MEMORANDUM
TO: City Council
FROM: Nicole Valentine, Director of Administrative Services SUBJECT: Resolution to Update Accounting Manager Name for Authorized Personnel for Financial Institutions
DATE: February 25, 2025
RECOMMENDATION:
1) Adopt a Resolution authorizing the deposit of City funds in various financial institutions and updating the names of designated employees in certain positions who are authorized to make deposits of City funds and enter into banking or investment arrangements; and 2) Determine that adopting a resolution authorizing the deposit of City funds in various financial institutions and updating the names of designated employees in certain positions who are authorized to make deposits of City funds and enter into banking or investment arrangements is not subject to the California Environmental Quality Act (“CEQA”) because it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, Cal. Code Regs., tit. 14, §§ 15060, subd. (c)(2)-(3), 15378.)
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:

There are no significant financial or personnel resource impacts to updating the Resolution.

BACKGROUND:

In 2024, the City Council adopted Resolution No. 5343, which authorized the deposit of City funds in various financial institutions and authorized certain employees to act on behalf of the City in banking or investment relationships. Since that time, the Resolution has been updated as position titles and banking regulations have changed.

ANALYSIS OF ISSUES:

Regulations for the banking industry require that the City’s Resolution authorizing employees to act on behalf of the City in banking and investment relationships include the names of the employees currently serving in the position, rather than just the titles.

The City hired a new Accounting Manager, who began work with the City on February 18, 2025. The proposed Resolution adds the Accounting Manager’s name and makes no other changes.

Item 9.b.

City Council
Resolution to Update Accounting Manager Name for Authorized Personnel for Financial Institutions
February 25, 2025

Page 2 ends

ALTERNATIVES:

The following alternatives are provided for the Council’s consideration:

1. Adopt the Resolution as presented;

2. Modify and adopt the Resolution; or

3. Provide other direction to staff.

ADVANTAGES:

Updating the Resolution will reflect the current names of persons authorized to enter into banking and investment relationships for the City and provides documentation compliant with banking regulations.

DISADVANTAGES:

There are no disadvantages in relation to the recommended action.

ENVIRONMENTAL REVIEW:

Adopting a resolution authorizing the deposit of City funds in various financial institutions and updating the names of designated employees in certain positions who are authorized to make deposits of City funds and enter into banking or investment arrangements is not subject to the California Environmental Quality Act (“CEQA”) because it has no potential to result in either a direct, or reasonably foreseeable indirect, physical change in the environment. (State CEQA Guidelines, Cal. Code Regs., tit. 14, §§ 15060, subd. (c)(2)- (3), 15378.)
PUBLIC NOTIFICATION AND COMMENTS:

The Agenda was posted at City Hall and on the City’s website in accordance with Government Code Section 54954.2.

MEMORANDUM
TO: City Council
FROM: Bill Robeson, Assistant City Manager/Public Works Director BY: Shane Taylor, Utilities Manager
SUBJECT: Monthly Water Supply and Demand Update
DATE: February 25, 2025
RECOMMENDATION:

Receive and file the Monthly Water Supply and Demand Update.

IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:

Approximately two (2) hours of staff time is required to prepare the report.

BACKGROUND:

The City of Arroyo Grande’s water entitlements are calculated on a water year that begins April 1st. The current water supply for water year 2024/2025 includes 2,290 Acre Feet from Lopez Reservoir, the current modeled, safe yield is 357 Acre Feet of groundwater from the Santa Maria River Groundwater Basin, with an entitlement of 1,323 Acre Feet.

An additional 160 Acre Feet of groundwater is available from the Pismo formation.

The predicted water use for the 2024/2025 water year is 2,100 Acre Feet.

The monthly water use for the City in January 2025 was 156.2 Acre Feet. Attachment 3 has been revised to show the comparison of the previous year’s use. February 2023 through January 2024 vs. the current years use, February 2024 through January 2025.

The increase is directly related to rainfall totals over the two years.

The per capita monthly water use for January 2025 is 91 gallons per day/per person. The residential per capita use was 71 gallons per day/per person. There was a total of 0.2 inches of rainfall in the City in January 2025.

ANALYSIS OF ISSUES:

The United States Drought Monitor, as of February 6, 2025, shows San Luis Obispo County is in moderate drought. Rainfall for the period of July 1, 2024, through February 6, 2025, is 4.5 inches at the Corporate Yard rain gauge. Lopez Lake is 91.2% as of February 10, 2025.

Item 9.d.

City Council
Monthly Water Supply and Demand Update
February 25, 2025

Page 2 ends

The deep well index for the first quarter of 2025 was completed on January 22, 2025, and is 10.78 feet above sea level, which is 3.28 feet above the threshold valve. The current deep well index is 0.73 feet lower than October 2024, and 1.55 feet lower than January 2024.

On January 15, 2025, in response to a preliminary injunction issued by the United States District Court to the County of San Luis Obispo, Lopez Lake downstream releases were increased from 2.0 million gallons per day to 5.1 million gallons per day. The County is preparing updated projections that reflect the increased release rate. The impact on Lopez Lake storage with this release level will be shown in next month's Monthly Water Supply and Demand Report to the Council.

The increased release rate does not currently impact the City's contract entitlement (how much water the City receives) from Lopez Lake. The County has appealed the preliminary injunction. The City and all other Zone III contractors will work with the County to assess and report the impacts on our water supply from Lopez Lake until the litigation is resolved.

ALTERNATIVES:

The following alternatives are provided for the Council’s consideration:

1. Receive and file the report, or

2. Provide other directions for staff.

ADVANTAGES:

The report provides the City Council and the public with the current and projected conditions of our water supply and demand.

ENVIRONMENTAL REVIEW:

No environmental review is required for this item.

MEMORANDUM
TO: City Council
FROM: Brian Pedrotti, Director of Community Development BY: Andrew Perez, Planning Manager
SUBJECT: General Plan Update Progress Report – February 2025 DATE: February 25, 2025
RECOMMENDATION:

Receive and file a progress report on the Comprehensive General Plan Update.

IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:

The financial and personnel impacts associated with this progress report are included in the budget for the Comprehensive General Plan Update.

BACKGROUND:

The most recent progress report was provided for the City Council on January 28, 20251.

That report described the activities planned for the land use alternatives phase of the project and explained how the three main focus areas that are being analyzed as potential growth opportunities were identified.

ANALYSIS OF ISSUES:

Since the last progress report, a community workshop was held on Wednesday, February 5, 2025. The purpose of the workshop was to gather community input on the four land use alternatives created based on community feedback gathered throughout the project up to this date. The four alternatives are:
 Alternative 1: Existing General Plan
 Alternative 2: Infill Focus
 Alternative 3: Residential and Complementary Uses Focus  Alternative 4: Commercial Focus

Item 9.e.

City Council
General Plan Update Progress Report – February 2025
February 25, 2025

Page 2 ends

Alternative 1 serves as a baseline scenario because no changes to existing land uses are proposed. Alternative 2 focuses on increasing density in areas that are already developed within the city, while preserving existing open space and agricultural areas. Alternative 3 identifies existing agricultural parcels within city limits as opportunities for growth and residential development. Finally, Alternative 4 prioritizes expanding opportunities for commercial and job-generating development and contemplates development of existing agricultural parcels. The expected outcomes of each alternatives on population, housing development, and job creation are described in greater detail in the Land Use Alternatives Memorandum2.

The input gathered from the workshop will be used to develop a preferred land use alternative scenario that will be presented to the Planning Commission for its consideration in March. The Planning Commission’s preferred land use alternative will be presented to the City Council in April for consideration and approval. The Planning Commission and City Council may select preferred features from any of the four alternative scenarios to create a hybrid alternative as the preferred land use scenario, which is a common action in comprehensive General Plan updates. The land use alternative approved by the City Council will then serve as the foundation for the General Plan land use map and subsequently the goals, policies, and implementation programs for each of the elements.

City Council’s selection of a preferred land use alternative will conclude this phase of the project. The next phase of the project consists of updating each element by developing the goals, policies, and implementation strategies that serve as the blueprint for future development. A series of public workshops are scheduled for this phase to continue the effort to maximize public engagement and participation in the update process. This phase will culminate with release of the public review draft of the General Plan in late 2025. A project schedule is included as Attachment 1.

ALTERNATIVES:

The following alternatives are provided for the Council’s consideration:

1. Receive and file this progress report on the Comprehensive General Plan Update; or

2. Provide other direction to staff.

ADVANTAGES:

Regular updates to the City Council will inform decision-makers and the community on the status of the project.

DISADVANTAGES:

None identified.

MEMORANDUM
TO: City Council
FROM: Bill Robeson, Assistant City Manager/Director of Public Works BY: Shannon Sweeney, City Engineer
SUBJECT: Halcyon Complete Streets Design Discussion
DATE: February 25, 2025
RECOMMENDATION:

Review and provide direction on specific aspects of the 30% design of the Halcyon Complete Streets Project.

IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:

The Halcyon Complete Streets Project (the “Project”) is being funded with $8,169,000 from the State Active Transportation Program (ATP) and $749,000 from the San Luis Obispo Council of Governments (SLOCOG) for a total of $8,918,000 in grant funding.

This grant funding is further broken down as follows:
 Design and right-of-way: $1,304,000
 Construction: $6,765,000
 Non-infrastructure activities: $100,000
$749,000 was budgeted in Fiscal Year 2024-25 for the design and right-of-way tasks that are anticipated to be completed this fiscal year. The remaining funds will be budgeted next year to complete design and right-of-way acquisition and begin construction, which is anticipated to begin March 2026.

Additional funding is available through the City’s Development Impact Fees (DIF) to fund 50% of the roundabout at the Halcyon Road/Fair Oaks Avenue intersection. In addition, approximately $120,000 of grant funds allocated to right-of-way activities can be transferred to construction.

Item 11.a.

City Council
Halcyon Complete Streets Design Discussion

Page 2 ends

Current construction estimates are as follows:

Item Grant Estimate 30% Design Estimate
Pavement treatment $1,429,132 $3,671,000
Testing/Construction Management $645,200 $367,100
Halcyon/Fair Oaks roundabout $941,298 $1,577,000
Halcyon/Grand traffic signal $627,500 $800,000
Storm Drain line $170,000 $170,000
Curb ramps $175,170 $576,000
Sidewalk gaps $40,985 $165,600
Sidewalk repair $265,814 $266,000
Bicycle green paint $0 $161,250
Striping/signs $167,445 $362,900
Mobilization, traffic control, etc. $1,678,055 $1,623,370 Total $6,140,599 $9,740,220
Current funding is summarized as follows:

Source Amount
ATP Grant $6,765,000
SLOCOG $749,000
DIF $788,500
ATP Grant Transfer $120,000
Total $8,422,500
The difference between the 30% design estimate and current available funding is $1,318,000. The largest difference between the 30% design estimate and the grant application is due to the increase in the type of pavement treatment. The original pavement assessment assumed a slurry seal treatment; however, deflection testing performed as part of the 30% design revealed that the appropriate treatment is a more intensive overlay.

Because one of the top priorities identified by the community for the use of Measure E24 revenue is pavement maintenance, and adequate funds will be available from Measure E-24 sales tax revenue to address this shortfall, this may be an appropriate source to address this issue. The use of Measure E-24 revenue will not represent a budget adjustment itself, and the Council is not being asked to approve any major amendments to the Project at this time. This additional $1.3M will be reviewed and incorporated through the CIP Budget process.

BACKGROUND:

The City obtained grant funding for the Halcyon Complete Streets Project through the State ATP. The stated purpose of the Project is to “transform Halcyon Road from a vehicle-centric facility to a welcoming environment that will provide for safe mobility and

Page 3 ends

accessibility, connecting people by enhancing the built environment for all modes of travel.” The Project conceptual design was initiated in 2015 and completed in 2023.

City Council approved a contract with North Coast Engineering (NCE) to develop plans, specifications, and an engineer’s estimate (PS&E) on June 25, 20241. NCE has been working with City staff to convert the conceptual plans into construction documents.

City Council approved the City of Arroyo Grande Circulation Element on July 27, 20212, the Halcyon Complete Streets Conceptual Design on July 25, 20233, and the Active Transportation Plan on January 28, 20254. All three documents help inform staff of the Council’s desires for improvements on Halcyon Road. Where these plans require additional guidance or harmonization, staff seeks City Council input. The recommendations are consistent with the grant funding.

ANALYSIS OF ISSUES:

Halcyon Road is classified as an arterial street. This type of street serves to connect areas of major activity within the urban area and function primarily to distribute cross-town traffic from freeways/highways to collector streets. The Circulation Element also recommends that these types of high-traffic volume arterial streets be 86 feet wide and contain 10-foot sidewalks and Class II or IV bikeways. Halcyon Road right-of-way ranges from 54 to 78 feet. This street width is inadequate to accommodate all desired features. To maximize the use of the Halcyon Road corridor for the greatest number of transportation modes, including vehicles, pedestrians, and cyclists, staff recommends minimum 6-foot sidewalks, minimum 11-foot vehicle lanes, and minimum 5-foot Class II bicycle lanes, with a three-foot Class II buffer where possible.

Vehicle Modifications
Vehicle Lane Width
Vehicle traffic lane widths along Halcyon Road range from 9.0 to 25.5 feet wide. Narrower lanes help calm traffic. When roadways are improved, State law requires a minimum of 10-foot vehicle lanes. 11-foot minimum lanes are recommended for truck routes. Since Halcyon Road is a truck route, staff recommends a minimum of 11-foot vehicle lanes.

Lane narrowing is listed as one of the grant objectives and is consistent with the Halcyon Complete Streets Plan (the “Plan”).

Page 62 of 89 ends

Item 11.a.

City Council
Halcyon Complete Streets Design Discussion
February 25, 2025

Page 4 ends

Road Diet
A road diet consists of reducing the number of vehicle lanes on a roadway. The number of vehicle lanes on Halcyon Road ranges from one to two in each direction. Staff recommends reducing the number of vehicle lanes to one lane in each direction for the entire road length, which is supported by all City planning documents. A road diet is listed as one of the grant objectives and is consistent with the Plan.

On-street parking
On-street parking is provided at some locations along Halcyon Road. All planning documents and the grant are silent on on-street parking except for the Circulation Element, which recommends “high turnover.” The on-street parking on North Halcyon Road traveling southbound towards Grand Avenue cannot accommodate both a Class II bicycle lane and on-street parking. Staff recommends eliminating on-street parking along this section. This will result in impacts to the cemetery, the First Methodist Church of Arroyo Grande, Pacific Telephone and Telegraph Company, and six commercial properties, all of which appear to have on-site parking.

Halcyon Road and Fair Oaks Avenue Intersection
An improved signalized intersection and a roundabout were both evaluated for this intersection. The roundabout is estimated to cost approximately $700,000 more than replacing the traffic signal. A roundabout at the Halcyon Road and Fair Oaks intersection is supported by all City Planning documents and is a grant objective. Staff recommends pursuing this roundabout.

Halcyon Road and Grand Avenue Intersection
An improved signalized intersection and a roundabout were both evaluated for this intersection. Too much right-of-way acquisition is expected to be able to accommodate a roundabout at this intersection and therefore is not practical. The roundabout at this location is not a grant objective and planning documents are silent on it. Staff does not recommend pursuing this roundabout on this project.

Bicycle Improvements
Bicycle Box
A bicycle box is a painted green square in an intersection that helps bicycle riders navigate left turns by providing a location in the intersection where they can travel forward on a green light, then turn 90° counterclockwise to set up for traveling forward on the cross street’s next green cycle. The ATP and the Plan both include this improvement, though not included as a grant objective. While this improvement results in greater perceived safety, it is not recommended in all scenarios. Staff does not recommend adding bicycle boxes to this project.

Page 63 of 89 ends

Item 11.a.

City Council
Halcyon Complete Streets Design Discussion
February 25, 2025

Page 5 ends

Bicycle Lanes
Recommended bicycle lane types along Halcyon Road differ depending on the planning document referenced. At this stage of the Project, staff recommends Class II bicycle lanes across the entire project, buffered when practicable where road width will accommodate the additional spacing requirements. On North Halcyon, this may require narrowing the existing sidewalk from 7.2 feet to 6 feet. Installing bicycle lanes the entire length of Halcyon Road in both directions is a grant objective. Note that this will require eliminating some on-street parking, as discussed above.

Green Paint Bike Lanes
Green paint at conflict points for greater bicycle path visibility through intersections is recommended along Halcyon Road in all City planning documents except the Circulation Element, which is silent on this topic. Green paint application is estimated at $30 per square foot and the cost to apply green paint across all intersections is estimated at $161,250. While this is a grant objective, the grant application did not include funds for this item. Additional funding beyond what is currently available to accommodate the street overlay will enable grant funding to cover the cost of the green paint. Since it is a grant objective, staff recommend that it be included in the project so as to not jeopardize the grant funding.

Pedestrian Improvements
Sidewalk Deficiencies Due to Trees
A recent survey of the sidewalk along Halcyon Road identified 92 irregularities such as panel uplifting and cracking. Twenty-eight of the sidewalk panel uplifting irregularities were caused by the root systems of large existing trees that are not an appropriate street tree species; are too large for the tree well and will continue to destroy the curb gutter and sidewalk, and cause significant safety and tree fall hazards. Attachment 1 shows photos of each of these locations. Several photos show that these segments have previously been replaced without removing the tree (root pruning and root barriers) but over just a few year period, the roots grow and uplift the newer sidewalk. City staff recommends that the Council permit staff to evaluate each location and remove and replace trees as appropriate to protect new sidewalk from future damage and to help maintain sidewalks for safe pedestrian use.

ALTERNATIVES/ADVANTAGES/DISADVANTAGES:

The following recommendations are provided for the Council’s consideration:

Item Staff Recommendation
Pavement Treatment Overlay
Minimum lane widths 11-foot vehicle lanes, 6-foot sidewalks, 5-foot Class II bicycle lanes 5 feet, with 3-foot buffer where practicable Road diet One vehicle lane in each direction

ENVIRONMENTAL REVIEW:

On July 25, 20235, the City Council adopted an MND for the Halcyon Complete Streets Project. The MND analyzed the environmental impacts of the Project in compliance with CEQA. Proceeding with design of the Project will have no direct or indirect physical impacts and does not constitute a substantial change to the Project such that revisions to the previously adopted MND are required. Thus, none of the conditions requiring subsequent environmental review called out in State CEQA Guidelines section 15162 or Public Resources Code section 21166 are present, and no further environmental review is required.

MEMORANDUM
TO: City Council
FROM: Matthew Downing, City Manager
Bill Robeson, Assistant City Manager/Director of Public Works Jessica Matson, Director of Legislative & Information Services/ City Clerk
SUBJECT: Direction on the Establishment of a Measure E-24 Citizen Sales Tax Oversight Committee
DATE: February 25, 2025
RECOMMENDATION:

Discuss and provide direction regarding the creation of a Citizen Sales Tax Oversight Committee to review the annual revenue and expenditure report before presentation to the City Council, and which is mailed to the residents, on the allocation and use of sales tax revenues collected through Measure E-24.

IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:

There are no immediate fiscal impacts associated with the creation of a Citizen Sales Tax Oversight Committee. Personnel impacts include time spent administering the Committee.

BACKGROUND:

In November 2024, voters in the City of Arroyo Grande approved Transactions and Use/Sales Tax Measure E-24 (E-24)1that increased the local sales tax rate in Arroyo Grande by one percent to 8.75%. Arroyo Grande voters passed Measure E-24 to generate revenue to fund many of the key priorities of the community and the City Council.

The measure is estimated to generate approximately $6 million annually.

As part of the City’s commitment to transparency and accountability, E-24 included language regarding citizen oversight. Although not required by the language of the Measure itself, a Citizen Sales Tax Oversight Committee (CSTOC, or Committee) is one approach by which oversight can be accomplished. This committee could review the annual reports of E-24, advise and provide feedback regarding the allocation of E-24 funds. The Annual Report will highlight how funds will be spent and include metrics and

a narrative on what the funds were used for and what was accomplished with the funds.

After reviewing the annual report and audit, the CSTOC will report their findings to the City Council.

ANALYSIS OF ISSUES:

The City's Administrative Services Department has begun coordinating with the California Department of Tax and Fee Administration to ensure the timely implementation of the new sales tax rate. The new sales tax increase will take effect on April 1, 2025.

Because E-24 is a general tax, related revenues and expenditures are included in the City’s General Fund and the City’s annual audited financial statements. Transparency and accountability were an important part of the passing of E-24. As such, the creation of the CSTOC annual review of the E-24 Report would help provide this transparency.

Committee Composition
The creation of a Committee is fully subject to local control. If the City Council provides direction to create a Committee, one option would be that Committee consist of 5 members representing a broad cross-section of the community. Potential members would be appointed by the City Council based on their knowledge, experience, and interest in the City’s fiscal health. Members may include:
 Residents with experience in public finance, government, or business;  Representatives from key community organizations and service groups;  Individuals with backgrounds in urban planning, public safety, or infrastructure development; or
 General residents of the City.

Committee Term and Meetings
If the City Council directs the creation of the Committee, it is recommended that the committee serve a term coinciding with their appointing Council Member, consistent with that of other City advisory bodies. Members would have the possibility of reappointment for additional terms. Meetings would be held annually or as needed to address key issues related to E-24 funds. The committee would operate in a transparent manner, with meetings open to the public, and all agendas and minutes posted on the City’s website in accordance with the Brown Act.

Recruitment and Appointment Process
The recruitment process for the Committee would also be fully subject to local control, and may involve:

1. A public notice seeking applications for Committee members, which would be posted on the City’s website, in other public locations, and through the City’s various communications channels.

2. Applications would be received by the City Clerk’s office and reviewed by each member of the City Council, who would recommend their appointment for final approval by the full City Council.

3. Preference would be given to applicants who reflect the diversity of the City and have relevant experience or knowledge.

Next Steps
Following City Council direction, staff would begin to advertise open seats on the Committee and begin the acceptance and review of applications to get a head start on the process of filling seats.

If directed, introduction of an Ordinance establishing a Citizen Sales Tax Oversight Committee would come to Council on March 11th with adoption on March 25th. Committee Bylaws would also be presented to Council at the March 25th City Council meeting for consideration of adoption.

Pending recruitment of individuals to serve on the Committee, Council appointments to the Committee are anticipated to take place in April with the first Committee meeting anticipated to take place in late spring/early summer 2025.

ALTERNATIVES:

The following alternatives are provided for the Council’s consideration:

1. Direct staff to initiate steps towards the creation of a Citizen Sales Tax Oversight Committee for Measure E-24 funds, and publish a notice seeking applications for committee members;

2. Direct staff to initiate steps towards the creation of a Citizen Sales Tax Oversight Committee for Measure E-24 funds, and do not publish a notice for applications at this time;

3. Direct staff to not initiate steps to create a Committee; or

4. Provide other direction to staff.

ADVANTAGES:

The creation of an E-24 Citizen Sales Tax Oversight Committee is one way the City of Arroyo Grande can maintain a high level of accountability and transparency in the allocation of its sales tax revenue. The committee will provide valuable community input when reviewing the annual report related to E-24 revenues and expenditures.

DISADVANTAGES:

The creation of an E-24 Citizen Sales Tax Oversight Committee will create another Brown Act committee for the City that requires record keeping and meeting administration.

ENVIRONMENTAL REVIEW:

No environmental review is required for this item.
