TO: Arroyo Grande City Council
FROM: Garry Schmidt, Sunrise Terrace Budget and Finance Committee Secretary REGARDING: South County Sanitary Services (SCSS) Base Rate Increase Request The SCSS base rate increase request has been or will be received by Arroyo Grande in the near future.
I am writing to let you know what happened to Sunrise Terrace Mobilehome Park after you approved the rate increase last time on June 14, 2022. As you remember, it was a larger than normal increase, totaling 27%+ for the remainder of 2022. Without any written notification or explanation, as is required in the Franchise Agreement, SCSS imposed a 54% increase on our community. This was justified in their eyes by the change in the definition of a “Multi-Family Dwelling Unit” which was amended in the 2022 Franchise Agreement from what had existed up to that time. For all the years since 1996 that SCSS served our community up to August of 2022, we were billed at the “residential” rate. The 54% increase that we experienced was due to SCSS converting our community to the “commercial” rate. Please bear in mind that +55 mobile home parks are the most affordable options for people on fixed incomes, and that we are least able to pay these exorbitant rates. I am sure that you were not aware that this would happen to mobile home park residents when the park receives one bill for all residences in the park.
The “commercial” rate is 20% higher than the “residential” rate, and for our park this amounts to around $45,000 over the past three years. For each year going forward it will be over $20,000 a year, increasing each year. This is an amazing business practice when you consider that our mobile home park receives reduced service from SCSS compared to other residential neighborhoods. We do NOT have the benefit of the bi-annual cleanup day. Residents here do NOT have the option to go on extended vacation rates when absent for extended periods, which means that SCSS does NOT have to come to pick up trash bins and redeliver them when service is resumed. SCSS does NOT have to manage 300 individual bills and receives full payment for 300 residences in a single check each month. Even at “residential” rates SCSS would be making “bank” on us. YOU’D THINK A COMMUNITY SUCH AS OURS SHOULD BE BILLED LESS THAN NORMAL “RESIDENTIAL” RATES, but that is not the way SCSS chooses to see it after many futile efforts to appeal for rational thinking.
The only option given to us by SCSS to reduce costs is for 100% of our residents to set up individual billing. If we do that each Customer will be billed at the “residential” rate. Although this will be an inconvenience for many of our older, single residents, it is something that we must seriously consider.
In order to be fully informed on the pros and cons of this possible change there are some things that we need to know from the City. I have sent several questions to the Manager and Assistant Manager two times, without response. So, I am asking you for answers to these two questions: ONE, when do you expect to respond to the SCSS base rate increase request? Last time, in 2022, it was not processed until June 14, 2022, resulting in a temporary rate increase of 5% above the 22% for the remainder of the year. The answer to this question will help us prepare our budget for 2025, which must be distributed to our membership by December 1, 2024. SECOND, the AG City Code allows for more than one residence to share a trash bin, “subject to conditions established by the city”. (see
8.32.030 b). The question is, what are these conditions and how might they apply to Sunrise Terrace? Thank you for your consideration of these concerns and the answers to our pertinent questions.

MEMORANDUM
TO: City Council
FROM: Bill Robeson, Assistant City Manager/Public Works Director BY: Shannon Sweeney, City Engineer
SUBJECT: Notice of Award, 2024 Streets Repair Project, PW 2024-01 DATE: October 22, 2024
RECOMMENDATION:
1) Award a construction contract for the 2024 Streets Repair Project to Papich Construction, Inc. (Papich) for $3,999,889; and
2) Authorize the City Manager to approve change orders of 10% of the contract amount, $399,989.90, for unanticipated costs during the construction phase of the 2024 Streets Repair Project.
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
The FY 2024-25 budget includes $4,430,000 for the Pavement Management Program (PMP) consisting of the following funds: $390,000 of Regional SHA, $2,360,000 of the general fund, $450,000 of SB 1 Funds, $966,833 of Measure-O 2006 Local Sales Tax Fund, $204,207 of American Rescue Plan Act (ARPA), and $58,960 of CDBG.
Construction, contingency, and special materials testing costs total $4,495,083.90, which exceeds the FY 2024-25 budget of $4,430,000 by $65,083.90. Carryover from FY 2023- 24 of over $1 million in unspent funds is sufficient to address this shortfall and will be included in the FY 2024-25 First Quarter Financial Status Report.
BACKGROUND:
On May 23, 20231, the City Council directed staff to apply $3 million from excess reserves in addition to the base amount of $1.25 million to pavement maintenance and repair for FY 2024-25. Staff value engineered the information available in the 2022 PMP to provide a recommended list of work to be done with available funds. In addition to critical point strategy, staff considered other factors, including the cost efficiency of applying only one kind of maintenance treatment, the management and staging efficiency of focusing on

locations on a neighborhood-basis rather than a single street-basis, economies of scale that arise as a result of one large single project rather than multiple small ones, and the bidding competitiveness that occurs when the City bids a larger project.
On January 23, 20242, staff presented a priority project list of neighborhood-based street locations along with a commercial street (Station Way) that is in poor condition for the 2024 PMP. The recommended list from that staff report is shown below. Based on Council direction, staff proceeded with project development for the top four locations listed in Table 1.
Table 1: Recommended Priority List
The City worked with the design consultant to develop plans and specifications. The engineer’s estimate as designed was $4,617,934.18. A Notice Inviting Bids was issued on September 12, 2024. The Notice Inviting Bids was published in the local paper, posted on the City’s website, and distributed to plan rooms.
Five bids were received by the bid opening date and time of October 1, 2024, 2:00 PM, ranging from $3,999,899 to $5,894,610, as shown in Attachment 1. The low bid of $3,999,889 with a 10% contingency of $399,989.90 totals $4,399,888.90.
Five consultants from the City’s on-call list were solicited for scope and fee for special materials testing. Three declined to provide a proposal. The two proposals received by the deadline of October 1, 2024, ranged from $95,195 to $154,673.
ANALYSIS OF ISSUES:
Based on the costs presented in Table 1 for all four priority projects, costs would have exceeded the available budget by a substantial amount, with almost $1 million dedicated to retrofitting curb ramps to meet current Americans with Disabilities Act (ADA)

regulations. Staff evaluated curb ramps in the project areas and determined that most meet exception criteria that preclude the need to retrofit them. As a result, only 11 curb ramps will be retrofit as part of this project, at a considerable cost savings.
The 2024 Streets Repair project contract time is 20 working days for the work on Station Way, and concurrently, 80 working days for the entire project. Staff has had early contact with both property owners and businesses on Station Way. The intent is for reconstruction of Station Way to be completed well before construction of the Traffic Way Bridge, currently scheduled to begin in April 2025.
Due to timing constraints associated with Station Way for the Traffic Way Bridge Project, efforts to reduce the overall costs of the Project through methods such as economies of scale with neighboring jurisdictions were unable to be reached. However, staff will continue to communicate with neighboring jurisdictions for opportunities to partner on these efforts to potentially further reduce costs in the future.
ALTERNATIVES:
The following alternatives are provided for the Council’s consideration:
A. Staff’s recommendation:
1) Award a construction contract for the 2024 Streets Repair Project to Papich Construction, Inc. (Papich) for $3,999,889; and
2) Authorize the City Manager to approve change orders of 10% of the contract amount, $399,989.90, for unanticipated costs during the construction phase of the 2024 Streets Repair Project;
B. Do not approve staff’s recommendations and request further information; C. Modify staff’s recommendation and approve; or
D. Provide other direction to staff.
ADVANTAGES:
Completing the 2024 Streets Repair Project will extend the service life of the treated street segments, reduce future costs and provide a smoother safer driving surface. New striping will be installed, which will provide safer driving facilities.
DISADVANTAGES:
There will be traffic impacts to the traveling public during construction. Staff will require traffic control to be in place during construction to minimize the impacts. The traveling public, neighborhoods, and the businesses on Station Way will be given advanced notice of the work. City and consultant inspectors will be at the site during construction to adjust the traffic control as needed (driveway access, etc.).
ENVIRONMENTAL REVIEW:
The project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline Section 15301 covering the repair and maintenance of

SUBJECT: Accept the 2022 Street Repairs Project PW 2022-05 DATE: October 22, 2024
RECOMMENDATION:
1) Accept improvements as constructed by JJ Fisher Construction, Inc., in accordance with the specifications for the 2022 Street Repairs Project, PW 2022-05; 2) Direct staff to file a Notice of Completion; and
3) Authorize release of retention thirty-five (35) days after the Notice of Completion has been recorded if no liens have been filed.
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
The original bid price for this project was $3,782,005. Field change orders (contingency costs) of $113,519.89, approximately 4% of the total project, were expended to address additional features that were deemed necessary but were not included in the original project. The final contract and change orders totaled $3,895,524.89.
The total amount billed, including retention, was $3,602,807.38, which is less the total contract amount. The $292,717.51 in unspent funds was due to lower material unit quantities than estimated, and unused allowances such as vegetation removal.
BACKGROUND:
On April 11, 20231, the City Council approved construction plans and specifications, authorized the solicitation of bids, and provided environmental determination for the 2022 Street Repairs Project. On June 13, 20232, the City Council awarded a construction contract for the 2022 Street Repairs Project to JJ Fisher Construction, Inc. This project was deemed substantially complete on July 2, 2024.

Accept the 2022 Street Repairs Project PW 2022-05
October 22, 2024
Although the project was deemed substantially complete on July 2, 2024, there were numerous punch list items at that time that needed to be resolved. City staff and the contractor conferred several times to come to resolution on those remaining items. The contractor ultimately accepted responsibility of the punch list items involving debris removal from manholes and valve cans and completed that work to the City’s satisfaction on October 7, 2024.
ALTERNATIVES:
The following alternatives are provided for the Council’s consideration:
1. Accept the 2022 Street Repairs Project and authorize release of retention;
2. Do not accept the project;
3. Provide other direction to staff.
ADVANTAGES:
The project is complete and accepting the improvements allows staff to close out the project.
DISADVANTAGES:
No disadvantages have been identified in accepting this project.
ENVIRONMENTAL REVIEW:
On April 11, 20233the City Council found that the project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Guidelines Section 15301(c), a Class 1 exemption covering the repair and maintenance of existing highways, streets and sidewalks, as it consists of a plan for the repair of existing streets without an expansion of use, and found none of the exceptions to the Class 1 Exemption applied, and directed the City Clerk to file a Notice of Exemption at that time.

SUBJECT: General Plan Update Progress Report – October 2024 DATE: October 22, 2024
RECOMMENDATION:
Receive an update on the status of the Comprehensive General Plan Update project.
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
The financial and personnel impacts associated with this progress report are included in the budget for the Comprehensive General Plan Update.
BACKGROUND:
On September 22, 20241, staff provided the first regular update to the City Council on the status of the Comprehensive General Plan Update project in a staff report. That report described the project scope, previously completed phases, and upcoming tasks.
ANALYSIS OF ISSUES:
The current phase of the project consists of evaluating and developing land use alternatives for growth over the life of the new General Plan. A meeting with the consultant team occurred on October 3, 2024, to establish milestones and deliverables that will be produced during this phase of the project.
An online mapping exercise will be made available to the public the week of October 21, 2024. Respondents will be asked to identify areas, or specific sites, within the City where land use changes are appropriate and areas where growth should, or should not, occur.
Changes may include increases in residential density, changes in land uses (residential, commercial, institutional, etc.), or development intensity. Staff is also investigating opportunities for additional public engagement, such as a pop-up at the Soto Sports Complex, and/or another round of mailers to solicit community engagement.

General Plan Update Progress Report – October 2024
October 22, 2024
The information gathered through the online exercise and other community engagement will generate initial land use alternative scenarios. These growth alternatives will be presented to the public at a community workshop in February. A digital survey will be available to collect community input from those that are unable to attend the in-person workshop. The feedback received from the workshop and online survey will inform the Alternatives Report that will be presented to Planning Commission and City Council for adoption.
At the conclusion of the activities planned for this phase, the land use alternatives will be presented to Planning Commission for a recommendation, then ultimately to City Council to select a preferred land use alternative. The preferred land use alternative will shape the land use map and guide the preparation of General Plan goals, policies, and implementation programs.
General Plan Citizen Advisory Group (GPCAG)
On Monday, October 7, 2024, the GPCAG met and staff provided an overview of the project, what has been accomplished thus far, and described the upcoming tasks. Staff also explained that the GPCAG will be tasked with reviewing administrative drafts of deliverables and will be consulted during initial policy development.
ALTERNATIVES:
The following alternatives are provided for the Council’s consideration:
1. Receive an update on the progress of the Comprehensive General Plan Update; or
2. Provide other direction to staff.
ADVANTAGES:
Regular updates to the City Council will inform decision makers and the community on the status of the project.
DISADVANTAGES:
None identified.
ENVIRONMENTAL REVIEW:
No environmental review is required for this General Plan Update. An EIR will be necessary to evaluate the potential impacts of the update and has been included in the scope of work.

MEMORANDUM
TO: City Council
FROM: Matthew Downing, City Manager
BY: Brian Pedrotti, Community Development Director
SUBJECT: Consider Commitment of Grant Authorization to Housing Authority of San Luis Obispo, for Additional Funding of a 63-Unit Affordable Housing Project at 700 Oak Park Blvd
DATE: October 22, 2024
RECOMMENDATION:
Adopt a Resolution to:
1) Provide a commitment by the City of Arroyo Grande for a grant from the City’s Affordable Housing Trust Fund, to the Housing Authority of San Luis Obispo (HASLO) for the design, funding, construction and management of a 100% affordable housing project in the City of Arroyo Grande;
2) Authorize a budget adjustment request in a not-to-exceed amount of $630,000 from the Affordable Housing Trust Fund; and
3) Authorize the City Manager to negotiate a grant agreement and any other associated documents, between the City and HASLO, establishing the terms of the grant for a total commitment and not-to-exceed amount of $630,000.
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
The fiscal impact of approving the attached Resolution and contemplated, corresponding documents, for a grant amount of $630,000 in FY 2024-2025, will be 100% funded from the City’s Affordable Housing Trust Fund. The current balance of the City’s Affordable Housing Trust Fund is approximately 858,600.
BACKGROUND:
On May 18, 20211, the Planning Commission approved an application from the Housing Authority of San Luis Obispo (HASLO) for Conditional Use Permit 21-001 and Lot Merger 21-001 for a mixed-use development consisting of 63 multi-family residential units, a 1,342 square-foot community room, and 1,178 square feet of commercial space. All of the units would be reserved for lower-income households in perpetuity. The project also

includes outdoor recreational space with a barbeque area and children’s playground near the remaining grove of oak trees near the eastern portion of the project site for the residents of the development. The 63 dwelling units are proposed in three (3) separate, three-story buildings. Two (2) of the buildings would be located along the El Camino Real frontage and one (1) along the Chilton Street frontage. Construction documents have been submitted and are currently in the review process. During the plan review process, HASLO submitted a request for a contribution from the City’s Affordable Housing Trust Fund to assist with defraying construction costs. Arroyo Grande Municipal Code (AGMC) Section 16.80 implements the City’s Inclusionary Housing Ordinance and establishes the regulations and administration of the Affordable Housing Trust Fund. Affordable housing requirements apply to residential projects proposing two or more housing units, not including the projects consisting of a single-family residence and an accessory dwelling unit. Projects subject to the inclusionary housing ordinance have the option of reserving a percentage of the proposed units for lower income households or paying the affordable housing in-lieu fee. The in-lieu fee is equal to five percent (5%) of the construction valuation. All affordable housing in-lieu fees are deposited into the Affordable Housing Trust Fund – Fund 232 for Budgetary purposes. The Municipal Code states the purpose of the Affordable Housing Fund is “solely to increase the supply of affordable housing units. Funds in the affordable housing trust fund may be used to better facilitate the improvement of the city's affordable housing stock as well as the provision of new affordable units.”
On July 25, 20232, Council approved a Development Review and Impact Fee Grant allocation from the Affordable Housing Trust Fund in a not-to-exceed amount of $448,370.37 to support the development of HASLO’s affordable housing project consisting of 63 affordable multi-family units located at 700 Oak Park Blvd. A breakdown of the permit fees for this project that City Council approved on July 25, 2023, is provided in Table 1 below:
Table 1: Breakdown of Permit Costs
Plan Review $33,620.92
Inspection $39,744.22
Utilities $261,070
Development Impact Fees $110,927.23
State Mandated Fees $3,008
Total $448,370.37
ANALYSIS OF ISSUES:
Due to rising interest rates and inflationary increases that have occurred since the project was approved in 2021, HASLO continues to face a funding gap of approximately $1 million to construct this project. See Attachment 2 for the funding request letter from

HASLO. The request from the Affordable Housing Trust Fund would cover a significant portion of the funding gap to allow construction of the project, and ultimately, get local residents into affordable units. HASLO will also be applying for Low Income Housing Tax Credit funding from the State for this project. The tax credit funding is highly competitive and projects that are able to secure and leverage the most local funding tend to be awarded State funding. HASLO has informed the City that to secure additional tax funding, they need to close on the property no later than November 20th of this year, and are seeking additional funds before that time to increase the likelihood they make up the remaining budget shortfall with additional tax credit funding.
Process
HASLO submitted a letter formally requesting a contribution from the Affordable Housing Trust Fund to cover the funding gap in order to begin construction on this project (Attachment 2). A contribution from the Affordable Housing Trust Fund will not only directly benefit the project by reducing the financial burden to construct the project, it may also prove to be critical to secure additional State funding. The Community Development Director is responsible for the general administration of the Affordable Housing Fund, and pursuant to the regulations adopted by City Council. Formal procedures and policies for the disbursement of funds from the Affordable Housing Trust Fund have not been established, so for the purposes of this project, staff is requesting that Council provide direction authorizing the City Manager, in consultation with the City Attorney, to develop a grant agreement and any related documents in a not-too-exceed amount of $630,000, with required conditions and consistent with applicable law.
ALTERNATIVES:
The following alternatives are provided for the Council’s consideration:
1. Adopt a Resolution to: 1) Provide a commitment by the City Council of Arroyo Grande for a grant from the City’s Affordable Housing Trust Fund, to the Housing Authority of San Luis Obispo (HASLO) for the design, funding, construction and management of a 100% affordable housing project in the City of Arroyo Grande; 2) Authorize a budget adjustment request in a not-to-exceed amount of $630,000 from the Affordable Housing Trust Fund; and 3) Authorize the City Manager to negotiate a grant agreement and any other associated documents, between the City and HASLO, establishing the terms of the grant for a total commitment and not-to-exceed amount of $630,000;
2. Do not adopt the Resolution; or
3. Provide other direction to staff.
ADVANTAGES:
A loan from the Affordable Housing Trust Fund will support the construction of a 63-unit housing development for lower income households and help the City meet its RHNA target for new affordable units.
Item 9.g.
City Council
Consider Commitment of Grant Authorization to Housing Authority of San Luis Obispo, for Additional Funding of a 63-Unit Affordable Housing Project at 700 Oak Park Blvd
October 22, 2024
DISADVANTAGES:
The allocation of funding to this project will reduce the balance of the Affordable Housing Trust Fund, making those funds unavailable to other projects. However, the City has no current requests from this fund, has only received one recent request from this fund in 2017, and staff is unaware of any other current projects that are eligible to receive an allocation from this fund.
ENVIRONMENTAL REVIEW:
In compliance with the California Environmental Quality Act (CEQA), the proposed grant agreement of funds from the Affordable Housing Fund does not qualify as a “project” under CEQA because the action will not result in a direct or reasonably foreseeable indirect physical change in the environment. (State CEQA Guidelines section 15060, subd. (c)(2), (3).) Section 15378 of the State CEQA Guidelines defines a project as the whole of an action, which could potentially result in either a direct physical change, or reasonably foreseeable indirect physical change, in the environment. Here, the action of disbursing the funding will not in itself result in any construction or development, and it will not have any other effect that would physically change the environment. The action therefore does not qualify as a project subject to CEQA. The project itself was granted a categorical exemption when it was approved in 2021. This disbursement of funds will not affect this prior determination.

RECOMMENDATION:
Receive an update on the status of the Active Transportation Plan (ATP).
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
The City’s contract with KTUA for preparation of the ATP is $249,744. The City received a Sustainable Transportation Planning Grant (STPG) in the amount of $221,325 and the remaining $28,675 comes from the Measure O-2006 Local Sales Tax Fund. The ATP was included in both the FY 2022-23 and FY 2023-24 Capital Improvement Program (CIP) budget.
BACKGROUND:
The State of California established its Active Transportation Program by Senate Bill 99 (Chapter 359, Statutes of 2013) and Assembly Bill 101 (Chapter 354, Statutes of 2013) to encourage the increased use of active modes of transportation, such as walking and biking. The State Active Transportation Program consolidates existing federal and state transportation programs, including the Transportation Alternatives Program, Bicycle Transportation Account, and State Safe Routes to School, into a single program with a focus on making California a national leader in active transportation.
The California Active Transportation Program provides the largest source of grant funding for bicycling and walking projects for California cities. Cities that have an Active Transportation Plan increase their chances for success in securing these highly competitive grant funds. On April 4, 2022, the City received a conditional letter of award for the STPG funding in the amount of $221,325. On June 28, 20221, the City Council authorized the Community Development Director to execute the necessary agreements for the STPG to allow City staff to complete the necessary conditions of grant approval

and move forward retaining a consultant to prepare the ATP. On June 13, 20232, the City Council approved a consultant services agreement with KTUA to assist staff with preparation of the ATP.
ANALYSIS OF ISSUES:
The ATP is being developed to provide the City with a guidebook for making the community a safe and comfortable place to walk, roll, and ride. The ATP includes an inventory of existing bicycle and pedestrian infrastructure, identifies key gaps and safety needs, and proposes recommendations for improvement. The recommendations to be included in the ATP are both physical and programmatic and are meant to improve active transportation infrastructure, promote walking, rolling, and bicycling in Arroyo Grande.
The recommendations are also meant to create viable travel options to support the existing and future population. The ATP will address these issues through the following activities:
1. Identify gaps and barriers, both perceived and actual, in the existing active transportation network.
2. Engage with the community to gather local knowledge on existing challenges and opportunities.
3. Analyze the existing infrastructure around activity centers such as parks, schools, employment, and commercial centers to determine appropriate solutions.
4. Develop a list of prioritized projects that improve the active transportation facilities along key corridors.
5. Create programmatic recommendations that promote walking, rolling, and bicycling as viable transportation modes.
6. Provide the City with a clear framework for implementation that can be used to pursue future grant and funding opportunities.
Community Engagement
City staff and the consultant team prioritize community input and participation throughout the project. Two community workshops, three pop-up events, five stakeholder working group meetings, and an online survey were included in the project’s scope of work. All but the fifth and final working group meeting have taken place, which is anticipated for mid to late November. The community was engaged to solicit input on the existing conditions and needs assessment, opportunity areas for active transportation infrastructure, and initial recommendations.
Draft Recommendations
An analysis of the proposed active transportation projects identified the corridors in the City that should be prioritized when considering future infrastructure improvements for active transportation. The prioritization analysis was based on several criteria related to proximity to key destinations such as schools and transit, community input, collision data, demographic data, and many others. The weight assigned to each criterion was

developed by the consultant and staff and refined by the stakeholder working group. The ATP will include conceptual designs for three corridors identified by the prioritization analysis: E. Grand Avenue, Fair Oaks Avenue, and Elm Street. Having these corridors identified in the ATP will benefit the City in the pursuit of future grant funding opportunities.
Each of these corridors is unique and offers ample opportunities for improvement with the addition of infrastructure for active transportation. E. Grand Avenue is the City’s major commercial corridor and has several transit stops and a high number of collisions. During community engagement there was a substantial community desire to improve this corridor. Both Fair Oaks Avenue and Elm Street serve as arterials through the City and provide connections to schools and parks, which would greatly benefit from improvements to aid active transportation.
Next Steps
Staff and the consultant will continue to progress with the draft ATP ahead of a recommendation hearing with Planning Commission in December prior to City Council adoption in January.
ALTERNATIVES:
The following alternatives are provided for the Council’s consideration:
1. Receive an update on the status of the ATP; or
2. Provide other direction to staff.
ADVANTAGES:
Receiving a project update on the status of the project is beneficial for the City Council and the public because it will increase familiarity with the project ahead of the proposed adoption in early 2025.
DISADVANTAGES:
None identified.
ENVIRONMENTAL REVIEW:
This Council update is not a project subject to the California Environmental Quality Act (“CEQA”) because the update itself has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, §§ 15060, subd. (c)(2)-(3), 15378). However, the City and consultant will evaluate potential impacts of the Active Transportation Plan in compliance with the California Environmental Quality Act, and prepare any appropriate environmental document at that time, if required.
PUBLIC NOTIFICATION AND COMMENTS:
The Agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2.
