CITY COUNCIL AGENDA REPORT &

ARTESIA HOUSING AUTHORITY REPORT
MEETING DATE: January 12, 2026 ITEM NO: 11A.

TO: Mayor and Members of the City Council and Commission of the Artesia Housing Authority SUBJECT: Interagency Loan for $666,300 Between the City of Artesia and the Artesia Housing Authority for the Purchase and Sale Agreement for Acquisition of 11820 168th Street by the Artesia Housing Authority
FROM: Leslie Nacionales-Tafoya, Management Analyst
REVIEWED AND APPROVED BY:

Melissa Burke, Deputy City Manager
Jamie Murguia, Finance Manager
HongDao Nguyen, City Attorney
Abel Avalos, City Manager
RECOMMENDATION:

Staff recommends the City Council approve and authorize the City Manager to execute on Council's behalf:

1. A Loan Agreement in which the City of Artesia ("City") loans the City of Artesia Housing Authority ("Housing Authority") $666,300 from its General Fund Unassigned Fund Balance, subject to the terms and conditions of the loan agreement ("Loan Agreement"); and

2. Finding that the action is exempt from CEQA pursuant to State CEQA Guidelines Section 15378.

Staff also recommends the Commission of the Housing Authority approve and authorize the Executive Director of the Housing Authority execute on Commission's behalf:

1. The Loan Agreement;

2. A purchase and sale agreement for real property located at 11820 168th Street (APN 7011-004-076) in the City of Artesia for a total purchase price of $630,000, plus relocation costs not to exceed $29,800, and $6,500 in closing costs; and

3. Finding that the action is exempt from CEQA pursuant to State CEQA Guidelines Section 15378.

BACKGROUND:

In June 2025, the owner of the property located at 11820 168th Street in Artesia (the "Property") contacted staff through her real estate agent offering to sell the Property to the City. The Property is adjacent to Housing Authorityowned property. The City asked Overland, Pacific & Cutler, Inc. ("OPC"), the City's property acquisition consultant, to secure a Property appraisal and begin negotiations with the owner of a potential sale to the Housing Authority.

OPC secured an appraisal for the City that valued the Property at $610,000, and the City made an offer to purchase it for the appraised value. The owner then sought an independent appraisal which valued the Property at $630,000. The City then offered to purchase the property at the newly appraised value. The owner placed her Property on the open market for a few months and ultimately accepted the City's offer to purchase the Property for $630,000.

ANALYSIS:

The Housing Authority currently owns properties on the north and south sides of 168th Street, including APNs 7011-005-900, 7011-005-901, 7011-005-902, and 7011-005-903 (north side) and 7011-004-902 and 7011-004-903 (south side) for a total of approximately 1.11 acres (please see attached map). If purchased, the property located at 11820 168th Street (APN 7011-004-076), together with the existing six parcels of Housing Authority property adjacent to it, will be approximately 1.29 acres (not including the street), and will make a more squared total property area that will ultimately be easier to develop. Therefore, Staff is recommending the Housing Authority purchase the property.

If the Property is purchased, the Housing Authority, as a public entity, is required to pay relocation assistance costs per Government Code sections 7260-7277. Relocation costs will be incurred once the homeowner begins to vacate the Property. The homeowner does not require a new replacement dwelling but has two rooms leased to three tenants residing in the Property. Relocation costs include rental assistance payments to the tenants. Rental assistance is calculated using comparable rentals to determine a monthly payment to be paid up to 42 months.

Total rental assistance payments for the tenants are estimated at $27,300. Self move payments are estimated to be $1,250 for each lease.

The cost to purchase the Property is $630,000, plus relocation costs not to exceed $29,800 and closing costs not to exceed $6,500, for a total cost of $666,300. The Housing Authority does not currently have the total funds available to purchase the Property due to other budgetary commitments, such as the completion of the Housing Element. As a result, Staff is requesting the City Council approve a loan from the City's General Fund Unassigned Fund Balance to the Housing Authority in the amount of $666,300 to complete the acquisition. The loan terms include interest to accrue on a quarterly basis through the duration of the loan based on an amount equal to the Local Agency Investment Fund ("LAIF") rates; had the City kept the funds in reserve, then it would have been invested in the LAIF. The loan terms include that the Housing Authority pay back the loan to the City for the principal loan and accrued interest from future revenues generated by the development of the property and adjacent Housing Authority proprieties, including revenue received from a future development agreement, disposition, lease, or similar entitlement based agreement. The loan terms also allow the City and Housing Authority to mutually agree to revise the terms or forgive the loan and accrued interest if any future project is developed for a public purpose.

This loan would enable the Housing Authority to purchase the Property to ensure one legal entity owns all the property for a future redevelopment project. Should the closing costs and/or relocation costs come in lower than the total amount of the loan, the Housing Authority shall return the unused funds to the City following the close of escrow.

GENERAL PLAN CONSISTENCY FINDINGS:

Government Code Section 65402 requires the purchase of property by the Housing Authority to be consistent with the City's General Plan. Because both 11820 168th Street and the Housing Authority-owned property are located in the Mixed Use Overlay zone, staff finds that the proposed acquisition of property to expand the Housing Authorityowned parcel and square it off are consistent with the following goals:

Community Planning Principle LU-1: The Artesia General Plan 2030 will focus on enhancing areas that will allow the development of mixed use. This type of development involves a greater utilization of uses that blends residential, commercial industrial or civic institutional. By combining complementary uses, mixed use developments bring energy and vitality to areas during both daytime and nighttime, and can benefit both residents and the businesses operating with them. In addition, mixed use allows the advantage of flexibility of design to take full advantage of market shifts and land use trends.

Community Planning Principle LU-1.1: Identify appropriate locations for residential and non residential development to accommodate growth through the year 2030 on the General Plan Land Use diagram.

CEQA FINDINGS:

The approval is not a project subject to the California Environmental Quality Act because it does not have the potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment (State CEQA Guidelines, § 15378). No development is being proposed, and thus this approval does not bind any party, or commit to any definite course of action, prior to CEQA compliance.

FISCAL IMPACT:

The cost to purchase the property is $630,000, plus relocation costs not to exceed $29,800 and closing costs not to exceed $6,500, for a total cost of $666,300. Approval of this item also includes approval of a loan from the City's General Fund Unassigned Fund Balance to the Housing Authority in the amount of $666,300. The loan and interest would be repaid to the City at the time the property is developed. If approved, the Housing Authority budget will be amended with the Mid-Year budget adjustment to reflect both the loan and the purchase.

RECOMMENDED COUNCIL AND BOARD ACTION:

Staff recommends the City Council approve and authorize the City Manager to execute on Council's behalf:

1. A Loan Agreement in which the City of Artesia loans the City of Artesia Housing Authority $666,300 from its General Fund Unassigned Fund Balance, subject to the terms and conditions of the loan agreement; and

2. Finding that the action is exempt from CEQA pursuant to State CEQA Guidelines Section 15378.

Staff also recommends the Commission of the Housing Authority approve and authorize the Executive Director of the Housing Authority execute on Commission's behalf:

1. The Loan Agreement;

OR RELEASED PARTY.

Each Party hereto acknowledges that it understands the effect and import of the provisions of this code section and of a waiver of the provisions of this code section. Effective on the Effective Date, each Party, with this knowledge and understanding, elects to and does waive the provisions of this code section and of any similar case or statutory law of other states that may be applicable, and relinquishes any rights which each may otherwise have thereunder, to the fullest extent permitted by law, and agrees that the releases herein shall remain in full force and effect notwithstanding the discovery or existence of any additional or different facts. Notwithstanding the foregoing, the releases set forth above are not intended to, and shall not, release or discharge (a) any duties, obligations, representations or warranties of Seller by reason of, or arising under, this Agreement or (b) any tortious acts or omissions of Seller in any way related to this Agreement or the Property.
