plan Update.

BACKGROUND:

On March 28, 20231, the City Council approved a consultant services agreement with Mintier Harnish to assist City staff with the Comprehensive General Plan Update. In addition to a comprehensive update of the existing General Plan Elements, the project’s scope includes creating an Environmental Justice Element, an evaluation of development standards, an East Grand Avenue Corridor Overlay District, creation of objective design standards, a Development Code update, retail market analysis, market demand study, and update to the City’s Climate Action Plan. An environmental impact report (EIR) will be prepared to analyze the significant environmental effects of the update and discuss options to mitigate or avoid those effects.

The project scope is divided among eleven (11) phases, the first four of which are complete:

Item 9.i.

Project initiation consisted of a kick-off meeting with city staff and a subsequent study session with City Council, which was held on August 22, 20232, to refine the scope of work and project schedule. Development of the project website3, logo and branding, creation of an email list were part of the Public Outreach Strategy phase. The Community Engagement Summary Report4 describes the outreach efforts that took place during the initial phases of the project and strategies to engage the community and transmit information to the public throughout the process. Although this phase is noted as being completed, it continues to evolve as staff and the consultant pursue additional ideas and concepts to encourage community input and involvement.

The Background Data and Analysis phase focused on the identifying existing trends in land use, population, employment, housing, circulation, economics, and environmental resources. The first community workshop was held on October 5, 2023, with the purpose of hearing the community’s opinions about the city’s major assets, issues, and opportunity areas. Information gathered during this phase informed the Existing Conditions and Trends Workbook5, which was published in February 2024.

Using data and information obtained from the first workshop and Existing Conditions Workbook, staff transitioned to developing a vision statement and guiding principles for the project. A second workshop was held on February 28, 2024, to obtain information about the community’s vision for the future. A series of exercises was provided to further identify the places in the City that offer opportunities for improvement and enhancements and describe the participants’ ideal vision for the future. Comments gathered from the workshop and the associated online survey were compiled and analyzed to create draft vision statements and guiding principles to be reviewed and refined by Planning Commission on July 2, 20246. Those recommendations were presented to Council on August 13, 20247, when the final vision statement and guiding principles were adopted.

A seven-member General Plan Citizen Advisory Group (GPCAG) has also been formed, consisting of residents from a wide range of professional backgrounds. The GPCAG will meet approximately one time per month to review administrative drafts of deliverables and be consulted during initial policy development.

This is the first version of what is anticipated to be regular updates to the Council from Community Development Department staff regarding the comprehensive General Plan Update project. The next phase of the project will be evaluating and developing land use alternatives for future development. This phase will rely heavily on input from the community and decision makers to identify development scenarios. Phase 5 will consist of at least one community workshop, an online survey and mapping exercise, and popup events at local venues and events, and is anticipated to go through the end of 2024 and into early 2025.

Decision-makers will weigh the costs and benefits of each alternative presented in this report and select a preferred land use alternative. The preferred land use alternative may be one of the alternatives or a combination of features from each alternative. The preferred land use alternative, along with community input and the City’s Vision Statement and Guiding Principles (prepared during Phase 4), will then guide the preparation of General Plan goals, policies, and implementation programs. Per the schedule, the main portion of the project (Comprehensive General Plan Update) will continue until mid-2025, with the Environmental Impact Report effort from spring 2025 through spring 2026, and the Comprehensive Development Code Update beginning in spring of 2025 extending to fall/winter 2026. Staff will continue to monitor the schedule to ensure that the timeline of the project components are maintained.
